MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
OCTOBER 25, 1994
The Regular Meeting of the City Council of the City of National City was
called to order at 7:02 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, McCabe, Myers, Peoples.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Councilman Dalla.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Regular
Meeting of October 18, 1994 be approved. Carried by unanimous vote.
CONSENT CALENDAR
ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 94-152
through 94-158). NOTE: Item No. 6, Resolution No. 94-157 was requested
to be pulled by a member of the audience. Motion by Morrison, seconded
by Zarate, in favor of the Consent Calendar (except Item No. 6, Resolution
No. 94-157). Carried by unanimous vote.

THE CHIEF OF POLICE TO SUBMIT A SERIOUS/VIOLENT
JUVENILE OFFENDER PROJECT PROPOSAL TO OCJP AND TO
EXECUTE THE GRANT AWARD AGREEMENT AND ALL
RELATED OPERATIONAL AGREEMENTS AND GRANT
DOCUMENTS, AND RESCINDING RESOLUTION NO. 94-140."
ACTION: Adopted. See above.
EQUIPMENT PURCHASE ADMIN (209-1-1)
6. Resolution No. 94-157. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING THE
BID OF CONTRACTOR'S EQUIPMENT COMPANY AND
AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT
WITH CONTRACTOR'S EQUIPMENT COMPANY FOR THE
PURCHASE OF ONE CASE BACKHOE."
TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue,
National City, made inquiry of Staff regarding the proposed
purchase.
ACTION: Motion by Dalla, seconded by Morrison, in favor
of Resolution No. 94-157. Carried by unanimous vote.
NEW BUSINESS
WARRANT REGISTERS 1994 (202-1-9)
8. SUBJECT: Warrant Register #16. Ratification of Demands in the
amount of $186,806.07 (Warrant Nos. 132068 through 132137
inclusive excepting 132097) and Certification of Payroll in the
amount of $376,450.52.
RECOMMENDATION: Staff recommended ratification of these
warrants.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of the Ratification of Demands and Certification of Payroll.
Warrants carried by the following vote, to -wit: Ayes: Dalla,
Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining:
None. Absent: None.

MUNICIPAL CODE 1994 (506-2-9)
BUSINESS LICENSE ADMIN (203-5-1)
9. SUBJECT: A Public Meeting to consider Amending Chapter 6.20 of
the National City Municipal Code and amending Ordinance No. 93-
2062 concerning Residential Rental Tax.
RECOMMENDATION: Staff recommended that council accept
input from members of the public and City Council. Final action will
be taken at public hearing on November 22, 1994.
TESTIMONY: J. Stewart Potter, 2323 "D" Avenue, National
City, representing the S.D.C.C.A. and AFL-CIO Building
Trades Corporation commended Staff and Council for their
assistance in reaching what he felt to be a good compromise.
Ted Smith, 2225 Camino del Rio So., San Diego, representing
the S.D.C.C.A., also spoke in support of the compromise
measure and commended Staff for their work.
ACTION: Motion by Inzunza, seconded by Dalla, the report
be accepted and filed. Carried by unanimous vote.
FIRE DEPARTMENT ADMIN (305-1-1)
10. SUBJECT: Request for Public Fireworks display by Sweetwater
Union High School.
RECOMMENDATION: Staff recommended that council approve
the fireworks display permit.
TESTIMONY: None.
ACTION: Motion by Dalla, seconded by Morrison, in favor
of the request. Carried by unanimous vote.

MAYOR
Mayor Waters stated that the Court had granted a Summary Judgment in
favor of the Port District with regards to the National City Marina Project.
He then spoke regarding a mayoral candidate's (Bryson) political flyer,
signed by National City Police Officers' Association spokesperson Lanny
Roark which included a city phone number. He requested the City Attorney
refer this to the FPPC and the Public Works Director disconnect the number
immediately.
CITY COUNCIL
Vice Mayor Inzunza stated that the credit for a job well done on the
Residential Rentals item should go to Terri Bettencourt, Revenue &
Recovery Coordinator.
Councilman Morrison echoed Vice Mayor Inzunza with regards to Ms.
Bettencourt and the hard work she put in on the Residential Rental item. He
then made inquiry of the Police Chief as to the staffing of the Photo Radar
program, and expressed his opinion on the passage of a public safety
funding bill, proposed by Willie Brown (AB2788), that was proposed to
increase public safety, but will hurt National City because it takes away our
Proposition 172 money, depriving us of approximately $65,000. allocated
for public safety.
Councilman Dalla made an inquiry regarding the lights being out on I-5
which he had previously requested be looked into. He then requested the
Police Chief meet with the National School District Superintendent and the
City Manager regarding the status of the DARE and JOG programs, as some
miscommunication had apparently taken place.
Councilman Morrison stated that at a recent forum, citizens requested an
environmental review board be established, and went on to explain that
there already was one in National City made up of the Fire Chief, Council
members, Staff, the County Health Department, etc. They have been
working with the Navy, who recently completed their environmental clean-
up of the site at the end of Civic Center Drive, where it ties into Tidelands
Avenue. It was a storage site for transformers, most of which contained
PCBs, which had been leaking.

PUBLIC ORAL COMMUNICATIONS
Aim Pietila, 818 Olive Avenue, National City, made inquiry of the EDCO
Silver Bag program.
Larry Beck, 13420 Orange Blossom, Poway, representing the N.C.F.F.A.
thanked Council for their support in filling the vacant positions within their
department and invited all present to attend their 1st Annual Spirit of the
Holidays Breakfast, Saturday, October 29th at the fire station (16th & D)
from 8:30 to 11:00 a.m. Tickets are $3.50 and will benefit the Spirit of the
Holidays toy/food drive.
Alfonso Hernandez, 2132 Euclid Avenue, National City, made inquiry of
Councilman Morrison as to where the items removed by the Navy during
their clean up were taken, made inquiry of Staff regarding the new EDCO
bins and a problem with a missed trash pick up and provided information on
a possible safety hazard at Division and Euclid on the south side which
could use red curbing.
Councilman Morrison reminded everyone that the second annual free trash
haul day was this Saturday, October 29th from 7:00 a.m. to 2:00 p.m. at
32nd and Tidelands Avenue.

ACTION: Motion by Inzunza, seconded by Zarate, in favor of
holding the Closed Session per Government Code Section
54956.9(a). Carried by unanimous vote.
Council members left the Council Chambers at 7:40 p.m.
Council members returned to the Council Chambers at 9:27 p.m.

City Attorney George Eiser gave a brief report on the item in compliance
with the Brown Act (copy on file in the office of the City Clerk).

Motion by Dalla, seconded by Morrison, in favor of the report and to
adjourn to the Next Regular City Council Meeting - November 1, 1994 -
4:00 p.m. - Council Chambers, Civic Center, Carried by unanimous vote.
