MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
AUGUST 16, 1988
The regular meeting of the City Council of the City of National City was
called to order at 4:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Cooper, Dalla, Pruitt, VanDeventer, Waters.
Absent: None. Administrative officials present: Bolint, Campbell, Eiser,
McCabe, Myers, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager McCabe,
followed with invocation by Chaplain Reyna, Paradise Valley Hospital.
APPROVAL OF MINUTES
The City Clerk reported that the minutes of the adjourned meeting of
August 9, 1988 held on August 11, 1988 have not been distributed. Moved by
VanDeventer, seconded by Cooper, the minutes of the regular meeting of
August 9, 1988 be approved. Carried by unanimous vote.
PRESENTATION
Councilman Cooper presented a check to Lt. Sweeney, National City Police
Reserves, on behalf of the National City Lions Club.
ADOPTION OF RESOLUTIONS
CONSENT RESOLUTIONS (Resolutions Nos. 15,703 through 15,705)
Moved by VanDeventer, seconded by Pruitt, the Consent Resolutions be
presented by title only. Carried by unanimous vote. Moved by Cooper,
seconded by VanDeventer, the Consent Resolutions be adopted. Carried by
unanimous vote.
PARKING/TRAFFIC
1. Resolution No. 15,703, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY ESTABLISHING ONE ON —STREET HANDICAPPED PARKING SPACE AT
1330 HARDING AVENUE — MS. SILVA OTILA (HANDICAPPED PLACARD NO.
K535688)." Adopted. See above.
PLANNED DEVELOPMENT PERMIT
2. Resolution No. 15,704, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY, CALIFORNIA, DENYING AN APPLICATION FOR MODIFICATION OF
PLANNED DEVELOPMENT PERMIT NO. 1-82 TO EXTEND THE HOURS OF OPERATION OF
MC DONALD'S RESTAURANT AT 2140 PLAZA BOULEVARD, APPLICANT: MC DONALD'S
CORPORATION; CASE FILE NO. PD-3-88." Adopted. See above.
PERSONNEL/LABOR RELATIONS
3. Resolution No. 15,705, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY APPROVING CHANGES IN SALARIES, BENEFITS, AND WORKING
CONDITIONS FOR EMPLOYEES IN BARGAINING UNIT REPRESENTED BY THE NATIONAL
CITY POLICE OFFICERS' ASSOCIATION." Adopted. See above.
ORDINANCE FOR ADOPT ION
Moved by VanDeventer, seconded by Cooper, the Ordinance be presented by
title only. Carried by unanimous vote.
MUNICIPAL CODE/ABATEMENT/VEHICLES
4. Ordinance No. 1958, "AN ORDINANCE AMENDING SECTION 8 OF ORDINANCE NO.
1433, AND THE FIRST PARAGRAPH OF SECTION 11.48.090 OF THE NATIONAL CITY
MUNICIPAL CODE, RELATING TO THE NOTIFICATION PROCEDURE ON PUBLIC
NUISANCE VEHICLES." Moved by Cooper, seconded by Pruitt, Ordinance No.
1958 be adopted. Carried by unanimous vote.
NEW BUSINESS
FINANCIAL MANAGEMENT/CONFLICT OF INTEREST
5. SUBJECT: Warrant Register No. 6, Ratification of Demands in the amount
of $277,053.62 (Warrants Nos. 101827 through 101930), and Certification
of Payroll for the period ending July 25, 1988, in the amount of
$344,367.47.

RECOMMENDATION: Staff recommended that the warrants be ratified.
CONFLICT OF INTEREST: Councilman VanDeventer said he would
abstain on Warrant No. 101881 because he owns the business
property.
ACTION: Moved by Cooper, seconded by VanDeventer, the bills be
ratified and the payroll certified. Warrants, except Warrant No.
101881, ratified by the following vote, to —wit: Ayes: Cooper,
Dalla, Pruitt, VanDeventer, Waters. Nays: None. Warrant No.
101881 ratified by the following vote, to —wit: Ayes: Cooper,
Dalla, Pruitt, Waters. Nays: None. Abstaining: VanDeventer.
Payroll ratified by the following vote, to —wit: Ayes: Cooper,
Dalla, Pruitt, VanDeventer, Waters. Nays: None.

CITY MANAGER — No report.

MAYOR
MAYOR/COUNCIL
Mayor Waters reported our National City well pumped 59,917,000 gallons of
water during the month of June; 28,425 gallons was taken from the public
faucet; the public is taking advantage of the free water.
MAYOR/COUNCIL
Mayor Waters reported that Edco Disposal is putting signs on their trucks
saying Drugs Are Garbage"; he has arranged for a ceremony in front of City
Hall on August 18 at 1:00 p.m.; all Council members are invited to attend.
MAYOR/COUNCIL
Mayor Waters reported that income from the Plaza Bonita was $153,445,000
this year, a 16% increase; income from South Bay Plaza was $76,630,000, a
14% increase.
MAYOR/COUNCIL
Mayor Waters read a letter thanking Council for responding to a complaint
about trash on E. 7th St.
MAYOR/COUNCIL
Mayor Waters read a letter from Admiral Hatcher expressing his appreciation
for the City's support of the Navy Community in National City; there will be
a Change of Command ceremony on August 26 aboard the U.S.S. Denver, at the
Broadway Pier and all Council members are invited.
STREET/GROVE/SUBDIVISION/SWEETWATER PLAZA EAST
6. SUBJECT: A letter from Mr. Robert Thomas, Thomas/O'Brien Associates,
requesting that the City share 50% of the cost for Grove St.
improvements, relative to Sweetwater Plaza East.
RECOMMENDATION: None.
ACTION: Councilman VanDeventer said Mr. Thomas has withdrawn the
request. No action taken.
ELECTION 11/8/88
Mayor Waters read a letter from Candidate Lori Anne Peoples to the City
Clerk (See Exhibit 'A' attached), requesting that she withdraw her
Candidate's Statement, since it is not in compliance with guidelines set
forth for candidates running for office, saying he has been accused of being
involved in this matter; he would like the record to show that he knew
nothing about this letter until Ms. Peoples came to see him yesterday
afternoon. City Attorney Eiser said he was advised by Ms. Peoples that she
had contacted the Registrar of Voters' office and was advised that the
Candidate's Statement would be modified to conform.
CITY COUNCIL
STREET/GROVE/SUBDIVISION/SWEETWATER PLAZA EAST
Councilman Dalla spoke on Item 6, saying the intent of the 50/50 program was
to assist the residential neighborhoods, not commercial development.
Councilman VanDeventer said the 50/50 alley program assists areas of mixed

residential and commercial use. Councilman Cooper said curbs and gutters
were added to the 50/50 sidewalk program because the money was not being
used; he has no problem with using this program for commercial areas; he
does not agree with forcing Thomas/O'Brien to put in the sidewalk, when it
does not benefit his project.
PERSONNEL/LABOR RELATIONS
7. SUBJECT: Discussion of study on police employees' benefits and working
conditions, by outside consultant.
RECOMMENDATION: None.
ACTION: Moved by VanDeventer, seconded by Waters, we direct
staff to solicit bids for an independent study on issues such as
salaries, benefits, vehicles and equipment, so we will be in the
ballpark on these items, the report to come back by January 15,
including such things as costs of lawsuits, destruction of
property, etc., and any item of concern to the Council, staff or
the P.O.A. (amended motion). Carried, by the following vote, to —
wit: Ayes: Dalla, Pruitt, VanDeventer, Waters. Nays: Cooper.
ZONING
8. SUBJECT: Discussion of small shopping centers throughout the City.
RECOMMENDATION: None.
ACTION: Moved by VanDeventer, seconded by Cooper, we declare a
90—day moratorium on permits for new shopping centers, the
Planning Director come back with an overall plan, during this
time, Council will conduct workshops, and the City Attorney draft
an Urgency Ordinance to be brought back next week. Carried by
unanimous vote.
Vice Mayor Dalla spoke of the shopping center at 24th & Highland,
and inquired why the developer was not required to dedicate
additional footage to widen 24th St.; he would like staff to come
back with an answer.
PERSONNEL
9. SUBJECT: Discussion of 1988-89 compensation adjustment for City
Manager, City Attorney and City Clerk.
RECOMMENDATION: Vice Mayor Dalla recommended that the City Manager and
City Attorney be given a compensation adjustment of 10%
ACTION: Moved by Pruitt, seconded by Cooper, this be put on next
week's agenda, and the Vice Mayor put his recommendations in
writing; in the meantime each Council member write an evaluation
of these three people, and see that it gets with the agenda
package for discussion next week (amended motion). Carried by
unanimous vote.
PUBLIC ORAL COMMUNICATIONS
PARKING/TRAFFIC
Everett Dickson, 2745 E. 14th St., was present and thanked Council for
having a Stop Sign at 18th & Prospect.
PUBLIC REQUEST/COMPLAINT
Mrs. , 1808 E Ave., was present and said she has a duplex and would
like to convert her patio to an enclosed room addition; she has not been
able to get a permit because the property is zoned for Commercial. Planning
Director Post said this zoning in this area is going to be changed to
Residential; the process will take 2-3 months.
PUBLIC REQUEST/COMPLAINT
Mary Morgan, 1808 E Ave., was present and said she has seen disinterest and
lack of concern from the Council; some Council members talk behind their
hands; she is going to be watching and getting involved. Ms. Morgan was
asked if she would like to serve on a Commission and she replied she would.
PUBLIC REQUEST/COMPLAINT
Don LaCroix, 1125 E. 21st St., was present, spoke of the labor problems with
the P.O.A. and inquired what Council proposed to do. Mr. LaCroix presented
a petition with 49 signatures, demanding police protection at all times, and
that steps be taken by immediate action of the City Council. Mayor Waters
said we have some excellent police officers and the problems are being
worked out. Councilman Cooper said we have seven officers out on injury

leave; the Acting Police Chief is not only working with the P.O.A., he is
transferring some of the officers from the Detective Division to Patrol
Division, so there will be people in the field to protect the citizens.
City Attorney Eiser advised that if Mr. LaCroix wants the petition to become
a part of the record, it should be given to the City Clerk. Mayor Waters
said he wants to look over the petition and would give it to the City Clerk
tomorrow. (Petition not received by Clerk)
PUBLIC REQUEST/COMPLAINT
Cynthia Weeks, 2715 Plaza Blvd., was present, spoke of the problems with the
P.O.A., saying when policemen are unhappy, they spread it throughout the
community; National City Police Officers have a good reputation and should
be well —paid.
PUBLIC REQUEST/COMPLAINT
Donald LaCroix, 1125 E. 21st St., returned to the podium and said he also
feels we have a good Police Dept., but it needs to be fortified, reinforced
or restructured to get better response time and better coverage.
SUBDIVISION
Paul and Joe , 2525 Camino del Rio South, San Diego, were
present and spoke of the Admiralty Condominium Project on Palm Ave.; they
are in escrow to purchase this property from the Bank of America; approval
to rent the units expired in 1986, and they would like to discuss Council's
feelings about removing the restrictions on renting the condos. They were
advised to submit this matter to staff to be placed on next week's agenda.
ADJOURNMENT
Moved by VanDeventer, seconded by Cooper, the meeting be adjourned to
7:00 p.m., August 23, 1988. Carried by unanimous vote. The meeting closed
at 5:35 p.m.
The foregoing minutes were approved at the regular meeting of
August 23, 1988.

PLEASE TYPE YOUR STATEMENT CLEARLY AND LEGIBLY AS
THIS FORM WILL BE SCANNED BY A COMPUTER AND
IT WILL NOT READ HANDWRITING OR PRINTING
Section 10012 of the Elections Code of the State of California sets forth guidelines for candidate's
statements. Please follow them:
Ms statement of each candidate shall be printed in type of uniform size and darkness and with uniform
spacing. This means:
a. Use either standard indentation or block paragraph form only - do nQI use leading asterisks (*),
bullets (•) or hyphens (-).
b. Do NQI use all CAPITAL letters - must be capital and lower case.
c. Do Ma capitalize individual words or underline individual words or lines for emphasis.
2. The statement shall not include any party affiliation or membership or activity in partisan political
organizations.

CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR
ELECTIVE OFFICE PERTAINING TO CANDIDATES STATEMENTS
SUBMITTED TO THE VOTERS AT AN ELECTION TO BE
HELD ON TUESDAY, NOVEMBER 8, 1988
WHEREAS, Section 10012 of the Elections Code of the State of
California provides that the governing body of any local agency adopt
regulations pertaining to materials prepared by any candidate for a municipal
election, including costs of the candidates statement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE,
DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. GENERAL PROVISIONS. That pursuant to Section 10012
of the Elections Code of the State of California, each candidate for elective
office to be voted for at an Election to be held in the City of National City on
November 8, 1988 may prepare a candidate's statement on an appropriate form
provided by the City Clerk. The statement may include the name, age and
occupation of the candidate and a brief description of no more than 200 words
of the candidate's education and qualifications expressed by the candidate
himself or herself. The statement shall not include party affiliation of the
candidate, nor membership or activity in partisan political organizations. The
statement shall be filed in the office of the City Clerk at the time the
candidate's nomination papers are filed. The statement may be withdrawn, but
not changed, during the period for filing nomination papers and until 5:00 p.m.
of the next working day after the close of the nomination period.
