MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
SEPTEMBER 13, 1994
The Regular Meeting of the City Council of the City of National City was
called to order at 7:01 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Morrison, Zarate, Waters. Absent:
Inzunza.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom McCabe, followed by the invocation by Assistant City Manger Gerald
Bolint.
APPROVAL OF MINUTES
NOTE: Councilman Morrison stated that he would be abstaining on the
approval of the Minutes of the Adjourned Meeting of August 31, 1994.
Motion by Zarate, seconded by Dalla, the Minutes of the Adjourned
Meeting of August 31. 1994 and the Regular Meeting of September 6, 1994
be approved. Carried by the following vote, to -wit: Ayes: Dalla, Zarate,
Waters. Nays: None. Absent: Inzunza.
PRESENTATIONS
COMMUNITY PROMOTION (102-1-3)
Mayor Waters introduced Patricia Barnes (SDG&E) who presented a plaque
to the Mayor and City Council in appreciation for their support for Sweater
Saturday.

PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Dalla, the Proclamation be read in its
entirety. Carried by unanimous vote. Absent: Inzunza.
The Proclamation proclaiming September 22, 1994 to be: "AMERICAN
BUSINESS WOMEN'S DAY" was read aloud in its entirety by Mayor
Waters, who then gave it to the City Manager to forward to the proper
people.
PUBLIC HEARINGS
SEWER CAPACITY/FEES ADMIN (906-1-4)
1. SUBJECT: Public Hearing by the City Council of National City on
the establishment of a fee to finance the Federal and State Mandated
Storm Water Management Program.
RECOMMENDATION: Staff recommended that the Public
Hearing be held, a Resolution authorizing this Fee is also on this
Agenda.
TESTIMONY: None.
Mayor Waters declared the Public Hearing closed.
ACTION: Motion by Morrison, seconded by Dalla, the Public
Hearing be closed. Carried by unanimous vote. Absent:
Inzunza.
NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Zarate, the Non -Consent Resolutions be
read by title only. Carried by unanimous vote. Absent: Inzunza.
CONTRACT (C94-23)
2. Resolution No. 94-131. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
THE CO-PERMITTEE JOINT WET WEATHER MONITORING
AGREEMENT WITH THE CITY OF SAN DIEGO AND
AUTHORIZING THE MAYOR TO EXECUTE SAID
AGREEMENT."

RECOMMENDATION: Staff recommended that Council adopt the
Resolution authorizing the City Engineer to enter into an agreement
with the City of San Diego, as Principal Permittee, for conducting
joint storm water monitoring program for a estimated not -to -exceed
cost of $17,838.04.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of Resolution No. 94-131. Carried by unanimous vote. Absent:
Inzunza.
CITY OF NATIONAL CITY FEE SCHEDULE (106-3-2)
3. Resolution No. 94-132. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AMENDING THE
CITY OF NATIONAL CITY FEE SCHEDULE BY ADDING THE
STORM WATER MANAGEMENT PROGRAM FEE."
RECOMMENDATION: Staff recommended that Council adopt the
Resolution authorizing collection of the fee according to the schedule
provided.
NOTE: The City Attorney requested that the Resolution be
pulled and be brought back as an ordinance.
SOLID WASTE MANAGEMENT ADMIN (911-1-8)
4. Resolution No. 94-133. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY SETTING
PUBLIC HEARING FOR THE NONDISPOSAL FACILITY
ELEMENT OF THE CITY'S WASTE MANAGEMENT PLAN."
RECOMMENDATION: Staff recommended that Council approve
the Resolution setting a public hearing, and directing the City Clerk
to make notification in accord with law.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Dalla, in favor
of Resolution No. 94-133. Carried by unanimous vote. Absent:
Inzunza.

Vice Mayor Inzunza arrived in Council Chambers at 7:12 p.m.
CONTRACT (903-16-2)
5. Resolution No. 94-134. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING
WORK AND AUTHORIZING THE FILING OF THE NOTICE OF
COMPLETION FOR THE WIDENING OF DIVISION STREET
FROM EUCLID AVENUE TO DREXEL AVENUE.
(ENGINEERING SPECS . 93-2)."
RECOMMENDATION: Staff recommended that Council adopt the
Resolution authorizing the acceptance of work and the filing of the
Notice of Completion.
TESTIMONY: None.
ACTION: Motion by Dalla, seconded by Morrison, in favor
of Resolution No. 94-134. Carried by unanimous vote.
ORDINANCES FOR INTRODUCTION
Motion by Dalla, seconded by Morrison, the Ordinances be introduced by
title only. Carried by unanimous vote.
MUNICIPAL CODE 1994 (506-2-9)
6. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AMENDING CHAPTER 1.20 OF THE
NATIONAL CITY MUNICIPAL CODE PERTAINING TO
GENERAL PENALTY."

7. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY ADDING CHAPTER 1.36 TO THE NATIONAL
CITY MUNICIPAL CODE PERTAINING TO ABATEMENT OF
PUBLIC NUISANCES."

WRITTEN COMMUNICATIONS
8. SUBJECT: Letter from David Manriquez requesting Council's input
regarding bringing professional boxing back to National City as a
viewer sport.
NOTE: Mayor Waters stated that Mr. Manriquez had requested his
letter be pulled from the Agenda at this time, as the Radisson Suites
and Holiday Inn had changed ownership.
NEW BUSINESS
WARRANT REGISTERS 1994 (202-1-9)
9. SUBJECT: Warrant Register # 10. Ratification of Demands in the
amount of $288,225.19 (Warrant Nos. 131586 through 131641
inclusive excepting none and Certification of Payroll in the amount of
$409,759.66.
RECOMMENDATION: Staff recommended ratification of these
warrants.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of the Ratification of Demands and Certification of Payroll.
Warrants carried by the following vote, to -wit: Ayes: Dalla,
Inzunza, Morrison, Zarate, Waters. Nays: None. Absent:
None. Abstaining: None.
STREET LIGHTS ADMIN 1994 (903-9-2)
10. SUBJECT: Overhead Street Lighting - Report for Council.
RECOMMENDATION: Staff recommended that the report be
review and filed.
TESTIMONY: Deputy Public Works Director McAvoy gave
a brief verbal overview of the report.
Councilman Morrison requested that the City pursue the
installation of metal halide lighting with San Diego Gas &
Electric for National City Boulevard and Highland Avenue,
revisit the lighting policy and update it to meet current needs,
and look into increasing funding for the dusk -to -dawn lights.
ACTION: No vote taken.

CABLE TV RATE/REGULATIONS ADMIN 1994 (908-2-2)
11. SUBJECT: Status Report submitted by National City Cable.
RECOMMENDATION: Staff recommended that the report be
received and filed. Unless the Council has additional comments or
direction at this point, staff will continue to monitor the situation and
will report back to Council as appropriate.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, the
report be filed. No objection as filed.
LEAGUE OF CALIFORNIA CITIES ADMIN (104-2-1)
12. SUBJECT: Designation of Voting Delegate for League Annual
Conference.
RECOMMENDATION: Staff recommended that Council appoint a
delegate and alternate.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of Assistant City Manager Bolint attending the League Annual
Conference as the Voting Delegate and Planning Director Post
as alternate for the City of National City, Carried by
unanimous vote.
BUDGET FY93-94 (206-1-9)
13. SUBJECT: F.Y. 1993-94 C.I.P. Project Year -End Status Report.
RECOMMENDATION: Staff recommended that the report be
received and filed.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Dalla, the report
be accepted and filed. No objection as filed.
CLAIM (501-1-101)
14. SUBJECT: Claim for Damages: David and Paula Roebuck.
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney.
TESTIMONY: None.

ACTION: Motion by Dalla, seconded by Zarate, to deny and
refer to the City Attorney. Carried by unanimous vote.

PUBLIC ORAL COMMUNICATIONS
Lori Anne Peoples, representing the National City Chamber of Commerce,
invited all to attend the National City Expo Trade Show and Support to
Business Luncheon (Trade Show-FREE/Luncheon-$9.00) on Tuesday,
September 20, 1994 at the new Boys and Girls Club of National City, 1430
D Avenue, National City. She also invited everyone to the Third Annual
"Taste of National City" on September 21, 1994, in Heritage Square - 900
Block of "A" Avenue, National City (Ticket cost-$7.50).
Remedios Basada, 207 E. 7th Street, National City, requested a street light
be installed in the alley near Bank of America and E. 7th Street, and
reported that the ivy needs trimming at 7th Street and B Avenue.
Rita Heuss, 2121 E. 4th Street, National City, spoke regarding El Toyon
Park and the problems occurring there.
Alfonso Hernandez, 2132 Euclid Avenue, National City, requested the City
Council to look into a possible redesign of the parking lot next to the new
Boys and Girls Club lot; reported that a tree branch is growing across a
sidewalk at 19th Street and Harding Avenue; and reported that the Radisson
Suites changed ownership on Friday.

CLOSED SESSION
CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED
LITIGATION
Initiation of litigation pursuant to subsection (c) of Section 54956.9 (One
potential case).
ACTION: Motion by Zarate, seconded by Morrison, in favor
of holding the Closed Session. Carried by unanimous vote.
Council members left the Council Chambers at 7:53 p.m.
Council members returned to the Council Chambers 8:10 p.m.
ROLL CALL
Council members present: Dalla, Inzunza, Morrison, Zarate, Waters.
ADJOURNMENT
Motion by Zarate, seconded by Morrison, to adjourn to the Next Regular
City Council Meeting - September 20, 1994 - 4:00 p.m. - Council
Chambers, Civic Center. Carried by unanimous vote.
The meeting closed at 8:11 p.m.
The foregoing minutes were approved at the Regular Meeting of September
20, 1994.
