MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
DECEMBER 6, 1988
The regular meeting of the City Council of the City of National City was called to order at 7:00
p.m. by Mayor Waters.
ROLL CALL
Council members present Cooper, Delia, Pruitt, VanDeventer, Waters. Absent None.
Administrative officials present Bolint, Campbell, Eiser, McCabe, Myers, Post
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager McCabe, followed with
invocation by Councilman Della
APPROVAL OF MINUTES
Councilman Della requested that approval of the minutes of the regular meeting of
November 22, 1988 be held over for one week, and that the minutes of the adjourned
workshop meeting of November 14, 1988 and the regular meeting of November 15, 1988
be approved. Carried by unanimous vote.
BUSINESS RELATING TO GENERAL MUNICIPAL ELECTION,
NOVEMBER 8, 1988

ELECTION/NOVEMBER 8, 1988
1. Resolution No. 15, 801, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION
HELD ON NOVEMBER 8, 1988, DECLARING THE RESULT AND SUCH OTHER
MATTERS AS PROVIDED BY LAW.
Moved by Della, seconded by Pruitt, Resolution 15,801 be adopted. Carried by
unanimous vote.
2. Mayor Waters made presentations to outgoing Councilman Cooper and City Clerk
Campbell.
Each gave a brief farewell speech.
The City Clerk administered the Oath of Office to Councilmen Inzunza and VanDeventer,
City Clerk Peoples and City Treasurer Redding.
Mayor Waters called a recess at 7:10 p.m. for refreshments.

23. ''An Ordinance authorizing the salaries of the Mayor and the City Council, and of the

VanDeventer, seconded by Pruitt, to have the same salary increase for both the
Mayor and Council, making the Mayors salary$2,123 per month. Carried by
unanimous vote.

FINANCIAL MANAGEMENT/CONFLICT OF INTEREST
25. SUBJECT: Warrant Register No. 21, Ratification of Demands in the amount of
$ 171,781.25 (Warrants Nos. 103204 through 103308 [except No. 103270]).
RECOMMENDATION: Staff recommended that the warrants be ratified.
CONFLICT OF INTEREST: Councilman VanDeventsr said he would abstain on
Warrant No. 103258 because he owns the property on which one of the businesses
is located.

30. SUBJECT: Application for Type 58 and Type 47, Original Ucense/Intercounty
Transfer, Type 58 - caterer's license, Type 47 - on -sale general license, 3030 Plaza
Bonita Road, Suite 1106.
RECOMMENDATION: Police and Building Departments state no grounds for
objection. Planning Department recommends that City Council protest the issuance
of Type 47 liquor license until applicant obtains a conditional use permit
ACTION: Moved by Della, seconded by VanDeventer, to protest the license
until a conditional use permit is obtained. Carried by unanimous vote.
ALCOHOLIC BEVERAGE LICENSE
31. SUBJECT: Application for Type 41, Person Transfer, (not a new license), 1903
Highland Avenue.
RECOMMENDATION: Police, Planning and Building Departments state no grounds
for objection.

RECOMMENDATION: Police, Planning and Building Departments state no grounds
for objection.
ACTION: Moved by VanDeventer, seconded by Pruitt, in favor of this
transfer. Carried by unanimous vote.

ZONE VARIANCE
33. SUBJECT: Notice of Decision - Planning Commission Resolution No 34-88
approving a Zone Variance Application for two 250 sq. ft signs, each on a wall facing
other than a street, at 3007 Highland Avenue.; Applicant California Neon Products;
Case File No. Z-7-88
RECOMMENDATION: The Planning Commission voted to approve the variance
subject to oonditions; Staff concurs with Planning Commission approval and
recommends that Notice of Decision be filed
ACTION: Filed without objection.
ADMIRALTY CONDOMINIUMS
34. SUBJECT: Request from Southwest Investments to authorize rental use of
Admiralty Condominiums.
RECOMMENDATION: Staff requested direction to bring back appropriate
resolution.
ACTION: Moved by VanDeventer, seconded by Waters, in favor of
Resolution upon compliance with items recommended by staff, inclusive of
additional condition that Southwest Investment provide a bond or cash
deposit for a period of 10 years to assure landscaping is kept up. Planning
Director to report on December 13. 1988 as to bond feasibility, Carried by
the following vote, to -wit Ayes: Della, Pruitt, VanDeventer, Waters. Nays:
Inzunza. Abstaining: None.
SOLID WASTE MANAGEMENT
35. SUBJECT: Request for exemption from requirement for trash service.
RECOMMENDATION: Staff recommended request for exemption or waiver be
denied.
ACTION: Referred to City Manager to for additional information to be back to
City Council by December 20, 1988.
STREET LIGHTING
36. SUBJECT: Street lighting on "D" Avenue
RECOMMENDATION: Staff reported funds are available and Tight will be ordered
fromSDG&E.
ACTION: Moved by VanDeventer, seconded by Pruitt, in favor. Carried, by
the following vote, to -wit Ayes: Della, Pruitt, VanDeventer, Waters. Nays:
None. Abstaining: Inzunza

MAYOR
SDG&E/EDISON TAKE OVER
Mayor Waters reported that he would be attending the regular monthly meeting with the
other county mayors on December 7, 1988 to discuss the SDG&E/Edison take over
INTERVIEWS
Mayor Waters noted that interviews for appointments to Boards/Commissions will be
conducted on January 10, 1989 by Vice Mayor Pruitt.
POLICE
Mayor Waters stated that he was aware of off -duty officers, carrying firearms while visiting
local cocktail establishments and asked the new Chief of Police to review this with his staff as
they may pose a potential hazard to the public.
MAYOR/SAN DIEGO
Mayor Waters referenced a letter received from Deputy Mayor McColl of San Diego regarding
a banquet meeting to be held on the evening of December 7, 1988 to discuss the site for
construction of the San Diego Olympic Training Center. Mayor Waters asked that Vice Mayor
Pruitt attend the banquet and report at the December 13. 1988 Council Meeting.

CHRISTMAS LIGHTS
Mayor Waters announced that at 6:00 p.m. on December 7, 1988, the annual Christmas
street lighting ceremony on 12th Street would occur. Council members were asked to
attend and participate in the sing along.
CITY COUNCIL
HART SETTLEMENT
37. SUBJECT: Terms of Hart settlement
RECOMMENDATION: Councilman Della discussed the Hart settlement and the
problems for the City resulting from the condition requested by Mr. Hart that the
terms of the agreement be kept confidential. The City is ready and willing to formally
disclose the financial terms of the agreement which have already been disclosed in
the normal course of City business. To avoid further questions, speculation and a
threatened lawsuit,
ACTION: Councilman Della made a motion "to direct the City Attorney to
contact Mr. Harts representative and formally request that he mutually
agree to wave the condition of the financial confidentiality so we can get
on with business." Seconded by VanDeventer. Carried by unanimous
vote.
STREET LIGHT
Councilman VanDeventer requested Public Works review the placement of another street
light for the corner of 22nd Street and Prospect.
VIETNAM VETERANS MEMORIAL
Vice Mayor Pruitt requested that National City adopt a Proclamation to be read this Saturday,
December 10, 1988 for the Califomia Vietnam Veterans Memorial presentation. Moved by
VanDeventer, seconded by Pruitt, that the need for action on this item arose subsequent to
theposting of the agendas. Carried by unanimous vote. Moved by Pruitt, seconded by
VanDeventer, in favor of preparing a Proclamation in support of the California Vietnam
Veterans Memorial. Carried by unanimous vote.
SISTER CITY
Councilman Delia informed Council that our Sister City had inquired about decorations or
possibly a tree for Christmas. He requested that they give this request some consideration
and contact him with their ideas, preferably prior to Christmas.
PUBLIC ORAL COMMUNICATIONS
PUBLIC REQUEST/TRAGEDY
Louie Natividad, 1418 Meadow Drive, submitted a press release and requested Council
assistance in securing funds for the family of a deceased National City woman.
ADJOURNMENT
The meeting was adjourned at 9:35 p.m.. The Next Regular Meeting will be held on
December 13, 1988 at 7:00 p.m. in the Council Chambers.

RESOLUTION NO. 15,801
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL
CITY RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION
HELD ON NOVEMBER 8, 1988, DECLARING THE RESULT AND
SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and
conducted in the City of National City, California, on Tuesday,
November 8, 1988, as required by law; and
WHEREAS, notice of the election was given in time, form
and manner as provided by law; voting precincts were properly
established; election officers were appointed and in all respects
the election was held and conducted and the votes were cast,
received and canvassed and the return made and declared in time,
form and manner as required by the provisions of the Elections
Code of the State of California for the holding of elections in
general law cities; and
WHEREAS, the San Diego County Registrar of Voters
canvassed the returns of the election and has certified the
results to this City Council, the results are received, attached
and made a part hereof as Exhibit "A."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1. That the whole number of votes cast in the
City except absent voter ballots was 7509.
That the whole number of absent voter ballots cast in
the City was 2110, making a total of 9619 votes cast in the City.

SECTION 3. That the number of votes given at each
precinct and the name of votes given in the City to each of the
persons above named for the respective offices for which the
persons were candidates were as listed in Exhibit "A" attached.
SECTION 4. The City Council does declare and determine
that:
RALPH INZUNZA was elected as Member of the City Council
of the City for the full term of four years;
JESS VAN DEVENTER was elected as Member of the City
Council of the City for the full term of four years.
LORI ANNE PEOPLES was elected as the City Clerk of the
City for the full term of four years.
DELBERT REDDING was elected as the City Treasurer of
the City for the full term of four years.
As a result of the election, a majority of the voters
voting on the measure relating to the ABANDONMENT AND
DISCONTINUANCE OF "Q" AVENUE PARK did not vote in favor of the
measure, and the measure was not carried, and shall not be deemed
adopted and ratified.
SECTION 5. That City Clerk shall enter on the records
of the City Council of the City, a statement of the result of the
election, showing:
(1) The whole number of votes cast in the City;
(2) The names of the persons voted for;
(3) The measures voted upon;
(4) For what office each person was voted for;
(5) The number of votes given at each precinct to each
person, and for and against each measure;
(6) The number of votes given to each person, and for
and against each measure.
SECTION 6. That the City Clerk shall immediately make
and deliver to each of the persons so elected a Certificate of
Election signed by the City Clerk and authenticated; that the
City Clerk shall also administer to each person elected the Oath
of Office prescibed in the Constitution of the State of
California and shall have them subscribe to it and file it in the
office of the City Clerk. Each and all of the persons so elected
shall then be inducted into the respective office which they have
been elected.
SECTION 7. That the City Clerk shall certify to the
passage and adoption of this resolution and enter it into the
book of original resolutions.
PASSED and ADOPTED this 6th day of December, 1988.

MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
DECEMBER 6, 1988
The regular meeting of the City Council of the City of National City was called to order at 7:00
p.m. by Mayor Waters.
ROLL CALL
Council members present Cooper, Delia, Pruitt, VanDeventer, Waters. Absent None.
Administrative officials present Bolint, Campbell, Eiser, McCabe, Myers, Post
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager McCabe, followed with
invocation by Councilman Della
APPROVAL OF MINUTES
Councilman Della requested that approval of the minutes of the regular meeting of
November 22, 1988 be held over for one week, and that the minutes of the adjourned
workshop meeting of November 14, 1988 and the regular meeting of November 15, 1988
be approved. Carried by unanimous vote.
BUSINESS RELATING TO GENERAL MUNICIPAL ELECTION,
NOVEMBER 8, 1988
Moved by Daila, seconded by Pruitt the Resolution be presented by title only. Carried by
unanimous vote.
ELECTION/NOVEMBER 8, 1988
1. Resolution No. 15, 801, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION
HELD ON NOVEMBER 8, 1988, DECLARING THE RESULT AND SUCH OTHER
MATTERS AS PROVIDED BY LAW.
Moved by Della, seconded by Pruitt, Resolution 15,801 be adopted. Carried by
unanimous vote.
2. Mayor Waters made presentations to outgoing Councilman Cooper and City Clerk
Campbell.
Each gave a brief farewell speech.
The City Clerk administered the Oath of Office to Councilmen Inzunza and VanDeventer,
City Clerk Peoples and City Treasurer Redding.
Mayor Waters called a recess at 7:10 p.m. for refreshments.
Council reconvened at 7:40 p.m.

The Proclamation declaring December 7, 1988 as "PEARL HARBOR REMEMBRANCE
DAY' was read by Mayor Waters and presented to Mr. George Green who represented the
Pearl Harbor Veterans.

3. Continued Public Hearing - Abatement of unused and abandoned service station
located at 1805 E. Fourth Street ** Deterred from Council Meeting of 7/12/88 **
ACTION: Moved by VanDeventer, seconded by Pruitt, this is to be continued to
the January 10. 1988 Council Meeting. Carried by unanimous vote.
