HomeMy WebLinkAbout1994 11-22 CC MINBook 76/Page 328 11/22/94 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA NOVEMBER 22, 1994 The Regular Meeting of the City Council of the City of National City was called to order at 7:00 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Eiser, McCabe, Myers, Peoples. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Morrison, seconded by Inzunza, the Minutes of the Regular Meeting of November 15, 1994 be approved. Carried by unanimous vote. INTERVIEWS/APPOINTMENTS CIVIL SERVICE COMMISSION (101-9-1) Mayor Waters recommended that Kathleen J. Smith be re -appointed to the Civil Service Commission for a term ending September 30, 1999. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the Mayor's recommendation. Carried by unanimous vote. PUBLIC HEARINGS MUNICIPAL CODE 1994 (506-2-9) BUSINESS LICENSE ADMIN (203-5-1) 1. SUBJECT: Public Hearing - A Public Hearing and Ordinance amending portions of Chapter 6.20 of the National City Municipal Code, amending Section 4 of Ordinance No. 1407, and amending Section 2 of Ordinance No. 93-2062, concerning residential rentals. Book 76/Page 329 11/22/94 PUBLIC HEARING (continued) NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff recommended that Council enact the proposed Ordinance. NOTE: Councilwoman Zarate stated that she would be abstaining on the item as she owns an apartment complex. TESTIMONY: Revenue & Recovery Coordinator Terri Bettencourt provided a brief overview of the item and answered questions of the Council. Councilman Inzunza expressed a "huge amount of gratitude" to Terri Bettencourt, Revenue & Recovery Coordinator, for her work on this item and assistance in reaching a consensus between the city and apartment owners/managers. Lee Harvey, representing the San Diego County Apartment Owners Association, 5235 Glenview Place, Bonita, expressed appreciation to the Mayor, Council, Staff and Ms. Bettencourt for communicating and working with them to reach an amicable agreement. ACTION: Mayor Waters declared the Public Hearing closed. Motion by Morrison, seconded by Inzunza, to close the Public Hearing and in favor of bringing Agenda Item No. 6, Ordinance No. 94-2085 forward for introduction by title only. Carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Waters. Nays: None. Abstaining: Zarate. Absent: None. Agenda Item No. 6, Ordinance No. 94-2085, was heard at this time. Book 76/Page 330 11/22/94 MUNICIPAL CODE 1994 (506-2-9) BUSINESS LICENSE ADMIN (203-5-1) 6. Ordinance No. 94-2085. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING PORTIONS OF CHAPTER 6.20 OF THE NATIONAL CITY MUNICIPAL CODE, AMENDING SECTION 4 OF ORDINANCE NO. 1407, AND AMENDING SECTION 2 OF ORDINANCE NO. 93-2062, CONCERNING RESIDENTIAL RENTALS." NOTE: City Attorney Eiser stated that this Ordinance could be adopted this evening and would become effective immediately. Councilwoman Zarate stated she would be abstaining as she owns an apartment complex. ACTION: Motion by Morrison, seconded by Inzunza, in favor of adoption of Ordinance No. 94-2085 by title only. Carried by the following vote to -wit: Ayes: Dalla, Inzunza, Morrison, Waters. Nays: None. Abstaining: Zarate. Absent: None. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 94-167 through 94-170). NOTE: Mayor Waters stated that he wanted to pull Agenda Item No. 5, Resolution No. 94-170. ACTION: Motion by Dalla, seconded by Inzunza, in favor of the Consent Resolutions (except Item No. 5, Resolution No. 94-170). Carried by unanimous vote. CONTRACT (C94-17) 2. Resolution No. 94-167. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION AND APPROVAL OF CHANGE ORDER NO. 1 FOR THE SWEETWATER ROAD IMPROVEMENTS AND SWEETWATER RIVER BIKE LANE PROJECT. (ENGINEERING SPECS. NO. 94-6)." ACTION: Adopted. See above. Book 76/Page 331 11/22/94 CONSENT CALENDAR (continued) CONTRACT (C94-18) 3. Resolution No. 94-168. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING CONTRACT CHANGE ORDER NO. 1 TO THE CONTRACT WITH DOUG KOST KONSTRUCTION FOR THE CONSTRUCTION OF MISCELLANEOUS CURBS, GUTTERS, SIDEWALKS, CROSS -GUTTERS, PAVEMENTS AND PEDESTRIAN RAMPS IMPROVEMENTS AT VARIOUS LOCATIONS PROJECT (ENGINEERING SPECS. NO. 94-12)." ACTION: Adopted. See above. CONTRACT (C94-28) 4. Resolution No. 94-169. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH DOKKEN ENGINEERING, INC. TO PROVIDE ENGINEERING AND ENVIRONMENTAL SERVICES FOR THE REPLACEMENT OF THE NATIONAL CITY BOULEVARD BRIDGE SOUTH OF 35TH STREET." ACTION: Adopted. See above. CONTRACT (C94-29) 5. Resolution No. 94-170. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A SEWER AGREEMENT AND AN OUTDOOR MAINTENANCE AGREEMENT, FOR THE PROPERTY AT THE SOUTHWEST CORNER OF 3OTH STREET AND NORTH SECOND AVENUE." NOTE: City Attorney Eiser advised the Council that a correction was requested to pages 5 and 6 of the Agreement, as paragraphs one and two of Section 8 had been requested to be deleted after discussion with the Chula Vista City Attorney. ACTION: Motion by Inzunza, seconded by Zarate, in favor of Resolution No. 94-170 with the correction noted by the City Attorney. Carried by unanimous vote. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING PORTIONS OF CHAPTER 6.20 OF THE NATIONAL CITY MUNICIPAL CODE, AMENDING SECTION 4 OF ORDINANCE NO. 1407, AND AMENDING SECTION 2 OF ORDINANCE NO. 93-2062, CONCERNING RESIDENTIAL RENTALS." MUNICIPAL CODE 1994 (506-2-9) SEWER CAPACITY/FEES ADMIN (906-1-4) 7. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 14.22 TO THE NATIONAL CITY MUNICIPAL CODE PERTAINING TO "STORMWATER MANAGEMENT AND DISCHARGE CONTROL." ORDINANCES FOR ADOPTION Motion by Morrison, seconded by Zarate, the Ordinances be adopted by title only. Carried by unanimous vote. REDEVELOPMENT/DOWNTOWN PROJECT (411-1-1) 8. Ordinance No. 94-2086. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ESTABLISHING AND AMENDING TIME LIMITS IN THE NATIONAL CITY DOWNTOWN REDEVELOPMENT PROJECT AREA." RECOMMENDATION: Staff recommended that council adopt the Ordinance. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, in favor of Ordinance No. 94-2086. Carried by unanimous vote. Book 76/Page 333 11/22/94 MUNICIPAL CODE 1994 (506-2-9) TELEPHONE SYSTEM CITY (908-1-1) 9. Ordinance No. 94-2087. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING ORDINANCE NO. 94-2084 TO RENUMBER CHAPTER 10.22, ENTITLED "PUBLIC PAY TELEPHONE REGULATIONS," TO CHAPTER 10.25." RECOMMENDATION: Staff recommended that council adopt the Ordinance. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, in favor of Ordinance No. 94-2087. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1994 (202-1-9) 10. SUBJECT: Warrant Register #20. Ratification of Demands in the amount of $230,359.25 (Warrant Nos. 132369 through 132456 inclusive excepting none) and Certification of Payroll in the amount of $377,672.15. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Zarate, seconded by Morrison, in favor of the Ratification of Demands and Certification of Payroll. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. Book 76/Page 334 11/22/94 MAYOR Mayor Waters read into the record a letter received from Foodland/IGA expressing thanks to the Police Department and its officers for "a job well done" during a recent robbery attempt (copy on file in the office of the City Clerk). CITY COUNCIL Councilman Dalla requested the Police Chief provide an update on the staffing situation. Councilwoman Zarate referred a tree trimming request to staff for Mr. Kino Macias at 440 I Avenue. She also provided an update for all in attendance, that a spaghetti dinner will be held in the National City Community Center on December 1, 1994, from 5 p.m. to 7:30 p.m., for city employee Kathy O'Brien, whose husband was murdered recently. Tickets are $7. SOLID WASTE/TRASH (911-1-4) 11. SUBJECT: Regional Trash Assessment District. TESTIMONY: Vice Mayor Morrison provided a report on the proposed Regional Trash Assessment District. Alfonso Hernandez, 2132 Euclid Avenue, National City, made inquiry of the Council and expressed his opinion on the issue. ACTION: Motion by Inzunza, seconded by Zarate, to authorize Vice Mayor Morrison to advise the County Board of Supervisors of their support of the establishment of a Regional Trash Assessment District. Carried by unanimous vote. PUBLIC ORAL COMMUNICATIONS - None. ADJOURNMENT Motion by Inzunza, seconded by Zarate, to dispense with the Regular City Council Meeting of December 6, 1994 at 4:00 p.m. and adjourn to December 6, 1994 at 7:00 p.m. - Next Regular City Council Meeting - December 13, 1994 - 7:00 p.m, Council Chambers, Civic Center. Carried by unanimous vote.
