MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
JULY 19, 1994
The Regular Meeting of the City Council of the City of National City was
called to order at 4:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Morrison, Waters. Absent:
Zarate.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples,
Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom McCabe, followed by the invocation by Assistant City Manager
Gerald Bolint.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Regular
Meeting of July 12, 1994 be approved. Carried by unanimous vote.
Absent: Zarate.
NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Dalla, the resolutions be introduced by
title only. Carried by unanimous vote. Absent: Zarate.

NON CONSENT RESOLUTIONS (continued)
SEWER METRO SAN DIEGO AREA WASTEWATER MGMT/SAD
1. Resolution No. 94-99. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE
MAYOR TO EXECUTE THE MEMORANDUM OF
UNDERSTANDING SETTING FORTH AND RESOLVING
FUNDAMENTAL POLICY ISSUES INVOLVED IN THE
TRANSFER OF THE METROPOLITAN SEWERAGE SYSTEM TO
THE SAN DIEGO AREA WASTEWATER MANAGEMENT
DISTRICT."
RECOMMENDATION: Staff recommended that having a viable
Regional Wastewater Management District is in the long range
interests of the City, and recommended authorizing the Mayor to
execute the San Diego City Council approved Memorandum of
Understanding.
TESTIMONY: Public Works Director Curt Williams gave a
brief overview of the process involved in the development of
the MOU and answered questions of the Council.
Councilwoman Zarate entered the Council Chambers at 4:02 p.m.
ACTION: Motion by Zarate, seconded by Inzunza, in favor
of Resolution No. 94-99. Carried by unanimous vote.
CONTRACT
2. Resolution No. 94-100. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO SIGN AN AGREEMENT BETWEEN THE CITY
OF NATIONAL CITY AND THE CITY OF LA MESA FOR THE
ESTABLISHMENT OF A REGIONAL FIRE PREVENTION AND
COMMUNITY SAFETY PROGRAM."
RECOMMENDATION: Staff recommended that the Resolution be
approved.
TESTIMONY: Charles Cheneweth, 2300 E. 7th Street,
National City, spoke neither for nor against the item.

CONTRACT (continued)
TESTIMONY: Patricia Pittman, National City Fire Marshal,
spoke in opposition to the item.
Mitch Guarano, 410 Harbison Avenue, National City, spoke in
opposition to the item.
Phil Ewert, representing the National City Firefighters
Association, spoke regarding his understanding of how the
10th Fire Captain position was created.
ACTION: Motion by Morrison, seconded by Inzunza, to not
approve Resolution 94-100 at this time, and direct Staff to look
for funding of the Fire Marshal position and bring a report back
to Council. Carried by unanimous vote.
BUDGET 1994-95
3. Resolution No. 94-101. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
AND ADOPTING PRELIMINARY BUDGET FOR FISCAL YEAR
1994-95."
RECOMMENDATION: Staff recommended that the Resolution be
adopted.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Dalla, in favor
of Resolution No. 94-101. Carried by unanimous vote.
LABOR RELATIONS CONFIDENTIAL EMPLOYEES ADMIN
4. Resolution No. 94-102. "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
FISCAL YEAR 1994-95 EMPLOYEE BENEFIT PLAN FOR
CONFIDENTIAL PERSONNEL."
RECOMMENDATION: Staff recommended that the Resolution be
adopted.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, in favor
of Resolution No. 94-102. Carried by unanimous vote.

LABOR RELATIONS MID MGMT EMPLOYEES ADMIN
5. Resolution No. 94-103. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
THE DESIGNATIONS, SALARIES AND BENEFITS FOR THE
MID -MANAGEMENT SUPERVISORY GROUP FOR FISCAL
YEARS 1994-95, 1995-96, AND 1996-97."
RECOMMENDATION: Staff recommended that the Resolution be
approved.
NOTE: City Attorney Eiser stated that under Section 1, the correct
date should read July 5, 1994.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in
favor of Resolution No. 94-103 with the correction noted by
the City Attorney. Carried by unanimous vote.
LABOR RELATIONS MID MGMT EMPLOYEES ADMIN
6. Resolution No. 94-104. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
THE DESIGNATIONS, SALARIES AND BENEFITS FOR THE
MID -MANAGEMENT PROFESSIONAL GROUP FOR FISCAL
YEARS 1994-95, 1995-96, AND 1996-97."
RECOMMENDATION: Staff recommended that the Resolution be
approved.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor
of Resolution No. 94-104. Carried by unanimous vote.
LABOR RELATIONS EXECUTIVE EMPLOYEES ADMIN
7. Resolution No. 94-105. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
THE DESIGNATIONS, SALARIES AND BENEFITS FOR
EXECUTIVE EMPLOYEES, INCLUDING THE CITY MANAGER,
CITY ATTORNEY AND CITY CLERK FOR FISCAL YEARS
1994-95, 1995-96, AND 1996-97."

RECOMMENDATION: Staff recommended that the Resolution
and the designations, salaries and benefits for executive employees be
approved.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, hi
favor of Resolution No. 94-105. Carried by unanimous vote.
PAYROLL ADMIN
8. Resolution No. 94-106. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY RESTORING
MAYOR AND CITY COUNCIL COMPENSATION."
RECOMMENDATION: None.
NOTE: Councilman Dalla stated that he would like to keep his
salary at the current level.
TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue,
National City, suggested the Mayor and all Councilmembers
keep their salaries at the current level.
ACTION: Motion by Inzunza, seconded by Waters, in favor
of Resolution No. 94-106. Carried by unanimous vote.
WRITTEN COMMUNICATIONS
TEMPORARY USE PERMITS 1994
9. SUBJECT: Letter from the Filipino -American Senior Citizens
Association concerning the reduction of the rental fee for the use of
the National City Community Center Social Hall.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, this
item be filed. No objection as filed.
CLAIM
10. SUBJECT: Letter from Joseph LaVeque concerning denial of a
claim for illegal seizure by NCPD.

CLAIM (continued)
TESTIMONY: Joseph LaVeque, 6245 Crystal Lake Avenue,
San Diego, explained the details of his claim against the city
and requested Council direct Staff to meet with him or he
would have no alternative but to sue for damages.
ACTION: No action taken.
NEW BUSINESS
WARRANT REGISTERS 1994
11. SUBJECT: Warrant Register #2. Ratification of Demands in the
amount of $243,594.57 (Warrant Nos. 130928 through 131029
inclusive excepting none) and Certification of Payroll in the amount
of $409,810.61.
RECOMMENDATION: Staff recommended ratification of these
warrants.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of the Ratification of Demanda and the Certification of Payroll.
Warrants carried by the following vote, to -wit: Ayes: Dalla,
Inzunza, Morrison, Zarate, Waters. Nays: None. Absent:
None. Abstaining: None.
AUDIT/FINANCIAL REPORT FY92-93
12. SUBJECT: Auditor's Examination of the Gas Tax Fund.
RECOMMENDATION: Staff recommended that the report be
accepted and filed.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, the
report be accepted and filed. No objection as filed.
COMMUNITY PROMOTION
13. SUBJECT: Request to use a fire apparatus at a fund raiser for the
National City Citizens Patrol.
RECOMMENDATION: Staff recommended that Council approve
the request.

TESTIMONY: Richard Sherman, 1236 E. 16th Street,
National City, declined to speak at this time.
ACTION: Motion by Morrison, seconded by Inzunza, in
favor of the request. Carried by unanimous vote.
STREET TREE COMMITTEE
14. SUBJECT: Street Tree Committee Minutes.
RECOMMENDATION: Staff recommended that the Minutes be
approved.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, in favor.
Carried by unanimous vote.
COMMUNITY PROMOTION
15. SUBJECT: Status Report II - Summer Pops Symphony Concert.
RECOMMENDATION: Staff recommended that the report be
accepted and filed, and that Council provide staff with any additional
comments or direction.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, the
report be accepted and filed. No objection as filed.
CITY MANAGER - No report.
CITY ATTORNEY
16. SUBJECT: Report on City Council Seats.
TESTIMONY: None.
ACTION: No action taken.

MAYOR
Mayor Waters pointed out the painting donated by the Ledgerwoods at the
last Council Meeting which had been hung in the rear of the Council
Chamber.
CITY COUNCIL
Councilwoman Zarate requested Staff look into several locations throughout
the city which were in need of clean up or code conformance action. She
also invited all to attend the Committee to Reclaim Our Neighborhoods
meeting scheduled for tomorrow evening, July 20, 1994 at 7:00 p.m. and
stated that the guest speaker would be Officer Alex Rascon, the Zero
Tolerance Coordinator for the San Diego Unified School District.
Councilman Morrison stated that he had received numerous comments
pertaining to how well the 4th of July Carnival in Kimball Park had gone.
He then expressed concerns with graffiti on a fence located at 18th and
Wilson on the back of a charter bus company depot and requested Staff look
into the possibility of having it removed and the building sprayed with anti -
graffiti coating. Councilman Morrison then requested Staff look into the
possibility of breaking up the large picnic area in the center of El Toyon
Park by planting large trees or posting designated areas.
Councilman Dalla suggested Councilman Morrison's last item be referred to
the Park and Recreation Advisory Board for comment.
PUBLIC ORAL COMMUNICATIONS
Everett Dickson, 2745 E. 14th Street, National City, expressed concerns
with citizens using the large dumpsters located behind the South Bay
Shopping Center.
Alex McLintock, 2038 Euclid Avenue, National City, made inquiry
regarding his project requirements.

PUBLIC ORAL COMMUNICATIONS (continued)
Richard Sherman, 1236 E. 16th Street, National City representing the
Citizens Patrol thanked Council for approving their request for the use of
the fire truck at their fund-raiser and invited all to attend the event which is
being held at McDonald's on Plaza Boulevard from 5:00 p.m. to 8:00 p.m.
on Friday, August 5, 1994.
Alfonso Hernandez, 2132 Euclid Avenue, National City, expressed his
opinion on the need for city clean up at the intersection of 16th and Euclid
Avenue.
Larry Beck, 13420 Orange Blossom Lane, Poway, representing the National
City Firefighter's Association thanked the Council for their support of Fire
Marshal Pittman's item and then spoke regarding their participation in the
annual demolition derby fund-raiser for the Burn Institute. Their group
raised $5,000. He invited all to attend the Padres game at the Stadium on
Friday, July 29th where their check along with those moneys collected by
firefighters from throughout the county will be presented to the Burn
Institute.
Al Alvarado, 2423 E. 20th Street, National City, representing the Sister City
Committee, requested Council assistance in obtaining the release of funding
to be used for transportation of band members to participate in the 50th
Anniversary Celebration of the Tecate Brewery.
Councilman Inzunza left the Council Chambers at 6:34 p.m.
ADJOURNMENT
Motion by Morrison, seconded by Zarate, to adjourn to the next Regular
City Council Meeting - July 26, 1994 - 7:00 p.m, - Council Chambers, Civic
Center. Carried by unanimous vote. Absent: Inzunza.
The meeting closed at 6:35 p.m.
