HomeMy WebLinkAbout1989 08-15 CC MINBook 71/Page 164 8/15/89 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA AUGUST 15, 1989 The regular meeting of the City Council of the City of National City was called to order at 4:01 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Pruitt, Van Deventer, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager McCabe, followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Moved by Van Deventer, seconded by Inzunza, the minutes of the regular meeting of August 8. 1989 be approved. Carried by unanimous vote. PROCLAMATIONS Moved by Van Deventer, seconded by Pruitt, the Proclamations be accepted by title only. Carried by unanimous vote. The Proclamation proclaiming August 15, 1989 to be: "DRUG AWARENESS DAY" was read aloud in full by Mayor Waters. The Mayor then gave the Proclamation to the City Manager to present to the County. The Proclamation proclaiming August 16, 1989 as "MEALS ON WHEELS DAY" was read aloud in full by Mayor Waters. The Mayor then presented the Proclamation to Marian Rutsch, a representative of Meals on Wheels. CONSENT RESOLUTIONS (Resolutions 16,049 through 16,052). Moved by Van Deventer, seconded by Pruitt, for adoption of the Consent Resolutions. Vice Mayor Pruitt stated he would be abstaining on Resolution No. 16,051 as his home is in that area. Carried by unanimous vote. PARKING/TRAFFIC SIGNS 1. Resolution No. 16,049," A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE REMOVAL OF STOP SIGNS ON RACHAEL AVENUE AT 6TH STREET." Adopted. See above. PARKING/TRAFFIC SIGNS 2. Resolution No. 16,050, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE REMOVAL OF STOP SIGNS ON HOOVER AVENUE AT 30TH STREET." Adopted. See above. PARKING/TRAFFIC 3. Resolution No. 16,051, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY PROHIBITING PARKING ON BOTH SIDES OF THE ALLEY, AND ESTABLISHING TWO-WAY TRAFFIC ON THE ALLEY WEST OF ORANGE STREET BETWEEN 18TH STREET AND 20TH STREET." Carried by the following vote, to - wit: Ayes: Dalla, Inzunza, Van Deventer, Waters. Nays: None. Abstaining: Pruitt. TRAFFIC/TAXI STAND 4 Resolution No. 16,052, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE ESTABLISHMENT OF A TAXI STAND ON THE NORTH SIDE OF 8TH STREET, EAST OF HARBOR DRIVE." Adopted. See above. NON -CONSENT RESOLUTIONS HAZARDOUS WASTE MANAGEMENT PLAN 5. Resolution No. 16,053, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE SAN DIEGO COUNTY HAZARDOUS WASTE MANAGEMENT PLAN" ACTION: Moved by Van Deventer, seconded by Pruitt in favor of Resolution 16.053. Carried by unanimous vote. Book 71/Page 165 8/15/89 NEW BUSINESS FINANCIAL MANAGEMENT 6 SUBJECT: Warrant Register No. 06. Ratification of Demands in the amount of $218,221.55 (Warrant Nos. 106722 through 106831 inclusive, excepting 106824) and Certification of Payroll in the amount of $445,008.82. RECOMMENDATION: Staff recommends the warrants be ratified. ACTION: Motion by Pruitt, seconded by Van Deventer, that the bills be ratified and the payroll certified. Carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Pruitt, Van Deventer, Waters. Nays: None. Abstaining: None. OTHER BUSINESS PLANNED DEVELOPMENT PERMIT 7. SUBJECT: Notice of Decision - Planning Commission Resolution No. 28-89 approving a Planned Development Permit for a four-story, 140-suite hotel and zone variance to provide 140 parking spaces in lieu of the 150 required at the northwest corner of 24th Street and Wilson Avenue. (Applicants: Ken Winslow & Harki Parekh) (Case File Nos. PD-6-892-7-89). RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. ACTION: Moved by Van Deventer, seconded by Pruitt, that the item be filed. Carried by unanimous vote. TEMPORARY USE PERMIT 8. SUBJECT: Temporary Use Permit - Bonita Optimist Club request a TUP to go thru the City (Plaza Bonita Road and Sweetwater Road) for their 9th Annual Bonita Fest Bonita Optimist Foundation Half Marathon and 5K Family & Youth Fun Run/Walk" on September 24, 1989 from 7 a.m. to 9:30 a.m. Waiver of fees is also requested.. RECOMMENDATION: That the City Council approve the request subject to the conditions of the City Attorney and Risk Manager, to -wit: 1) Requires public liability insurance, with amount of coverage determined by Risk Manager, and with City and Parking Authority as additional insureds. Also requires hold harmless in favor of City and Parking Authority. Application should be reviewed by CDC Director. 2) Recommend one million dollars general liability insurance. ACTION: Moved by Van Deventer, seconded by Pruitt, for approval subject to conditions of the City Attorney and the Risk Manager. Carried by unanimous vote. TEMPORARY USE PERMIT 9. SUBJECT: Temporary Use Permit - Saint Mary's Parish request a TUP to hold their "Annual Fall Festival Fund Raising" from September 30 to October 1, 1989 from 10 a.m. to 7 p.m. Request to serve/sell alcoholic beverages and waiver of fees is also requested. RECOMMENDATION: Staff recommends approval subject to the conditions of the Fire, Police and Finance Departments, to -wit: 1) Fire - separate Fire Department permit shall be obtained prior to opening. All booth canopies shall be fire retardant, fire extinguishers (type 2A:10BC) shall be provided. Inspection required. 2) Finance - A business license is required if monies are solicited, admittance charged or food, beverages or merchandise is sold. If any of the vendors or organizations are registered not -for -profit there will not be a charge for the business license. 3) Police - If alcoholic beverages are served, must be in an enclosed area with security at entrance to maintain legal avenues of consumers. Consumers must stay in the closed area. ACTION: Moved by Van Deventer, seconded by Pruitt, for approval subiect to conditions of the Fire. Police and Finance Department. The City Attorney noted that our practice in the past has been not to waive fees for Churches on the basis that it would be prohibited by the Establishment Clause of the First Amendment. Maker and 2nd agreed to an amendment to also include conditions of the City Attorney. Carried by the following vote, to -wit: Ayes, Pruitt, Inzunza, Van Deventer, Waters. Nays: None. Abstaining: Dalla because he is involved in the project. CITY MANAGER The City Manager noted that the Council Workshop scheduled for Thursday August 17 at 2:00 p.m. has been requested to be cancelled by the architect, Mr. Richard Blackman. Council had no objections. CITY ATTORNEY - No report. OTHER STAFF - No report. Book 71/Page 166 8/15/89 MAYOR Mayor Waters complemented Jim Ruiz Director of Parks and Recreation and his Staff for getting the Marine Band to play in the Kimball Bowl today. The community turn out was good and the people really enjoyed themselves. Mayor Waters also read a letter from SANDAG (copy on file in the Office of the City Clerk), requesting an elected official from the City to be on the recently approved policy and technical committee to oversee the construction of the Bay Route Bikeway. The Mayor appointed Councilman Inzunza to represent National City. CITY COUNCIL Councilman Dalla credited the City Attorney for his recent success in a downtown redevelopment case, which set a precedent. Mayor Waters also credited City Attorney Eiser for the success of the "Boom Box Ordinance" which other cities are following our lead on. PUBLIC ORAL COMMUNICATIONS H. Donald Hughes, 644 M Avenue, spoke regarding Meals on Wheels. He also spoke regarding the USS Black and told of writing a letter to President Bush requesting a commendation for National City to be recognized as "The Model City." Tim Moynahan, 3200 National City Boulevard, owner of Moynahans Towing & Storage, spoke regarding his towing contract with the City which he felt was not being adhered to. The City Manager was requested by the Mayor to look into the compliance of the contract. The Police Chief stated he was conducting an investigation of Mr. Moynahans allegations and would submit a complete report to Council. H. Donald Hughes, 644 M Avenue, National City spoke regarding his experience with calls not being logged in the daily report at the Police Department. ADJOURNMENT Motion by Van Deventer, seconded by Pruitt, the meeting be adjourned to the next regular City Council Meeting - August 22. 1989 - 7:00 p.m. - Council Chambers - Civic Center.
