MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
AUGUST 9, 1994
The Regular Meeting of the City Council of the City of National City was
called to order at 7:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples,
Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom McCabe, followed by the invocation by Councilman Dalla.
The Closed Sessions were heard at this time.
CLOSED SESSIONS
CONFERENCE WITH LEGAL COUNSEL -EXISTING LITIGATION
National City Police Officers' Association, et at. V. City of National
City, et al.
CONFERENCE WITH LABOR NEGOTIATOR
Agency Negotiators: Roger DeFratis, Michael Bouse, Jim Ruiz
Employee Organization: National City Firefighters' Association.
ACTION: Motion by Morrison, seconded by Inzunza, in favor of
holding the Closed Session. Carried by unanimous vote.

APPROVAL OF MINUTES
Motion by Zarate, seconded by Inzunza, the Minutes of the Regular
Meeting of August 2, 1994 be approved. Carried by unanimous vote.
MAYOR'S PRESENTATIONS (102-14-2)
Mayor Waters requested that the Presentation be held over pending the
arrival of Detective Dunn.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Inzunza, the Proclamations be read in
their entirety. Carried by unanimous vote.
The Proclamation proclaiming August 9, 1994 to be: "YOUTH REACH
NETWORK DAY" was read in its entirety by Mayor Waters, who then
presented it to Todd Durrance, 5933 Steeple Chase, Bonita, who thanked
the Mayor and the City Council for their support.
The Proclamation proclaiming the 1st week of December of each year as
Arbor Week and the 1st Saturday of each December of each year to be:
"NATIONAL CITY ARBOR DAY" was read in its entirety by Mayor
Waters. The Mayor explained the reasoning behind the proclamation and
gave it to the City Manager to forward to the appropriate people.

PUBLIC HEARINGS
PARKING ADMIN 1994 (801-2-14)
1. SUBJECT: A Public Hearing by the City Council of National City
to consider the adoption of a resolution revising the Residential
Permit Parking Policy.
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the City Clerk.
RECOMMENDATION: Staff recommended that the Council hold
the Public Hearing on the consideration of the revisions to the
Residential Permit Parking District Policy.
The Traffic Safety Committee at its April 13, 1994 meeting
recommended approval of the revisions.
TESTIMONY: None.
Mayor Waters declared the Public Hearing closed.
ACTION: Motion by Zarate, seconded by Morrison, to file
this item, with a Resolution to be brought back at a later date.
Carried by unanimous vote.
NON CONSENT RESOLUTIONS
Motion by Zarate, seconded by Morrison, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.
ABATEMENT WEED 1994 (402-3-4)
2. Resolution No. 94-117. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY SETTING A
PUBLIC HEARING FOR THE REPORT OF PROCEEDINGS AND
ACCOUNTING FOR CLEAN UP OF PROPERTY AT 2917 "L"
AVENUE."
RECOMMENDATION: Staff recommended that Council approve
the resolution setting a date for a Public Hearing on this matter, and
directing the clerk to make notification in accord with the law.

TESTIMONY: None.
ACTION: Motion by Dalla, seconded by Morrison, in favor
of Resolution No. 94-117. Carried by unanimous vote.
WRITTEN COMMUNICATIONS
TEMPORARY USE PERMITS 1994 (203-1-10)
3. SUBJECT: Letter from the Filipino -American Senior Citizen's
Association requesting the City Council to reduce the rental fee for
the use of the National City Community Center Social Hall.
RECOMMENDATION: Staff offered no objection to reducing the
overall fee by two hours custodial (2 x $11.17 = $22.34).
TESTIMONY: Jake Benjamin, President, Filipino -American
Senior Citizen's Association of National City, spoke in support
of their request.
Aileane Roberts, 845 E. 13th Street, National City, spoke in
opposition to the request.
M. Louise Martin, 1527 E. 15th Street, National City, spoke in
opposition to the request with the exception of Mr. William's'
recommendation.
ACTION: Motion by Zarate, seconded by Morrison, the item
be filed. No objection as filed.
The Mayor's Presentation was heard at this time.
MAYOR'S PRESENTATIONS (102-14-2)
Mayor Waters read into the record (copy on file in the office of the City
Clerk) the presentation to Detective James Dunn, National City Police
Department, who was recognized by the San Diego Chapter of Crime
Stoppers. He was one of eleven (11) individuals that were honored at their
annual "Enough is Enough" awards luncheon. He then presented a
Certificate of Appreciation and a key to the City to Detective Dunn, who
thanked the Mayor and the City Council for their support.

NEW BUSINESS
WARRANT REGISTERS 1994 (202-1-9)
4. SUBJECT: Warrant Register #5. Ratification of Demands in the
amount of $177,585.91 (Warrant Nos. 131185 through 131247
inclusive excepting none).
RECOMMENDATION: Staff recommended ratification of these
warrants.
ACTION: Motion by Zarate, seconded by Inzunza, in favor of
the Ratification of Demands. Warrants carried by the following
vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Zarate, Waters.
Nays: None. Absent: None. Abstaining: None.
VARIANCE 1994 (409-1-17)
5. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 17-94 approving a zone variance to allow a 6 foot high fence
within the front and exterior side yard setbacks at 1606 Coolidge
Avenue. Applicant: Jolly Terry - Case File No. Z-1994-5.
RECOMMENDATION: Staff concurred with the decision of the
Planning Commission to approve the zone variance and
recommended that the Notice of Decision be filed.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, the
Notice of Decision be filed. No objection as filed.
CONDITIONAL USE PERMITS 1994 (403-9-8)
6. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 16-94 approving a Conditional Use Permit for an automotive
storage and employee parking lot adjacent to a residential zone at
1904-1910 "A" Avenue. Applicant: John and Betty Ball - Case File
No. CUP-1994-3.
RECOMMENDATION: Staff concurred with the decision of the
Planning Commission to approve the application and recommended
that the Notice of Decision be filed.

TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, the
Notice of Decision be filed. No objection as filed.
Mayor Waters stated that there was an off -agenda item that arose after the
posting of the Agenda.
ACTION: Motion by Zarate, seconded by Inzunza, in favor of
bringing the off -agenda item onto the agenda as the need to
take action arose after the posting of the agenda. Carried by
unanimous vote.
COMMUNITY PROMOTION (102-1-3)
7. SUBJECT: City Entry in the National City Automobile Heritage
Days.
RECOMMENDATION: Staff recommended approval of the
request.
NOTE: The entry fee and personnel to accompany the antique fire
engine are being donated by Firefighters Local 2744.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of the request. Carried by unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR
Mayor Waters read into the record a letter from Andrew M. Cuomo,
Assistant Secretary of the U.S. Department of Housing and Urban
Development (copy on file in the office of the City Clerk) thanking the City

for applying for designation under the President's Empowerment Zone and
Enterprise Community Initiative.
The Mayor then read a Symphony report from Parks and Recreation
Director Jim Ruiz (copy on file in the office of the City Clerk).
Mayor Waters also announced that on Thursday, August 11, 1994, there
will be a bus full of National City supporters going to Long Beach, where
they will speak in support of the proposed Marina project to the Coastal
Commission.
CITY COUNCIL
Councilman Morrison commented on the positive success of the Symphony
and suggested a round -table discussion with those involved to prepare for
next year's event. He then requested that Staff look into the replacement of
the barricade that was removed from the 900 block of "N" Avenue, and the
need for lighting in that vicinity.
Councilwoman Zarate thanked all involved in the Symphony who made it
the great success that it was.
Councilman Dalla also thanked Assistant Manager Bolint, Parks &
Recreation Department Director Ruiz, the Municipal Employees
Association, the Port Commission and City Staff for their work on the
Symphony.
PUBLIC ORAL COMMUNICATIONS
Richard Sherman, 1236 E. 16th Street, National City, spoke regarding
several incidents which occurred Sunday evening on Highland Avenue.
Alda West, 315 E. 3rd Street, National City, requested that Staff look into
the garage between 314-320 "B" Avenue where an auto business has been
established; inquired as to the time frame given to meet city violation
requirements with regards to the 321 E. 2nd Street apartment being
constructed; and reported that the parkway shrubs at the corner of 7th Street

and "B" Avenue, and the hedges at 4th Street and "B" Avenue need
trimming.
Kathy Smith, 3028 E. 1 lth Street, National City, thanked Councilwoman
Zarate, Councilman Morrison, and Mayor Waters for attending a fund-raiser
on Friday evening which raised over $600.00
Alfonso Hernandez declined to speak at this time.
William Mayberry, 2007 Lanoitan Avenue, National City, spoke regarding
an incident involving National City Police and the confiscation of items
from his home and requested Council and Staff assistance.
Laura Hunter, representing the Environmental Health Coalition, 1717
Kettner Blvd., San Diego, clarified her organization's position on the
National City Marina Project.
Alda West, 315 E. 1st Street, National City, stated that she supports the
Marina.
National City Port Commissioner, 1706 Prospect Street, National City,
addressed previously -made comments regarding the proposed Marina.
Lori Anne Peoples, 1504 E. 22nd Street, National City, representing the
National School District Educational Foundation, invited all to attend the
Ice Cream Festival at Plaza Bonita on Satruday from 11 a.m. to 3 p.m. after
they view the Auto Heritage Days Parade.
M. Louise Martin, 1527 E. 15th Street, National City, spoke in support of
the proposed Marina, added personal congratulations to Detective Dunn,
and reminded all to attend the Auto Heritage Days events, and spoke
regarding the need for increased revenue to hire additional City Staff and
safety personnel.
The Closed Sessions were heard earlier, after the Invocation.

Motion by Inzunza, seconded by Morrison, to adjourn to the next Regular
City Council Meeting - August 16_, 1994 - 4:00 p.m - Council Chambers,
Civic Center. Carried by unanimous vote.
The meeting closed at 10:12 p.m.
