HomeMy WebLinkAbout1988 06-21 CC MINBook 70/Page 20 6/21 /88 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA JUNE 21, 1988 The regular meeting of the City Council of the City of National City was called to order at 4:00 p.m. by Mayor Waters. ROLL CALL Council members present: Cooper, Dalla, Pruitt, VanDeventer, Waters. Absent: None. Administrative officials present: Bolint, Campbell, Eiser, McCabe, Senior Civil Engineer Pachon, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager McCabe, followed with invocation by Vice Mayor Dalla. APPROVAL OF MINUTES The City Clerk reported the minutes of the regular meeting of June 14, 1988 were not distributed until today and asked that approval be held over for one week. Moved by VanDeventer, seconded by Cooper, approval of the minutes of the regular meeting of June 14, 1988 be held over one week. Carried by unanimous vote. PROCLAMATION Moved by VanDeventer, seconded by Cooper, the Proclamation be read by title only. Carried by unanimous vote. The Proclamation declaring the week of June 20-26, 1988 to be "AMATEUR RADIO WEEK" was read aloud in full to Mayor Waters. Moved by VanDeventer, seconded by Cooper, in favor of this Proclamation. Carried by unanimous vote. The Mayor presented the Proclamation to Walter Popelar and Lloyd Beauregard MAYOR'S PRESENTATIONS Mayor Waters presented a Certificate of Appreciation to Fred Sterzick, who performed mouth—to—mouth resuscitation on a man who was a guest in his home, keeping him alive until paramedics arrived. PRESENTATIONS AREA DEVELOPMENT Rick Alexander, SANDAG, 1200 Third Ave., San Diego, was present, spoke on SANDAG's Draft Regional Growth Management Recommendations and answered Council's questions. Mr. Alexander said SANDAG conducted a survey and found that the public was most concerned about impacts on the transportation system and environmentally sensitive lands; SANDAG staff has proposed five draft recommendations, which will be presented to local jurisdictions to determine whether the SANDAG Board should recommend them for action: 1. Cities adopt the new Series 7 Regional Growth Forecast for Dwelling Units for the next five years; 2. Jurisdictions to enact consistent sensitive lands policies for preservation of flood plains and steep slopes; 3. To determine if a Regional Strategy to provide new coordinated policies for the financing of region —serving public facilities and resources can be put together; 4. Try to determine if there is a strategy to better balance population and employment; 5. SANDAG would like to put together a regional monitoring system to determine how the jurisdictions are doing in keeping up with their voluntary agreements, economic and demographic changes, and the region —serving public facilities and resources. Mr. Alexander said the final recommendations would be presented to the cities this fall. BD/COMM — LIBRARY BOARD Mayor Waters read into the record a letter from Aida Rodriguez, tendering her resignation from the Library Board. .(See Exhibit 'A' attached) BD/OOMM — TRAFFIC SAFETY COMMITTEE Mayor Waters read into the record a letter from Jesse Ramirez, tendering his resignation from the Traffic Safety Committee. Carried by unanimous vote. Moved by VanDeventer, seconded by Cooper, the Consent Resolutions be adopted. Carried by unanimous vote. PERSONNEL 1. Resolution No. 15,649, "A RESOLUTION ESTABLISHING SALARY BAND FOR THE NEW CLASSIFICATION OF ASSISTANT CITY ATTORNEY." Adopted. See above. CONTRACT — CITY FACILITY/CIVIC CENTER 2. Resolution No. 15,650, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF NOTICE OF COMPLETION FOR REPAIRS OF INTERIOR SURFACE OF THE OOUNCIL CHAMBERS AND LOBBY (ENGINEERING SPECIFICATION N0. 288)." Adopted. See above. BUILDING 3. Resolution No. 15,651, " A RESOLUTION OF THE CITY OOUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE BUILDING VALUATIONS MULTIPLIERS FOR 1988-1989." Adopted. See above. CONTRACT — TAXES — WEED ABATEMENT 4. Resolution No. 15,652, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AMENDED AGREEMENT BETWEEN THE COUNTY OF SAN DIEGO AND THE CITY OF NATIONAL CITY FOR COLLECTION OF TAXES AND SPECIAL ASSESSMENTS." (At present, these charges would cover only assessments for unpaid weed abatement charges) Adopted. See above. DEEDS & EASEMENTS — CITY OWNED LAND 5. Resolution No. 15,653, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED OF EXCESS CITY PROPERTY TO JOE E. WILLIS AND SHIRLEY STACK." Adopted. See above. CONTRACT — EQUIPMENT PURCHASE 6a. Resolution No. 15,654, "A RESOLUTION DECLARING NIXON—EGLI EQUIPMENT COMPANY THE LOWEST RESPONSIBLE BIDDER AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE AN AGREEMENT WITH NIXON—EGLI EQUIPMENT COMPANY (street striper)." Adopted. See above. BUDGET TRANSFER FY87-88 6b. Resolution No. 15,655, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING APPROPRIATION AND TRANSFER OF FUNDS ($40,000) "FOR THE EQUIPMENT MAINTENANCE DIVISION." Adopted. See above. DEEDS & EASEMENTS — FLOOD CONTROL 7. Resolution No. 15,656, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY CLERK TO ACCEPT A STORM DRAIN EASEMENT FROM THE NATIONAL SCHOOL DISTRICT (PORTION OF A.P.N. 558-110-03 WEST OF PALMER SCHOOL)." Adopted. See above. BUDGET TRANSFER 87-88 — PARKING/TRAFFIC 8. Resolution No. 15,657, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE TRANSFER OF FUNDS ($1,500) FOR INSTALLATION OF TRAFFIC SIGNALS AND ROADWORK (BONITA ROAD AND INTERSTATE ROUTE 805)." "An Ordinance rezoning certain parcels of real property pursuant to the Land Use Code of the City of National City, on the edge of Las Palmas Park, north of an adjacent condominium subdivision (GP-1-88 and ZC-1-88)." ZONING — SUBDIVISION/GALLERIA 11. "An Ordinance rezoning certain parcels of real property pursuant to the Land Use Code of the City of National City, in the CalTrans (1-5) right—of—way, on the north side of Civic Center Drive and west of the MTDB Trolley (GP-3-87 and ZC-3-87)." Ordinance No. 1947, "AN ORDINANCE OF THE CITY OF NATIONAL CITY ADDING CHAPTER 11.64 TO THE NATIONAL CITY MUNICIPAL CODE, RELATING TO SKATEBOARDS." (restricting the use of skateboards, roller skates, coasters and similar toy vehicles) The following were present and spoke: Christopher Garcia, 938 'N' Ave.; Daniel (?), 1516 E. 8th St.; Jason Dare, 933 'N' Ave. Moved by Cooper, seconded by Pruitt, Ordinance No. 1947 be adopted. Carried by unanimous vote. NEW BUSINESS FINANCIAL MANAGEMENT — CONFLICT OF INTEREST 14. SUBJECT: Warrant Register No. 50, Ratification of Demands in the amount of $250,692.66 (Warrants Nos. 101200 through 101335), and Certification of Payroll for the period ending May 30, 1988, in the amount of $346,960.95. RECOMMENDATION: ACTION: Moved by Cooper, seconded by VanDeventer, the bills be ratified and the payroll certified. Councilman VanDeventer said he would abstain on Warrant No. 101270 because he owns the building. SUBJECT: Letter from Robert Coons, United States Institute of Amateur Athletics, requesting a waiver of the $500 fee required to process a Conditional Use Permit. RECOMMENDATION: None. ACTION: Moved by Pruitt, seconded by Cooper, in favor of waiving the $500 fee for Conditional Use Permit processing. Carried by unanimous vote. OTHER BUSINESS AUDIT 16. SUBJECT: Arthur Young & Company's Single Audit Report for the year ending June 30, 1987. RECOMMENDATION: Staff recommended that Council authorize and direct the Finance Director to handle the combined financial functions of the Book 70/Page 23 6/21/88 City, the CDC and the Parking Authority, including cash collections, deposit and investment of funds, disbursements and payroll preparation, general accounting, and preparation of annual budgets. ACTION: Moved by VanDeventer, seconded by Waters, this be held over two weeks, and during that period the Executive Director, Community Development Commission get together with the Finance Director and the City Manager and try to iron this out. Carried by unanimous vote. (Councilman VanDeventer left Council Chambers at 5:13 p.m.) STREET TREES 17. SUBJECT: The recommendations of the Street Tree and Parkway Committee (The following street tree removals: 1811 'N' Ave.; 1515 E. 20th St.; 1611 Alpha St.; 1436 'Q' Ave.; 1312 Roosevelt Ave.) RECOMMENDATION: The Street Tree and Parkway Committee recommended removal of the trees; staff recommended ratification of the Street Tree and Parkway Committee's action. ACTION: Ordered filed by unanimous vote. Absent: VanDeventer. (Councilman VanDeventer returned at 5:14 p.m. STREETS/PARAISO CT — ASSESSMENT DISTRICT (POSSIBLE) 18. SUBJECT: The City Engineer's report on Paraiso Ct. (preliminary cost estimate of paving Paraiso Ct. with 5 1/2" of concrete, providing a hammer head type of turn around; total cost is approximately $60,000, including purchase of a 30' x 20' right—of—way for turn around area; this project would be a candidate for an Assessment District, if Council desires). RECOMMENDATION: Council can direct staff to proceed with an Assessment District; to avoid the expense of the preliminary report required by law, Council can, by a 4/5 vote, direct staff to proceed or Mr. Slawson can submit a petition with 60% or more of the property owners' signatures. ACTION: Moved by Pruitt, seconded by VanDeventer, staff contact Mr. Slawson and ask him to submit a petition (with signatures) of 60% or more of the property owners. Carried by unanimous vote. ASSESSMENT DISTRICT 228 19. SUBJECT: The City Engineer's report on Alley 35 (Alley construction was investigated per Council's request; alley apron was constructed 1/4" too high and due to ponding water, Public Works has been unable to clean the alley.) RECOMMENDATION: Engineering Dept. shall order the contractor to grind concrete apron at Civic Center Dr. and assure that proper drainage is obtained; Public Works Dept. shall sweep this alley on a regular basis after proper drainage is obtained; Code Conformance Officer shall investigate trash problem and require installation of trash bins if required. TESTIMONY: Noreen Ball, 417 W. 14th St., was present and spoke. ACTION: Ordered filed by unanimous vote. TRANSPORTATION/NCT 20. SUBJECT: Request of National City Transit for discontinuance of National City's elderly and handicapped bus pass subsidy program (Due to the recent passage of the dedicated sales tax for transportation in San Diego County, the monthly bus pass for elderly and handicapped citizens is due to drop from $20 to $10, below the level of National City's subsidized rate.) RECOMMENDATION: Staff recommended approval. TESTIMONY: Bob Arthur, National City Transit, was present and answered Council's questions. ACTION: Moved by Cooper, seconded by VanDeventer, in favor of staff's recommendation. Carried by unanimous vote. CITY MANAGER — No report. CITY ATTORNEY — No report. MAYOR COMMUNITY PROMOTION Mayor Waters said he will be riding on our antique fire engine in the Oceanside Parade; Councilman Cooper will be tied up with the July 4 carnival, but perhaps other Council members would like to ride in the parade as well. Councilmembers Pruitt, VanDeventer and Dalla said they would go. CITY COUNCIL PUBLIC REQUEST/COMPLAINT Councilman Cooper read into the record a letter from Harold C. Arnold, outlining problems encountered when he attempted to replace his old garage (See Exhibit 'C' attached). Harold Arnold, 1350 '0' Ave., was present and spoke. PUBLIC ORAL COMMUNICATIONS — None. EXECUTIVE SESSION — LITIGATION — PERSONNEL Closed Session for pending litigation under Government Code Section 54956.9(A) (Theresa Padilla vs City of National City), and Closed Session with City's designated representatives under Government Code Section 54957.6. Moved by Cooper, seconded by VanDeventer, in favor of the closed sessions. Carried by unanimous vote. ( C� EXHIBIT "B" Book 70/Page 27 6/21/88 June 16, 1988 Mayor George 'Waters Administrative Office 1243 National City Blvd. National City, Ca. 92050 Mr. Waters: A month or so ago, I requested a permit to remove a old garage, that was built in the mid 40's and is about ready to fall down, from, my property. I was told then that I would have to get a permit to provid a covered off street parking space, which was fine. I then submitted the required blueprints and plans for a permit to erect a 24'x 24' garage on the back of my property. When I returned vacation I inquired on the permit and was told that the Planning Commission had approved it, but the permit was being held up untill I agreed to put in a P.des- trian Ramp on the corner of 14 th S t . and "0" AvP... , at a cost of between $500 to $800 dollars. I felt that this imposed re- quest was out of line and voiced my opinion on it to the point of calling it asinine. There was no mention of asking for an exemption, all I was told that if I wanted to delay the ramp, I would have to put up $700.00, which was not refundable. This took place on June 7, 1988. 0n June 8, 1988 I talked to you on the phone and you promised tc come out the next day to talk about it. But to this date you have not shown up. On June 11, 1988 I received a Certifed letter from the Planning Dept., with a notice to clean the Premises of wooden pallets, pieces of fabric, ect.. Also a notice of Violation of the code, stating I had 10 days to remove 3 storage sheds from the back yard or enclose the yard with a solid 6' fence. When I put up the Storage sheds over 10 year ago, I asked about permits and was told at that time there were no limits on the number of sheds if they were not over 100 sq. ft. and were portable, or could be moved, which they are. I take this as pure harassment from your Planning Dept. The reasons I oppose putting in a Pedestrian Ramp are as follows: 1. A few months ago when I got a permit to remove a driveway and replace it with sidewalk and curbing (within 5' of the proposed ramp) I was not required to do so then. 2. There are no other Ramp's in the immediate area. There are no Ramp's on "N" Ave., from loth to 18th Streets. There are no Ramp's on Palm Ave., from Plaza Blvd., to 18th_Street. EXHIBIT " C " Book 70/Page 28 6/21/88 3. When the City had sidewalks put in on the 'test side of Palm Ave., between 14th St. and Plaza Blvd., no Ramp's were put in. 4,, Both Gas Stations on Plaza Blvd., and Palm have done remodeling without having to put in Ramp's. Also the Market on the North-West corner of 18th St., and Palm Ave., did extensive remodeling on the Store front without being required to put in Ramp's. 5. The National School District on "N" Ave., between 14th and 16th Street's have been, and are still remodeling and building without being required to put in Ramp's at 14th and 16th Street. ('What's good for the goose is good for the gander) . When I asked why the City didn't pay for putting in the Ramp, I was told they didn't pay for it, the public did, I told them that as I am part of the public and have been Laying my taxes they have my permission to spend some of my money on the Ramp's. Mr. '.eaters I have been a property owner and resident of National City for 2e years. I retired from the Navy after 25 years in the Service which includes Duty in WWII, Korean War and the Vietnam War. I worked many years with the Cubs Scouts, Boy Scouts. (Trp.32), Girl Scouts, and mamaged Little League for 4 years. I was very Proud to be a property owner and resident of National City, but now I have my doubts. My feeling as of now are that if you are a business man and want to open a business in National City(being a resident or not) you are given the Key the the City to do as you please, even to the extent of running a business in violation of the Code, without permit's or License's. But if you are a property owner and tax payer you are nothing but scum and don't bother to ask the City for any, assistance or consideration as you will be completely disregarded and harassed. In 25 years in the Navy and 3 wars, I was shot at and missed, but of recently in National City,(excuse the expres- sion), I've been s--t at_ard hit right between the eyes' and in my pocket book. To me this is not the best P.R. for the Council and Mayor of National City. All this over a request for a permit to remove an old garage that is about to fall down. I am sincerly thinking of removing my request to build a new garage and let the old one fail dcwn and leave it as an eyesore until' the City removes it. Thank you for taking the time to read this.
