HomeMy WebLinkAbout1980 10-14 CC MIN1 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA OCTOBER 14, 1980 The regular meeting of the City Council of the City of National City was called to order at 7:30 p,m. by Mayor Morgan. ROLL CALL Council members present: Camacho, Dalla, Van Deventer, Waters, Morgan. Absent: None, Administrative officials present: Ballard, Campbell, McCabe, McLean, Stracker, SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager McCabe followed with invocation by the Rev. Hubert Campbell, APPROVAL OF MINUTES Moved by Van Deventer, seconded by Camacho, the minutes of the regular meeting of October 7. 1980 be approved, Carried by unanimous vote, PUBLIC ORAL COMMUNICATIONS C. L. LIPOVSKY, 435 W, 18th St,.., was present and read his letter requesting the hiring of Pax'<ettes to enforce parking regulations• within the City ("..,Limited parking signs are ignored by the public creating parking problems for businessmen, homeowners and tourists; possible loss of business,..,?'), Mr, Lipovsky filed his letter with the City Clerk, CARLOS GODINEZ GARCIA, 981 Norstad Street, San Diego was present and requested a permit to park his lunch wagon and sell food on public right..of..way (in vicinity of the Swap Meet). Councilman Camacho inter- preted for Mr, Godinez saying he was not asking for a permit to prepare hot food; his food was prepared in a kitchen with a county license; the only preparation on his truck was heating and adding of spices to the food, The City Attorney cited Municipal Code Sec„ 11,32.150, b "No person shall park or stand on any street, any lunch wagon,,,.from which,,,arti.cles of food are sold or offered for sale without first obtaining a written permit to do so from the legislative body which shall designate the specific location in which such cart shall stand," Discussion regarding the City's having done away with all selling of food, etc, on public streets several years ago and the existing 10 minute limit for lunch wagons to park and sell on public right-of-way. Mr, Godinez was asked if he tried to rent one of the stalls in the swap meet, and he replied that he had been denied this by the swap meet owner, Mr, Derr. BARNEY WATSON, Business License Inspector, was present and answered Council's questions, saying Mr, Godinez parks alongside the Harbor Drive -In, which is in Chula Vista; Mr, Godinez has been cited by Chula Vista for parking longer than their ordinance allows; Mr Godinez went to the Chula Vista City Council to request permission to park and sell, and Chula Vista refused to change their limited parking ordinance, Councilman Camacho asked if Council could grant Mr, Godinez permission to park five (5) hours on Saturday and five (5) hours on Sunday, say from 6 .. 12 both days, Discussion. Moved by Van Deventer, seconded by Camacho, The City Manager talk to the swap meet people, Mayor Morgan advised Mr, Godinez to try the Spring Valley swap meet and to try to get Chula Vista to extend the time. Discussion, Motion carried by unanimous vote. ADOPTION OF RESOLUTIONS Moved by Van Deventer, seconded by Dalla, the Resolution be presented by title only, Carried by unanimous vote, RESOLUTION NO. 13,450, "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA AUTHORIZING AND APPROVING AN AGREEMENT OF COOPERATION WITH THE COUNTY OF SAN DIEGO", moved by Van Deventer, 10/14/80 2 seconded by Dallas Resolution No. 13,450 be adopted. Carried by unanimous vote. INTRODUCTION AND ADOPTION OF ORDINANCES Moved by Camachoi seconded by Van Deventer, the ordinances be presented by title only. Carried by unanimous vote. Ordinance No. 1728 41rQ/&4/8A.44, "AN INTERIM ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTED PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65858 AS AN EMERGENCY MEASURE. REQUIRING 'SITE PLAN REVIEW' FOR ALL FACTORY BUILT HOUSING HEREAFTER PLACED WITHIN NATIONAL CITY. Moved by Van Deventer, seconded by Camacho, Ordinance No. 1728 $ 8-44 be adopted. Carried)by the following vote, to -wit: Ayes: Camacho, Dalla, Van Deventer, Morgan, Nays: Waters, Ordinance No. 1729 (10/7/80..1), "AN ORDINANCE PURSUANT TO LAND USE CODE OF THE CITY OF NATIONAL CITY, CALIFORNIA (2..2.80, to rezone from ML-RD [Manufacturing, Light -Redevelopment Area] to CT..RD[C ial, Tourist - Redevelopment Area] the block bounded by 25th Street and Hoover Avenue)." Moved by Waters, seconded by Van Deventer, Ordinance No. 1729 # l 14 be adopted. Carried by unanimous vote. NEW BUSINESS The City Treasurer/Finance Director's request for ratification and confirmation of WARRANT REGISTER and PAYROLL as follows: Warrant Register No. 14, dated October 14, 1980, in the amount of $71,240.46 (Warrants No. 70,027 through 70,097; Payroll for the period ending September 30, 1980, in the amount of $202,128.37, was presented. Moved by Waters, seconded by Dalla, The bills be paid and warrants drawn, Carried, by the following vote, to -.wit: Ayes: Camacho, Dalla, Van Deventer, Waters, Morgan. Nays: None. Moved by Dalla, seconded by Van Deventer, it be denied and referred to the City Attorney. Carried by unanimous vote. THE CLAIM FOR DAMAGES OF MARK ANTHONY TREVINO, 829 Jefferson Avenue, filed with the City Clerk on October 8, 1980 was presented, Moved by Dalla, seconded by Van Deventer, it be denied and referred to the City Attorney. Carried by unanimous vote. CITY MANAGER - No Report. CITY ATTORNEY - No Report. OTHER STAFF - No Report. MAYOR - No Report. CITY COUNCIL Councilman Camacho reported Mr. Reynolds, Civil Service Commission, is sending his resignation. Councilman Dalla said he wanted to deal in a general way with what Mr. Camacho said; he was not speaking of this particular happening with Mr. Reynolds, but he hoped that if we have anything like this again, it can be handled in a more professional and humane way; a number of people serve on boards and commissions and except for the planning commission, they don't get paid; they donate their time and energy and effort; those people are entitled to know that if they make a mistake, whether it's an act of omission, even if intentional or an 10/14/80 3 ignorant mistake, they will not be "hung out to cry". Councilman Dalla continued, we talk about image and are concerned about the image of this City, and we have been cautioned about the kinds of things that we discuss at Council Meetings that get into the newspaper and reflect on the image of the City; there is a part of the image that we contribute as elected officials: the way we conduct our business and the way we deal with personnel; there are more appropriate ways to deal with such things than to go to the news media. and hash it out in public; the people who serve are adults and are responsible; we are adults and responsible and it can be handled in a more dignified manner; we do an untold amount of harm to people who are otherwise of giving of their time and efforts to the City and they are more deserving of consideration and being treated better than they were in this particular instance. City Clerk read Councilman Van Devent•er's letter requesting additional police: ("Several weeks ago a proposal was made to tax residents of National City in order to provide needed police protection. The council declined to pursue new taxes as a means of providing police protection but instructed the City Manager and Police Chief to review the matter, determine the needs of the Department and report back to City Council. The source of any funding was to be general fund money from the existing budget. I feel as everyone on the Council that adequate police protection for our citizens is of the highest priority. In the absence of any report or recommendation from the City Manager or Police Chief, I think it is time for the Council to act. To that end, I make the following recommendations: a) The City Council authorize the hiring of three additional police officers for night time duty in patrolling our neighborhoods and businesses at an estimated cost of: Cost Factor for First 6 months left in Fiscal Year 80-81: Police Officer Salaries and benefits (3) @ $29,609.00 annually: $44,413.50; Vehicles (2) @ $6600.00 each: $13,2n0.00; Vehicle Equipment (2) @ $3500.00 each: $7000.00; Radio Equipment (2) @ $1200.00 each: $2400.00; Basic Police Academy (3) @ $300.00 each: $900.00; TOTAL: $67,913.50; b) The new officers to be hired or on board no later than January; c) The City Manager and Police Chief are to report back to the Council within two weeks if they consider the additional manpower unnecessary, or have any other problems with this Council action. I ask the Council to give favorable consideration to these recommendations at this time and let the Manager come back if he has any problems." Dis- cussion re the existing budget and the added $67,913.50; three men will cost at least $110 - $115 thousand dollars per year; all of the cities in the State of California are having financial trouble, National City is in a different situation and should try to stay that way; and the motion that passed 3 - 2 on August 19, 1980, directing the City Manager and Chief of Police to prepare a report on the needs of the Police Department. Moved by Van Deventer, seconded by Dalla, we move forward (on the recommendations in the letter). Discussion regarding the previous proposal to add six policemen and have a tax to do that; the need for six additional policemen; if Council looked real hard we could come up with the money for the last six months of the year; if money is needed, it's there in the budget; the recommendation is that if there is a problem (and the Manager hasn't come back and the Police Chief hasn't come back and with any kind of recommendation); a lot of people have communicated that they are in favor of hiring those additional policemen, and if we need them in the budget we are going to be able to find the money; the first priority is (if we provide nothing else to our citizens) to provide them with adequate police protection, adequate fire protection, and have the streets paved. Moved by Dalla, seconded by Van Deventer, the motion be amendedto include that since we originally proposed that we add a tax for six additional police officers, the City Manager and the Police Chief get together before the next budget session and determine if we need the additional three, assuming that we approve the first three and if we do, then they can come back at budget time 10/14/80 4 and let us know. Further discussion. City Manager McCabe said the report referred to is in preparation; he met with the Police Chief immediately after he was directed to; he advised the Police Chief that instead of looking at the Department on a piece -meal basis, to prepare a report that would deal with each and every division of the Police Department with comparisons to the other agencies, based not only on population, geographic size, special problems, crime rates, etc. but to be specific as to the various divisions needed and the number of people in each and what any increase would mean to the City in dollar cost; that report will be brought back with some kind of projected plan for more than one year on how to reach that goal. It was suggested that the City Manager be given two weeks to come back with that recommendation with no influence from anybody. City Attorney ?Lean said the motion he just heard was to table the motions, Moved by Van Deventer, seconded by Dalia, the motion be amended to table for two weeks. Amendment carried,by the following vote, to -wit: Ayes: Camacho, Dalla, Van Deventer, Waters. Nays: Morgan. Motion to table carried by unanimous vote. Vice Mayor Waters reported the California Legislature passed a law which became effective January 1, 1980; it is not practical, it maybe unconstitutional or it is not right in many ways; if a retired person is laid off, he can not draw unemployment insurance if his retirement pay exceeds the unemployment benefits; he was going to do more research on it, but he wanted the Council to think about it; if a retiree haa. to pay into anything (unemployment or whatever), then he should reap the benefits or that. Discussion. Moved by Morgan, seconded by Camacho, we authorize George to look into this and make a report to the Council. Carried by unanimous vote. Councilman Dalia discussed "A" Avenue now one-way and whether it should be two. -way, saying Council held that over until the road is finished; as soon as they take that barricade down, that area is finished over there, Moved by Dalia, seconded by Camacho, it be referred to the Traffic Safety Committee and they should contact the bank and grocery store and the people who are involved with the old MAAC building Carried by unanimous vote* Councilman Dalia said there have been reports back from Cal -Trans about landscaping I.■8O5 and I-5, and there are portions of I-5 that they can't landscape because of 54; on I-5 an area near the 24th street interchange, has brown weeds, and it is pretty ugly. Councilman Dalia requested the City Manager call Ca1..Trans. ADJOURNMENT Moved by Waters, seconded by Camacho, the meeting be closed. Carried by unanimous vote.
