HomeMy WebLinkAbout1994 09-27 CC MINBook 76/Page 274 09/27/94 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA SEPTEMBER 27, 1994 The Regular Meeting of the City Council of the City of National City was called to order at 7:02 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Berkuti, Bolint, Eiser, Peoples. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by Assistant City Manager Gerald J. Bolint, followed by the invocation by Councilman Dalla. Mayor Waters requested a moment of silence in honor of Fred Pruitt, Councilman of National City from 1986-1990 who had passed away Monday evening, September 26th. Councilman Dalla provided the invocation which honored Mr. Pruitt. Mayor Waters then stated that the Funeral Services would be Saturday, October 1, 1994, at 1 p.m., at the Bayview Baptist Church, 6126 Benson Avenue, San Diego, with a Memorial Reception beginning between 2:30 and 3:00 p.m. at the National City Boys & Girls Clubs. The Mayor then read into the record a request from Mrs. Pruitt, for the use of the National City Seagraves Fire Truck for the funeral procession. ACTION: Motion by Morrison, seconded by Dalla, to bring the item onto the Agenda as the need to take action arose after the posting of the Agenda. Carried by unanimous vote. Motion by Dalla, seconded by Inzunza, in favor of the request. Carried by unanimous vote. Book 76/Page 275 09/27/94 APPROVAL OF MINUTES Motion by Morrison, seconded by Inzunza, the Minutes of Regular Meeting of September 20, 1994 be approved. Carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Waters. Nays: None. Abstaining: Zarate. Absent: None. BOARDS & COMMISSIONS INTERVIEWS/APPOINTMENTS Mayor Waters turned the meeting over to Vice Mayor Inzunza. Vice Mayor Inzunza introduced Mr. Anthony Portillo, 104 North Belmont Avenue, National City, who explained his interest in serving as a Student Commissioner to the Boards and Commissions of the City of National City, and answered questions of the Council. Vice Mayor Inzunza turned the meeting back over to Mayor Waters. PUBLIC HEARINGS SOLID WASTE MANAGEMENT ADMIN (911-1-8) 1. SUBJECT: Public Hearing - Draft Nondisposal Facility Element Addition to the City's Waste Management Plan. NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff recommended that the Council hold the Public Hearing. TESTIMONY: None. Mayor Waters declared the Public Hearing closed. NON CONSENT RESOLUTIONS Motion by Morrison, seconded by Zarate, the Non -Consent Resolutions be read by title only. Carried by unanimous vote. Book 76/Page 276 09/27/94 NON CONSENT RESOLUTIONS (continued) SOLID WASTE MANAGEMENT ADMIN (911-1-8) 2. Resolution No. 94-138. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE NONDISPOSAL FACILITY ELEMENT OF THE CITY'S WASTE MANAGEMENT PLAN." RECOMMENDATION: Staff recommended that Council adopt the Resolution. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, in favor of Resolution No. 94-138. Carried by unanimous vote. PARKING ADMIN 1994 (801-2-14) 3. Resolution No. 94-139. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE INSTALLATION OF A THREE -MINUTE PASSENGER LOADING ZONE (WHITE CURB AND SIGNS) ON THE SOUTH SIDE OF 28TH STREET FROM "F" AVENUE TO HIGHLAND AVENUE." RECOMMENDATION: Staff recommended that Council adopt the Resolution. TESTIMONY: Louise Martin, 1527 E. 15th Street, National City, member of the National City Traffic Safety Committee, answered questions of the Council. ACTION: Motion by Zarate seconded by Morrison, in favor of Resolution No. 94-139. Carried by unanimous vote. GRANT/LAW ENFORCEMENT (302-1-2) 4. Resolution No. 94-140. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CHIEF OF POLICE TO EXECUTE A GRANT AWARD AGREEMENT FOR THE FIRST YEAR OF THE SERIOUS/VIOLENT JUVENILE OFFENDER PROJECT, AND TO EXECUTE ALL RELATED OPERATIONAL AGREEMENTS AND GRANT DOCUMENTS." Book 76/Page 277 09/27/94 GRANT/LAW ENFORCEMENT (302-1-2) (continued) RECOMMENDATION: Staff recommended that Council approve the Resolution. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Morrison, in favor of Resolution No. 94-140. Carried by unanimous vote. ORDINANCES FOR ADOPTION Motion by Morrison, seconded by Zarate, the Ordinances be read by title only. Carried by unanimous vote. MUNICIPAL CODE 1994 (506-2-9) ABATEMENT WEED 1994 (402-3-4) 5. Ordinance 94-2081. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 1.36 TO THE NATIONAL CITY MUNICIPAL CODE, PERTAINING TO ABATEMENT OF PUBLIC NUISANCES." RECOMMENDATION: Staff recommended that Council adopt the ordinance. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Morrison, in favor of Ordinance No. 94-2081. Carried by unanimous vote. CITY OF NATIONAL CITY FEE SCHEDULE (106-3-2) SEWER CAPACITY FEES/ADMIN (906-1-4) 6. Ordinance 94-2082. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING THE CITY OF NATIONAL CITY FEE SCHEDULE BY ADDING THE STORM WATER MANAGEMENT PROGRAM FEE." RECOMMENDATION: Staff recommended that Council adopt the ordinance. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Zarate, in favor of Ordinance No. 94-2082. Carried by unanimous vote. Book 76/Page 278 09/27/94 OLD BUSINESS POLITICAL SUPPORT (102-4-1) 7. SUBJECT: Letter from Taxpayers Against 187 concerning Proposition 187. Continued from Council meeting of September 20, 1994. TESTIMONY: Tom Oriola, 1774 Gotham Street, Chula Vista, leader of the San Diego County group in opposition to Proposition 187 answered questions of the Council. ACTION: Motion by Inzunza, seconded by Dalla, in favor of the City Council's adoption of Resolution No. 94-141 against Proposition 187. Carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Zarate, Waters. Nays: None. Abstaining: Morrison. Absent: None. WRITTEN COMMUNICATIONS TEMPORARY USE PERMITS 1994 (203-1-10) 8. SUBJECT: Letter from the Filipino American Community of National City regarding serving of alcoholic beverages for private party (wedding) at the Multicultural Service Center. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Inzunza, in favor of the request. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1994 (202-1-9) 9. SUBJECT: Warrant Register #12. Ratification of Demands in the amount of $646,641.42 (Warrant Nos. 131730 through 131810 inclusive excepting none) and Certification of Payroll in the amount of $396,471.59. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Zarate, seconded by Inzunza, in favor of the Ratification of Demands and Certification of Payroll. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Zarate, Waters. Nays: None. Absent: None. Abstaining: None. Book 76/Page 279 09/27/94 TEMPORARY USE PERMITS 1994 (203-1-10) 10. SUBJECT: Request for use of Community Building by United States Institute of Amateur Athletics (USIAA) with waiver of some fees and serving of alcohol. RECOMMENDATION: Staff recommended that Council approve the date of 19 November 1994 for use by USIAA, approve waiver of fees except custodial, approve the sale of alcohol subject to ABC permit, and authorize the event subject to approval of security arrangements by the Police Department. NOTE: Public Works Director Williams stated that there had been an error in the A-200. The USIAA did not request the serving of alcohol. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Inzunza, in favor of the request with Staff's recommendation. Carried by unanimous vote. TEMPORARY USE PERMITS 1994 (203-1-10) 11. SUBJECT: Request to use Community Center and waiver of fees - Salute to Navy Event. RECOMMENDATION: Staff stated that this is considered a City - sponsored event for which no fees are charged, therefore recommended that the use of the facility as requested, without charge, be approved. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Zarate, in favor of the request with Staffs recommendation. Carried by unanimous vote. ASSISTANT CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR- No report. Book 76/Page 280 09/27/94 CITY COUNCIL Councilman Morrison requested the City Attorney look into the setting of Closed Sessions at an earlier meeting time than the regular meeting so not to inconvenience the public who attend the regular meetings. Councilman Dalla made inquiry of Police Captain Deese regarding call backs to loud parties and the billing process. He then provided a citizens suggestion that for calls after midnight, a flat fee be established in order to streamline the process. Councilman Dalla then requested the Public Works Director override the energy saving system so that when they are in Closed Session, the air conditioning remains on. Mayor Waters read into the record the final settlement offer made to the National City Police Officers Association (copy on file in the Office of the City Clerk), and stated that further action was on hold until mid -October. PUBLIC ORAL COMMUNICATIONS Mary Alice Taliack, Executive Director, National City Chamber of Commerce, 711 "A" Avenue, National City, invited all to attend the 30th Annual Salute to Navy event, thanked the Council for their continued support of the event and provided them each with a Salute to Navy Newsletter highlighting the scheduled events. CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION - GOVERNMENT CODE SECTION 54956.9(A) - VELTMAN V. STATE LANDS COMMISSION, CITY OF NATIONAL CITY, ET. AL. ACTION: Motion by Morrison, seconded by Zarate, in favor of holding the Closed Session under Government Code Section 54956.9(A). Carried by unanimous vote. Council members left the Council Chambers at 8:01 p.m. Council members returned to the Council Chambers 8:13 p.m. Book 76/Page 281 09/27/94 ROLL CALL Council members present: Dalla, Inzunza, Morrison, Zarate, Waters. ADJOURNMENT Motion by Zarate, seconded by Morrison, to adjourn to the Next Regular City Council Meeting - October 4, 1994 - 4:00 p.m. - Council Chambers, Civic Center. Carried by unanimous vote.
