Mayor Morgan said it has been a pleasure to serve the City for the past 26 years, seven months; the people have always supported him and he appreciates that; he will never forget that and he would like to thank the people of National City; he is leaving the City Council in good, sound financial condition. ROLL CALL Council members present: Cooper, Daila, VanDeventer, Waters, Morgan. Absent: None. Administrative officials present: Bolint, Campbell, Eiser, McCabe, Post, Stafford. SALUTE TO THE FLAG AND INVOCATION Councilman Waters introduced Boy Scout Troop 114, who posted colors and led the salute to the flag; invocation followed by the Rev. Thomas Byrnes, St. Mary's Catholic Church. APPROVAL OF MINUTES Moved by Cooper, seconded by VanDeventer, the minutes of the regular meeting of November 18, 1986 be approved. Carried by unanimous vote. BUSINESS RELATING TO GENERAL MUNICIPAL ELECTION NOVEMBER 4, 1986 Moved by Cooper, seconded by VanDeventer, the Resolution be presented by title only. Carried by unanimous vote. ELECTION/NOVEMBER 4, 1986 1. Resolution No. 15,130, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 4, 1986, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW. "WHEREAS, a General Municipal Election was held and conducted in the City of National City, California, on Tuesday, November 4, 1986, as required by law; and "WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the return made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and "WHEREAS, the San Diego County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as 'Exhibit A.' "NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: "SECTION 1. That the whole number of votes cast in the City except absent voter ballots was 6628. "That the whole number of absent voter ballots cast in the City was 429, making a total of 7057 votes cast in the City. "SECTION 2. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates were as listed in Exhibit "A" attached. "SECTION 4. The City Council does declare and determine that: "GEORGE H. WATERS was elected as Mayor for the full term of four years; "MICHAEL DALLA was elected as Member of the City Council of the City for the full term of four years; "FRED PRUITT was elected as Member of the City Council of the City for the full term of four years; "That as a result of the election, two—thirds of the voters voting on the measure relating to the POLICE FACILITY BOND ISSUE did not vote in favor of it, and that the proposition was not carried, and shall not be deemed adopted and ratified. "SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of votes cast in the City; (2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against each measure; (6) The number of votes given to each person, and for and against each measure. "SECTION 6. That the City Clerk shall im mediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. "SECTION 7. Carried by unanimous vote. The City Clerk administered the Oath of Office to Mayor Waters, and Councilmen Michael Dalla and Fred Pruitt. Mayor Morgan congratulated the newly elected officials and passed the gavel to Mayor Waters. Mayor Waters presented the flag which flew over City Hall today to retiring Mayor Morgan. ROLL CALL Council members present: Cooper, Dalla, Pruitt, Van Deventer, Waters. Absent: None. The newly elected officials introduced their families who were present in the audience. Mayor Waters recognized Mrs. Donna Morgan, who was present in the audience. Jennifer Waters presented Mayor Waters with a gavel. Mayor Waters called a recess at 7:20 p.m. for cake and coffee in honor of out —going Mayor Morgan. Council reconvened at 7:42 p.m. ROLL CALL Council members present: Cooper, Dalla, Pruitt, Van Deventer, Waters. Absent: None. EXECUTIVE SESSION — PERSONNEL LABOR REL Mayor Waters called an Executive Session at 7:43 p.m. City Attorney Eiser said the closed session would be held to consider an employee relations matter. Moved by VanDeventer, seconded by Cooper, in favor of the Executive Session. Carried by unanimous vote. Council reconvened at 8:10 p.m. ROLL CALL Council members present: Cooper, Dalla, Pruitt, Van Deventer, Waters. Absent: None. PUBLIC ORAL COMMUNICATIONS COMMUNITY DEVELOPMENT COMMISSION JANICE MARTINELLI, 916 "A" Ave., was present and said the City had an agreement to maintain the exterior of the properties and the landscaping in Heritage Square; she believes this agreement will expire at the end of November, and it is important that it be renewed. Moved by Van Deventer, seconded by Cooper, this be referred to the Executive Director, Community Development Commission. Carried by unanimous vote. PUBLIC HEARINGS COMMUNITY DEVELOPMENT COMMISSION/BLOCK GRANT 2. SUBJECT: Public Hearing — Community Development Block Grant Program 1987-88. RECOM MENDATION: Staff recommends the public hearing be held and continued to January 13, 1986. TESTIMONY: Arnold Peterson, Executive Director, CDC (Outlined the proposed program, including requests from San Diego Resident Relations Foundation and the Samahan Clinic; Mr. Peterson recommended enlargement of the Morgan Towers dining room at a cost of $125,000 and $500,000 toward the Home Improvement Loan Program; the C.I.P. Committee has suggested the following for consideration, along with other competing priorities: 1. National City Blvd. drain from South of 31st St. to 32nd St. — $45,000; 2. National City Blvd. Drain from 32nd St. to Sweetwater Flood Channel — $125,000; 3. Extend Storm Drain, NE City limit to Honeysuckle — $200,000; 4. 'N' Ave., 8th St. to Plaza — $302,000; 5. Traffic Signal, 30th & "D" — $120,000.) Dan Murphy, 936 "A" Ave., member Committee for Housing and Community Development (Suggested part of the funds be used to study the possibility of extending the Downtown Redevelopment from 9th to Plaza; what we are doing there is wonderful, but only half solving the problem.) Book 67/Page 217 11/25/86 Grace Rice, Director, San Diego Resident Relations Foundation (They have submitted a written request, but they would like to make some modifications of their budget from $134,000 to $175,000; originally they asked for $10,000 for the share of tenant/landlord problems they solve for National City; National City's percentage comes to 3.2% of the total calls received requesting assistance, and that comes to $5,500, and she is requesting that as opposed to the $10,000 they originally requested.) Bobby Cruz, Executive Director, Samahan Clinic, 2743 Highland Ave. (Thanked the members of the citizens' com mittee, and Council for awarding $20,000 last year, which can be used in facelifting the clinic; there are increased demands for medical services, and they need to expand the clinic; they are requesting $80,000; they can get some Federal Grant Funds to render services, but those funds cannot be used for capital improvement. Bill Wallace, member of Committee for Housing and Community Development (Asked Council to consider using some of the funds to enlarge the dining room at Morgan Towers; there is seating for 96; today over 300 people were served; the volunteers are doing a marvelous job.) Martin San Victores, President, Philipino—American Community of National City (Thanked Council for giving $20,000 to Samahan Clinic, and requested Council consider a donation this year for their expansion project; the Samahan Clinic is the training ground for many of their professionals; Samahan renders needed services to the whole community.) Councilman Dalla outlined his suggestions, including Senior Citizens' dining room expansion — $125,000; home loan program — $170,000; National City Blvd. drain — $45,000; 50/50 sidewalk program — $60,000; curb, gutter, sidewalk infill program — $60,000; traffic signal at 30th & "D" — $120,000; school crossing signals — $120,000; traffic signal upgrade and computerization — $250,000. Councilman Van Deventer said there is a need for a crossing at Paradise Valley Hospital, across the street to the clinic, on the west side of the street; it was estimated at $40,000, and he would like to submit this as an option to be included; he would also like to pursue the drainage ditch that we are covering, and get it all the way up to Plaza Blvd. in the north part of the City at the easterly boundary. ACTION: Moved by Cooper, seconded by Van Deventer, the public hearing be continued to January 13. Carried by unanimous vote. Resolution No. 15,134, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CHIEF OF POLICE TO SUBMIT AN APPLICATION FOR GRANT FUNDS TO THE OFFICE OF CRIMINAL JUSTICE PLANNING AND TO UTILIZE THE GRANT AWARD FOR LAW ENFORCEMENT PURPOSES." Moved by Van Deventer, seconded by Cooper, Resolution No. 15,134 be adopted. Carried by unanimous vote. SUBDIVISION 10. Resolution No. 15,138, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING A TENTATIVE PARCEL MAP FOR THE DIVISION OF .73 ACRES INTO 4 LOTS LOCATED AT THE EAST END OF FIRST STREET, BETWEEN "L" AVENUE AND LAUREL AVENUE (A.P.N. 554- 011-21 AND 23, APPLICANT: JOSEPH M. Nays: Dalla, VanDeventer. ORDINANCE FOR INTRODUCTION Moved by Van Deventer, seconded by Cooper, the Ordinance be presented by title only. Carried by unanimous vote. CITY COUNCIL ORG/BEN 13. "An Ordinance establishing the salaries of the Mayor and City Council." ACTION: Moved by VanDeventer, seconded by Cooper, in favor of the proposed 5% increase for the City Council (to increase compensation from $500/mo. to $525/mo.) and a 5% increase for the Mayor. Carried by unanimous vote. City Attorney Eiser said it would also be appropriate to increase the compensation of the Board Members of the Community Development Com mission, and include that in this Ordinance; the recom mendation made on the CDC agenda was that this amount be $525 per month, and the compensation be increased at the same time the salary increase for the City Council takes place. Mr. Eiser read the proposed ordinance. ACTION: Moved by VanDeventer, seconded by Cooper, in favor of the City Attorney's recommendation. Carried by unanimous vote. Book 67/Page 219 11/25/86 OLD BUSINESS SURPLUS PROPERTY 14. SUBJECT: Report on Surplus Properties (Roosevelt at 18th & Euclid at Plaza). RECOMMENDATION: None. TESTIMONY: City Attorney Eiser said last time this item (property at Roosevelt & 18th) came before Council, Mr. Schwartz (Mr. Beauchamp's attorney) requested that this be opened up for competitive bidding; his advice at that time was that since notice had been provided and groundrules had been set forth, we were bound to allow only the individual who had complied with the notice (Mr. Fred West) to participate, and he was the only one who had submitted a written bid on a timely basis; last week he was notified that Mr. Beauchamp would be applying in Superior Court for a Temporary Restraining Order to halt the sale of this property until he could obtain a hearing on the merits of a lawsuit which he had filed, wherein he claims that he should be entitled to participate in this transaction; the Temporary Restraining Order was issued, and at this point, the City is precluded from going forward with this matter; a hearing is set for December 15; Mr. West is also involved in the suit, and he will have an opportunity to set forth his position to the court at that time. Fred West, 1706 Hoover (He doesn't fully understand the motivation behind the plaintiff's actions; he knows without a doubt that the Beauchamps were aware that this was a public offering on three occasions prior to October 14; he is not intimidated and he will commit his resources to see that justice prevails.) Steve Schwartz, Attorney for Mr. Beauchamp (Open competitive bidding serves the public interest, and will mean that the City will acquire more money for this property than would otherwise be available; he doesn't see the contrary interest on the side of the City; the notice was undated, and called for sealed bids to be submitted before October 14, 1985; he believes that was a misprint, but it may have been an old notice; he submitted the notice to the Court, and It was reviewed by the Court; the notice makes reference to overbids occurring at the tim e of sale, but does not say it will be limited to those who put forth written proposals prior to any date.) Vice Mayor Cooper said he understands the property at Euclid & Plaza is already in escrow. City Engineer Stafford said we have obtained the title policy, but he has not apprised himself of whether they have entered escrow. ACTION: Moved by Cooper, seconded by Dalla, we hold off on the sale of the property at Roosevelt & 18th until after the court case is settled. TESTIMONY: Fred West (He will swear under oath that he knows the Beauchamps were aware that this property was being put out to bid, because he spoke to Mr. Beauchamp and told him he was going down to submit a bid.) ACTION: Motion carried, by the following vote, to —wit: Ayes: Cooper, Dalla, Pruitt, Waters. Nays: None. Abstaining: VanDeventer. City Manager Mc Cabe said it is his understanding that Mr. Kerch has made an offer on the property at Euclid & Plaza, and is entering escrow. ACTION: Moved by Cooper, seconded by VanDeventer, this item be filed. Carried by unanimous vote. NEW BUSINESS FINANCE MGMT 15. SUBJECT: WARRANT REGISTER NO. 20 ,Ratification of Demands in the amount of ;497,288.36 (Warrants Nos. 94299 through 94387). RECOMMENDATION: Staff recommends the warrants be ratified. ACTION: Moved by Cooper, seconded by VanDeventer, the bills be ratified. Carried, by the following vote, to —wit: Ayes: Cooper, Dalla, Pruitt, VanDeventer, Waters. Nays: None. WRITTEN COMMUNICATIONS CITY FACILITY/KIMBALL COMMUNITY BLDG — ALCOHOLIC BEV LICENSE 16. SUBJECT: Request from Kiwanis Club of National City to serve alcoholic beverages and for waiver of rental fees (for "Recognition of Kile Morgan Dinner on December 5, 1986). 1 Book 67/Page 220 11/25/86 RECOMMENDATION: Staff recommends waiver of all fees. ACTION: Moved by VanDeventer, seconded by Cooper, in favor of this request. Carried by unanimous vote. OTHER BUSINESS PLANNED DEVELOPMENT PERMIT 17. SUBJECT: Planning Commission — Notice of Decision. Resolution No. 55-86 approving an application for Planned Development Permit to allow construction of a 20—unit senior citizen apartment complex at 304 and 306 Palm Avenue (Applicant: Apostolic Assembly Church of National City, Case File No. PD-07- 86). RECOM MENDATION: The Planning Com mission recom mends approval; staff concurs with the Planning Commission's recommendation. ACTION: Moved by VanDeventer, seconded by Cooper, in favor of this request. Carried by unanimous vote. CONDITIONAL USE PERMIT — PLANNED DEVELOPMENT PERMIT 18. SUBJECT: Planning Commission — Notice of Decision. Resolution No. 56-86 denying Conditional Use Permit and Planned Development Applications for construction of a 52—unit motel at the north east corner of 7th Street and Roosevelt Avenue (Applicant: Chivay Hsu Architects, Case File Nos. C U P-1986-14/P D-08-86), and ZONE VARIANCE 19. SUBJECT: Planning Commission — Notice of Decision. Resolution No. 53-86 approving an application for a Zone Variance to permit a minimum front yard setback of five feet in conjunction with the proposed developm ent of a 52—unit motel at the northeast corner of 7th Street and Roosevelt Avenue (Applicant: Chivay Hsu Architects, Case File No. Z-04-86). The City Clerk reported the applicant has appealed the Planning Commission's denial of CUP and Planned Development Permits, and this will be set for public hearing (tentative date December 9); the Zone Variance is not affected. ACTION: Moved by Dalla, seconded by VanDeventer, this be set for public hearing on December 9. Carried by unanimous vote. STREET VAC/PORTION OF 15TH ST EAST OF LANOITAN 20. SUBJECT: Report on Vacation of a Portion of 15th Street East of Lanoitan Avenue. RECOMMENDATION: Staff recommends Council direct staff to start vacation proceedings. ACTION: Moved by Dalla, seconded by Cooper, staff be directed to start vacation proceedings. Carried by unanimous vote. FLOOD CONTROL 21. SUBJECT: Report on Petition for "M" Avenue Drainage Certificate of Engineer. RECOMMENDATION: Staff recommends that the City schedule a project for some future Capital Improvement Program contingent upon 25% participation each by Mr. & Mrs. Knight, and the National School District. TESTIMONY: Marcele See, Business Manager, National School District (A letter was sent to the City Manager from the administrators of National School District for the purpose of determining the City's intention and expectation of what to do about the drainage ditch on the proposed "M" Ave.; the governing board of National School District has made no commitment; this street adjoins the School District's property; she feels the governing board might consider a 1911 Act, but that decision would be at the governing board level. ACTION: Moved by Cooper, seconded by VanDeventer, we instruct staff to meet with the School District and give them more information, including cost factors, how the ditch would be covered etc., and Mr. & Mrs. Knight be given the same information. Carried by unanimous vote. FIRE PROTECTION 22. SUBJECT: Report on Fire Department Dispatching. RECOMMENDATION: Staff recommends the report be filed. ACTION: Moved by Dalla, seconded by VanDeventer, the report be accepted and filed. Carried by unanimous vote. Book 67/Page 221 11/25/86 CITY MANAGER — No report. CITY ATTORNEY — No report. OTHER STAFF — No reports. MAYOR Mayor Waters reported the Kiwanis Club is going to "roast" Mayor Morgan on December 5, and invited anyone who knows the Mayor and has something nice to say to attend; tickets are available at the Chamber of Commerce or from City Treasurer Del Redding. CITY COUNCIL CITY COUNCIL MET REGS/SCH Moved by Van Deventer, seconded by Cooper, Council go dark the weeks of December 22 and December 29. Carried by unanimous vote. The City Manager was advised that if anything that comes up where he feels a meeting should be held during those weeks, he should notify Council. Councilman Pruitt recognized William Blair, representing Mayor O'Connor's office, who was present in the audience. Mr. Blair congratulated the new Council members. ADJOURNMENT Moved by Cooper, seconded by Van Deventer, the meeting be adjourned to 4:00 p.m., December 2, 1986. Carried by unanimous vote. Corrections No corrections MAYOR CITY OF NATIONAL CITY, CALIFORNIA RESOLUTION NO. 15,130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 4, 1986, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of National City, California, on Tuesday, November 4, 1986, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the return made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, the San Diego County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of votes cast in the City except absent voter ballots was 6628. That the whole number of absent voter ballots cast in the City was 429, making a total of 7057 votes cast in the City. SECTION 2. That the names of persons voted for at the election for Mayor are as follows: GEORGE H. WATERS JESS E. VAN DEVENTER IONE CAMPBELL JUAN LOZANO DAVID WIGNALL That the names of persons voted for at the election for Member of the City Council of the City are as follows: MICHAEL DALLA FRED PRUITT DARRYL GORHAM NORMA A. FISHER PAUL D. RINKS JAMES L. LADD That the measure voted upon at the election is as follows: POLICE FACILITY BOND MEASURE SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates were as listed in Exhibit "A" attached. SECTION 4. The City Council does declare and determine that: GEORGE H. WATERS was elected as Mayor for the full term of four years; MICHAEL DALLA was elected as Member of the City Council of the City for the full term of four years; FRED PRUITT was elected as Member of the City Council of the City for the full term of four years; That as a result of the election, two-thirds of the voters voting on the measure relating to the POLICE FACILITY BOND ISSUE did not vote in favor of it, and that the proposition was not carried, and shall not be deemed adopted and ratified. SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of votes cast in the City; (2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against each measure; (6) The number of votes given to each person, and for and against each measure. SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED, AND ADOPTED ON November 25, 1986.
