MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
APRIL 28, 1987
The regular meeting of the City Council of the City of National City was called to
order at 7:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Cooper, Dalla, Pruitt, VanDeventer, Waters. Absent:
None. Administrative officials present: Bolint, Campbell, Eiser, Post, Stafford.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by Asst. City Manager Bolint,
followed with invocation by the Rev. Wilfred Reyna, Paradise Valley Hospital
Chapel.
APPROVAL OF MINUTES
Moved by Cooper, seconded by Pruitt, the minutes of the regular meetings of
April 14, and April 21, 1987, and the adjourned meeting of April 14, 1987 held on
April 21, 1987 be approved with the following change to Page 108, Para. 8, Line 5
of the minutes of the regular meeting of April 21: "...he spoke to the inspector..."
should be changed to "...he spoke to the (State) inspector...". Carried by unanimous
vote.
MAYOR'S PRESENTATIONS
Mayor Waters presented a plaque to the Boys' Club of National City Mini —Soccer
All —Star Team (members of the team were present) for bringing honor and
distinction to the City by winning the San Diego County Section Championship and
capturing the 1987 Southern California Torch Games for Mini —Soccer. Mayor
Waters introduced Boys' and Girls' Club Director Greg Beatty, who was present in
the audience.
COMMUNITY PROMOTION — CENTENNIAL
Mayor Waters and a representative of the School District presented Certificates to
the following winners of the National City Chamber of Commerce Centennial
Writing Contest: Shauna Stanich (primary grades), Deidre Mesquita (grades 4-6),
Joanna Loscano (Jr. High), Dina Maramba (High School). It was noted that the
letters written by these students will be placed in the time capsule.
PROCLAMATION
Moved by VanDeventer, seconded by Cooper, the Proclamation be read by title
only. Carried by unanimous vote. The title was read. Moved by Cooper, seconded
by VanDeventer, the Proclamation be adopted. Carried by unanimous vote.
The Proclamation declaring May 3-9, 1987 to be "NATIONAL CITY WEEK" at the
Museum of Photographic Arts was read aloud in full by Mayor Waters.
MAYOR'S APPOINTMENTS
BD COMM
STREET TREE AND PARKWAY COMMITTEE
RECOMMENDATION: Mayor Waters recommended that Albert Keen be
reappointed.
ACTION: Moved by Cooper, seconded by VanDeventer, in favor of this
appointment. Carried by unanimous vote.
APPOINTMENTS
BD COMM/PLANNING COMMISSION/CIVIL SERVICE COMMISSION
Vice Mayor Cooper presided. John Arguilez was interviewed and stated he
would like to be on the Civil Service Commission or the Planning Commission.
Vice Mayor Cooper reported that appointments will be made next week.

PUBLIC HEARINGS
VARIANCE — CONFLICT OF INTEREST
1. SUBJECT: Continued Public Hearing on application for a zone variance to
permit a minimum front yard setback of five feet in conjunction with the
proposed development of a 52—unit motel at the northeast corner of 7th St.
and Roosevelt Ave.; Applicant: Chivay Hsu Architects.
RECOMMENDATION: The Planning Commission voted to approve the
zone variance application; staff recommends that the zone variance
application be approved.
CONFLICT OF INTEREST: Vice Mayor Cooper said he has a conflict
of interest because this property is close to his property on E. 9th St.,
so he would abstain from discussion and voting.
TESTIMONY: Jim Bear (Attorney for applicant), 616 National City
Blvd. was present and spoke in favor.
ACTION: Moved by VanDeventer, seconded by Dalla, the public hearing
be closed and for approval of the zone variance. Carried, by the
following vote, to —wit: Ayes: Dalla, Pruitt, Van Deventer, Waters.
Nays: None. Abstaining: Cooper.
CONDITIONAL USE PERMIT — PLANNED DEVELOPMENT PERMIT —
CONFLICT OF INTEREST — FOR THE RECORD
2. SUBJECT: Continued Public Hearing on appeal of Planning Commission denial
of Conditional Use Permit and Planned Development Permit application for
construction of a 52—unit motet at the northeast corner of 7th St. and
Roosevelt Ave.; Applicant: Chivay Hsu Architects, Case File Nos. CUP 1986-
14/PD-08-86.
RECOM MENDATION: The Planning Commission denied this application;
staff concurs with the Planning Commission's denial.

so he would abstain from discussion and voting.
TESTIMONY: Jim Bear (Attorney for applicant), 616 National City
Blvd., was present and spoke in favor.
John Arguilez, 1302 Carol Place, was present and spoke in opposition.
FOR THE RECORD: Mayor Waters said he wanted the record to show
that he has nothing against motels if they're built properly, but in this
case he feels the site is too small; that is his main objection.
Councilman Dalla said he wanted to clarify for the record that the
figures the Mayor read indicating the number the units and the
occupancy rates were taken from a correspondence from Mr. Bear who
is representing the applicant; those are not the figures that staff came
up with in the study.
ACTION: Moved by Dalla, seconded by VanDeventer, the public hearing
be closed and Council affirm the action of the Planning Commission
and the recommendations of the Planning Department and reiterate the
findings of both the Planning Commission, and those that were raised
by Council. Carried, by the following vote, to —wit: Ayes: Dalla,
Pruitt, VanDeventer, Waters. Nays: None. Abstaining: Cooper.
ASSESSMENT DISTRICT 227
3. SUBJECT: Public Hearing on Resolution of Intention No. 15,251, District No.
227 ("I" Ave., 24th to 26th Streets). The City Clerk reported the Affidavit of
Posting, Affidavit of Mailing and Certificate of Publication were on file.
RECOMMENDATION: Staff recommends the hearing be held, Council
deny or overrule all protests, and close the hearing.
TESTIMONY: Engineering Staff Asst. Onley was present and outlined
the project. No one else was present in this regard.
ACTION: Moved by VanDeventer, seconded by Pruitt, the public
hearing be closed and overrule all protests and close this public hearing.
Carried by unanimous vote.
FIRE PROTECTION
4. SUBJECT: Public Hearing for the Ordinance adopting the 1985 Edition of the
Uniform Fire Code and amendments. The City Clerk reported the Certificate
of Publication was on file.
RECOMMENDATION: Staff recommends Council hold the public hearing
for adoption of the 1985 Uniform Fire Code and its amendments.
Fire Chief Kimble read the findings into the record:

"These findings are applicable to the Building and Fire Codes; they are
as follows:
"Limited fire protection resources.
"Considerable mixed residential, commercial and industrial use
throughout the City.
"Santa Ana wind conditions.
"Considerable old housing stock.
"Traffic congestion due to abandonment of Route 252.
"Compatibility with other jurisdictions:
"Examples are Air Pollution Control District, Sewer District,
County Health Department and other related districts and
jurisdictions."
TESTIM ONY: None.
ACTION: Moved by Cooper, seconded by VanDeventer, the public
hearing be closed, and we adopt this new 1985 Edition of the Uniform
Fire Code and Amendments. Carried by unanimous vote.
BUSINESS LICENSE
5. SUBJECT: Public Hearing on Appeal of Business License penalty (Harold
Weinberger, D.D.S.).
RECOMMENDATION: Staff recommends the appeal be denied.
TESTIMONY: Harold Weinberger, D.D.S., was present and appealed the
imposition of penalty.
ACTION: Moved by Waters, seconded by Cooper, we waive the penalty.
Motion failed by the following vote, to —wit: Ayes: Cooper, Waters.
Nays: Dalla, Pruitt, VanDeventer.
ADOPTION OF RESOLUTIONS
CONSENT RESOLUTIONS (Resolutions Nos. 15,286 through 15,287)
Moved by VanDeventer, seconded by Dalla, the Consent Resolutions be adopted.
Carried by unanimous vote.

6. Resolution No. 15,286, "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA, APPROVING AMENDMENTS TO
APPENDIX D OF THE LAND USE CODE, CASE FILE NO. A-1-87." Adopted.

CONTRACT — LITIGATION
7. Resolution No. 15,287, "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT WITH ARTHUR L. CARVER,
BRUCE A. CARVER, SUSAN E. CARVER, AND RANDALL B. CARVER (to
satisfy the Carvers' liability arising out of an undertaking, which was filed in
connection with a judgment obtained by the City against Carver Corp.)."

9. Ordinance No. 1917, "AN ORDINANCE ADOPTING THE UNIFORM FIRE
CODE 1985 EDITION, THE APPENDIX THERETO, AND THE UNIFORM FIRE
CODE STANDARDS, PRESCRIBING REGULATIONS GOVERNING CONDITIONS
HAZARDOUS TO LIFE AND PROPERTY FROM FIRE AND EXPLOSION, AND
ESTABLISHING A BUREAU OF FIRE PREVENTION AND PROVIDING
OFFICERS THEREFOR AND DEFINING THEIR DUTIES AND POWERS, AND

ZONE
10. SUBJECT: The Planning Director's report on lot size requirements for
automotive repair uses in the light manufacturing zone.
RECOMMENDATION: Staff recommends the report be filed.
ACTION: Moved by VanDeventer, seconded by Cooper, this be held
over for two weeks. Carried by unanimous vote.
NEW BUSINESS
FINANCE MGMT
11. SUBJECT: WARRANT REGISTER NO. 42, dated April 21, 1987, Ratification
of Demands in the amount of $306,294.68 (Warrants Nos. 96274 through
96346), and CERTIFICATION of PAYROLL for the period ending
April 6, 1987, in the amount of $313,585.62.
RECOMMENDATION: Staff recommends the warrants be ratified.
ACTION: Moved by Cooper, seconded by VanDeventer, the bills be
ratified and the payroll certified. Carried, by the following vote, to —
wit: Ayes: Cooper, Dalla, Pruitt, VanDeventer, Waters. Nays: None.
CLAIMS/LITIGATION
12. SUBJECT: The Claims for Damages of Lic. Roberto Morales Grajales,
Roberto Luis Morales Lever and Oscar Moreno Cabian, and
13. The Claim for damages of Kathy Murray.
RECOMMENDATION: Staff recommends these claims be denied and
referred to the City Attorney.
ACTION: Moved by VanDeventer, seconded by Cooper, these claims be
denied and referred to the City Attorney. Carried by unanimous vote.
OTHER BUSINESS
SUBDIVISION — CONFLICT OF INTEREST
14. SUBJECT: The Planning Director's report on final subdivision map for five
single—family residential lots on .689 acres on the west side of Grove St.,
south of 14th St.; Applicant: Priscilla L. Maloney, Case File No. S-1-85.
RECOMMENDATION: The Planning Commisison approved and
recommended its adoption by Council; staff recommends that the final
subdivision map be approved.
ACTION: Moved by Cooper, seconded by Pruitt, in favor of this final
subdivision map for approval.
CONFLICT OF INTEREST: Councilman VanDeventer said he would
abstain on this because he has financial interests with the people who
purchased this land.
ACTION: Motion carried by the following vote, to —wit: Ayes: Cooper,
Dalla, Pruitt, Waters. Nays: None. Abstaining: VanDeventer.
VARIANCE — FOR THE RECORD
15. SUBJECT: Planning Commission Notice of Decision, Resolution No. 13-87,
approving Zone Variance Application for a 66 sq. ft. wall mounted sign which
will not face the street (in lieu of the 25 sq. ft. maximum area allowed) on
the west side of the Sweetwater Inn, located at 2435 Sweetwater Rd.;
Applicant: Shirley Grasser, Case File No. Z-3-87.
RECOMMENDATION: The Planning Commission approved based on
findings and conditiions set forth in Resolution No. 13-87; staff concurs
with the Planning Commission's approval.

ACTION: Moved by VanDeventer, seconded by Pruitt, this be approved.
Carried, by the following vote, to -wit: Ayes: Dalla, Pruitt,
VanDeventer, Waters. Nays: Cooper.
FOR THE RECORD: Vice Mayor Cooper said this City has worked long
and hard trying to keep signs on buildings on the streets they faced; he
can recall a gentleman who tried to get a variance to put a sign up on
a building on 8th St. and Council denied the variance; now the Planning
Commission and Council has approved this one; he feels we are going
against our Code.
16. SUBJECT: The City Engineer's report on Harbison/8th St./Plaza Blvd. project
slope and guard rail protection (for constructing a combination retaining -
sound -safety wall opposite the back yards of affected lots).
RECOMMENDATION: Staff recommends that the gunite slope
protection and guard rails be installed.
ACTION: Moved by Cooper, seconded by VanDeventer, this be held
over until the C.I.P. program or until budget time. Moved by
VanDeventer, seconded by Cooper, the motion be amended to include
contacting the people out there; this would give them an opportunity to
participate financially, and if they're not willing, it would give us the
opportunity to move on with the less expensive approach. Carried by
unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF
COMMUNITY PROMOTION - MAYTIME BAND REVIEW
17. SUBJECT: The Fire Department's report on request for permit to allow
Maytime Band Review Committee to conduct fireworks cannon shot display on
May 2, 1987 at 10:00 a.m.
RECOMMENDATION: Staff recommends that Council approve the
cannon shot display permit. City Attorney Eiser recommended the City
require a Hold Harmless Agreement, or be indicated as a named insured
on the Insurance Certificate.
ACTION: Moved by VanDeventer, seconded by Cooper, in favor with
all the conditions of the City Attorney and the Fire Chief. Carried by
unanimous vote.
MAYOR
COMMUNITY DEVELOPMENT
Mayor Waters said he received a letter from the County of San Diego commending
Mr. Peterson, saying the recent audit performed by the County Auditors and
Controllers Office examined the financial and related records of the Community
Development Commission, and the audit found the system of internal accounting
and administrative controls adequate; compliance with Federal and State
requirements was found to be satisfactory.
COMMUNITY PROMOTION - MAYTIME BAND REVIEW
Mayor Waters said he contacted the Maytime Band Review Committee and assured
them that the Council members will be wearing their Centennial costumes and their
wives will also be dressed in Centennial attire.
SANDAG
Mayor Waters said Council requested that staff send a letter to SANDAG regarding
the distribution of proposed added sales tax based on 2/3 of the population, 1/3 of
the miles of roadway maintained. Asst. City Manager Bolint said he took care of
that.
FLOOD CONTROL
Mayor Waters said the Sweetwater Authority will hold a grand opening for the new
pump station on May 30 at 11:00 a.m.; Council will be invited for a tour of the
plant and dinner.
SOLID WASTE MANAGEMENT
Mayor Waters said he has received complaints that Nelco is no longer accepting
used oil, and people have been told that the County will no longer allow Nelco to
accept it; he contacted the County Dept. of Health Services and read their
response into the record (See Exhibit "A" attached).

ACTION: Moved by Cooper, seconded by Pruitt, we put this on next week's
agenda and talk about running an ad in the newspaper telling people where to
dispose of used oil. Carried by unanimous vote.
COMMUNITY PROMOTION — CENTENNIAL
18. Discussion of City Centennial Float.
RECOMMENDATION: None.
ACTION: Moved by VanDeventer, seconded by Cooper, this be referred
to staff for cost and availability. Carried by unanimous vote.
CITY COUNCII,PERSONNEL
Councilman Van eventer said he would like to refer to staff the matter of the
City Attorney's workload and possibly having some reports brought back at budget
tim e on costs; different departm ents are having a hard tim e processing their court
cases that we're not able to keep up with it; the Planning Dept. has numerous
cases being cited, and we cannot take care of that in a timely manner; by staff
looking at that now and having it in time for budget hearing it would be beneficial
to the City and the City Council; I'm talking about an Asst. City Attorney, maybe
on a contract business relating strictly with the code enforcement problems and our
business license code enforcing; he would like to see a report come back with the
opinions of the City Attorney, the City Attorney and the departments that would
be affected and it be referred to the budget chairman at that time.
PUBLIC REQUEST/COMPLAINT
Vice Mayor Cooper said the Mayor received a letter from Mrs. Martha C. Ganius,
and it should be put on next week's agenda.
ACTION: Moved by Cooper, seconded by Pruitt, this be put on next week's
agenda. Carried by unanimous vote.
PARKING/TRAFFIC
Councilman Dalla said a couple weeks ago we had a report from staff following a
citizen complaint about a neighborhood shopping center (30th & "I") where there
was no parking left for the customers after all the employees parked in the lot,
and they were parking on the street; the report verified that if you took all the
businesses, and the number of employees and the number of parking places, there
was a real problem; over the past few months, he has had a number of comments
about these kinds of problems; perhaps we should look at this and determine if the
standards need to be modified.
ACTION: Moved by Dalla, seconded by VanDeventer, this be referred to the
Planning Commission. Carried by the following vote, to —wit: Ayes: Dalla,
Pruitt, VanDeventer, Waters. Nays: Cooper.
AREA DEVELOPMENT
Councilman Pruitt reported that he, Vice Mayor Cooper and Port Commissioner
Reopelle attended the Bayfront Development Conference in New York last week; he
gave each Council member a copy of the tape from the conference; some of the
professionals will be in this area the end of May and will be stopping by. Vice
Mayor Cooper said they made some important contacts at the conference with
people who are interested in doing some things on the west coast.
EXECUTIVE SESSION — PERSONNEL — LITIGATION
City Attorney Eiser reported the closed session to discuss personnel matters, and
the closed session with City representatives which were listed on the agenda will
not be held; he requested the closed session to discuss pending litigation (James
Zuffoletto vs the City of National City) under Government Code Section 54956.9(A)
be held.
ACTION: Moved by Van Deventer, seconded by Cooper, in favor of the
Executive Session. Carried by unanimous vote.

RE: NELCO OIL RECYCLING
Dear Mayor Waters:
In response to your recent inquiry regarding Nelco Oil's refusal to accept
waste oil from individual citizens an investigation was made. As a result
of this investigation it was found that the State Department of Health
Services Toxics Division conducted an inspection of Nelco in December
1986. During this inspection the state inspector observed that waste
oil was being disposed of to the ground in the area where homeowner waste
oil was collected. This disposal to the ground apparently occurred when
unsupervised citizens dumped oil on the ground rather than into the drums
provided. The state identified this disposal to the ground and asked
the owners of Nelco to stop disposal to the ground. (They did not instruct
them to stop collecting homeowners waste oil). The owners of Nelco
responded to this problem by stopping the practice of receving waste oil
from homeowners.
While Nelco will no longer receive waste oil from homeowners, there are
other points of disposal homeowners can use. Generally auto repair
businesses which sell retail oil and do repairs will receive homeowners
waste oil. Additionally, most gas stations which do auto repair work
will also receive waste oil. This waste oil is then taken in bulk to
recyclers such as Nelco.
I have enclosed a list of businesses which will receive homeowners waste
oil. Also enclosed is information on the County's Household Toxics Program.

During your meeting with Mr. Victor Miranda of our Solid Waste Division,
you asked for our assistance to determine how many oil retailers are complying
with requirements of Section 3465 of the California Public Resources Code.
A survey was made of fifty-two oil retailing establishments in San Diego
County. Each establishment was visited by a member of Recycling Referral
Service, under contract with the County for Volume Reduction and Public Infor-
mation.
Only one establishment was in compliance, Kragen Auto Parts, 504 Oceanside
Blvd., Oceanside, California 92054.
We hope this survey will be of assistance in enforcing CPRC Section 3465.

The survey revealed that only Kragen Auto Parts, 504 Oceanside Blvd., Oceanside,
California 92054 had a cused oil sign in compliance with California Public Resources
Code Section 3465. Kragen also had used oil flyers for distribution to customers.
