MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
JULY 5, 1988
The regular meeting of the City Council of the City of National City was
called to order at 4:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Cooper, Dalla, Pruitt, VanDeventer, Waters.
Absent: None. Administrative officials present: Campbell, Eiser, McCabe,
Senior Civil Engineer Pachon, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager McCabe,
followed with invocation by the Rev. Ken Nichols, Southport Christian
Church.
APPROVAL OF MINUTES
Moved by VanDeventer, seconded by Cooper, the minutes of the regular meeting
of June 28, 1988 be approved. Carried by the following vote, to —wit:
Ayes: Cooper, Pruitt, VanDeventer, Waters. Nays: None. Abstaining:
Dal la.
Mayor Waters requested that the second Executive Session listed on the
agenda be held at this time.
EXECUTIVE SESSION/PERSONNEL
Closed Session with City's designated representatives under Government Code
Section 54957.6. Moved by VanDeventer, seconded by Pruitt, in favor of the
closed session. Carried by unanimous vote.
Council went into closed session at 4:03 p.m.
Council reconvened at 5:02 p.m.

Mayor Waters requested that Item 16 be considered at this time.
TEMPORARY USE PERMIT
16. SUBJECT: The request of Southport Christian Center for a Temporary Use
Permit for a Youth Rally and Gospel Concert to combat drugs and gangs,
to be held on July 8, 1988, from 4:30 p.m. to 12:00 a.m., at the
Kimball Bowl; waiver of fees is requested.
RECOMMENDATION: Staff recommended approval subject to the following
conditions: Police will monitor activity and provide security
assistance as needed; Parks & Recreation will provide standby
personnel; if food or merchandise is sold, or money solicited, a
Business License is required; waiver of fees is not permitted; fire
extinguishers shall be provided if cooking is done; parking shall not
obstruct fire access.
ACTION: Moved by VanDeventer, seconded by Cooper, in favor of
this request and the fees not be waived (amended motion).
Carried by unanimous vote.
ADOPTION OF RESOLUTIONS
CONSENT RESOLUTIONS (Resolutions Nos. 15,669 through 15,672)
Moved by VanDeventer, seconded by Cooper, the Consent Resolutions be
adopted. City Attorney Eiser requested that No. 1 (Resolution No. 15,669)
be removed from the agenda and brought back at a later date. Councilman
VanDeventer said he would abstain on Nos. 2 and 3 (Resolutions Nos. 15,670
and 15,671) because he has business dealings with these people. Resolutions
Nos. 15,670 and 15,671 adopted by the following vote, to —wit: Ayes:
Cooper, Dalla, Pruitt, Waters. Nays: None. Abstaining: VanDeventer.

4. Resolution No. 15,672, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD ON
JUNE 7, 1988, DECLARING THE RESULT AND SUCH MATTERS AS PROVIDED BY
LAW." Adopted. See above.
"WHEREAS, a Special Municipal Election was held and conducted in
the City of National City on Tuesday, June 7, 1988, as required by law;
and
"WHEREAS, notice of the election was given in time, form and
manner as provided by law; voting precincts were properly established;
election officers were appointed and in all respects the election was
held and conducted and the votes were cast, received and canvassed and
the returns made and declared in time, form and manner as required by
the provisions of the the Elections Code of the State of California for
the holding of elections in general law cities; and
"WHEREAS, pursuant to Resolution No. 15,534 adopted
February 9, 1988, the County Registrar of Voters canvassed the returns
of the election and has certified the results to this City Council, and
the results are received, attached and made a part hereof as
'Exhibit A'.
"NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
"SECTION 1. That the whole number of ballots cast in the City
except absent voter ballots was 4,605.
"That the whole number of absent voter ballots cast in the City
was 475, making a total of 5,080 ballots cast in the City.
"SECTION 2. That the measure voted upon at the election is as
follows:

in favor of it, and that the measure was carried, and shall be deemed
adopted and ratified.
"SECTION 5. The City Clerk shall enter on the records of the
City Council of the City, a statement of the result of the election,
showing: (1) The whole number of ballots cast in the City; (2) The

measure voted upon; (3) The number of votes given at each precinct for
and against the measure; (4) The total number of votes for and against
each measure.
"SECTION 6. That the City Clerk shall certify to the passage and
adoption of this resolution and enter it into the book of original
resolutions.

1. Resolution No. 15,669, "A Resolution of the City Council of the City of
National City authorizing the Mayor to execute a Facilities Use Cross
Agreement between Sweetwater Union High School and the City of National
City." (allowing the City to use district property for City —sponsored
recreation activities) Ordered filed by unanimous vote.

5. Resolution No. 15,673, "A RESOLUTION APPROVING A MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF NATIONAL CITY AND THE NATIONAL CITY
FIREFIGHTERS' ASSOCIATION." Moved by Cooper, seconded by VanDeventer,
Resolution No. 15,673 be adopted. Carried by unanimous vote.
ORDINANCE FOR ADOPTION
Moved by VanDeventer, seconded by Cooper, the Ordinance be presented by
title only. Carried by unanimous vote.
ZONING/FLOOD CONTROL
6. Ordinance No. 1952, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AMENDING TITLE 18 (ZONING) OF THE MUNICIPAL CODE
REGARDING THE EFFECTIVE DATE OF THE RECENTLY UPDATED FLOOD INSURANCE
STUDY AND FLOOD INSURANCE RATE MAP." Moved by Cooper, seconded by
VanDeventer, Ordinance No. 1952 be adopted. Carried by unanimous vote.
OLD BUSINESS
AUDIT
7. SUBJECT: The Finance Director's Single Audit Report for the year
ending June 30, 1988.
RECOMMENDATION: Staff recommended that Council authorize and direct
the Finance Director to handle the combined financial functions of the
City, CDC and the Parking Authority, including cash collections,
deposit and investment of funds, disbursements and payroll processing,
general accounting and preparation of annual budgets.
TESTIMONY: Art Budman and Vicky Capps, Arthur Young & Co., were
present and answered Council's questions.
ACTION: Moved by Pruitt, we initiate Alternative B. Motion died
for lack of second. Moved by Cooper, seconded by Pruitt, in
favor of Alternative B (Set up computerized accounting system on
CDC's PC, with periodic transfer of data to the City's Prime
computer), and give them 60 days to get this system working; if
they run into problems, they come back to Council and request
more time. Carried, by the following vote, to —wit: Ayes:
Cooper, Pruitt, VanDeventer, Waters. Nays: Dalla.
Mayor Waters called a recess at 6:02 p m.

NEW BUSINESS
FINANCIAL MANAGEMENT
8. SUBJECT: Warrant Register No. 52, Ratification of Demands in the
amount of $201,121.50 (Warrants Nos. 101414 through 101497), and
Certification of Payroll for the period ending June 13, 1988, in the
amount of $338,152.23.
RECOMMENDATION: Staff recommended that the warrants be ratified.
ACTION: Moved by Cooper, seconded by VanDeventer, the bills be
ratified and the payroll certified. Carried, by the following
vote, to —wit: Ayes: Cooper, Dalla, Pruitt, VanDeventer,
Waters. Nays: None.
CLAIMS
9. SUBJECT: Claim for Damages of The Mason Gordon Company and
10. Claim for Damages of San Diego Gas & Electric Co.
RECOMMENDATION: Staff recommended that these claims be denied and
referred to the City Attorney.
ACTION: Moved by Cooper, seconded by VanDeventer, these claims
be denied and referred to the City Attorney. Carried by
unanimous vote.
OTHER BUSINESS
ASSESSMENT DISTRICT 237
11. The City Engineer's report on the public hearing for (Assessment
District 237) five alleys (Alleys 10,11, 18, 24 & 27).
RECOMMENDATION: Staff recommended that Alley 10 be deleted from
Assessment District 237, and Council direct staff to proceed with the
Assessment District.
ACTION: Moved by Cooper, seconded by VanDeventer, we hold this
over for two weeks. Carried by unanimous vote.
PUBLIC REQUEST/COMPLAINT/STREET/0 AVE
12. SUBJECT: The City Engineer's report on approval of exemption of street
improvements at 1350 '0' Ave. (Harold Arnold wishes to file a request
for exemption from street improvements, but doesn't feel he should have
to pay the $75 non—refundable fee required; he is requesting a waiver
of this fee.)
RECOMMENDATION: Staff recommended that Council place the exemption on
hold until Mr. Arnold deposits the $75.00 non—refundable filing fee
with the City.
TESTIMONY: Harold Arnold, 1350 '0' Ave., was present and
requested that the fee be waived.
ACTION: None.
STREET TREES — CONFLICT OF INTEREST
13. SUBJECT: The recommendations of the Street Tree and Parkway Committee
(The following street tree removals: 1413 Wilson Ave.; 302 E. 2nd St.;
2534 Melrose St.)
RECOMMENDATION: The Street Tree and Parkway Committee recommended
removal; staff recommended ratification of the Street Tree and Parkway
Committee's action.
CONFLICT OF INTEREST: Councilman VanDeventer said he would abstain on
1413 Wilson because he has a business arrangement with these people.
ACTION: Moved by VanDeventer, seconded by Cooper, this be
approved. Street tree removals (except 1413 Wilson Ave.)
approved by unanimous vote. Street tree removal at 1413 Wilson
Ave. approved by the following vote, to —wit: Ayes: Cooper,
Dalla, Pruitt, Waters. Nays: None. Abstaining: VanDeventer.
TEMPORARY USE PERMIT
14. SUBJECT: The request of Victory Outreach Church for a Temporary Use
Permit to hold a rally to preach and reach the drug addicts and gang
members on July 9, 1988, from 5:00 p.m. to 8:30 p.m., at Kimball Park.
RECOMMENDATION: Staff recommended approval subject to the following
conditions: security help is suggested; exterior lighting must be
approved by the City; applicant shall obtain a permit for any tents or
cooking equipment from the Fire Dept.; waiver of fees is not legally

permitted; if funds are to be solicited, or food, beverages or
merchandise sold, a Business License is required; extra police patrol
and monitoring of area)
ACTION: Moved by VanDeventer, seconded by Cooper, in favor of
staff's recommendation. Carried by unanimous vote.
TEMPORARY USE PERMIT
15. SUBJECT: The request of Great Western Bank for a Temporary Use Permit
for their "Open House" to introduce their new District Loan Office; the
event (10' canopy, tables with food and drink) will be held at the rear
parking lot of 1536 Sweetwater Rd. on July 21, 1988 from 5:00 p.m. to
8:00 p.m.; they are also requesting permission to serve alcoholic
beverages.
RECOMMENDATION: Staff recommended approval subject to the following
conditions: Applicant shall provide proof to the Fire Dept. that the
canopy is flame retardant and shall secure a permit with plot plan
prior to the event.
ACTION: Moved by Cooper, seconded by VanDeventer, in favor of
this request. Carried by unanimous vote.

TRANSPORTATION/NCT
17. SUBJECT: National City Transit's report on negotiations to purchase a
bus maintenance and operations facility for National City Transit (NCT
has been investigating the possibility of having the City purchase
property located at 2020 Hoover Ave. for possible use as a maintenance
and operations facility.)
RECOMMENDATION: Staff recommended that Council accept the report.
ACTION: This item was referred to Executive Session at the end
of the agenda.

MAYOR
MAYOR/COUNCIL
Mayor Waters read a letter from Janice Martinelli, thanking the Parks &
Recreation Dept. for the beautiful landscaping in front of Brick Row.
MAYOR/COUNCIL
Mayor Waters read a letter from the Parks and Recreation Advisory Board
expressing their concern for loss of trees that may occur when the new
addition is built south of the Civic Center, and urging the Mayor and
Council to take all necessary steps to preserve the trees.
MAYOR/COUNCIL
Mayor Waters commended the City Manager, Asst. City Manager and staff for
the major C.1.P. projects that have been completed; 41 major projects have
been completed.
MAYOR/ COIR IC I L
Mayor Waters thanked the City Manager, and Acting Chief of Police for taking
care of the City yesterday in a professional manner (when police officers
scheduled to work two shifts called in sick); he received several calls from
citizens who felt things were handled well.
MAYOR/COUNCIL
Mayor Waters reported he received a copy of a letter from Senator Proxmire
to Congressman Bates regarding Mr. Bates' support for the $27 million
appropriation for defensive collection and conveyance system for sewage from
the Mexican border.

CITY COUNCIL
Councilman Dalla said he had spoken to representatives from Tecate who
indicated an interest in reviving the Sister City Program; they would like
to come on Thursday, July 7 or Monday, July 11, and formally invite Council
to participate in a fair they are having from July 14-24; they will
designate one day of the fair as National City Day, and would like us to
indicate which date would be desirable. There was consensus that Monday,
July 11 would be the best date to meet with these people, and either
Saturday, July 23 or Sunday, July 24 would be the best days to attend the
fair.
PUBLIC ORAL COMMUNICATIONS
PUBLIC REQUEST/COMPLAINT
Howard Adler (Eagle Furniture), 5465 Beulah Dr., San Diego, was present and
said he was given two months probation and fined $300 for Code violations
(improper sign and no trash enclosure); he has removed the sign, gotten his
permit and will start building the trash enclosure tomorrow; he has to go
back to court on July 7 and will have to pay another $250; he does not have
the money and requested that Council dismiss the case and refund the $300.
No action taken.
EXECUTIVE SESSION/TRANSPORTATION/NCT/LITIGATION
Closed Session with City's Negotiators under Government Code Section 54956.8
to consider purchase of real property at 2020 Hoover Avenue, and
Closed Session for pending litigation under Government Code Section
54956.9(A) (Terry Hart vs City of National City). Moved by Cooper, seconded
by VanDeventer, in favor of the Closed Sessions. Carried by unanimous vote.
Council went into closed sessions at 6:52 p.m.
Council reconvened at 7:24 p.m.
