ROLL CALL Council members present: Cooper, Dalla, Pruitt, VanDeventer, Waters. Absent: None. Administrative officials present: Bolint, Campbell, Eiser, McCabe, Post, Stafford. SALUTE TO THE FLAG AND I NVOCAT I ON The meeting was opened with salute to the flag led by City Manager McCabe, followed with invocation by The Rev. Wayne Rowland, First Congregational Church. APPROVAL OF MINUTES Moved by VanDeventer, seconded by Pruitt,the minutes of the regular meeting of May 10, 1988 be approved. Carried, by the following vote, to —wit: Ayes: Dalla, Pruitt, VanDeventer, Waters. Nays: None. Abstaining: Cooper. PROCLAMATIONS Moved by VanDeventer, seconded by Cooper, the Proclamations be accepted by title only. Carried by unanimous vote. The Proclamation declaring Wednesday, May, 18, 1988 to be "TRANSIT APPRECIATION DAY" was read aloud in full by Mayor Waters. Moved by VanDeventer, seconded by Cooper, in favor of this Proclamation. Carried by unanimous vote. The Mayor presented the Proclamation to Mr. Mitchell. The Proclamation declaring the week of May 22-28, 1988 to be "TRAFFIC SAFETY WEEK" was read aloud in full by Mayor Waters. Moved by VanDeventer, seconded by Cooper, in favor of this Proclamation. Carried by unanimous vote. The Mayor asked the City Manager to mail the Proclamation to the proper person. PUBLIC HEARINGS COMMUNITY DEVELOPMENT COMMISSION/BLOCK GRANT PROGRAM 1. SUBJECT: Public Hearing for reconsideration of the 1988-1989 Community Development Block Grant Program funding, and to consider the reprogramming of funds from prior Block Grant Years into the 1988-1989 Program. (See Exhibit "A attached.) RECOMMENDATION: None. TESTIMONY: Greg Beatty, Executive Director, Boys, and Girls, Club; Gary Smith, Superintendent, National School District. ACTION: Moved by Waters, seconded by VanDeventer, this be continued to June 14, the City Manager look into other available funds, and bring back a report on June 14 (amended motion). Carried by unanimous vote. ADOPTION OF RESOLUTIONS CONSENT RESOLUTIONS (Resolutions Nos. 15,615 through 15,617) Councilman Cooper requested that No. 4 (Resolution No. 15,617) be considered separately. Councilman Pruitt requested that No. 2 (Resolution No. 15,615) be considered separately. Marilyn Ponseggi (representing Shirley Stack and Joe Willis), 922 Denise Lane, El Cajon, was present and said she was available to answer any questions Council might have on Item 2 (Resolution No. 15,615). Moved by VanDeventer, seconded by Cooper, the Consent Resolutions (except Resolutions Nos. 15,615 and 15,617) be adopted. Carried by unanimous vote. CONTRACT — STREET IMPROVEMENTS 3. Resolution No. 15,616, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING SIM J. HARRIS COMPANY TO BE THE LOWEST RESPONSIBLE BIDDER AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH SIM J. HARRIS COMPANY (ENGINEERING SPECIFICATION NO. 1019)." Adopted. See above. Resolution No. 15,615, "A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN IMPROVEMENT AGREEMENT BETWEEN SHIRLEY STACK AND JOE E. WILLIS FOR GRADING, PUBLIC IMPROVEMENTS AND MONUNENTATION." (parcel at 14th & Orange is being subdivided into three parcels) Councilman Pruitt said he would abstain because his home abuts the Euclid Ave. extension area. Moved by VanDeventer, seconded by Cooper, Resolution No. 15,615 be adopted. Carried, by the following vote, to —wit: Ayes: Cooper, Dalla, VanDeventer, Waters. Nays: None. Abstaining: Pruitt. CONDITIONAL USE PERMIT 4. Resolution No. 15,617, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT APPLICATION FOR THE SALE OF USED MERCHANDISE IN THE GENERAL COMMERCIAL ZONE AT 1469 THROUGH 1475 EAST PLAZA FILE NO. CUP-1988-2." Resolution No. 15,617 wit: Ayes: Dalla, Prui BOULEVARD; APPLICANT: GOOD►NILL INDUSTRIES; CASE Moved by VanDeventer, seconded by Pruitt, be adopted. Carried, by the following vote, to— tt, VanDeventer, Waters. Nays: Cooper. ADOPTION OF RESOLUTIONS (NOT PART OF THE CONSENT AGENDA) STREET IMPROVEMENTS/22ND STREET 5. Resolution No. 15,617, "A Resolution of the City Council of the City of National City denying exemption or deferral of installation of street improvements." (1521 E. 22nd St.) George Hood, 1521 E. 22nd St., was present and requested exemption from the street improvements. Moved by Cooper, seconded by VanDeventer, we go ahead and allow Mr. Hood to pull his permit, this matter be brought back next week in form of a resolution, and Mr. Hood agree to participate in a 50/50 curb and gutter program (the sidewalk will not be replaced). Carried by unanimous vote. NEW BUSINESS FINANCE MGMT 6. SUBJECT: Warrant Register No. 45, Ratification of Demands in the amount of $85,777.90 (Warrants Nos. 100840 through 100908). RECOMMENDATION: Staff recommended that the warrants be ratified. ACTION: Moved by Cooper, seconded by VanDeventer, the bills be ratified. Carried, by the following vote, to —wit: Ayes: Cooper, Dalla, Pruitt, VanDeventer, Waters. Nays: None. ALCOHOLIC BEVERAGE LICENSE — CONFLICT OF INTEREST 7. SUBJECT: Application for Type 20, Person Transfer, off —sale beer and wine license of Jae Ye and Kwang R. Chung, 1241 Highland Ave., dba Seoul Market. RECOMMENDATION: Police and Building Departments state no grounds for objection; the Planning Dept. recommended that this license be protested until such time as the applicant obtains a Conditional Use Permit. CONFLICT OF INTEREST: Mayor Waters said he would abstain because this location is close to his business. ACTION: Moved by Cooper, seconded by Pruitt, this transfer application be protested until the applicant obtains a Conditional Use Permit. Carried, by the following vote, to —wit: Ayes: Cooper, Dalla, Pruitt, VanDeventer. Nays: None. Abstaining: Waters. ALCOHOLIC BEVERAGE LICENSE — CONFLICT OF INTEREST 8. SUBJECT: Application for Type 20, Person Transfer, off —sale beer and wine license of Tuan B. Chau and Que H. Tran, 1245 Highland Ave., Suite B, dba Laguna Seafood Market. RECOMMENDATION: Police, Planning and Building Departments state no grounds for objection. CONFLICT OF INTEREST: Mayor Waters said he would abstain because this location is close to his business. SUBJECT: Request from California Army National Guard to use El Toyon Park as an alternate assembly area (The park would mainly serve as a location to disperse information to the troops in the event their headquarters on Palm Ave. was inaccessible.) RECOMMENDATION: Staff recommended approval. ACTION: Moved by VanDeventer, seconded by Cooper, in favor of this request. Carried by unanimous vote. 10. SUBJECT: Department reports regarding Old Town National City Study (See Exhibit "B" attached). RECOMMENDATION: Staff recommended that the report be received and filed. ACTION: Ordered filed by unanimous vote. Council commended staff and the Traffic Safety Committee for their efforts. CITY MANAGER — No report. CITY ATTORNEY LITIGATION City Attorney Eiser spoke of the criminal complaint filed against Chuck's Book Store, saying Deputy City Attorney Fritsch appeared in court yesterday, and the defendant was convicted of a violation of the Municipal Code (prohibiting doors on peep show booths); sentencing was delayed pending receipt of a probation report, but the defendant was ordered to remove the doors by 10:00 p.m. today. PERSONNEL 11. SUBJECT: Assistant City Attorney position. RECOMMENDATION: City Attorney Eiser recommended the part—time position, Deputy City Attorney, be expanded to a full—time position. ACTION: Moved by Cooper, seconded by Waters, we fill this position of Assistant City Attorney. Carried by the following vote, to —wit: Ayes: Cooper, Datla, Pruitt, Waters. Nays: VanDeventer. OTHER STAFF — No reports. MAYOR POLITICAL SUPPORT — HAZARDOUS WASTE Mayor Waters said he received a letter from Capt. Berkebile, Commanding Officer, Naval Station saying Chapter 160, Section 2705 of the Super Fund Amendment and Reauthorization Act of 1986 requires that a Technical Review Committee be established to review the findings of installation of restoration programs, and comment on the Navy's actions to document the type and extent of contamination at three sites undergoing study for the Naval Station, and requesting the Mayor provide a member for the Board; he would like to appoint Councilman Cooper. Councilman Cooper said he would accept. COMMUNITY PROMOTION Mayor Waters said Channel 8 Sports Announcer Jim Laslovitch has advised him that the 10th Annual Benefit Golf Tournament sponsored by the Coronado branch of the American Cancer Society will be held on Sunday, June 5 at the Coronado Municipal Golf Course; one of the features of this year's tournament will be the presentation of the Mayor's Cup to the winning foursome representing one of the South Bay cities; the competition will be held each year, with the cup going to the current winner; the fee is $50, and if anyone is interested in forming a foursome, the Mayor has the information in his office. CITY COUNCIL TRAFFIC SAFETY Councilman Pruitt asked the City Manager to look into the increased traffic on Highland Avenues over the weekends with the modified pickups. City Manager said he would talk to the Acting Police Chief tomorrow. PUBLIC ORAL COMMUNICATIONS — None. Book 70/Page 4 5/17/88 EXECUTIVE SESSION — CITY COUNCIL MEETINGS Closed Session with City's designated representatives under Government Code Section 54957.6 and Closed Session for pending litigation under Government Code Section 54956.9(A) (Leonard Tidwell vs the City of National City.) were listed on the agenda. Councilman VanDeventer said he would not attend any closed sessions unless he has obtained the backup information 24—hours in advance; he has asked that this be put on next week's agenda; he cannot make a good decision without having the facts in advance. Mayor Waters said from time to time, Council members tell other people what has happened in Executive Session, and at times, the information gets around town before the City Attorney can act; he feels that any Council member who does not keep closed sessions confidential should be barred from further closed sessions; Councilman Pruitt said a couple weeks ago, Vice Mayor Dalla expressed concern about individuals putting things on the agenda at the last minute without backup; Mr. VanDeventer brought this matter up at the last minute today; if we are going to have a policy, we should adhere to it as well. Councilman VanDeventer said if the City Manager or Council members would feel uncomfortable putting the backup information in writing, he would be happy to meet with the City Manager or City Attorney 24—hours in advance to discuss the items. Moved by Cooper, seconded by Pruitt, in favor of the closed sessions. Carried, by the following vote, to —wit: Ayes: Cooper, Dalla, Pruitt, Waters. Nays: VanDeventer. Council went into closed session at 6:01 p.m. Councilman VanDeventer did not attend either of the closed sessions. Council reconvened at 6:43 p.m. ROLL CALL Council members present: Cooper, Dalla, Pruitt, VanDeventer, Waters. Absent: None. ADJOURNMENT Moved by Cooper, seconded by Pruitt, the meeting be adjourned to 7:00 p.m., May 24, 1988. Carried by unanimous vote. FROM: Executive Director, Community Development Commission SUBJECT: Community Development Block Grant Program. L At the City Council Meeting held April 5, 1988 Councilman Pruitt suggested the following: (1) 1988-1989 Program: Move $20,000 from home improvement loan program plus the $7,410 referred to at the bottom of the attached sheet to U.S.I.A.A. $27,410 (2) Reprogram street lights, $100,000, plus $5,302 balance of funds, Exhibit A hereof, as follows: (a) Samahan Health Clinic 60,000 (b) Streetscape 8th do National City Blvd. 45,302 (this would raise streetscape from $90,000 to $135,302). II. Alternately, Councilman Pruitt suggested I.(1), above, and instead of I.(2), above, reprogramming 50/50 sidewalk, Exhibit "B", hereof, $51,102, plus 50/50 sidewalk, Exhibit "C", hereof, $54,084 or $105,186 as follows: (a) Samahan Health Clinic 60,000 (b) Streetscape, 8th ( National City Blvd. 45,186 (this would raise streetscape from $90,000 to $135,186). III. The City Council then requested that this public hearing be set. The City Council earlier determined that no new applications for the 1988-1989 Program would be accepted. The notice for the public hearing is written in such a way that the City Council may do revisions within the 1988-1989 Program as well as reprogramming of funds from 1985-1986 and 1986-1987 and 1987-1988 to the 1988-1989 Program. Eight problems were listed under "Sites Needing Dumpster Enclosures" and forty-four were listed under "Abandoned Vehicles". Of the eight situations listed under "Sites Needing Dempster Enclosures", two have been resolved, three are in the process of resolution, and three still have a few weeks remaining on their allotted time to achieve resolution. Of the forty-four "Abandoned Vehicle" complaints, all but one had been resolved by 4/25/88. Public Works addressed the areas of: Street Sweeping Due to adverse effect on citizen parking, staff recommends not signing entire areas with advisory sweeping signs and that the City limit No Parking - Sweeping signs to those areas with significant continuing problems. Flood Control Slough Tb fence the entire channel is of CIP scope and would require cooperation of adjacent property owners. Although same dumping is apparent, extent and nature of it does not appear to warrant expenditure to fence. Mowing of weeds on both banks and removal of trash is ongoing Public Works project. Weed Abatement Weed Abatement accomplished on City property. Efforts being made to clean up and re -stow property in Public Works Yard. Condition curb/ nutter/sidewalk Public Works recognizes the deteriorating condition of the curb/gutter/sidewalks in the area. Potholes are given priority attention by "patch crew" in Public Works. Curb/gutter/sidewalk repair is handled under a continuing appropriation authorized by Council and administered by the City Engineer. Street/Curb/Sidewalk Repair Of 112 locations: 12 are candidate for sidewalk "fill- in" program; 66 are candidate for Engineering Curb/Glitter/sidewalk project; 23 are to be patched the 1st quarter of FY 1989; 1 is R&R & overlay in-house FY 1989; 2 are candidate for Engineering repair and overlay by contract program, 2 are complete; 2 could not be located; for 1 an Engineering study is required and 2 were referred to Code Conformance. Exhibit "B" Book 70/Page 7 Signage/Street Markings Engineering addressed sturdy: Street/Curb/Sidewalk Rem Diagonal Parking On -Street Handi- capped Zones Truck Parking Zones Signage & Street Markings Traffic Patterns Parking Patterns and Permits Three locations were recommended to have the red curbing removed. Staff recommends two remain and one has been referred to Code Conformance. There were eight locations recommended to be red curbed. 'I , are done, four are scheduled and on two the requirement is not clear. In the instance where the sign is obstructed, this will be cleared in May. The red curbing is a uniform 25 feet unless field conditions dictate otherwise. The -CA Vehicle Code establishes unsigned residential speed limits as 25 mph. Staff considers additional signs an unwarranted expense. In the case of repainting markings, the work has been scheduled. Other concerns require studies by Engineering or approval by City Council. the following areas of the Old Tbwn National City Estimated cost of curb and sidewalk repairs alone will be approximately $110,000. Thirty five locations reocxanended for angle parking. Ninth, Eleventh and TWelth Streets were studied and because of numerous driveways, fire hydrant and other red curb locations, only one block was found where parking would increase due to change from parallel to angle parking. Six parking spaces for handicapped were identified as being possibly no longer needed. Staff identified four as still being needed, one has been removed and another is tentatively going to be removed. This item needs to be coordinated with the proposed revision of truck routes within National City. Inconsistencies noted in Old Tbwn National City Study and throughout the City are being addressed by an on- going inventory of all signs in the sturdy area. This item will be addressed at the Traffic Safety Committee meeting of 6/15/88. This would appear to be problem where City needs to establish policy for car dealers so general public is not endangered by those taking test drives. Text of Old Tbwn National City study shows violations are main concern regarding parking patterns and these are an enforcement concern. Exhibit "B" Book 70/Page o Police addressed the areas of abandoned vehicles and enforcement of parking violations. Abandoned Vehicles Parking Violations The Fire Department illegal dumping. Weed Abatement Illegal dumping Of the 44 vehicles initially reported, 17 were still present when the PDO's made their inspection. All were tagged either March 21, 22 or 23, 1988. Between the dates of March 25 and March 29, all vehicles were checked. All had been moved except 6 which were eventually impounded. The PEO assigned to the west side has been asked to make special efforts to address enforcement of parking violations including long -teen parking of tractor and trailers in the center street median, parking of vehicles across the sidewalk right of way, parking on parkways and repairing of vehicles on the street or across sidewalks. was asked to address the concerns of weed abatement and Of 22 properties identified, 15 have been brought into compliance with the ordinance. The owners of the remaining 7 properties will be given "Final Notice" and, if necessary, the properties will be brought into compliance by either City crews or the City's private weed abatement contractor. Regarding possible illegal dumping of hazardous waste in the slough. After several inspections, no evidence has been found, although the Fire Department will continue to monitor the area for such activity.
