MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
JULY 5, 1983
The regular meeting of the City Council of the City of National City
was called to order at 4:04 p.m. by Vice Mayor Dalla.
ROLL CALL
Council members present: Camacho, Dalla, Van Deventer, Waters. Absent:
Morgan. Administrative officials present: Benzing, Bolint, Campbell,
McCabe, McLean, Acting Planning Director Post.
APPROVAL OF MINUTES
The City Clerk reported the minutes of the regular meeting of
June 28, 1983 had not been distributed and requested that approval be
held over one week.
PUBLIC ORAL COMMUNICATIONS
HARRY ROSE, 2203 E. 1st St., was present and presented a petition from
the residents of E. 1st St. and 'U' Ave., requesting an investigation
of conditions at El Toyon Park. Mr. Rose said the park is overcrowded
by non-residents, there is a lot of speeding and reckless driving,
filthy language and trash scattered around; there are a group of people
who play Cricket in the park and windows have been broken in homes and
cars. Discussion. Mr. Rose continued, in the past two weeks, he has
seen an improvement; several arrests have been made, but there are
still a lot of problems. RUSS PENNEY, 2131 E. 1st St., was present and
said there have been 3 accidents caused by speeding in the past four
weeks; people from SE San Diego are taking over the park; the past two
Sundays, police officers patrolled the park and there were fewer
problems, but the police cannot be there all the time; he would be
willing to pay higher taxes in order to have a special police officer
stationed in the park. Discussion re the use of "speed bumps" in the
park area. City Attorney McLean said if the roadway is a private road
and not a public thoroughfare, the artificial barriers are appropriate;
if the City changes the type of road surface on a public thoroughfare,
the City could be liable. Further discussion. MR. SAMONTE, 2315 E.
1st St., was present and said the Cricket players walk into the
residents' yards to retrieve their ball; they even climbed on his roof
once; his rights are being violated; the Cricket players have broken
windows; he would like to see Cricket banned in El Toyon Park. Vice
Mayor Dalla said this would be referred to staff. City Attorney McLean
said if the Park Director comes up with a list of things that should be
forbidden in the park, Council may want to adopt an Ordinance to enable
the police to enforce it.
ADOPTION OF RESOLUTIONS
Moved by Camacho, seconded by Van Deventer, the Resolutions be
presented by title only. Carried by unanimous vote. Absent: Morgan.
Resolution No. 14,086, "RESOLUTION APPROVING THE HAZARDOUS WASTE
ELEMENT OF THE REVISED SAN DIEGO REGIONAL SOLID WASTE MANAGEMENT PLAN
(1982-2000)." Moved by Van Deventer, seconded by Waters, Resolution
No. 14,086 be adopted. Carried by unanimous vote. Absent: Morgan.
Resolution No. 14,087, "RESOLUTION AWARDING CONTRACT FOR CONSTRUCTION
OF AUTOMOTIVE HOISTS FOR THE PUBLIC WORKS YARD (Engineering
Specification No. 929)." Moved by Waters, seconded by Van Deventer,
Resolution No. 14,087 be adopted. Carried by unanimous vote. Absent:
Morgan.

Resolution No. 14,088, "RESOLUTION ACCEPTING GRANT DEED FOR STREET
PURPOSES FROM W.T. & E. BLACKBURN (2432 EAST 13TH STREET -
558-092-16)." Moved by Van Deventer, seconded by Camacho, Resolution
No. 14,088 be adopted. Carried by unanimous vote. Absent: Morgan.
Resolution No. 14,089, "RESOLUTION AUTHORIZING THE CITY ENGINEER TO
ENTER INTO AN ACQUISITION ESCROW FOR PROPERTY AT 2432 EAST 13TH STREET
(BLACKBURN) PER ESCROW NUMBER 57015-S DATED JUNE 20, 1983 (Land Title
Insurance Company)." Moved by Van Deventer, seconded by Waters,
Resolution No. 14,089 be adopted. Carried by unanimous vote. Absent:
Morgan.
Resolution No. 14,090, "RESOLUTION APPROVING FISCAL YEAR 1983-84
COMPENSATION PLAN FOR THE MUNICIPAL EMPLOYEES' ASSOCIATION." Moved by
Camacho, seconded by Van Deventer, Resolution No. 14,090 be adopted.
Discussion. Carried by unanimous vote. Absent: Morgan.
ORDINANCES FOR ADOPTION
Moved by Camacho, seconded by Van Deventer, the Ordinances be presented
by title only. Carried by unanimous vote. Absent: Morgan.
Ordinance No. 1796 (6/14/83-1), "ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE
CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AND THE
BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT
SYSTEM AND ADOPTING SAID ORDINANCE AS AN URGENCY ORDINANCE." Moved by
Waters, seconded by Van Deventer, Ordinance No. 1796 (6/14/83-1) be
adopted. Carried by unanimous vote. Absent: Morgan.
Ordinance No. 1797 (6/28/83-1), "ORDINANCE AMENDING TITLE 18 (ZONING)
OF THE NATIONAL CITY MUNICIPAL CODE TO PROHIBIT THE ESTABLISHMENT OF
SECOND UNITS IN SINGLE FAMILY RESIDENTIAL ZONES." Moved by Camacho,
seconded by Waters, Ordinance No. 1797 (6/28/84-1) be adopted. Carried
by unanimous vote. Absent: Morgan.
Ordinance No. 1798 (6/28/83-3), "ORDINANCE AMENDING SECTION 14.06.060
(FEES --- SEWER LATERALS) OF THE NATIONAL CITY MUNICIPAL CODE PROVIDING
FOR INCREASES IN THE FEES." Moved by Van Deventer, seconded by Camacho,
Ordinance No. 1798 (6/28/83-3) be adopted. Carried, by the following
vote, to -wit: Ayes: Camacho, Dalla, Van Deventer. Nays: Waters.
Absent: Morgan.
ORDINANCES FOR INTRODUCTION (FIRST READING)
Ordinance No. 7/5/83-2, "Ordinance of the City of National City,
California, adopting the Combined General Plan/Zoning Map."
Ordinance No. 7/V/83-3, "Ordinance approving an amendment to the
National City Land Use Code regarding zone categories."
NEW BUSINESS
The application for OFF -SALE GENERAL LIQUOR LICENSE, TYPE 21, PERSON
TRANSFER of Basim Younan, Joseph Younan, Nizar Younan and Habib Y.
Younan, dba FARMER'S DISCOUNT MARKET, 1535 E. 18th Street (Police,
Planning and Building Departments state no grounds for objection) was
presented. Moved by Camacho, seconded by Van Deventer, this license be
approved. Carried by unanimous vote. Absent: Morgan.
The CLAIM for DAMAGFS of YOLANDA CARRUTHERS, arising from an accident
on March 24, 1983 and filed with the City Clerk on June 23, 1983 was
presented. Moved by Camacho, seconded by Van Deventer, this claim be
denied and referred to the City Attorney. Carried by unanimous vote.

The CLAIM for DAMAGES of DE SHAWN GROSS, arising from an accident on
March 24, 1983 and filed with the City Clerk on June 23, 1983 was
presented. Moved by Camacho, seconded by Van Deventer, this claim be
denied and referred to the City Attorney. Carried by unanimous vote.
Absent: Morgan.
OTHER BUSINESS
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF - No reports.
MAYOR
Vice Mayor Dalla announced that on completion of the agenda, Mr.
Humphrey of National University High school would make a presentation.
CITY COUNCIL - No reports.
Mr. Humphrey of National University High School requested Council's
support, explained the school's program and showed films of the school
and students. Moved by Camacho, seconded by Van Deventer, the City do
everything possible to assist this program, either by Resolution or by
writing letters to members of the school board, depending on time
available. Carried by unanimous vote. Absent: Morgan.
ADJOURNMENT
Moved by Camacho, seconded by Van Deventer, the meeting be adjourned
to 7:00 p.m., July 12, 1983. Carried by unanimous vote. Absent:
Morgan. The meeting closed at 5:00 p.m.
The foregoing minutes were approved at the regular meeting of the City
Council on July 12, 1983.
