ROLL CALL Council members present: Dalla, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Berkuti, Bolint, Eiser, McCabe, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Morrison, seconded by Zarate, the Minutes of the Regular Meeting of November 22, 1994 be approved. Carried by unanimous vote. Item Nos. 5 and 6 were heard at this time. NEW BUSINESS WARRANT REGISTERS 1994 (202-1-9) 5. SUBJECT: Warrant Register #21. Ratification of Demands in the amount of $343,526.06 (Warrant Nos. 132458 through 132507 inclusive excepting none). RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Morrison, seconded by Waters, in favor of the Ratification of Demands. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. Book 76/Page 337 12/06/94 WARRANT REGISTERS 1994 (202-1-9) 6. SUBJECT: Warrant Register #22. Ratification of Demands in the amount of $91,506.49 (Warrant Nos. 132509 through 132553 inclusive excepting none) and Certification of Payroll in the amount of $391,759.28. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Morrison, seconded by Waters, in favor of the Ratification of Demands and Certification of Payroll. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. BUSINESS RELATING TO GENERAL MUNICIPAL ELECTION, NOVEMBER 8, 1994 Motion by Inzunza, seconded by Morrison, the resolution be introduced by title only. Carried by unanimous vote. ELECTION 11-8-94 (505-08-03) 1. Resolution No. 94-171. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 1994, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW." RECOMMENDATION: Staff recommended that Council approve the resolution. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, in favor of Resolution No, 94-171. Carried by unanimous vote. Mayor Waters made a presentation to outgoing City Council member Michael Dalla. Mr. Dalla spoke regarding his twenty years on the Council, and thanked Council, Staff, and the citizens of National City for their support and friendship. Book 76/Page 338 12/06/94 City Clerk Lori Anne Peoples administered the Oath of Office to re-elected Mayor Waters, and presented him with a Certificate of Election. City Clerk Peoples then introduced re-elected Councilwoman Zarate, and newly -elected Councilman Beauchamp, administered their Oaths of Office, and presented them with Certificates of Election. First Lady Vickie Waters presented a crystal eagle to Mayor Waters. Councilman Beauchamp introduced his wife, family and business associates present in the audience. Councilwoman Zarate introduced her family members present in the audience. Mayor Waters introduced his son Jim who was present in the audience. Councilman Beauchamp thanked his supporters and pledged to serve the community. ROLL CALL OF THE NEW CITY COUNCIL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Re-elected Councilwoman Zarate and Mayor Waters addressed the Council, Staff and citizens. Mayor Waters called a recess. Council members left the Council Chambers at 7:48 p.m. Council members returned to the Council Chambers at 8:20 p.m. Book 76/Page 339 12/06/94 ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Item No. 10 was heard at this time. SOLID WASTE/TRASH (911-1-4) CONTRACT (C90-26) 10. SUBJECT: Recommendation for modification to EDCO Silver Bag Trash Program. RECOMMENDATION: Staff recommended that Council approve the elimination of yard waste pick-up for silver bag subscribers effective January 1, 1995. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, to lay this item over for one week. Carried by unanimous vote. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 94-172 through 94-173). ACTION: Motion by Inzunza, seconded by Morrison, in favor of the Consent Resolutions. Carried by unanimous vote. SOLID WASTE/HAZARDOUS (911-1-7) 2. Resolution No. 94-172. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DESIGNATING THE SAN DIEGO COUNTY DEPARTMENT OF ENVIRONMENTAL HEALTH AS THE UNIFIED PROGRAM AGENCY FOR HAZARDOUS WASTE AND HAZARDOUS MATERIALS MANAGEMENT." ACTION: Adopted. See above. Book 76/Page 340 12/06/94 ENCROACHMENT AGREEMENT ADMIN (903-14-1) 3. Resolution No. 94-173. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AND AUTHORIZING THE RECORDATION OF AN ENCROACHMENT AGREEMENT WITH SCIENCE AND ENGINEERING ANALYSIS CORP. D/B/A SEACOR FOR THE INSTALLATION OF ONE MONITORING WELL AT 8TH, WEST OF PLAZA BOULEVARD." ACTION: Adopted. See above. ORDINANCES FOR ADOPTION Motion by Morrison, seconded by Zarate, the Ordinance be read by title only. Carried by unanimous vote. MUNICIPAL CODE 1994 (506-2-9) SEWER CAPACITY FEES/ADMIN (906-1-4) 4. Ordinance No. 94-2088. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 14.22 TO THE NATIONAL CITY MUNICIPAL CODE PERTAINING TO THE "STORMWATER MANAGEMENT AND DISCHARGE CONTROL." RECOMMENDATION: Staff recommended that council adopt the proposed ordinance. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Zarate, in favor of Ordinance No. 94-2088. Carried by unanimous vote. Mayor Waters recognized Jess Van Deventer, National City Port Commissioner, 1706 Prospect Street, National City, who addressed the Mayor and City Council and presented them with 1995 pocket calendars. CONDITIONAL USE PERMITS (403-9-7) 7. SUBJECT: Notice of Decision - Planning Commission Resolution No. 29-94 approving a Conditional Use Permit for the sale of beer and wine within a restaurant at 2503 Sweetwater Road. (Case File No. CUP-1994-11). (Applicant: Rafael Gonzalez). RECOMMENDATION: Staff concurred with the decision of the Planning Commission to approve the application, and recommended that the Notice of Decision be filed. ACTION: Motion by Inzunza, seconded by Waters, the. Notice of Decision be filed. Vice Mayor Morrison requested that this item be held over for review by Planning Staff for current compliance with conditions. Motion withdrawn by maker and second. NOTE: Planning Director Post advised Council that they legally had two options: file the item or set for Public Hearing. General discussion ensued. ACTION: Motion by Inzunza, seconded by Waters, the Notice of Decision be filed. Carried by the following vote, to - wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: Beauchamp. Abstaining: None. Absent: None. Book 76/Page 342 12/06/94 STREET TREE AND PARKWAY COMMITTEE (101-2-1) 8. SUBJECT: Street Tree Committee Minutes. RECOMMENDATION: Staff recommended approval of the minutes. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, in favor. Carried by unanimous vote. SOLID WASTE/TRASH (911-1-4) CONTRACT (C90-26) 9. SUBJECT: Request for Waiver of Trash Subscription Requirement - Zertuche. RECOMMENDATION: Staff recommended denial of the request for waiver. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, In favor of Staff's recommendation to deny the waiver. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: Beauchamp. Abstaining: None. Absent: None. Item No. 10 was heard earlier, after the recess. SOLID WASTE/TRASH (911-1-4) CONTRACT (C90-26) 10. SUBJECT: Recommendation for modification to EDCO Silver Bag Trash Program. ENCROACHMENT AGREEMENT ADMIN (903-14-1) 11. SUBJECT: Request direction from the City Council for the issuance of an Encroachment Permit for a sign at 340 National City Boulevard. RECOMMENDATION: Staff requested direction from the City Council on the issuance of an Encroachment Permit. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Waters, in favor. Carried by unanimous vote. Book 76/Page 343 12/06/94 COMMUNITY PROMOTION (102-1-3) 12. SUBJECT: Request for approval - Food for Fare Days. RECOMMENDATION: Staff recommended approval. TESTIMONY: A. Rios Jr., National City Transit, answered questions of the Council. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the request. Carried by unanimous vote. COMMUNITY PROMOTION (102-1-3) 13. SUBJECT: Request by the National City Firefighters' Association to use the 1925 Seagraves Fire Truck. RECOMMENDATION: Staff recommended approval of the request as submitted. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, in favor. Carried by unanimous vote. COUNCIL MEETINGS REGS/SCH ADMIN (102-7-1) 14. SUBJECT: City Council Meetings - Holiday Season Recess. RECOMMENDATION: Staff recommended that the City Council declare a holiday season Council meeting recess on Tuesday, December 27, 1994 and Tuesday, January 3, 1995. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. Book 76/Page 344 12/06/94 MAYOR Mayor Waters stated that requests to serve alcoholic beverages by the National School District and the Pilipino American Community of National City were received after the posting of the Agenda, and requested that the items be brought onto the Agenda. ACTION: Motion by Inzunza, seconded by Zarate, to bring these items onto the Agenda, as the need to take action arose after the posting of the Agenda. Carried by unanimous vote. TEMPORARY USE PERMITS 1994 (203-1-10) 15. SUBJECT: City Librarian and Board Member of National School District Anne Campbell requested the serving of alcoholic beverages at a Christmas party in the National City Community Center on December 13, 1994, which was inadvertently left off the previously approved application, and answered questions of the Council ACTION: Motion by Inzunza, seconded by Waters, in favor. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: Beauchamp. Abstaining: None. Absent: None. 16. SUBJECT: Bert Andrade, 1609 Casa Place, National City, representing PACNC, answered questions of the Council regarding the serving of alcoholic beverages at several events in their Center as submitted in his letter dated December 5, 1994, and requested an extension of the hours of operation (on New Year's Eve only) from 12 p.m. to 1 a.m. (copy on file in the office of the City Clerk). ACTION: Motion by Inzunza, seconded by Zarate, in favor of the request. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: Beauchamp. Abstaining: None. Absent: None. The Mayor read into the record a report regarding a citizen inquiry/comment on the need for a crosswalk and lighting in front of the Senior Towers. Book 76/Page 345 12/06/94 MAYOR (continued) He also announced that the National City Middle School "Music in Motion" will be performing at 10 a.m. Thursday, December 8, 1994, in the Council Chambers. CITY COUNCIL Councilwoman Zarate requested that Staff review the recent increase in sidewalk sales: Produce stand on Highland between 3rd and 4th Streets, Lace for Less by Lucky Market on Highland and a furniture store at the same site. She also thanked all those involved in the O'Brien fund-raiser, including the Municipal Employees Association, the Firefighters Association, and Police Officers Association; over $2,000. was raised. She then reported that the ovens in the Community Center kitchen had been left dirty by prior users. Vice Mayor Morrison reported on SANDAG action regarding reactivation of rail lines within the city, and made inquiry as to the representation of our city on the committee. He also congratulated the Chula Vista Mayor for purchasing a new car on the National City Mile of Cars. Councilman Inzunza commended Councilwoman Zarate for organizing the committee and creating such a wonderful event for the O'Brien Family. He welcomed his new colleague Mitch Beauchamp and returning colleague Rosalie Zarate. He then made inquiry regarding a memorandum stating that he & Mr. Beauchamp were to serve on the City Fee Committee, and requested a meeting to review what committees are standing, and see who wants to or has expertise to serve on what. Councilman Beauchamp requested a consensus of Council that the City establish a protocol to introduce new employees at a meeting of the City Council if they wish to be introduced. Council concurred and agreed that the first such set of introductions for employees hired in the last year would occur at the December 20, 1994 Council meeting. He expressed concurrence with a suggestion to meet and discuss committees, and expressed concerns with sidewalk sale and regulation enforcement, and requested a review in the future with perhaps changes to meet the community's needs. Book 76/Page 346 12/06/94 Councilwoman Zarate left the Council Chambers at 9:25 p.m. PUBLIC ORAL COMMUNICATIONS Richard Sherman, 1236 E. 16th Street, National City, thanked the City Council for the approval of the use of the Fire Truck on December 18th for the toy drive. Councilwoman Zarate returned to the Council Chambers at 9:29 p.m. Mary Alice Taliak, Executive Director, National City Chamber of Commerce, 711 A Avenue, National City, congratulated the Mayor and Councilwoman Zarate in their reelection, and congratulated new Councilman Mitch Beauchamp. She also reminded everyone of the Holiday Decoration Contest, judging on December 10th and l lth, with awards to be presented on December 12, 1994 at Hometown Buffet for the best residential and commercial entries, and the Chamber unit in the Holiday Bowl Parade on December 30th. Louise Martin, 1527 E. 15th Street, National City, welcomed Mitch Beauchamp and expressed her opinions on Council policy and Council discussions prior to the meetings. Everett Dickson, 2745 E. 14th Street, National City, expressed concerns on a neighbor at 2739 E. 14th Street, National City, who does not have EDCO trash pick-up. Matias Garcia, 2231 Van Ness Avenue, National City, provided a diagram of his neighborhood and the locations of illegal dumping in the alley between Van Ness and Rachael, between Harbison and 20th Street, which is affecting his neighborhood and quality of life, and requested assistance to remedy the situation. He also provided photos of several repeated Building Code violations (converted garages, etc.) within his neighborhood, and expressed concerns with the passive enforcement of same. Book 76/Page 347 12/06/94 PUBLIC ORAL COMMUNICATIONS (continued) Vice Mayor Morrison expressed his opinion on the need for review of Code Enforcement items. Alfonso Hernandez, 2132 Euclid Avenue, National City, reported that the businesses at the entrance to National City, at Osborne, 1st Street and National City Blvd. are using the city sidewalk for parking. He thanked Mr. Garcia for being an active, concerned citizen regarding his neighborhood and identified 17th Street, and Harbison from 24th to 20th Streets as sites needing review of dumping problems. He encouraged Council members to do more homework on agenda item, and spoke regarding the senior trash bag program. Councilman Beauchamp thanked Alfonso Hernandez, Rosalie Zarate, and Pete Flores for their clean, positive campaigns.
