MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
NOVEMBER 14, 1989
The regular meeting of the City Council of the City of National City was called to order at 7:00
p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Pruitt, Van Deventer, Waters.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager Tom G. McCabe, followed
by the invocation by Councilman Dalla.
APPROVAL OF MINUTES
Moved by Van Deventer, seconded by Dalla, the minutes of the regular meeting of
November 7, 1989 be approved, Carried by unanimous vote.
MAYORS' APPOINTMENTS
VICE MAYOR
Mayor Waters stated that Vice Mayor Fred Pruitts' term for 1989 had expired and
recommended Councilman Jess Van Deventer for Vice Mayor.
ACTION: Moved by Dalla, seconded by Pruitt in favor. Carried by the
following vote, to -wit: Ayes: Dalla, Inzunza, Pruitt, Waters. Nays: None.
Abstaining: Van Deventer.
INTERVIEWS/APPOINTMENTS
BOARDS AND COMMISSIONS
Mayor Waters turned the meeting over to Council member Pruitt.
CIVIL SERVICE COMMISSION: Councilman Pruitt introduced Carolyn Redding, 335 S.
Harbison, who spoke as to why she was interested in serving on the Commission.
PARK & RECREATION ADVISORY COMMITTEE: Councilman Pruitt stated that
Jose Pedro Charles had been interviewed by the City Council in January of 1989.
ACTION: Moved by Van Deventer, seconded by Pruitt in favor of the
appointment. Carried by unanimous vote.
Councilman Pruitt then turned the meeting back over to the Mayor.
PROCLAMATIONS
Moved by Van Deventer, seconded by Inzunza, the Proclamations be accepted by title only.
Carried by unanimous vote.
The Proclamation proclaiming November 19, 1989 to be IN CELEBRATION OF THE 120TH
ANNIVERSARY OF THE FOUNDING OF NATIONAL CITY'S FIRST CHURCH: "THE FIRST
CONGREGATIONAL CHURCH OF NATIONAL CITY," was read aloud in full by Mayor
Waters who stated he would be personally presenting the proclamation to the Church on
Sunday, November 19, 1989.
The Proclamation proclaiming November 13-19, 1989 as: "CHILDREN'S BOOK WEEK,"
was read aloud in full by Mayor Waters who then presented it to Candy David of the National
City Library.
The Proclamation proclaiming November 21, 1989 through January 1, 1990, as:
"PROJECT RED RIBBON SEASON," was read aloud in full by Mayor Waters who then
presented it to the City Manager to send to the proper people.

PUBLIC HEARING
ZONING/MUNI CODE
1. SUBJECT: Public Hearing - Amendment to Title 18 (Zoning) of the National City
Municipal Code regarding Temporary Uses. (Case File No. A-4-89) (Applicant: City of
National City).
NOTE: The City Clerk stated that Proof of Publication was on file in the Office of the City
Clerk.
RECOMMENDATION: Staff concurs with the recommendation of the Planning
Commission and recommends that the Code Amendment be adopted.
TESTIMONY: None.
ACTION: Motion by Van Deventer, second by Pruitt that the Public Hearing
be closed and move in favor of the recommendation of the Planning
Commission. the recommendation that the Code Amendment be adopted.
Carried by unanimous vote.
CONDITIONAL USE PERMIT
2. SUBJECT: Public Hearing - Appeal of Planning Commission denial of a Conditional
Use Permit for the sale of beer and wine at a restaurant at 505 East 8th Street. (Case
File No. CUP-1989-10) (Applicant: Carlito Rocillo Aure).
NOTE: The City Clerk noted that an Affidavit of Mailing and Proof of Publication was
on file in the Office of the City Clerk.
RECOMMENDATION: Staff concurs with the decision of the Planning
Commission and recommends that the conditional use permit be denied, based on
findings adopted in the Planning Commission resolution.
TESTIMONY: Phil Saenz, 395 "H" Street, Chula Vista, Attorney for Mr.
Aure spoke in favor of the appeal.
ACTION: The Mayor declared the Public Hearing closed. Motion by Van
Deventer, seconded by Pruitt to uphold the Planning Commission's vote to
deny this applicant. based on the same finding's as were found by the
Planning Commission. Carried by unanimous vote.
ADOPTION OF RESOLUTIONS
CONSENT RESOLUTIONS (Resolutions 16,109 through 16,112). Moved by Van
Deventer, seconded by Pruitt in favor of Consent Resolutions . Carried by unanimous vote.
BUDGET TRANSFERS
3. Resolution No. 16,109. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AUTHORIZING APPROPRIATION AND TRANSFER OF FUNDS
FOR THE WIDENING AND RECONSTRUCTION OF THE SOUTH BAY FREEWAY."
(Engineering Spec. No. 1026). Adopted. See above.
FIRE DEPARTMENT REVOLVING FUND
4. Resolution No. 16,110. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY ESTABLISHING FIRE DEPARTMENT ACTIVITIES REVOLVING
FUND." Adopted. See above.
CONTRACT/MCDANIEL ENGINEERING
5. Resolution No. 16,111. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT WITH
MCDANIEL ENGINEERING CO. TO PROVIDE ENGINEERING SERVICES FOR
RECONSTRUCTION OF LA PALETA CREEK BRIDGES ON HARBOR DRIVE
FEDERAL BRIDGE REPLACEMENT PROJECT, BRIDGE NO. 57C-192 R/L."
(Engineering Spec. No. 1028). Adopted. See above.
LAW ENFORCEMENT RESERVES/REVOLVING FUND
6. Resolution No. 16,112. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY ESTABLISHING POLICE RESERVES REVOLVING FUND."
Adopted. See above.
NON -CONSENT RESOLUTIONS (Resolutions 16,113 through 16,115). Moved by Van
Deventer, seconded by Inzunza the Resolutions be accepted by title only. Carried by
unanimous vote.
GRANT/CRIMINAL JUSTICE
7. Resolution No. 16,113. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AUTHORIZING THE ASSISTANT CHIEF OF POLICE OF THE
NATIONAL CITY POLICE DEPARTMENT TO APPLY FOR AN OFFICE OF CRIMINAL
JUSTICE PLANNING GRANT, TO RECEIVE AND ADMINISTER THE GRANT
PROCEEDS, AND TO SIGN ANY AND ALL DOCUMENTS IN CONNECTION WITH
SAID GRANT."
ACTION: Moved by Van Deventer, seconded by Inzunza in favor of
Resolution 16.113. Carried by unanimous vote.

CONTRACT/SOUTHWEST SIGNAL SERVICE
8. Resolution No. 16,114. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CONTRACT WITH SOUTHWEST SIGNAL SERVICE TO PROVIDE TRAFFIC SIGNAL
AND STREET LIGHTING MAINTENANCE AND EMERGENCY REPAIR SERVICES."
ACTION: Moved by Van Deventer, seconded by Inzunza in favor of
Resolution 16.114. Carried by unanimous vote.
POLITICAL SUPPORT
9. Resolution No. 16,115. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY URGING THE CALIFORNIA LEGISLATURE TO AMEND THE SAN
DIEGO UNIFIED PORT DISTRICT ACT TO PROVIDE SHARING OF REVENUES WITH
DISTRICT CITIES FOR PUBLIC SAFETY PURPOSES."
ACTION: Moved by Van Deventer, seconded by Dalla in favor of
Resolution 16.115. Carried by unanimous vote.
NEW BUSINESS
WARRANT REGISTERS
10. SUBJECT: Warrant Register No. 19. Ratification of Demands in the amount of
$175,837.86 (Warrant Nos. 108072 through 108133 inclusive, excepting none).
NOTE: Vice Mayor Van Deventer stated he would abstain from Warrant 108107 as it
was a prior business he owned and they lease from him.
RECOMMENDATION: Staff recommended the warrants be ratified.
ACTION: Motion by Inzunza, seconded by Pruitt, for approval. Warrants
(except 108107) carried by the following vote, to -wit: Ayes: Dalla, Inzunza,
Pruitt, Van Deventer, Waters. Nays: None. Warrant 108107 carried by the
following vote, to -wit: Ayes: Dalla, Inzunza, Pruitt, Waters. Nays: None.
Abstaining: Van Deventer.
WRITTEN COMMUNICATIONS
11. SUBJECT: Letter from Carol Council, Executive Director of the Center for Womens'
Studies and Services requesting Council initiation of a code amendment regarding
homes for battered women.
TESTIMONY: Carol Council, 3365 'B' Street, San Diego, spoke in favor of
the request and presented the Mayor and Council with an information packet
on the program. (Copy on file in the Office of the City Clerk).
Elizabeth Mura, San Diego, Coordinator of SAFE House, spoke regarding
the safety and anonymity of the proposed Home.
ACTION: Moved by Inzunza, seconded by Pruitt to direct the Planning
Department to do everything necessary to bring this home for Battered
Women into National City. Maker and second agreed to amended motion to
have Staff come back with altemate recommendations on how we might
accomplish this. Carried by unanimous vote.
OTHER BUSINESS
CONDITIONAL USE PERMIT/DENIAL
12. SUBJECT: Notice of Decision - Planning Commission Resolution No. 36-89
denying a Conditional Use Permit for the outdoor storage of automobiles at 1840
Harrison Avenue. (Applicant: Edward Brammer) (Case File No. CUP-1989-4).
RECOMMENDATION: Staff concurs with the decision of the Planning
Commission and recommends the Notice of Decision be filed.
ACTION: Moved by Dalla, seconded by Pruitt the notice be filed. No
objection as filed.
REPORT/ALCOHOL SALES
13. SUBJECT: Report regarding hours of alcohol sales and live entertainment at
McDini's Baja Restaurant and the Radisson Hotel.
RECOMMENDATION: Staff recommends that the City Council consider the
report.
ACTION: Moved by Dalla, seconded by Van Deventer, the report be filed.
No objection as filed.
HOLIDAY SEASON RECESS
14. SUBJECT: City Council Meetings - Holiday Season Recess.
RECOMMENDATION: Staff recommends that the City Council declare a holiday
season Council meeting recess on Tuesday, December 19, 1989, December 26,
1989 and Tuesday, January 2, 1990.
ACTION: Moved by Van Deventer, seconded by Inzunza, in favor of Staffs
recommendation on the three dates 12/19. 12/26 and 1/2/90, Carried by
unanimous vote.

BIDS/CIVIC CENTER COMPLEX
15. SUBJECT: Authorization to obtain bids for the construction of the Civic Center
Complex.
RECOMMENDATION: Authorize the City Engineer to obtain bids for the
construction of the Civic Center Complex.
ACTION: Moved by Van Deventer, seconded by Dalla in favor of the
recommendation. Tied vote as follows, to -wit: Ayes: Dalla, Van Deventer. Nays:
Inzunza, Pruitt. Abstaining: Waters. Moved by Pruitt, seconded by Inzunza, for the
Mayor to set a workshop as soon as possible to discuss this item. Carried by
unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR -
Mayor Waters read into record a release from the U.S. Supreme Court denying the application
for the stay of injunction that closed Chucks Bookstore and commended City Attorney Eiser
and his staff. (Copy on file in the Office of the City Clerk).
CITY COUNCIL -
Councilman Dalla spoke regarding acquiring bids and receiving some hard numbers as
opposed to the estimates by the Architect.
PUBLIC ORAL COMMUNICATIONS -
lone Campbell, 808 Ethel Place spoke regarding the booksale sponsored by Friends of the
Library.
Warren Nielsen, 631 Port Dunbar, Chula Vista, spoke regarding Item 15.
Everett Dickson, 2745 E. 14th Street, National City, spoke regarding the prior attempts to get
the Police Facility across the street and suggested the City Council at least accept bids.
ADJOURNMENT
Motion by Van Deventer, seconded by Pruitt the meeting be adiourned to 3:00 P.M.
November 21. 1989 - Council Chambers. Carried by unanimous vote.
The meeting closed at 9:20 p.m.
