HomeMy WebLinkAbout1988 02-23 CC MINBook 69/Page 111 2/23/88 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA FEBRUARY 23, 1988 The regular meeting of the City Council of the City of National City was called to order at 7:00 p.m. by Mayor Waters. ROLL CALL Council members present: Cooper, Dalla, Pruitt, VanDeventer, Waters. Absent: None. Administrative officials present: Bolint, Campbell, Eiser, Post, Stafford. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by Asst. City Manager Bolint, followed with invocation by the Rev. Bruce Talbert, United Church of Christ of Paradise Hills. APPROVAL OF MINUTES Moved by Van Deventer, seconded by Pruitt, the minutes of the adjourned meeting of February 9, 1988, held on February 16, 1988 and the regular meeting of February 16, 1988 be approved. Carried by unanimous vote. PUBLIC HEARINGS COMMUNITY DEVELOPMENT — BLOCK GRANT PROGRAM 1. SUBJECT: Final Public Hearing on Community Development Block Grant Program 1988-1989. RECOMMENDATION: Executive Director, Community Development Commission recommended that the hearing be held and the Program be adopted. (See Exhibit "A" attached for City Council guidelines and recommendations of the Committee for Housing and Community Development.) Executive Director, Com munity Development Commission Peterson reported that HUD would not allow certain expenditures in areas of the City where the income level is high (See Exhibit "B" attached). TESTIMONY: None. Mayor Waters declared the Public Hearing closed. Vice Mayor Dalla suggested that Council take the 21 items in seriatim, discuss those items where Council is not in agreement with the Citizens' Committee and reaffirm the others; any funds left over can be allocated as Council wishes. 1. Day Care Facility (National School District) — $0.00 — No discussion. 2. Boxing Facility (USIAA) — Councilman Pruitt said he feels this is an important program, and he would like to see this item approved. Mayor Waters requested that this be discussed later. 3. Concrete Box Hoover & 19th — $0.00 — No discussion. 4. Euclid Ave., 16th-20th — $370,000 — No discussion. 5. N Ave., Plaza to 8th — $0.00 — No discussion. 6. Streetscape Phase I, 8th & NCB — Councilman VanDeventer said he would like to see this increased from $50,000 to $90,000. Councilman Pruitt inquired where the additional $40,000 would be taken from. Vice Mayor Dalla replied that Council guidelines total $851,958 and the estimated funding is $898,000. It was suggested $20,000 be taken from Item 18 (demolition of buildings) and $20,000 from the reserves. Note: There was no motion and second. Approved by unanimous vote. 7. 48" drain, 24th St., A to NCB — $0.00 — No discussion. 8. Drainage/street culvert Paradise Creek Channel at 18th St. — $0.00 — No discussion. Book 69/Page 112 2/23/88 9. Remodeling Boys' & Girls' Club — Moved by Van Deventer, seconded by Cooper, we allot an additional $17,000 to remodel the restroom facilities, for a total of $42,000. TESTIMONY: Greg Beatty, Executive Director, Boys' & Girls' Club was present and answered Council's questions. Motion carried by the following vote, to —wit: Ayes: Cooper, Dalla, VanDeventer, Waters. Nays: Pruitt. 10. Street Tree Planting Phase I11 — $0.00 — No Discussion. 11. Vector Control — Moved by Waters, seconded by Cooper, we decrease this from $80,368 to $20,000, to be used for materials, or in the event the County elects to charge the City for vector control. Carried, by the following vote, to —wit: Ayes: Cooper, Pruitt, VanDeventer, Waters. Nays: Dalla. 12. Samahan Health Clinic — $0.00 — Moved by $65,000. Motion died for lack of second. TESTIMONY: Bobby Cruz, Director, Samahan present and answered Council's questions. It this item be left open and come back to it. ACTION: None. Council did not address the evening. Curb/Gutter/Sidewalk inflll — Moved by VanDeventer, seconded by Cooper, 13a be increased from $60,000 to $80,000 and 13b be increased from $60,000 to $70,000 (amended motion). Carried by unanimous vote. 14. Traffic Signal 8th/I-5 — $55,000 — No discussion. 15. Home Improvement Loans — Moved by Dalla, seconded by Van De venter, this be increased from $50,000 to $70,000. Carried, by the following vote, to —wit: Ayes: Cooper, Daila, VanDeventer, Waters. Nays: Pruitt. 16. Alcohol Recovery Program — $24,590 — No discussion. 17. Graffiti removal --parks — Moved by Cooper, seconded by VanDeventer, we leave this at $23,100. Carried by unanimous vote. 18. Clearance/demoliton of buildings — $20,000 — Deleted. See No. 6 above. 19. Landlord —Tenant Relations —Housing — $12,900 — No discussion. 20. Welcome to National City Signs — Moved by Van Deventer, seconded by Dalla, we add an additional $12,000 (to total $18,000) and install the signs on Highland Ave. and National City Blvd. Carried, by the following vote, to —wit: Ayes: Cooper, Dalla, VanDeventer, Waters. Nays: Pruitt. 21. Anti —Graffiti Program Police — $15,000 — No discussion. 2. Boxing Facility (cont'd.) — Moved by Waters, seconded the remaining $7,400 go towards the boxing program. failed by the following vote, to —wit: Ayes: Pruitt, Nays: Cooper, Dalla, VanDeventer. by Pruitt, Motion Waters. Moved by Cooper, seconded by Van Deventer, the remainder of the Block Grant Program be approved (See Exhibit "C" attached). Carried by unanimous vote. TRANSPORTATION 2. SUBJECT: Public Hearing on the adoption of the City's Proposition A, First five —Year Regional Transportation Improvement Program. RECOMMENDATION: The City's Capital Improvement Project Committee approved the five—year list; staff recommended that Council approve the first five—year Regional Transportation Improvement Program; the deadline for submittal to SANDAG is March 1, 1988. TESTIMONY: None. ACTION: Moved by Cooper, seconded by VanDeventer, the Public Hearing be closed and we adopt staff's recommendations (five projects totaling $4,720,000). Carried by unanimous vote. ADOPTION OF RESOLUTIONS CONSENT RESOLUTIONS (Resolutions Nos. 15,541 through 15,542) Moved by VanDeventer, seconded by Cooper, the Consent Resolutions be adopted. Carried by unanimous vote. CONTRACT — FLOOD CONTROL/PARADISE CREEK CHANNEL 3. Resolution No. 15,541, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING WESTERN GUNITE, INC. TO BE THE LOWEST RESPONSIBLE BIDDER AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH WESTERN GUNITE, INC., ENGINEERING SPECIFICATION NO. 1014 (DRAINAGE IMPROVEMENT OF PARADISE CREEK EAST)." ZONE 6. "An Ordinance rezoning certain parcels of real property pursuant to the Land Use Code of the City of National City in the area North and South of 7th Street, West of Palm Avenue (GP-2-87 AND ZC-2-87)." MUNI CODE 7. "An Ordinance of the City of National City amending Ordinance No. 1910 and Section 15.12.045 of the National City Municipal Code, and adding Section 11.40.110 to the National City Municipal Code." Ordinance No. 1939, "AN ORDINANCE OF THE CITY OF NATIONAL CITY AMENDING ORDINANCE NOS. 1812 AND 1930, AND SECTIONS 7.10.010(D) AND 7.10.080(B) AND (C) OF THE NATIONAL CITY MUNICIPAL CODE." (exempting duplexes from the trash enclosure requirement) Moved by Cooper, seconded by Dalla, Ordinance No. 1939 be adopted. Carried by unanimous vote. NEW BUSINESS FINANCE MGMT — CONFLICT OF INTEREST 10. SUBJECT: WARRANT REGISTER NO. 33, Ratification of Demands in the amount of $54,072.95 (Warrants Nos. 99854 through 99951). RECOMMENDATION: Staff recommended that the warrants be ratified. CONFLICT OF INTEREST: Councilman VanDeventer said he would abstain on Warrant No. 99901 because he owns the building. ACTION: Moved by Cooper, seconded by VanDeventer, the bills be ratified. Warrants (except No. 99901) ratified by the following vote, to —wit: Ayes: Cooper, Dalla, Pruitt, Van Deventer, Waters. SUBJECT: Application for Type 41, Person Transfer, on —sale beer and wine license, authorizing the sale of beer and wine for consumption on a bona fide public eating place type premises, plus the sale of beer and wine for consumption off the premises where sold of Alberto L. and Lidia L. Lim, 1630 E. 8th St. RECOMMENDATION: Police, Planning and Building Departments stated no grounds for objection. FOR THE RECORD: Vice Mayor Dalla said this is a person transfer and not a new license. ACTION: Moved by VanDeventer, seconded by Pruitt, in favor of this request. Carried by unanimous vote. PERMITS AND LICENSES 12. SUBJECT: Application for Type 09/17, Premises Transfer (Type 09 is Beer and Wine Importer; Type 17 is Beer and Wine Wholesaler) of J oie De Vin, Lawrence B. Robinson, Pres., Richard S. Hodson. Vice Pres., 205 W. 35th St., Ste. J. RECOMMENDATION: Police, Planning and Building Departments stated no grounds for objection. ACTION: Moved by VanDeventer, seconded by Cooper, in favor of this request. Carried by unanimous vote. WRITTEN COMMUNICATIONS PUBLIC REQUEST/COMPLAINT 13. SUBJECT: A letter from Mr. R. C. Hogle regarding alleged improper buidling inspection of homes on 610 and 612 E. 8th St. Mayor Waters said Mr. Hogle has withdrawn his request in a letter dated February 18, 1988, in which he said he would ask to have it scheduled at a later date. RECOMMENDATION: None. ACTION: Ordered filed by unanimous vote. OTHER BUSINESS POLITICAL SUPPORT 14. SUB J E CT: The Administrative Assistant's report on participation in Regional Legislative Coalition and Support for Legislative Platform (The Coalition would include staff representatives from all 18 cities, along with the County of San Diego and SANDAG, to promote legislative issues of mutual concern). RECOMMENDATION: Staff recommended that Council authorize the City Manager to participate in the Regional Legislative Coalition and to express National City's concurrence on the legislative platform. ACTION: Moved by VanDeventer, seconded by Cooper, in favor of staff's recommendation. Carried by unanimous vote. Book 69/Page 115 2/23/88 CITY FACILITY/LIBRARY 15. SUBJECT: The Building & Safety Director's report on C.I.P. No. 1502, construction of cabinet work for National City Public Library. RECOMMENDATION: Since the successful bidder was reluctant to sign the contract prepared by the City because of certain conditions and requirements, staff recommended that Council reject the bid. ACTION: Moved by Cooper, seconded by VanDeventer, we reject the bid. Carried by unanimous vote. CITY MANAGER — No report. CITY ATTORNEY — No report. OTHER STAFF — No reports. MAYOR PUBLIC HEALTH/SAFETY/WELFARE 16. SUBJECT: A letter from Supervisor George Bailey regarding regulation of bathhouses in the County of San Diego. RECOMMENDATION: Mayor Waters recommended that this be referred to staff for study and a draft Ordinance. ACTION: Moved by VanDeventer, seconded by Pruitt, in favor of the Mayor's recom mendation. Carried by unanimous vote. 17. SUBJECT: Discussion of Paul Rinks' Letter to the Editor of the Star News (Exhibit "B" attached). RECOMMENDATION: Mayor Waters said he did not like what Paul Rinks said about the Council; people know the Council is working hard; he doesn't have the right to criticize City Government; he understands there is no City Council member sleeping in the building at night; he would like the City Attorney to write to Mr. Rinks and inform him that we would like to see him at City Hall to discuss this matter. SCHOOLS — COMMUNITY PROMOTION Mayor Waters said he and members of the City Council were asked to read in the schools this week; one of the teachers requested that he speak on the City, but said the schools had no books on National City; he checked with the Library and there are historical books on National City for sale for $5 each; the School District should obtain one of these books for each of the schools. CITY COUNCIL POLICE PROTECTION Councilman VanDeventer reported that the latest report from SANDAG regarding crime in San Diego indicates that National City no longer has the highest crime rate in the County; the average increase has been 9% and National City is below that; our Police Dept. is doing a good job. POLICE PROTECTION Councilman Dalla said he was watching television news last night, and there was a report on the "Bolder Than Most Rapist"; the newspaper story would have you believe that the San Diego Police Dept. apprehended this individual in National City; he did some checking, and this person was apprehended because a National City Detective saw something he considered to be suspicious and followed through on it. Mayor Waters said he talked to one of our senior police officers, and was informed that when this individual was apprehended, the San Diego Police Dept. showed up immediately and even instructed our department on how to write the report. Councilman Cooper said Lt. Short was on television and told it like it really was; he did a good job. PUBLIC ORAL COMMUNICATIONS — None. If you have a lot of money and are rich, the city pays for it. 1 can take you around National City and show you who paid for the sidewalks. 1 can show you where the city paid for them and where the poor people had to pay for them. You would be able to see that the rich people didn't pay, but the poor people paid through the 1911 Act. It seems to me that if the city and council are going to put in sidewalks for the rich, they should do it for the poor people of National City as well. Every time a new house or building goes up, it usually needs a sidewalk and curb. The owner is supposed to pay for them but that's not always how it works. I will be running for city coun- cil this year and maybe 1 can heat City Hall up a little. I hear that the ex -mayor of National City is going to run for city council this year. 1 hope it's just a tumor. If he does run, 1 see it as jest a step- ping stone to run for mayor two years from now. I thought he retired.
