MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
AUGUST 23, 1994
The Regular Meeting of the City Council of the City of National City was
called to order at 7:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples,
Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom McCabe, followed by the invocation by Councilman Dalla.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Regular
Meeting of August 16, 1994 be approved. Carried by the following vote,
to -wit: Ayes: Dalla, Inzunza, Morrison, Waters. Nays: None. Abstaining:
Zarate.
Mayor Waters requested Closed Session be held at this time.

ACTION: Motion by Inzunza, seconded by Morrison, in favor of
holding the Closed Session. Carried by unanimous vote.

MAYOR'S PRESENTATIONS
NATIONAL CITY TRANSIT ADMIN (805-1-2)
Mayor Waters introduced Bob Arthur of McDonald Transit who thanked the
Council for their 12 years of support provided him and then introduced Mr.
Freddy Rios, who will become the General Manager of National City
Transit on or about September 1.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Inzunza, the Proclamation be read in its
entirety. Carried by unanimous vote.
The Proclamation proclaiming August 26, 1994 to be: "CLARENCE
"JONESY" JONES DAY" was read aloud in its entirety by Mayor Waters,
who then presented it to "Jonesy." "Jonesy" thanked the Mayor, Council
and citizens for their support provided him during his 35 years with EDCO.
BOARDS AND COMMISSIONS
INTERVIEWS/APPOINTMENTS
PARKS AND RECREATION ADVISORY BOARD (101-5-1)
Mayor Waters announced the resignation of Mr. Freddie L. Boykin, Jr. from
the Parks and Recreation Advisory Board.
RECOMMENDATION: None.
TESTIMONY: None.
ACTION: No action was taken.

PUBLIC HEARINGS
CABLE TV RATE/REGULATIONS ADMIN 1994 (908-2-2)
1. SUBJECT: Continued Public Hearing - Cox Cable Base Rates and
Charges for the Basic Services Tier and Related Equipment.
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the Office of the City Clerk.
RECOMMENDATION: Staff recommended that the Council
accept and file the letter of proposal from Cox Cable.
TESTIMONY: Asst. City Manager Bolint provided Council
with a brief verbal overview.
ACTION: Mayor Waters declared the Public Hearing closed.
Motion by Morrison, seconded by Inzunza, to accept and file
the letter of proposal from Cox Cable. Carried by unanimous
vote.
ABATEMENT/WEED 1994 (402-2-1)
2. SUBJECT: Public Hearing - Report of Proceedings and Accounting
for Clean-up of Property at 2917 "L" Avenue (Parcel 563-141-05),
and Assessment.
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the Office of the City Clerk.
RECOMMENDATION: Staff recommended that Council approve
the Resolution confirming the proceedings and accounting and
directing the City Clerk to file the assessment of $21,409.31 with the
County Auditor.
TESTIMONY: Michael O'Connell, 2845 "L" Avenue,
National City, spoke in support of Staff's action and
encouraged on -going monitoring of the property.
Bill Niedzwiecki, 2914 "L" Avenue, National City, spoke in
support of Staff's action and encouraged on -going monitoring
of the property.
ACTION: Mayor Waters declared the Public Hearing Closed.

Mayor Waters requested Agenda Item No. 5, Resolution No. 94-123 be
heard at this time.
ABATEMENT/WEED 1994 (402-2-1)
5. Resolution No. 94-123. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY CONFIRMING
THE ASSESSMENT OF CLEAN UP OF PROPERTY AT 2917 "L"
AVENUE, NATIONAL CITY. A.P.N. 563-141-05."
RECOMMENDATION: Staff recommended that Council adopt the
Resolution.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, Ih_Q
Resolution be read by title only. Carried by unanimous vote.
Motion by Dalla, seconded by Zarate, in favor of Resolution
No. 94-123. Carried by unanimous vote.
NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Zarate, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.
CONTRACT (C93-12)
3. Resolution No. 94-121. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING
WORK AND AUTHORIZING THE FILING OF THE NOTICE OF
COMPLETION, AND APPROVAL OF CHANGE ORDER NO. 1
FOR THE STREET IMPROVEMENTS AND MISCELLANEOUS
CURB, GUTTER, AND SIDEWALK PROJECT. (ENGINEERING
SPEC. NO. 93-3)."
RECOMMENDATION: Staff recommended that Council adopt the
resolution authorizing the acceptance of the work, approving the
Change Order No. 1 and filing of the Notice of Completion.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Dalla, in favor of
Resolution No. 94-121. Carried by unanimous vote.

PARKING DISTRICT ADMIN (801-1-1)
4. Resolution No. 94-122. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING A
REVISED RESIDENTIAL PERMIT PARKING PROGRAM
POLICY, AND RESCINDING RESOLUTION NO. 14,357."
RECOMMENDATION: Staff recommended that Council adopt the
Revised Residential Permit Parking District Policy.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Resolution No. 94-122. Carried by unanimous vote.
Agenda Item No. 5, Resolution No. 94-123 was heard earlier, after Public
Hearing.

FOR A CONSORTIUM FOR A TRAINED AND EDUCATED
WORKFORCE FOR SAN DIEGO COUNTY."
RECOMMENDATION: Staff recommended that Council approve
the Resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
Resolution No. 94-124. Carried by unanimous vote.

POLITICAL SUPPORT ADMIN (102-4-1)
7. Resolution No. 94-125. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY OPPOSING THE
GREGORY CANYON LANDFILL AND RECYCLING
COLLECTION CENTER BALLOT INITIATIVE THAT WOULD
ALLOW A LANDFILL IN THE PALA/PAUMA AREA OF SAN
DIEGO COUNTY."
RECOMMENDATION: Staff recommended that Council approve
the Resolution.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Resolution No. 94-125. Carried by unanimous vote.
ORDINANCES FOR INTRODUCTION
Motion by Dalla, seconded by Morrison, the Ordinance be introduced by
title only. Carried by unanimous vote.
MUNICIPAL CODE 1994 (506-2-9)
8. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY ADDING CHAPTER 10.24 TO THE
NATIONAL CITY MUNICIPAL CODE PERTAINING TO
LOITERING FOR DRUG ACTIVITIES."
OLD BUSINESS
ORGANIZATIONS, LOCAL/CAST (109-8-1)
9. SUBJECT: National City Citizens Advisory Support Team (CAST).
Continued from Council Meeting of 8/16/94.
RECOMMENDATION: Staff recommended that a National City
CAST Team be established as described in the Staff Report attached
to the Agenda, with volunteer training to begin in January 1995.
Actual Team operation would being in April 1995. The
recommendation was made with the understanding outlined in the
Staff report.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, in favor.

WARRANT REGISTERS 1994 (202-1-9)
10. SUBJECT: Warrant Register #7. Ratification of Demands in the
amount of $130,027.98 (Warrant Nos. 131325 through 131406
inclusive excepting none).
RECOMMENDATION: Staff recommended ratification of these
warrants.
ACTION: Motion by Dalla, seconded by Morrison, in favor
of the Ratification of Demands. Warrants carried by the
following vote, to -wit: Ayes: Dalla, Inzunza, Morrison,
Zarate, Waters. Nays: None. Absent: None. Abstaining:
None.
CONDITIONAL USE PERMITS 1994 (403-9-4)
11 SUBJECT: Notice of Decision - Planning Commission Resolution
No. 18-94 approving a Conditional Use Permit for expansion of an
industrial building at 1031 Coolidge Avenue. (Applicant: Gary
Jacobs) (Case File No. CUP-1994-6).
RECOMMENDATION: Staff concurred with the decision of the
Planning Commission to approve the application, and recommended
that the Notice of Decision be filed.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, the Notice
of Decision be filed. No objection as filed.
CONDITIONAL USE PERMITS 1994 (403-9-5)
12. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 19-94 approving a Cellular Communications Facility at 801
National City Boulevard. (Applicant: Nextel Communications, Inc.)
(Case File No. CUP-1994-8).
RECOMMENDATION: Staff concurred with the decision of the
Planning Commission to approve the application, and recommended
that the Notice of Decision be filed.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, the
Notice of Decision be filed. No objection as filed.

13. SUBJECT: EDCO Shift to Automated City Support.
RECOMMENDATION: Staff recommended the item be filed.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of the two proposals submitted in the Staff report. Carried by
unanimous vote.
SOLID WASTE/TRASH (911-1-4)
14. SUBJECT: Status on Storage Trailer Adjacent to Civic Center.
RECOMMENDATION: Staff recommended the item be filed.
TESTIMONY: None.
ACTION: Motion by Dalla, seconded by Inzunza, the item be
filed. No objection as filed.
TEMPORARY USE PERMITS 1994 (203-1-10)
15. SUBJECT: Temporary Use Permit - La Mesa R.V. Center, Inc.
requests a TUP to conduct a recreational vehicle sale in the parking
lot of Plaza Bonita from 9:00 a.m. to 8:00 p.m. on August 27-28. A
waiver of fees is also requested.
RECOMMENDATION: Staff recommended approval of the
application for a Temporary Use Permit subject to compliance with
all conditions of approval and denial of the request for waiver of the
$345.00 processing fee.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of Staff's recommendation, including denial of the request for
waiver of fees. Carried by unanimous vote.
CLAIM (501-1-100)
16. SUBJECT: Claim for Damages: Ed Botardo.
RECOMMENDATION: Staff recommended the claim be denied
and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, to deny
and refer to the City Attorney. Carried by unanimous vote.

17. SUBJECT: Claim for Damages: Juan Navarro.
RECOMMENDATION: Staff recommended the claim be denied
and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, to deny
and refer to the City Attorney. Carried by unanimous vote.
CLAIM (501-1-100)
18. SUBJECT: Claim for Damages: Julian M. Harmston.
RECOMMENDATION: Staff recommended the claim be denied
and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, to deny
and refer to the City Attorney. Carried by unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY- No report.
OTHER STAFF - No report.
MAYOR
Mayor Waters stated that an item had been submitted this afternoon by
PACNC that requires action this evening as the next regularly scheduled
Council Meeting will occur after the event is scheduled.
ACTION: Motion by Inzunza, seconded by Dalla, to bring the item
onto the Agenda as the need to take action arose after the posting of
the Agenda. Carried by unanimous vote.
Motion by Dalla, seconded by Inzunza, in favor of the request to
serve alcoholic beverages at the PACNC Center on Saturday,
September 3, 1994. Carried by unanimous vote.

CITY COUNCIL
Councilwoman Zarate thanked the Fire and Police Departments, Committee
to Reclaim Our Neighborhoods and citizens involved in the support for and
establishment of the National City CAST program.
Councilman Dalla thanked Councilwoman Zarate for researching and
proposing the CAST program to the Council and Staff. He then requested
Staff look into the series of parking signs on 1st Street adjacent to El Toyon
Park and their inconsistency of requirements.
PUBLIC ORAL COMMUNICATIONS
Richard Sherman, 3400 E. 8th Street, National City, representing the
Citizens Patrol, stated that their members are gathering lists of items
throughout the city that they feel might be violations or things requiring city
action.
Helen Sterling, 2320 E. 16th Street, National City, had to leave the Council
Meeting early - City Clerk Peoples submitted invitations on her behalf to
the Mayor and City Council to attend a dinner regarding the Boys and Girls
State, a program offered by the American Legion.
Kathy Smith, 3023 E. l lth Street, National City, thanked Fire Chief Kimble
for providing 5 radios to the Citizens Patrol. She then made comment and
inquiry regarding the procedure for and placement of pay telephones near
Keith's Restaurant and their usage for illegal purposes and stated that she
had observed people jumping on the bike racks of the National City Transit
busses in order to obtain a free ride.
Closed Session was heard earlier, after Approval of Minutes.
