HomeMy WebLinkAbout1995 02-28 CC MINBook 77/Page 66 02/28/95 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA FEBRUARY 28, 1995 The Regular Meeting of the City Council of the City of National City was called to order at 7:00 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Daniels, Eiser, McCabe, Myers, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Morrison. APPROVAL OF MINUTES Motion by Inzunza, seconded by Zarate, the Minutes of the Regular Meeting of February 21, 1995 be approved. Carried by unanimous vote. Mayor Waters deviated from the agenda and presented a bottle of water to each Councilmember, since he had received recent complaints about the taste of the City water. PRESENTATIONS SANDAG BICYCLE FACILITIES STUDY (105-3-1) BICYCLE PATH/TRAINS PLANNING (802-4-1) Stephan M. Vance, Senior Transportation Planner for SANDAG, presented a slide show that described the bikeway, the SANDAG Bayshore Bikeway Policy Advisory Committee's efforts to date, and the projects they are working to implement. Mr. Vance then answered questions of the Council. Book 77/Page 67 02/28/95 PROCLAMATIONS (102-2-1) Motion by Morrison, seconded by Inzunza, the Proclamation be read in its entirety. Carried by unanimous vote. The Proclamation proclaiming February 28, 1995 to be: "SPAY DAY USA" was read in its entirety by Mayor Waters, who then presented it to Candy Shuman of the San Diego Department of Animal Control. BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS Mayor Waters turned the meeting over to Vice Mayor Morrison. BUILDING ADVISORY & APPEALS BOARD (101-10-1) Mayor Waters recommended that Mr. Raymond R. Duke and Mr. Roy G. Fierro be re -appointed to the Building Advisory & Appeals Board for full terms ending February 28, 1999. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the Mayor's recommendation to appoint Mr. Duke to the Building Advisory & Appeal Board. Carried by unanimous vote. Motion by Inzunza, seconded by Zarate, in favor of the Mayor's recommendation to appoint Mr. Fierro to the Building Advisory & Appeal Board. Carried by unanimous vote. The Oath of Office was administered to Mr. Duke. Vice Mayor Morrison turned the meeting back over to Mayor Waters. PUBLIC HEARINGS CONDITIONAL USE PERMITS 1995 (403-9-11) 1. SUBJECT: Public Hearing - Conditional Use Permit to allow live entertainment within a restaurant at 933 Harbison Avenue. (Applicant: Alfonso U. Tojino, Jr.). (Case File No. CUP-1994-15). Book 77/Page 68 02/28/95 CONDITIONAL USE PERMITS 1995 (403-9-11) (continued) RECOMMENDATION: Staff concurred with the decision of the Planning Commission to deny the application, and recommended that the application be denied. TESTIMONY: Eddie Alaysa, 6865 Simi Pl., San Diego, spoke in support of the request. Arnold Tojino, 8380 Cacus St., Spring Valley, spoke in support of the request and answered questions of the Council. Kathy Smith, 3028 E. 1 lth St., National City, spoke in opposition of the request. Alfonso Tojino Jr., 935 E. Harbison Ave., National City, spoke in support of the request. Councilman Inzunza left the Council Chambers at 8:12 p.m. Councilman Inzunza returned to the Council Chambers at 8:14 p.m. Louise Martin, 1527 E. 15th St., National City, spoke in opposition to the request. ACTION: Mayor Waters declared the Public Hearing closed. Motion by Zarate, seconded by Waters, in favor of denial per Planning Commission recommendation based on the findings in the Planning Commission Resolution. Carried by unanimous vote. NON CONSENT RESOLUTIONS Motion by Morrison, seconded by Zarate, the Non Consent Resolutions be read by title only. Carried by unanimous vote. LABOR RELATIONS CITY CLERK (605-9-1) 2. Resolution No. 95-29. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DEFINING THE POSITION OF THE ELECTED CITY CLERK." TESTIMONY: None. ACTION: Motion by Zarate, seconded by Inzunza, in favor of Resolution No. 95-29. Carried by unanimous vote. Book 77/Page 69 02/28/95 LABOR RELATIONS CITY CLERK (605-9-1) 3. Resolution No. 95-30. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY FIXING COMPENSATION FOR THE POSITION OF THE ELECTED CITY CLERK OF THE CITY OF NATIONAL CITY." TESTIMONY: None. ACTION: Motion by Zarate, seconded by Inzunza, in favor of Resolution No. 95-30. Carried by unanimous vote. CONTRACT (C95-8) GRANT/LAW ENFORCEMENT (302-1-2) 4. Resolution No. 95-31. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CHIEF OF POLICE TO ENTER INTO AN OPERATIONAL AGREEMENT WITH THE COUNTY OF SAN DIEGO FOR THE SERVICES OF A PROBATION OFFICER AS PART OF THE OCJP GRANT - FUNDED SERIOUS VIOLENT JUVENILE OFFENDERS PROGRAM." TESTIMONY: National City Police Chief Kent Reesor introduced Sgt. Iglesias who gave a brief overview of the program and answered questions of the Council. ACTION: Motion by Morrison, seconded by Zarate, in favor of Resolution No. 95-31. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1994 (202-1-9) 5. SUBJECT: Warrant Register #32. Ratification of Demands in the amount of $236,940.87 (Warrant Nos. 133366 through 133435 inclusive excepting none) and Certification of Payroll in the amount of $403,132.72. RECOMMENDATION: Staff recommended ratification of these warrants. Book 77/Page 70 02/28/95 WARRANT REGISTERS 1994 (202-1-9) (continued) ACTION: Motion by Zarate, seconded by Inzunza, in favor of the Ratification of Demands and Certification of Payroll. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. CLAIM (501-1-101) 6. SUBJECT: Claim for Damages: Luis Hernandez, Jr. RECOMMENDATION: Staff recommended that the claim be denied and referred to the City Attorney. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Inzunza, to deny and refer the item to the City Attorney. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY MUNICIPAL CODE 1995 (506-2-10) 7. SUBJECT: Regulation of Alcoholic Beverages. TESTIMONY: None. ACTION: No action taken. OTHER STAFF - No report. MAYOR - No report. Book 77/Page 71 02/28/95 CITY COUNCIL Councilwoman Zarate provided Council with a handout (copy on file in the Office of the City Clerk) and requested the item of SANDAG reimbursement agreement with the MTDB be brought onto the Agenda as the need to take action arose after the posting of the Agenda. ACTION: Motion by Inzunza, seconded by Morrison, to bring the item onto the Agenda as the need to take action arose after the posting of the Agenda. Carried by unanimous vote. Motion by Inzunza, seconded by Morrison, to hold this item over for one week. Carried by unanimous vote. Councilman Beauchamp spoke regarding correspondence he had received from the Environmental Health Coalition and their efforts to get support from Governor Wilson by March 6, 1995 for the establishment of San Diego Bay as a National Estuary. Vice Mayor Morrison provided a brief update on the County Board of Supervisors meeting and the financial situation of the County of San Diego, and the possible negative effect on the City. He then stated that a meeting was scheduled for March 7, 1995 with the Board of Supervisors with regards to the County Investment Pool, and requested that City Staff attend the meeting. Councilman Inzunza left the Council Chambers at 9:12 p.m. Councilman Inzunza returned to the Council Chambers at 9:14 p.m. PUBLIC ORAL COMMUNICATIONS Rita Heuss, 2121 E. 4th St., National City, expressed her opinion in support of the way the City Council had voted on the carnival (at 30th Street and Highland Avenue) and Karoke items. Richard Sherman, 1236 E. 16th St., National City, stated that weeds in the tree wells across from his parents house were in need of pulling. Book 77/Page 72 02/28/95 CLOSED SESSIONS CLOSED SESSION: Conference with Legal Counsel -- Existing Litigation -- Government Code Section 54956.9(a) - Fuentes v. City of National City. ACTION: Motion by Zarate, seconded by Inzunza, in favor of holding the Closed Session under Government Code Section 54956.9(a). Carried by unanimous vote. Conference with Legal Counsel -- Existing Litigation -- Government Code Section 54956.9(a) -- National City Police Officers' Association, et al. v. City of National City, et al. (Adjourned from the meeting of February 24, 1995). Council Members left the Council Chambers at 9:25 p.m. Council members returned to the Council Chambers at 11:30 p.m. ROLL CALL Council Members present: Inzunza, Morrison, Zarate, Waters. Absent: Beauchamp. ADJOURNMENT Motion by Waters, seconded by Morrison, to adjourn to the next Regular City Council Meeting - March 7, 1995 - 4:00 p.m. Council Chambers, Civic Center.
