ROLL CALL Council members present: Dalla, Inzunza, Waters. Absent: Pruitt, Van Deventer. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager McCabe, followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Moved by Dalla, seconded by Inzunza, the minutes of the regular meeting of June 13. 1989 be approved. Carried by unanimous vote. Absent: Pruitt, Van Deventer. BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS LIBRARY BOARD RECOMMENDATION: Mayor Waters recommended that Zelva Moeser be reappointed to the Library Board of Trustees. ACTION: Moved by Inzunza, seconded by Dalla, Zelva Moeser be reappointed to the Library Board of Trustees. Carried by unanimous vote. Absent: Pruitt, Van Deventer. ADOPTION OF RESOLUTIONS CONSENT RESOLUTIONS (Resolutions 15,994 through 16,003). Mayor Waters requested that Items 3, 5, 6 and 10 (Resolution Nos. 15,996, 15,998, 15,999 and 16,003) be pulled . Moved by Dalla, seconded by Inzunza the Consent Resolutions (Items 1.2.4. 7 through 9 Resolution Nos. 15.994. 15.995. 15.997 and 16.000 through 16.002 be adopted. Carried by unanimous vote. Absent: Pruitt, Van Deventer. CONDITIONAL USE PERMIT 1. Resolution No. 15,994, " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING A CONDITIONAL USE PERMIT APPLICATION FOR RECONSTRUCTION OF A FAST-FOOD RESTAURANT WITH ADDITION OF A DRIVE-THRU AREA AT 840 HIGHLAND AVENUE. Resolution No. 15,997, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING EXTENSION OF CONTRACT WITH AMERICAN RED CROSS FOR OPERATION OF NATIONAL CITY WHEELS, AND AUTHORIZING THE CITY MANAGER TO EXTEND AN AMENDMENT TO SAID AGREEMENT." Resolution No. 16,002, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER AGREEMENT WITH ROBERT B. Resolution No. 15,998, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE TRANSFER OF FUNDS FOR THE WESTSIDE PARKING STUDY." Moved by Waters, seconded by Inzunza, in favor of Resolution 15.998. Carried by unanimous vote. Absent: Pruitt, Van Deventer. PARKING/TRAFFIC 6. Resolution No. 15,999, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE INSTALLATION OF 2-HOUR PARKING ON THE 00 BLOCK OF 17TH STREET." Moved by Waters, seconded by Inzunza, in favor of Resolution 15.999. Carried by unanimous vote. Absent: Pruitt, Van Deventer. PERSONNEL/TRAFFIC ENGINEER/SALARY 10. Resolution No. 16,003, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ESTABLISHING MID -MANAGEMENT SALARY BAND FOR NEW CLASSIFICATION OF TRAFFIC ENGINEER." Moved by Waters, seconded by Inzunza, in favor of Resolution 16.003. Carried by unanimous vote. Absent: Pruitt, Van Deventer. NON -CONSENT RESOLUTIONS Motion made by Dalla, seconded by Inzunza the Resolutions be introduced by title only. Carried by unanimous vote. Absent: Pruitt, Van Deventer. BUDGET TRANSFER 89/WORKERS COMPENSATION 11. Resolution No. 16,004, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE TRANSFER OF FUNDS FOR WORKERS' COMPENSATION ESTIMATED CASE LIABILITIES." Moved by Dalla, seconded by Inzunza, for the adoption of Resolution No. 16.004. Carried by unanimous vote. Absent: Pruitt, Van Deventer. GOVERNMENT CODE/VECTOR CONTROL 12. Resolution No. 16,005, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY CONSENTING TO INCLUSION IN THE SAN DIEGO COUNTY VECTOR CONTROL SERVICES ESTABLISHED PURSUANT TO GOVERNMENT CODE SECTION 25842.5." TESTIMONY: Gary Stephany, Director of Environmental Health Services, San Diego County, spoke in favor. ACTION: Moved by Dalla, in favor of Resolution 16.005, died for lack of second. Motion by Inzunza, seconded by Waters to hold Item 12 over until July 11. 1989. Carried by unanimous vote. Absent: Pruitt, Van Deventer. SUBJECT: Warrant Register No. 50. Ratification of Demands in the amount of $268,357.30. (Warrant Nos. 105921 through 106043 inclusive, excepting none). and Certification of Payroll for the period ending May 29, 1989, in the amount of $354,016.27. RECOMMENDATION: Staff recommends the warrants be ratified. ACTION: Motion by Dalla, seconded by Inzunza the demands be ratified and the payroll certified. Carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Waters. Nays: None. Absent: Pruitt, Van Deventer. CLAIM(S) FOR DAMAGES 16. SUBJECT: Claim for Damages of Carl F. Stroud. RECOMMENDATION: Staff recommended that the claim be denied and referred to the City Attorney. 17. SUBJECT: Claim for Damages of Leland Fred Hero. RECOMMENDATION: Staff recommended that the claim be denied and referred to the City Attorney. ACTION: Moved by Inzunza, seconded by Dalla, these claims (Agenda Items 16 and 17) be denied and referred to the City Attorney. Carried by unanimous vote. Absent: Pruitt, Van Deventer. LIQUOR LICENSE APPLICATIONS ALCOHOLIC BEVERAGE LICENSE 18. SUBJECT: Type 41 - Original License - 3007 Highland Avenue, Suite 13. Type 41 Liquor License is an on -sale beer and wine type license which authorizes the sale of beer and wine for consumption on a bona fide public eating place type premises plus the sale of beer and wine for consumption off premises where sold. RECOMMENDATION: Police and Building Department state no objections, the Planning Department indicated that this application should be denied until the conditional use permit application has received final approval. ACTION: Motion by Dalla, seconded by Waters this item be protested pending the reauired conditional use permit. Carried by unanimous vote. Absent: Pruitt, Van Deventer. SUBJECT: Temporary Use Permit - Bill's Quality Cars request a TUP for the use of a trailer as a temporary office while new building is under construction. Site address is 1040 National City Blvd., from June 1, 1989 to April 28, 1990. RECOMMENDATION: Staff recommends approval subject to the conditions of the Fire Department to -wit: Provide one 2A:10BC fire extinguisher. Trailer not to obstruct Fire Department access. ACTION: Moved by Dalla, seconded by Water, in favor of the permit Carried by unanimous vote. Absent: Pruitt, Van Deventer. TEMPORARY USE PERMIT 20. SUBJECT: Temporary Use Permit - Sweetwater Town & Country Merchants Association request a TUP to celebrate "Western Days," an annual summer promotion at the parking lot of 1700-1900 Sweetwater Road on August 5-6, 1989 from 4:00 p.m. to 9:00 p.m. RECOMMENDATION: Staff recommends approval subject to the conditions of the Fire, Police, and Finance Departments to -wit: Obtain separate Fire Safety Permit from Fire Department prior to event opening. Submit Plan. A Business License is required of all vendors and businesses participating. Regular Center merchants can operate on their current 1989 license. Will not have nationally known recording group - request for security has been downgraded. Applicant will submit in writing a request for reserve officers. ACTION: Moved by Inzunza, seconded by Waters in favor, with all stipulated conditions. Carried by unanimous vote. Absent: Pruitt, Van Deventer. GRANT/POLICE 21. SUBJECT: Request to pursue an Office of Traffic Safety Grant for drunk driving enforcement and traffic education. RECOMMENDATION: Staff recommends approval to pursue grant funding. ACTION: Moved by Waters, seconded by Dalla, in favor. Carried by unanimous vote. Absent: Pruitt, Van Deventer. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR - No report CITY COUNCIL - No report. PUBLIC ORAL COMMUNICATIONS Mr. Allen Olson, 970 E "J" Street, Chula Vista, CA spoke against property condemnation initiated by CDC Director. CLOSED SESSION FOR PENDING LITIGATION UNDER GOVERNMENT CODE SECTION 54956.9(A) (GARCIA V. CITY OF NATIONAL CITY). Moved by Inzunza, seconded by Dalla, in favor of closed session. Carried by unanimous vote. Absent: Pruitt, Van Deventer. Council left the Council Chambers and went into closed session at 5:23 p.m. Council returned to the Council Chambers at 5:50 p.m. ROLL CALL Council members present: Dalla, Inzunza, Waters.
