MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
May 5, 1987
The regular meeting of the City Council of the City of National City was called to
order at 4:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Cooper, Dalla, Pruitt, VanDeventer, Waters. Absent:
None. Administrative officials present: Bolint, Campbell, Eiser, Mc Cabe, Post,
Stafford.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager Mc Cabe,
followed with invocation by the Rev. Albert Young, First Christian Church.
APPROVAL OF MINUTES
Moved by Cooper, seconded by Pruitt, the minutes of the regular meeting of April
28, 1987 be approved. Carried by unanimous vote.
APPOINTMENTS
BD/COM M
The agenda listed appointments to Civil Service and Planning Commissions. Vice
Mayor Cooper requested the appointments be held over for two weeks in order to
interview an additional applicant (Tirada) for Planning Commission. Moved by
Pruitt, seconded by VanDeventer, the appointments be held over for two weeks.
Carried by unanimous vote.
PUBLIC ORAL COMMUNICATIONS
STREET LIGHTS
THE REV. ALBERT YOUNG, 1800 E. 17 St. (474-2254 or 421-0326), was present
and requested a street light be placed at the corner of 17th and Palm. Moved by
VanDeventer, seconded by Cooper, this be referred to staff. Carried by unanimous
vote.
COMMUNITY PROMOTION — MAYTIME BAND REVIEW
EDITH HUGHES, 1104 Manchester St., Maytime Band Review, was present and
thanked Council, Public Works Dept., Park Dept., Police Dept., and all others who
helped to make this year's Review the success it was; they all did an outstanding
job.
HOWARD KING, 2226 E. 5 St., was present and reiterated his remarks of 4/21/87
re the offset closet rings installed at the state licensed nursing home. Mr. King
said since that tim e he has been accused (by Peter Lutz) of sabotaging the job.
Mayor Waters advised Mr. King to see the City's Director of Housing and Safety
Reid during regular working hours.
PERSONNEL
Mayor Waters read letters praising the actions of Police Officer Wes Andrews and
Fire Chief Kimble.
ADOPTION OF RESOLUTIONS
CONSENT RESOLUTIONS (Resolutions Nos.15,288 through 15,294)
Vice Mayor Cooper requested that Resolutions 2 (15,289) and 7 (15,294) be
considered separately. Moved by Van Deventer, seconded by Dalla, the Consent
Resolutions, with the exceptions of 2 and 7 be adopted. Carried by unanimous
vote.
FIRE PROTECTION
1. Resolution No. 15,288, "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY APPROVING NATIONAL CITY FIRE
DEPARTMENT UNIFORM SHOULDER PATCH DESIGN." Adopted. See above.
PARKING/TRAFFIC
3. Resolution No. 15,290, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY ABOLISHING ONE ON —STREET HANDICAPPED PARKING

interest because he owns property on 9th Street. Moved by VanDeventer,
seconded by Pruitt, Resolution No. 15,289 be adopted. Carried, by the following
vote, to —wit: Ayes: Dalla, Pruitt, VanDeventer, Waters. Nays: None.
Abstaining: Cooper.
VARIANCE — CONFLICT OF INTEREST
7. Resolution No. 15,294, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY, CALIFORNIA, APPROVING A ZONE VARIANCE
APLICATION FOR REDUCTION IN FRONT YARD SETBACK FROM 10 TO 5
FEET FOR PROPERTY AT THE NORTHWEST CORNER OF SEVENTH STREET
AND ROOSEVELT AVENUE, APPLICANT: CHIVAY HSU ARCHITECTS, CASE
FILE NO. S-4-86." Vice Mayor Cooper said he has a conflict of interest
because he owns property on 9th Stree. Moved by Van Deventer, seconded by
Pruitt, Resolution No. 15,194 be adopted. Carried, by the following vote, to —
wit: Ayes: Dalla, Pruitt, VanDeventer, Waters. Nays: None. Abstaining:
Cooper.
ORDINANCE FOR ADOPTION
Moved by Cooper, seconded by VanDeventer, the Ordinance be presented by title only.
Carried by unanimous vote.
PERMITS
8. Ordinance No. 1918, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY ADDING CHAPTER 1.32 TO THE NATIONAL CITY
MUNICIPAL CODE RELATING TO INSURANCE REQUIREMENTS FOR THE
ISSUANCE OF PERMITS." Moved by VanDeventer, seconded by Cooper,
Ordinance No. 1918 be adopted. Carried by unanimous vote.
9. OLD BUSINESS
PORT DISTRICT — FINANCE
SUBJECT: TROLLEY/CONVENTION CENTER, Continued discussion. (At the
adjourned meeting held on 4/21/87 there was a motion to have this matter on
the agenda in two weeks.)
RECOMMENDATION: None.
Discussion.
A CTION: Moved by Cooper, seconded by Pruitt, this be laid over for
about a month. Carried by unanimous vote.

NEW BUSINESS
FINANCE MANAGEMENT
10. SUBJECT: WARRANT REGISTER NO. 43, dated April 28, 1987, Ratification of
Demands in the amount of ;156,381.03 (Warrants Nos. 96347 through 96402).
RECOM MENDATION: Ratify these warrants.
ACTION: Moved by Cooper, seconded by Pruitt, the warrant register be
ratified. Carried, by the following, vote, to —wit: Ayes: Cooper, Dalla,
Pruitt, VanDeventer, Waters. Nays: None.
CLAIMS/LITIGATION
11. SUBJECT: Claim for Damages of D'Wayne Avila,
12. Claim for Damages of Jose Manuel Cota and
13. Claim for Damages of Martha & Edward Oxley.
RECOMMENDATION: Staff recommends these claims be denied and
referred to the City Attorney.
ACTION: Moved by Cooper, seconded by VanDeventer, these claims be
denied and referred to the City Attorney. Carried by unanimous vote.
WRITTEN COMMUNICATIONS
WASTEWATER MANAGEMENT
14. SUBJECT: Letter from Ms. Martha Gainous regarding a joint sewer line
connection at 117 and 111 E. 5th and, flooding problems at 117 E. 5th St.
RECOMMENDATION: None.
TESTIM ONY: Martha Gainous, 117 E. 5th was present and outlined the
problem.
City Attorney Eiser said this is basically a dispute between private
parties; the typical way to bring the City into it is, if there are
dam ages suffered by the private parties and the parties feel the City
should be responsible, a claim is filed and a determination is made as to
whether the City should pay the claim; the City could take some
initiative, do an investigation and perhaps make a determination that the
City bears some responsibility, and should participate in the costs to
correct the situation.
ACTION: Moved by VanDeventer, seconded by Pruitt, a letter be sent
to Mr. Day (111 E. 5th St.) advising him that the City will install a
lateral line to his property line; he is to bring a line from his house
separately, all the way and requesting that he respond as soon as possible
(amended motion). The City Attorney recommended in future staff bring
problems like this to Council. Carried by unanimous vote.
TEMPORARY USE PERMIT — COMMUNITY PROMOTION — CENTENNIAL
15. SUBJECT: Request fro m National City Centennial Com mittee for Temporary
Use Permit for their Historical Home Tour and Preservation and Arts Fair on
May 16 & 17, 1987, from 8:00 a.m. to 5:00 p.m. at Heritage Park, Brick Row,
and for waiver of fees.
RECOMMENDATION: Staff recom mends approval subject to the following
conditions: "No Parking" signs must be in place, advising "Tow Away Zone"
(6:00 a.m. Saturday to 7:00 p.m. Sunday) at least 24 hours prior to time of
enforcement to occur; public liability insurance required with City named as
additional insured; area to be swept 6:00 a.m. Saturday by Public Works (2 hrs.
overtime); chairs and tables to be delivered, set—up and returned by Public
Works (8 manhours overtime); electrical will be set up by Public Works (4 hours
overtime); arrangements and payment for a trash container to be made with
EDCO by Committee; arrangements and payment for toilet facilities to be made
by Committee).
ACTION: Moved by Cooper, seconded by VanDeventer, this be approved and the
fees be waived. Carried by unanimous vote.
TEMPORARY USE PERMIT — COMMUNITY PROMOTION — CENTENNIAL
16. SUBJECT: Request from San Diego County Youth Band, Inc. for Temporary Use
Permit for Pacific Coast Youth Band Association Standstill Contest, sponsored
by the National City Centennial Committee, on May 23, 1987, from 3:00 p.m. to
8:00 p.m., at Kimball Park War Memorial Bowl, with waiver of fees.
RECOM MENDATION: Staff recommends approval subject to the following
conditions: a no fee business license required; all vendors approved to
sell must be listed and must have a fee business license; bus parking at
west curb of "D" Ave., posted "No Parking" in advance of event; two
officers plus two reserves for security; public liability insurance with the
Ci ty nam ed as addional insured must be provided; 6 hours overtim e for
Public Works electrician for power.

ACTION: Moved by VanDeventer, seconded by Cooper, in favor of this
request. Carried by unanimous vote.
TEMPORARY USE PERMIT
17. SUBJECT: Request from Ministerial Association of Seventh Day Adventists for
Temporary Use Permit for their Annual Retreat for Religious Purposes on
May 15-17, 1987, from 9:00 a.m. to 9:00 p.m. at the San Diego Academy,
2700 E. 4th St., and for waiver of fees.
RECOMMENDATION: Staff recommends approval subject to the following
conditions: Applicant to secure permit from Fire Dept.; tent to be flame
retardant; applicant shall provide certification.
ACTION: Moved by VanDeventer, seconded by Cooper, in favor of this
request. Carried by unanimous vote.
TEMPORARY USE PERMIT
18. SUBJECT: Request from the National City Police Reserves to serve alcoholic
beverages in the Kimball Community Bldg. at their annual banquet on
May 23, 1987, and for waiver of fees.
RECOMMENDATION: Staff recommends that Council approve the request
to serve alcoholic beverages at this event.
ACTION: Moved by VanDeventer, seconded by Cooper, in favor of this
request. Carried by unanimous vote.
SOLID WASTE MANAGEMENT
19. SUB J E CT: Administrative Assistant Garza's report on publicity for waste oil
collection sites.
RECOMMENDATION: Staff recommends that Council direct staff to
proceed as outlined (Should Council direct, staff could place a classified
ad similar to the one for the new Ordinance requiring signs warning about
dangers of alcohol and pregancy, approximate cost ;25 for one insertion;
for greater visibility, we could place a display ad in the Star News at a
cost of ;55-110; the subject would be appropriate for a story and/or
public notice in the sum mer issue of National City Today.)
ACTION: Moved by VanDeventer, seconded by Pruitt, in favor of staffs
recommendation. Carried by unanimous vote.
CITY MANAGER — No report.
CITY ATTORNEY — No report.
OTHER STAFF — No reports.
MAYOR
GRAFFITI
Mayor Waters spoke of the graffiti program, saying there have been some arrests;
these people should be made to pay for the damage they are doing to the community.
PORT — AREA DEVELOPMENT
20. SUBJECT: Marina decision discussion.
TESTIMONY: Delton Reopelle (Port Commissioner), 801 Ethel Place, was
present and answered Council's questions, and recommended that Council
request the Port District do a preliminary feasibility study on the
approximately 15 acres located immediately east and north of Pepper
Park; we would have the background as data should Council want to
proceed with something else, dovetailing it with the proposed beach park.
ACTION: Moved by Van Deventer, seconded by Pruitt, we ask the Port
District to do a preliminary feasibility study for the marina on the
designated area, including the beach park and the private property in the
report, the report to be completed in six months. Carried by unanimous
vote.
Members of the Council requested they be furnished with a list of
"possible" (Port) CIP projects.
CITY COUNCIL
ZONE
21. SUB J E CT: Agenda item regarding lot size requirements for automotive repair
uses inthe Light Manufacturing Zone.
RECOMMENDATION: Councilman VanDeventer recommended this be held
over to May 19.
A CTION: Moved by Cooper, seconded by Pruitt, this be held over for
two weeks. Carried by unanimous vote.

EXECUTIVE SESSION — PERSONNEL
Closed Session to discuss personnel matters, and Closed Session city City
Representatives under Government Code Section 54957.6.
ACTION: Moved by VanDeventer, seconded by Cooper, in favor of the closed
sessions. Carried by unanimous vote.
Council went into Executive Session at 5:12 p.m.
Council reconvened at 5:45 p.m.

None.
ADJOURNMENT
Moved by Cooper, seconded by Pruitt, the meeting be adjourned to 7:00 p.m.,
May 12, 1987. Carried by unanimous vote. The meeting closed at 5:47 p.m.
