ROLL CALL Council members present: Daila, Inzunza, Pruitt, Van Deventer, Waters. Administrative officials present: Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager McCabe, followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Moved by Van Deventer, seconded by Inzunza, the minutes of the regular meeting of July 18 1989. and the minutes of the adjourned meeting of July 19. 1989 be approved. Carried by unanimous vote. PUBLIC HEARINGS PLANNED DEVELOPMENT PERMIT 1. SUBJECT: Continued Public Hearing - Appeal of Planning Commission approval of Planned Development Permit Application for a 2-story, 3000 sq. ft. office building at the northeast corner of Euclid Avenue and Sweetwater Road. (Applicant: Witkin Design, for David and Annie Malcolm and Wilma Southworth) (Case File No. PD-3-89) ** Continued from Council Meeting of 6/13/89 ** RECOMMENDATION: Staff recommends approval of the application based on findings and conditions required by the Planning Commission with the added condition to restrict left -turns to or from the site. TESTIMONY: David Malcolm, 625 Third Avenue, Chula Vista spoke in favor of the project but against the restricted left turn. Alfonso Hernandez, 2132 Euclid Avenue, National City spoke in favor of right turn. ACTION: The Mayor declared the Public Hearing closed. Moved by Van Deventer, seconded by Inzunza to continue Public Hearing for 60 days with Staff to meet with property owner or his representative to a) consider if a land swap (eaual exchange) would be possible. b) Staff to give the projected increase in traffic that Euclid Avenue will generate when open. c) Staff to look into the provision by the applicant of a bond with a review of the proiect in 6 months for traffic movement problems and d) a final decision to be made by the Council at the end of the 60 day period. Carried by unanimous vote. GENERAL PLAN/ZONING MAP 2. SUBJECT: Continued Public Hearing - Specific Plan for residential development in the canyon area northwest of "D" Avenue and 30th Street and amendment to the Combined General Plan/Zoning Map from CH (Heavy Commercial) to RS-3-PD (Single -Family Residential Planned Development) for property in the southwestern portion of the specific plan area. (Case File Nos. SP-2-89/GP-2-89/ZC-2-89). ** Continued from Council Meeting of 7/11/89 ** RECOMMENDATION: Staff concurs with the recommendation of the Planning Commission which was to approve with recommended conditions. TESTIMONY: Kevin Mineo, attorney representing Mr. & Mrs. Paul Howell, owners of 101 E. 30th, spoke in opposition. Ralph King 2820 "D" Avenue, National City, spoke in opposition. Alfonso Hernandez, 2132 Euclid Avenue, National City spoke in opposition. Councilman Van Deventer said he would be abstaining as he has done work for Mr. Howell in the past. ACTION: Moved by Pruitt, seconded by Waters to close the Public Hearing. leave the zoning as is. residential . with the exception of the one parcel on the southwest corner and not entertain a proposal for the soils test from either of the three firms that have applied. Carried by the following vote: Ayes: Dalla, Inzunza, Pruitt, Waters, Nays: None. Abstaining: Van Deventer. Book 71/Page 150 7/25/89 UBC, UPC, UMC, UHC and UNIFORM CODE FOR ABATEMENT OF DANGEROUS BUILDINGS 3. SUBJECT: Public Hearing and adoption of the Uniform Building Code, Uniform Plumbing Code, Uniform Mechanical Code, Uniform Housing Code, and Uniform Code for Abatement of Dangerous Buildings, 1988 Editions. RECOMMENDATIONS: Staff recommends approval of the amendments and adoption of the ordinances. TESTIMONY: None. ACTION: Moved by Dalia, seconded by Van Deventer the Public Hearing be closed. recommend approval of the amendments and adoption of the Ordinances. Carried by unanimous vote. UNIFORM FIRE CODE 4. SUBJECT: Public Hearing for the adoption of the 1988 Edition of the Uniform Fire Code and Amendments. RECOMMENDATIONS: Staff recommends adoption of the 1988 Uniform Fire Code and it's amendments. TESTIMONY: None. ACTION: Moved by Van Deventer, seconded by Pruitt, in favor of adoption and closing the Public Hearing. Carried by unanimous vote. MUNICIPAL CODE/MEDICAL WASTE 5. SUBJECT: Public Hearing for the adoption of an Ordinance of the City of National City adding Chapter 9.48 to Title 9 of the National City Municipal Code, relating to the regulation of the storage and disposal of medical waste. RECOMMENDATION: Staff recommends approving the Ordinance. TESTIMONY: None ACTION: Moved by Van Deventer, seconded by Inzunza the Public Hearing be closed and move for approval. Carried by unanimous vote. ADOPTION OF RESOLUTIONS CONSENT RESOLUTIONS (Resolutions 16,032 through 16,040). Moved by Dalla, seconded by Inzunza for adoption of the Consent Resolutions. Carried by unanimous vote. CONTRACT/SIDEWALKS, CURB & GUTTER 6. Resolution No. 16,032, " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF NOTICE OF COMPLETION FOR THE REMOVAL AND REPLACEMENT OF SIDEWALKS, CURB AND GUTTERS AT VARIOUS LOCATIONS IN NATIONAL CITY. Resolution No. 16,033, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROPRIATING $16,306.52 OF FORFEITED FUNDS SEIZED PURSUANT TO TITLE 21, U.S. CODE, SECTION 881, TO THE CITY OF NATIONAL CITY POLICE DEPARTMENT F.Y. 1989-90 BUDGET." Resolution No. 16,034, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO APPROVE THE PERIODIC USE OF VEHICLES SEIZED FROM DRUG DEALERS FOR USE IN PRO -ACTIVE LAW ENFORCEMENT ACTIVITIES." Resolution No. 16,035, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE TRANSFER OF FUNDS FOR THE UNAPPROPRIATED RESERVES OF THE GAS TAX AND CDBG FUNDS TO "UPGRADE 3 TRAFFIC SIGNALS." (Warrant Nos. 106409 through 106538 inclusive, excepting 106495, 196493 and 106426). RECOMMENDATION: Staff recommends the warrants be ratified. Councilman Van Deventer stated that he would be abstaining from Warrant No. 106473 as he owns and leases the building and Warrant No. 106505 because it was his prior business. ACTION: Motion by Van Deventer, seconded by Pruitt the demands be ratified. Warrants (except 106473 and106505) ratified by the following vote, to -wit: Ayes: Della, Inzunza, Pruitt, Van Deventer, Waters. Nays: None. Abstaining: None. SUBJECT: Temporary Use Permit - National Multiple Sclerosis Society, San Diego request a TUP for bike riders to ride through designated streets of National City as part of the MS Society's Bike Tour on September 10, 1989 from 9 a.m. to 6 p.m. Waiver of fees is also requested. RECOMMENDATION: Staff recommends approval subject to the conditions of the Risk Manager, to -wit: Request a hold harmless be signed, and the City named as additional insured on a one million dollar general liability policy. ACTION: Moved by Della, seconded by Van Deventer jn favor including Staffs recommendation. Carried by unanimous vote. Book 71/Page 153 7/25/89 TEMPORARY USE PERMIT/NEIGHBORHOOD WATCH BLOCK PARTY 24. SUBJECT: Temporary Use Permit - Neighborhood Watch Block Party request a TUP to barricade streets (East 7th Street and Tolas Court) to hold an "Annual Neighborhood Watch Block Party" on August 12, 1989 from 5:00 p.m. to 11:00 p.m. Wavier of fees is also requested. RECOMMENDATION: Staff recommends approval subject to the conditions of the City Attorney, Public Works, and Fire Departments, to -wit: Fire - Fire Dept. shall have access for any emergencies. No bonfires allowed. Approved bar-b-ques only. City Attorney - requires hold harmless, public liability insurance with City, its officers and employees as additional insureds. Public Works - Barricades will be delivered to site on Friday and retrieved on Monday. ACTION: Moved by Van Deventer, seconded by Inzunza jn favor of Staffs recommendation subject to the condition of the City Attorney, Public Works and Fire Department. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR 25. SUBJECT: Proclamation presentation to Sister City. ACTION: Moved by Van Deventer, seconded by Inzunza to approve the Proclamation. Carried by unanimous vote. CITY COUNCIL Councilman Van Deventer stated that there are residents on the Westside that have reported some streets deteriorating on the numbered streets (16th, 12th and 9th) and requested Public Works Director Williams look into it. Councilman Pruitt spoke about a Regional swim meet at the municipal pool and requested the City Manager to draft a letter to Mr. Paradowski advising him that whenever he has a special event like that he needs to coordinate with the Police Department for assistance so to eliminate potential parking problems. PUBLIC ORAL COMMUNICATIONS Mr. Warren Nielsen, 631 Port Dunbar, Chula Vista spoke regarding the San Diego Convention Center naming and development of the 252 connector. Alfonso Hernandez, 2132 Euclid Avenue, National City spoke regarding Vice -Mayor Pruitts' comments on the pool facility and park services.
