MINUTES OF THE REGULAR MEETII':^ OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
AUGUST 25, 1981
The regular meeting of the City Council of the City of National City
was called to order at 7:00 p.m, by Mayor Morgan.
ROLL CALL
Council members present: Camacho, Dallas Waters, Morgan. Absent:
Van Deventer. Administrative officials present: Campbell, Gerschler,
Grahl, McCabe, McLean.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager
McCabe followed with invocation by Father Peter Borda, St. Mary's
Church.
APPROVAL OF MINUTES
Moved by Waters, seconded by Camacho, the minutes of the regular meeting
of August 18, 1981 be approved. Carried by unanimous vote. Absent:
Van Deventer,
PUBLIC ORAL COMMUNICATIONS
TOM MAC FADEN, 7456 Pacific Ave., Lemon Grove, was present representing
the Jaycees, and asked for Council approval of a carnival permit for
this weekend (to be held on the lot next to Dixieline Lumber); he has
Police and Fire approval, but did not submit the request in time for
the agenda. Moved by Waters, seconded by Camacho, this request be
approved, subject to all requirements of the City being met, and refer
this matter to the City Manager. Discussion. Carried by unanimous
vote. Absent: Van Deventer.
JOSE GONZALEZ, 2534 Division St., was present and said he has been a
resident of National City since 1970; he is a member of New Waves Car
Club, whose main function is to promote unity and culture identity
within the chicano community; this car club is a member of the San Diego
Low Rider Council, which consists of 11 car clubs within San Diego
County. Mr. Gonzalez said he was here to protest the harrassment, unfair
treatment, illegal search of vehicles, unfair ticketing, and verbal and
physical threats the chicano community is experiencing. Mr. Gonzalez
further stated 50% of the people in National City are chicanos who pay
taxes; they should feel secure and protected, not scared; chicanos
should not be placed on a list for having customized vehicles.
ELSA SANCHEZ, 801 27th St., San Diego, was present and restated Mr.
Gonzalez's views. Ms, Sanchez said she is a member of Ladies' Pride
Car Club; they put a lot of time and effort into their cars; they are
proud of their cars and should be allowed to show them off.
ENRIQUE MORALES, 1629 Harding Ave., was present and asked why the City
Council is ordering the Police to harrass chicanos? What gives the
Police Dept. the right to play God?, and said the low riders are told
by the police to shut up and get out of town. Mr. Morales said the
Chicanos are taxpayers and demand their legal rights; their cars are
their hobby.
RIGOBERTO REYES, 1475 Peter Lane, San Diego, was present and said there
is concern in the chicano community about the abuse and discrimination
going on in National City, especially on Highland Ave.; the chicanos
are being treated as second-class citizens.

GEORGE RODRIGUEZ, 1728 Kearney Ave., San Diego, was present and said
the National City Police treat low riders like criminals; when
chicanos are stopped by the Police, they are told they have five seconds
to leave town. Mr. Rodriguez further stated the Low Rider Council is
demanding elimination of the NCPD "hit list", stop the threats and
demands for low riders to get out of town, issue public statements that
chicano community constitutional rights will be protected, and stop
unwarranted tickets and impounding of vehicles.
R. C. KESTER (sp? - no address given) was present and said National City,
along with other cities, has a real problem; these young people have
nice cars and have spent a lot of money on them; possibly the City
could issue a permit for one night a week, or one night a month to show
their cars off.
PUBLIC HEARINGS
The PUBLIC HEARING on EXTENSION of INTERIM ORDINANCE 1744, limiting the
number of mechanical and/or electronic video game machines that may be
placed in a business as an incidental use - Case File No. I-2-81 (This
Ordinance will expire August 28, 1981; on Aug. 4, 1981, the City Council
adopted Ordinance No. 1749, which will go into effect September 4, 1981;
it is necessary to extend the Interim Ordinance since it will expire
before Ordinance 1749 goes into effect; staff recommends approval of
this extension) was held at this time. The City Clerk reported the
Certificate of Publication was on file. Planning Director Gerschler
reported the Planning Commission and staff recommend approval. ROBERT
FRYER, 15 Blue Anchor Cay Rd., Coronado, was present representing the
National City Businessmen's Association, and said there is some
confusion re how many video games will be allowed; Ordinance No. 1744
states two video games, but Ordinance No. 1749 states four video games.
Planning Director Gerschler explained the new Ordinance (1749), which
goes into effect next week, allows four video games; the old Ordinance
(1744) allows two video games until the Ordinance dies. Moved by Waters,
seconded by Camacho, the Public Hearing be closed and all stipulations
of staff be adhered to. Carried by unanimous vote. Absent: Van
Deventer.
The PUBLIC HEARING on APPEAL of Planning Commission's approval of
PLANNED DEVELOPMENT PERMIT (PD-4-81), 1710 E. 4th St. (The proposed
project consists of the addition of one two-story frame and stucco
duplex on property having one existing single-family dwelling; each
unit within the proposed duplex will have three bedrooms and
approximately 1,100 sq. ft. of floor area; a private patio area of
either 270 or 275 sq. ft., unenclosed off-street parking for two
automobiles and access to 847 sq. ft. of common open space; the proposed
areas of open spaces and off-street parking are consistent in area and
number with that required by code; project site is located at the SE
corner of 4th St. and "Q" Ave.; staff concurs with the Planning
Commission's approval of this application) was held at this time. The
City Clerk reported the Certificate of Publication and Affidavit of
Mailing were on file. Planning Director Gerschler reported the
Planning Commission and staff recommend approval. No one spoke in this
regard. Moved by Waters, seconded by Camacho, the Public Hearing be
closed and the Planned Development Permit be approved. Carried by
unanimous vote. Absent: Van Deventer.
The PUBLIC HEARING on PROPOSED AMENDMENT to the National City LAND USE
CODE to specifically allow the buying of second-hand precious gems or
metals in Use Group 19 of Appendix D of the National City Land Use Code
(This use involves the buying of second-hand precious metals and gems
with no resale involved; the metals and gems are melted down and used
to make new jewelry; businesses of this type are required by State Law
to do the same type of reporting pawn shops and second-hand stores are
required to do; staff recommends approval) was held at this time. The
City Clerk reported the Certificate of Publication was on file.

Planning Director Gerschler reported this change would affect only those
businesses where the principal activity is the buying of second-hand
precious gems or metals; it would not affect those businesses where
that is an accessory activity; the Planning Commission and staff
recommend approval. No one was present in this regard. Moved by
Camacho, seconded by Waters, the Public Hearing be closed and all
stipulations of the Planning Commission be adhered to. Carried by
unanimous vote. Absent: Van Deventer.
ADOPTION OF RESOLUTIONS
Moved by Camacho, seconded by Dalla, the Resolutions be presented by
title only. Carried by unanimous vote. Absent: Van Deventer.
Resolution No. 13,617, "Resolution extending fund limitation on contract
for city inspection on Plaza Bonita public improvement work." Mayor
Morgan said he did not know where we stood on this matter; he has talked
to the Manager from time to time; the Resolution assumes this work
won't be finished until the end of September; the paving will be laid
tomorrow and all the work within National City will be finished; he
believes the inspector has been including the (adjacent) County
property. Moved by Waters, seconded by Camacho, this be laid over for
one week and invite Berryman & Stephenson to come in and explain this
request. Discussion. City Engineer Grahl said there is not very much
work left; in addition to the paving, he is concerned that the
irrigation system for the landscaping go in properly; there is a large
City responsibility that will occur when the contract is turned over for
maintenance of that landscaping and irrigation system; this work will
be completed around mid -September. Further discussion. Carried by
unanimous vote. Absent: Van Deventer.
Resolution No. 13,618, "RESOLUTION ACCEPTING A REQUEST FOR DEFERRAL OF
STREET IMPROVEMENTS AND A COVENANT RUNNING WITH THE LAND (1534 Earl Dr.,
Mr. & Mrs. Kukec)." Moved by Waters, seconded by Dalla, Resolution No.
13,618 be adopted. Carried by unanimous vote. Absent: Van Deventer.
ORDINANCES FOR ADOPTION
Moved by Camacho, seconded by Dalla, the Ordinances be presented by

Ordinance No. 1752 (8/18/81-1), "AN ORDINANCE PURSUANT TO LAND USE CODE
OF THE CITY OF NATIONAL CITY, CALIFORNIA (Proposal to add PUD rPlanned
Unit Development] Zoning to property at the Southwest corner of 24th St.
and Euclid Ave. - Applicant, Pat Hart, Jerry Hart, Ernie Miller, Steve
Siemers, ZC-3-80)." Moved by Dalla, seconded by Camacho, Ordinance No.
1752 (8/1g/81-1) be adopted. Carried by unanimous vote. Absent:
Van Deventer.
Ordinance No. 1753 (8/18/81-2), "AN ORDINANCE PURSUANT TO LAND USE CODE
OF THE CITY OF NATIONAL CITY, CALIFORNIA to rezone from Residential,
Two -Family rRT] to Institutional -Private [IP] the property located
between 2035 and 2119 East 8th St., ZC-8-80)." Moved by Camacho,
seconded by Dalla, Ordinance No. 1753 (8/18/81--2) be adopted. Carried
by unanimous vote. Absent: Van Deventer.
Ordinance No. 8/18/81-3, "An Ordinance pursuant to Land Use Code of the
City of National City, California (rezone those specific properties
located on the South side of 17th St., addressed 1902 through 1938
inclusive, from Residential, Multiple -Family, density 15, to Residential,
Multiple -Family, density 30, ZC-4-80)." Moved by Waters, seconded by
Morgan, this be denied. Carried by unanimous vote. Absent: Van Deventer.
Ordinance No. 1754 (8/18/81-4), "AN ORDINANCE PURSUANT TO LAND USE CODE
OF THE CITY OF NATIONAL CITY, CALIFORNIA (initiated zone change to rezone
from Institutional -Civic, Open Space jIC-OS] to Residential, Multiple -
Family Planned Development [RM-1-PD], the property at 2820 Lincoln
Court, ZC-2-81)." Moved by Waters, seconded by Dalla, Ordinance No.

Ordinance No. 1755 (8/&8/81-4), "AN ORDINANCE PURSUANT TO LAND USE
CODE OF THE CITY OF NATIONAL CITY, CALIFORNIA (proposed zone change to
pre -zone from Limited Control [LC -County] to Commercial Central
Business District Planned Development [CBD-PD] the properties at 1755,
1833, 1835, 1843-45 [inclusive] and 1825-31 [inclusive Sweetwater Road,
subject to annexation to the City of National City, ZC-3-81)." Moved
by Camacho, seconded by Dalla, Ordinance No. 1755 (8/18/81-6) be adopted.

NEW BUSINESS
The City Treasurer/Finance Director's request for RATIFICATION OF
WARRANT REGISTERS NOS. 5, dated August 18, 1981, in the amount of
$49,441.51 (Warrants Nos. 73150 through 73223); 6, dated August 18, 1981,
in the amount of $123,429.67 (Warrants Nos. 73224 through 73284); and
7, dated August 19, 1981, in the amount of $61,217.50 (Warrants Nos.
73285 through 73362) was presented. Moved by Waters, seconded by
Camacho, the bills be paid and warrants drawn. Carried, by the
following vote, to -wit: Ayes: Camacho, Dalla, Waters, Morgan. Nays:
None. Absent: Van Deventer.
The APPLICATION for TRANSFER of ON -SALE BEER AND WINE LICENSE, Type 42,
of Wayne Wakefield, dba Gallopin Inn, 2325-29 Highland Ave. (Police,
Planning and Building Departments state no objections) was presented.
Moved by Waters, seconded by Camacho, this application be approved.
Carried, by the following vote, to -wit: Ayes: Camacho, Dalia, Waters.
Nays: None. Abstaining: Morgan. Absent: Van Deventer.
The APPLICATION for PREMISES TRANSFER of OFF -SALE GENERAL LICENSE for
the sale of beer, wine and distilled spirits of Daniel Kasid, Inc„
2335 Highland Ave. (Police, Planning and Building Departments state no
objections) was presented. Moved by Dalia, seconded by Waters, this
application be protested because of the over -abundance of police
problems in the immediate neighborhood relating to existing liquor
stores. Discussion. Carried, by the following vote, to -wit: Ayes:
Camacho, Dalla, Waters. Nays: None, Abstaining: Morgan. Absent:
Van Deventer.
OTHER BUSINESS
PLANNING
The REQUEST for TIME EXTENSION for filing of FINAL MAP and PLANNED UNIT
DEVELOPMENT PERMIT for Canyon Park Townhomes, Applicant, Pat Hart,
Case File Nos. S-1-79 and PUD-3-79 (on September 11, 1979, City Council
adopted Resolution No. 13,129, approving a tentative map for Canyon
Park Townhomes Subdivision, a one lot condominium subdivision containing
17 units, located within the 2300 block of Euclid Ave.; pursuant to
Government Code Section 66452,6, a map expires one year from the date
of approval by the local legislative body; applicant has secured approval
of a Planned Unit Development Permit [Resolution No. 63-79] granting
deviation from Section 18.102.120 of the Land Use Code requiring a
maximum slope ratio; project slopes were allowed to be 1-1/2:1; on
September 2, 1980, City Council granted a time extension for filing the
Final Map and Planned Unit Development; these permits will expire
September 12, 1981; applicant has requested a six-month extension to
complete processing of the Final Map; pursuant to Government Code
Section 66452.6, a map may be extended for a period not to exceed an
additional 18 months; the PUD permit expires on September 12, 1981 and
will also need to be extended since it cannot be exercised without
approval of the final subdivision map; staff recommends approval of the
extension of time requests for both the subdivision and Planned Unit
Development Permit) was presented. Moved by Waters, seconded by
Camacho, in favor of the six-month extension. Discussion. Carried by
