MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
FEBRUARY 8, 1983
The regular meeting of the City Council of the City of National City
was called to order at 7:00 p.m. by Mayor Morgan.
ROLL CALL
Council members present: Camacho, Dalla, Waters, Morgan. Absent:
Van Deventer. Administrative officials present: Benzing, Campbell,
Gerschler, McCabe, Asst. City Attorney G. McLean.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager
McCabe followed with invocation by Chaplain Bill Ward, Paradise Valley
Hospital.
APPROVAL OF MINUTES
Moved by Camacho, seconded by Dalla, the minutes of the regular meeting
of February 1, 1983 and the adjourned meeting of February 1, 1983 be
approved. Carried by unanimous vote. Absent: Van Deventer.
PUBLIC ORAL COMMUNICATIONS
None
ADOPTION OF RESOLUTIONS
Moved by Camacho, seconded by Waters, the Resolutions be presented by
title only. Carried by unanimous vote. Absent: Van Deventer.
Resolution No. 13,971, "RESOLUTION AUTHORIZING THE CITY ENGINEER TO
EXECUTE IMPROVEMENT AGREEMENTS WITH SWEETWATER TOWN AND COUNTRY." Moved
by Waters, seconded by Camacho, Resolution No. 132,971 be adopted.
Carried by unanimous vote. Absent: Van Deventer.
Resolution No. 13,972, "RESOLUTION AMENDING RESOLUTION NO. 13,967
RELATING TO PAYMENT OF $50,000 AS PARTIAL CONSIDERATION FOR PURCHASE OF
REAL PROPERTY (APN 563-150-22 - Oliver)." Moved by Camacho, seconded
by Waters, Resolution No. 13,971 be adopted. Carried, by the following
vote, to -wit: Ayes: Camacho, Waters, Morgan. Nays: Dalla. Absent:
Van Deventer.
ORDINANCE FOR INTRODUCTION (FIRST READING)
Moved by Camacho, seconded by Dalla, the Ordinance be presented by
title only. Carried by unanimous vote. Absent: Van Deventer.
Ordinance No. 2/8/83-1, "Ordinance of the City of National City,
California amending Ordinance No. 1790 adopted February 1, 1983 relating
to regulations affecting location of adult entertainment establishments
in the City of National City."
NEW BUSINESS
The City Treasurer/Finance Director's request for RATIFICATION of
WARRANT REGISTER NO. 31, dated February 1, 1983, in the amount of
$15,301.64 (Warrants Nos. 78844 through 78897 [voided 78843, 78855,
78861]) was presented. Moved by Waters, seconded by Camacho, the bills
be paid and warrants drawn. Carried, by the following vote, to -wit:
Ayes: Camacho, Dalla, Waters, Morgan. Nays: None. Absent:
Van Deventer.
The City Treasurer/Finance Director's FINANCIAL STATEMENTS - Annual
Audit - with REPORT on EXAMINATION by CERTIFIED PUBLIC ACCOUNTANTS were
presented. Ordered filed by unanimous vote. Absent: Van Deventer.

Library Board of Trustees Chairperson Lillis Hlawatsch, 1239 E. 30th St.,
was present and outlined the LIBRARY PLAN OF SERVICE (developed by the
Library staff) and distributed copies to Council. Mrs. Hlawatsch said
the Board is proud of the Plan which is extremely well done; the State
Librarian praised it highly. RUBEN RODRIGUEZ, member of the Library
Board of Trustees, 411 E. 2nd, was also present and said he hoped
Council members would read the report.
The CLAIM for DAMAGES of Presbitero Alfaro, arising from an incident on
November 5, 1982 and filed with the City Clerk on January 28, 1983 was
presented. Moved by Camacho, seconded by Dalla, this claim be denied
and referred to the City Attorney. Carried by unanimous vote. Absent:
Van Deventer.
OTHER BUSINESS
CITY MANAGER - No report.
CITY ATTORNEY
A communication from the County of San Diego regarding settlement of
Superior Court Case concerning Robert C. Bradley vs the County of San
Diego, et al was presented. Asst. City Attorney McLean said this
involves no money on the part of the City. Ordered filed by unanimous
vote. Absent: Van Deventer.
OTHER STAFF - No reports.
MAYOR - No report.
CITY COUNCIL
Councilman Waters said that coins, jewelry, etc. that are recovered from
robberies are seldom claimed; they usually end up being auctioned off
by the Police; when the Police recover stolen items, they should contact
people and businesses who have been robbed, so possibly some of it could
be identified and reclaimed. He has discussed this with the Chief of
Police who will bring it up at a meeting with the County Chiefs of
Police and report on their reaction.
Councilman Waters said he thought we should celebrate the commencement
of the landscaping on I-805 after waiting 10 years for the work to be
done. Mayor Morgan commented we should celebrate when the work is
completed.
Councilman Dalla said he read in this afternoon's paper that National
City lost its appeal on Route 252; we should not have to rely on the
newspaper to learn the status of our litigation; he would like the City
Attorney to report on further options open to the City. Asst. City
Attorney McLean said it appears the decision was filed and dated
February 7; to her knowledge, it was not received in the City's mail
this morning; it is not their practice to call the Court of Appeals on
a daily basis.
ADJOURNMENT
Moved by Waters, seconded by Camacho, the meeting be adjourned to
4:00 p.m., February 15, 1983. Carried by unanimous vote. Absent:
Van Deventer. The meeting closed at 7:15 p.m.

The foregoing minutes were approved at the regular meeting of the City
Council on February 8, 1983.
