ROLL CALL Council members present: Dalla, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Berkuti, Bolint, Eiser, McCabe, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Assistant City Manager Gerald Bolint. APPROVAL OF MINUTES Motion by Morrison, seconded by Zarate, the Minutes of the Regular Meeting of February 1, 1994 and the Adjourned Meeting of February 3, 1994 be approved. Carried by unanimous vote. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 94-10 through 94- 14). NOTE: Mayor Waters requested Item No. 3, (Resolution No. 94-12) be pulled. Motion by Dalla, seconded by Inzunza, in favor of Consent Calendar (except Item No. 3, Resolution No. 94-12). Carried by unanimous vote. CONTRACT 1. Resolution No. 94-10. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH THE MAYTIME BAND REVIEW CORPORATION." ACTION: Adopted. See above. DEEDS & EASEMENTS 2. Resolution No. 94-11. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY GRANTING AN EASEMENT TO SAN DIEGO GAS AND ELECTRIC FOR THE MAINTENANCE OF ITS OVERHEAD POWER LINES AT PLAZA BONITA CENTER WAY (REO DRIVE)." ACTION: Adopted. See above. Book 76/Page 30 02/08/94 STREET DIVISION WIDENING 4. Resolution No. 94-13. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO RETURN PROGRAM SUPPLEMENT NO. 002 TO STATE -LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP- 5066 WITH CALTRANS, FOR THEIR PARTICIPATION IN THE CONSTRUCTION COST OF WIDENING DIVISION STREET FROM EUCLID AVENUE TO DREXEL AVENUE. (ENGINEERING SPEC. 93-2)." ACTION: Adopted. See above. STREET REO DRIVE EXTENSION 5. Resolution No. 94-14. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO RETURN PROGRAM SUPPLEMENT NO. 003 TO STATE -LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP- 5066 WITH CALTRANS, FOR THEIR PARTICIPATION IN THE CONSTRUCTION COST OF REO DRIVE (PRESENTLY KNOWN AS PLAZA BONITA CENTER WAY). (ENGINEERING SPEC. 92-7)." ACTION: Adopted. See above. CONTRACT 3. Resolution No. 94-12. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A MODIFIED AGREEMENT WITH THE STATE OF CALIFORNIA FOR THE MAINTENANCE OF A TRAFFIC SIGNAL AT THE INTERSECTION OF VALLEY ROAD AND REO DRIVE, AND RESCINDING RESOLUTION NO. 93-83." TESTIMONY: City Attorney Eiser stated that the Resolution and agreement placed on the Agenda had required additional modification based on discussion with Caltrans, Engineering and Public Works Staff and recommended the following revision which was read into the record in full: Resolution No. 94-12. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY RESCINDING RESOLUTION NO. 93-83." WHEREAS, a portion of the proposed Reo Drive between Valley Road and Sweetwater Road is located within Caltrans right-of-way at Valley Road; and WHEREAS, the city will be installing a traffic signal at the intersection of Valley Road and Reo Drive; and WHEREAS, the City Council authorized an agreement with Caltrans on June 22, 1993 pursuant to Resolution No. 93-83 which authorized Caltrans to assume maintenance and control responsibilities for said traffic signal; and WHEREAS, it has been determined that it is in the best interest of the city for maintenance and control for said traffic signal to be provided by city forces. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that Resolution No. 93-83 be rescinded. PASSED and ADOPTED this 8th day of February, 1994. ACTION: Motion by Zarate, seconded by Morrison, in favor. Carried by unanimous vote. Book 76/Page 31 02/08/94 WRITTEN COMMUNICATIONS TEMPORARY USE PERMITS 1994 6. SUBJECT: Letter from the Chinese Consolidated Benevolent Association, Inc. requesting a waiver of a firecracker firing permit fee. TESTIMONY: None. NOTE: Councilman Dalla commented that the Council had always been precluded from granting requests for waiver of fees for religious events in the past. City Attorney Eiser stated that Councilman Dalle's statement was consistent with past practices and that the first paragraph of the request states that the event is for religious ceremonies. ACTION: Motion by Morrison, seconded be Zarate, for approval of the permit without waiver of fees. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1993 7. SUBJECT:. Warrant Register No. 30. Ratification of Demands in the amount of $897,686.02 (Warrant Nos. 129036 through 129095 inclusive excepting none). RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by lnzunza, seconded by Morrison, in favor of ratification of demands. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. EQUIPMENT PURCHASE 8. SUBJECT: Recommendation regarding the acquisition of five (5) Police Black & White units for F.Y. 1993-94. RECOMMENDATION: Staff recommended that Council support the Purchasing Agent's decision to accept the proposal from Colonial Ford for the acquisition of five (5) Police Black and White units. TESTIMONY: Purchasing Agent Brenda Hodges gave a brief overview of the item and recommended Council waive the bidding process due to special circumstances and accept the offer of Colonial Ford. ACTION: Motion by Zarate, seconded by Dalla, in favor of Staff's recommendation to waive the bidding process due to special circumstances and accept the offer of Colonial Ford. Carried by unanimous vote. Mayor Waters deviated from the Agenda to introduce Jerry Pearson, President of Colonial Ford, who provided Council with a brief progress report on the construction of their new facility which is expected to be open in March. CABLE TV RATE/REGULATIONS ADMIN 1994 9. SUBJECT: Status Report submitted by National City Cable. RECOMMENDATION: Staff recommended that the report be received and filed. Unless Council has additional comments or direction, staff anticipates bringing a follow-up report back to Council after March 1, 1994. Book 76/Page 32 02/08/94 CABLE TV RATE/REGULATIONS ADMIN 1994 (continued) TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Della, to accept and file the report. No objection as filed. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR Mayor Waters reported that Public Works Street Sweeper Operator, Ben Hensley, had passed away. No services are planned, however a gathering at his home was being held this evening. The Mayor then read into the record, a letter from the City of San Diego regarding homeless shelters. (Copy on file in the Office of the City Clerk). He also read into the record a letter from the National School District regarding their recently held Community Forum on Education, thanking the Council for their support and allowing the use of the Community Center with a waiver of fees. The Mayor then requested the City Manager and City Attorney look into the possibility of billing costs of city services to Radio Station Z-90 for their promotion of cruising on Highland Avenue. Lastly, he spoke of a complaint he had received but had not yet had the opportunity to look into with regards to the Port District taking action which might endanger the National City boat yards. CITY COUNCIL Councilman Morrison requested Staff look into the available rights of the city with regards to the recycling center located behind Big Ben's Market and the negative impact it is having on the surrounding neighborhoods. Councilman Morrison also suggested Staff look into inviting the Police Reserve Officers to attend the Annual Boards & Commissioners Banquet as he felt it would provide them arr opportunity to be recognized by the citizens more so than at their private banquet. Vice Mayor Inzunza stated that Able (Tito) Portillo Jr., National City native and S.U.H.S. graduate, who had been teaching at Sweetwater High School for the past 5 years had passed away this morning. Councilwoman Zarate expressed concurrence with Councilman Morrison's comment that the Police Reserve Officers should be recognized for their service to the community. Councilman Dalla requested Staff look into complaints received that gas stations in National City were charging more than those in surrounding areas such as Spring Valley, and whether there is an agency that oversees and monitors this type of thing. Book 76/Page 33 02/08/94 PUBLIC ORAL COMMUNICATIONS Alfonso Hernandez, 2132 Euclid Avenue, National City requested the city look into the possibility of allocating redevelopment funds to complete Roosevelt behind the new Colonial Ford building and also at 21 st and 22nd, Harding to Roosevelt. He also stated that the abandoned car sweep missed the van on "D" Avenue by the fire station which does not have current license tags as well as one at 17th and Harding on the North side of the street which has been up on blocks for quite some time. He also made inquiry of Staff regarding a sewer lateral not being hooked up on Euclid Avenue between 20th and 22nd Street. Elias Rodriguez, 1440 "I" Avenue, National City, spoke in opposition to the implementation of a user utility tax and suggested the city install parking meters throughout the city to generate revenue to be designated to public safety. Robert Coons, 431 N. Highland Avenue, Suite C, National City, representing U.S.I.A.A. commented on Councilman Dallas statement regarding higher gas prices in National City stating that he had also observed this. He then spoke regarding the Council action taken last week to decline his request to use the new Community Center for a boxing tournament. Lori Anne Peoples, 1504 E. 22nd Street, National City, Chairwoman for the National City Living History Farm Preserve, operators of the Stein Family Farm, invited all to attend this Sunday's Quilt Raffle Drawing and Open House at the Stein Farm from 10 am to 3 pm. ADJOURNMENT Motion by Morrison, seconded by Zarate, to adjourn to the next Regular City Council Meeting - February 15, 1994 - 4:00 p.m. - Council Chambers. Civic Center. Carried by unanimous vote.
