HomeMy WebLinkAbout1989 03-14 CC MINBook 71/Page 66 3/14/89 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA MARCH 1.4, 1989 The regular meeting of the City Council of the City of National City was called to order at 7:00 p.m. by Mayor Waters. ROLL CALL Council members present: Della, Inzunza, Pruitt, Van Deventer, Waters. Absent: None. Administrative officials present Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager McCabe, followed with invocation by Councilman Della. APPROVAL OF MINUTES Moved by Van Deventer, seconded by Inzunza, the minutes of the regular meeting of March 7, 1989 be approved. Carried by unanimous vote. PUBLIC HEARINGS WEED ABATEMENT 1. SUBJECT: Public Hearing - Weed Abatement. The City Clerk reported that an Affidavit of Mailing was on file in the Office of the City Clerk All property owners were sent Certified Mail notices. Two were returned unclaimed and were remailed lst Class. Two letters of protest have been received and are on file in the Office of the City Clerk RECOMMENDATION: Staff recommends the consideration of any written or oral protests or objections to the Report and Account. TESTIMONY: John Winters and Mike Michaels, 417 E. Grand, Escondido (attorney representing Golden Eagle Property investments) spoke in opposition on Parcel #551-490-19, 1205 Fig Court. Patti Schiff, National City Fire Marshall, read into the record a written protest reeved from Kent E. Prokop, Branch Manager for ABF who leases property from Herbert & David Williams. The property is parcel #559-200-38, West end of 30th Street. ACTION: Motion by Van Deventer, seconded by Pruitt, to confirm the weed abatement hearing and that all properties attached on the list be billed against the property owner and to close the Public Hearing. Carried by unanimous vote. MUNICIPAL CODE/N.C. ELECTRICAL CODE UPDATE/2ND READING 2. SUBJECT: Public Hearing - Adoption of the 1987 Edition of the National Electrical Code. The City Clerk stated that the Certification of Publication was on file in the Office of the City Clerk as was the Ordinance Summary. RECOMMENDATION: Staff recommends the Public Hearing be opened then closed and the 1987 Edition of the National Electric Code be adopted by reference. The Advisory and Appeals Board recommends approval. TESTIMONY: None. ACTION: Mayor Waters declared the Public Hearing closed. Moved by Van Deventer, seconded by Pruitt, in favor of this adoption. Carried by unanimous vote. ADOPTION OF RESOLUTIONS CONSENT RESOLUTIONS (Resolutions Nos. 15,902 through 15,905). Vice -Mayor Pruitt said he would be abstaining on Item 4 (Resolution No. 15,904) as his home abuts Euclid Avenue. Moved by Van Deventer, seconded by Della, the Consent Resolutions be adopted. Carried by unanimous vote. GRANTS 3. Resolution No. 15,903, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE APPLICATION FOR GRANT FUNDS UNDER THE ROBERTI-A'BERG-HARRIS URBAN OPEN SPACE AND RECREATION PROGRAM FOR PARK PLAYGROUND EQUIPMENT." Adopted. See above. ENCROACHMENT REMOVAL AGREEMENT 4. Resolution No. 15,904, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AND AUTHORIZING THE RECORDATION OF AN ENCROACHMENT REMOVAL AGREEMENT FOR 2207-22'12 EUCLID AVENUE (Gretler)." Adopted. Abstaining: Pruitt See above. Book 71/Page 87 3/14/89 POLITICAL SUPPORT 5. Resolution No. 15,905, "'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING THE CAUFORNIA WATER COMMISSION'S RECOMMENDATION TO SUPPORT THE ALLOCATION OF $5.3 MILLION TO THE FEDERAL F.Y. 1990 BUDGET FOR THE SWEETWATER FLOOD CONTROL PROJECT, AND RESCINDING RESOLUTION NO. 15,895." Adopted. See above. NON -CONSENT RESOLUTIONS Motion by Van Deventer, seconded by Della, the Resolution be accepted by title only. Carried by unanimous vote. CONTRACT/PERSONNEL SERVICES 6. Resolution No. 15,906,"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE LAW FIRM OF LIEBERT, CASSIDYAND FRIERSON TO PROVIDE CONSULTING, REPRESENTATIONAL AND LEGAL SERVICES PERTAINING TO EMPLOYEE RELATIONS MATTERS, AND AUTHORIZING THE ALLOCATION OF FUNDS TO MEET THE COSTS OF SAID SERVICES." Moved by Van Deventer, seconded by Waters, in favor of Resolution No. 15,906. Carried by unanimous vote. ORDINANCES FOR ADOPTION Moved by Van Deventer, seconded by Pruitt, the Ordinances be accepted by title only. Carried by unanimous vote. MUNICIPAL CODE/N.C. ELECTRICAL CODE UPDATE/2ND READING 7. "An Ordinance of the City of National City adopting the National City Electrical Code, 1987 Edition, as amended, establishing requirements, rules and standards for electrical installations and materials, within the City and amending Ordinance No. 1914 and Chapter 15.24 of the Municipal Code of the City of National City." Motion by Van Deventer, seconded by Pruitt, in favor of adoption of Ordinance No. 1972. Carried by unanimous vote. NEW BUSINESS FINANCIAL MANAGEMENT 8. SUBJECT: Warrant Register No. 36. Ratification of Demands in the amount of $222,073.66 and Certification of Payroll in the amount of $375,062.24 (Warrants Nos. 104668 through 104758 inclusive, excepting 104718 and 104744). RECOMMENDATION: Staff recommends the warrants be ratified. ACTION: Moved by Van Deventer, seconded by Pruitt, the bills be ratified and the payroll certified. Warrants ratified by the following vote, to -wit Ayes: Della, Inzunza, Pruitt, Van Deventer, Waters. Nays: None. LIQUOR LICENSE APPLICATIONS ALCOHOLIC BEVERAGE LICENSE 9. SUBJECT: Type 41 - Original License (non -intensification of use, just adding wine), 831 East Eighth Street. Type 41 Liquor License is an on -sale beer and wine type license which authorizes the sale of beer and wine for consumption on a bona fide public eating place type premises plus the sale of beer and wine for consumption off premises where sold. RECOMMENDATION: Planning, Police and Building Departments state no grounds for objection. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor. Carried by unanimous vote. WRITTEN COMMUNICATIONS 10. SUBJECT: information from Mr. W. Nielsen regarding the Martin Luther King Freeway Connector. TESTIMONY: None. ACTION: Motion by Van Deventer, the item be filed. No objection as filed. OTHER BUSINESS - None. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report MAYOR TECATE/SISTER CITY/EASTER Mayor Waters said that on March 25th, Council was to meet at 10:00 a.m. in the parking lot of Jimmy's to leave on the trip to deliver Easter baskets to the Tecate orphans. Book 71/Page 68 3/14/89 CITY COUNCIL FENCE Vice Mayor Pruitt requested Staff look at the 12th & Highland Avenue on the south side of the shopping center where the bushes have been removed and a very bad looking fence installed. EQUIPMENT STORAGE Councilman Van Deventer requested Staff look at 12th & 13th on McKinley , someone is storing equipment on the street and sidewalk. PUBLIC ORAL COMMUNICATIONS Everett Dickson, 2745 E. 14th Street inquired as to whether Agenda item #7, Ordinance for Adoption, was available for public review in the Library. Building & Safety Director, Ernie Reid answered that a copy will be available in the National City Public Library as well as his office and the Office of the City Clerk. Warren Nielsen, 831 Port Dunbar, Chula Vista, spoke regarding the Martin Luther King issue. He then presented the Mayor with a newspaper article for review by the Council. ADJOURNMENT Moved by Van Deventer, seconded by Dalia, the meeting be adjourned to the next regular council meeting, March 21. 1989, 4:00 p.m. Council Chambers - Civic Center. Carried by unanimous vote.
