HomeMy WebLinkAbout1995 03-28 CC MINBook 77/Page 95 03/28/95 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA MARCH 28,1995 The Regular Meeting of the City Council of the City of National City was called to order at 7:00 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Zarate, Waters. Absent: Morrison. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Assistant City Manager Bolint. APPROVAL OF MINUTES Motion by Zarate, seconded by Inzunza, the Minutes of the Regular Meeting of March 21. 1995 and the Adjourned Meeting of March 22, 1995 be approved. Carried by unanimous vote. Absent: Morrison. Vice Mayor Morrison entered the Council Chambers at 7:02 p.m. PROCLAMATIONS Motion by Zarate, seconded by Inzunza, the Proclamations be read in their entirety. Carried by unanimous vote. Book 77/Page 96 03/28/95 PROCLAMATIONS (continued) Mayor Waters announced that Retired Fire Captain Dave Jacobs had passed away on Saturday, March 26th. Captain Jacobs had completed a 28-year career with the National City Fire Department retiring in 1985. He was also a National City resident for many years making his retirement home here in the City. Memorial services will be conducted at the Fraternal Order of Eagles Hall, 1131 Roosevelt Avenue, April 1, 1995 at 1:00 p.m. The Proclamation proclaiming support for "SCHOOL -TO -CAREER PROGRAM" was read aloud in its entirety by Mayor Waters who then presented it to Dr. Joyce Krutop, Assistant Superintendent, National School District. The Proclamation proclaiming the month of April, 1995 to be: "CHILD ABUSE PREVENTION MONTH" was read aloud in its entirety by Mayor Waters who then presented it to Annetta James, Chairwoman and Dr. Mark Hopper, President and CEO of the San Diego Center for Children. The Proclamation proclaiming the month of April, 1995 to be: "TEACHING TOXICS MONTH" was read aloud in its entirety by Mayor Waters who then gave it to the City Manager to forward to the appropriate people. Mayor Waters requested Agenda Item No. 6 be heard at this time. FIRE DEPARTMENT ADMIN (305-1-1) NATIONAL CITY CRISIS TEAM (101-30-1) 6. SUBJECT: Progress Report on the National City Crisis Team. RECOMMENDATION: Staff recommended that Council receive the report, acknowledge the volunteers and allow the continuation of the program. TESTIMONY: National City Fire Captain Kevin Killacky provided a brief verbal overview of the program. Program volunteers who were present in the audience and who had completed the training program were introduced. ACTION: No action taken. Book 77/Page 97 03/28/95 BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS HOUSING & COMMUNITY DEVELOPMENT COMM (101-12-1) The resignation from the Housing & Community Development Committee of Dorine M. Ross was announced by Mayor Waters. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 95-37 and 95-38). Motion by Inzunza, seconded by Morrison, the Consent Resolutions be adopted by title only. Carried by unanimous vote. CONTRACT (C94-33) 1. Resolution No. 95-37. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION FOR THE REPLUMB OF THE MAIN FIRE STATION WATER SUPPLY LINES. (PUBLIC WORKS SPEC. NO. PW-001-94)." ACTION: Adopted. See above. BICYCLE PATH/TRAILS PLANNING ADMIN (802-4-1) 2. Resolution No. 95-38. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING A GRANT APPLICATION BY THE CITY OF SAN DIEGO FOR TRANSPORTATION DEVELOPMENT ACT/TRANSNET BIKEWAY FUNDS TO CONDUCT THE HARBOR DRIVE/TIDELANDS AVENUE BIKEWAY STUDY." ACTION: Adopted. See above. WRITTEN COMMUNICATIONS SOLID WASTE HAZARDOUS (911-1-7) 3. SUBJECT: Letter and presentation from the Department of the Navy promoting public awareness of environmental cleanups at Naval Station San Diego and discussing the Restoration Advisory Board. Book 77/Page 98 03/28/95 SOLID WASTE ADMIN (911-1-8) (continued) TESTIMONY: Theresa Morley, Environmental Engineer of the Naval Station San Diego, made a brief verbal presentation on the establishment of the Restoration Advisory Board and requested assistance from the Council in the provision of a person to serve on the selection panel. ACTION: Consensus of the Council was to have Fire Chief Kimble serve on the selection panel. NEW BUSINESS WARRANT REGISTERS 1994 (202-1-9) 4. SUBJECT: Warrant Register #36. Ratification of Demands in the amount of $177,856.18 (Warrant Nos. 133710 through 133785 inclusive excepting 133711-133717) and Certification of Payroll in the amount of $412,427.86. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the Ratification of Demands and Certification of Payroll. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. LEAGUE OF CALIFORNIA CITIES ADMIN 104-2-1 5. SUBJECT: Discussion of League of California Cities, San Diego County Division Quarterly Dinner Meeting in Santee. ACTION: No action taken. Item No. 6 was heard earlier, after Proclamations. FIRE DEPARTMENT ADMIN (305-1-1) NATIONAL CITY CRISIS TEAM (101-30-1) 6. SUBJECT: Progress Report on the National City Crisis Team. Book 77/Page 99 03/28/95 BUDGET FY94-95 (206-1-10) 7. SUBJECT: Proposed Postponement of Project Implementation - Library Renovation Project. RECOMMENDATION: Staff requested council direction. Regardless of the action to postpone the full project implementation, it is recommended that the Local History Room roofing part of the project proceed given the problem of roof leaks. TESTIMONY: Building & Safety Director Bouse requested Council approve going forward with the roofing part of the project for the Local History Room. ACTION: Motion by Zarate, seconded by Morrison, Q approve only $25,000. at this time to re -roof the Local History Room. Carried by unanimous vote. CLAIM (501-1-107) 8. SUBJECT: Claim for Damages: Norma Barrera. RECOMMENDATION: Staff recommended that the claim be denied and referred to the City Attorney. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, the claim be denied and referred to the City Attorney. Carried by unanimous vote. CLAIM (501-1-107) 8. SUBJECT: Claim for Damages: National Homecare Systems. RECOMMENDATION: Staff recommended that the claim be denied and referred to the City Attorney. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, the claim be denied and referred to the City Attorney. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY - No report. Book 77/Page 100 03/28/95 OTHER STAFF - No report. MAYOR Mayor Waters read into the record a letter Council requested he send to Governor Wilson regarding the TEA Grant moneys for the purchase of the National City Transcontinental Depot (copy on file in the Office of the City Clerk). CITY COUNCIL BOARD OF PORT COMM/CIP PROJECTS (701-5-2) 10. SUBJECT: Discussion of San Diego CIP Request. TESTIMONY: Councilman Beauchamp made a brief posterboard presentation on the rail line that goes around the San Diego Bay and its' proposed restoration for the purpose of a tourist rail line. ACTION: Motion by Zarate, seconded by Inzunza, to ask the National City Port Commissioner to pursue "Port" CIP Budget Allocation to fund a feasibility study of the tourist train from National City to Imperial Beach and/or Coronado. Carried by unanimous vote. Vice Mayor Morrison reported on the results of his contact with the Chula Vista Police Department to remedy the transient problems behind the new Food 4 Less, Toys R Us and Food Saver stores up to Highland Avenue. He then requested Staff change the budget policy to a 50% roll over of non - designated funds and to provide a feasibility report at the budget meeting for funding of a part-time code conformance officer for weekends. PUBLIC ORAL COMMUNICATIONS - None. Book 77/Page 101 03/28/95 CLOSED SESSIONS CLOSED SESSION: Conference with Legal counsel - Anticipated Litigation -- Initiation of Litigation Pursuant to Subdivision (c) of Government Code Section 54956.9 (One potential case). ACTION: Motion by Morrison, seconded by Zarate, in favor of holding the Closed Session under Government Code Section 54956.9(c). Carried by unanimous vote. Council Members left the Council Chambers at 8:03 p.m. Council Members returned to the Council Chambers at 8:40 p.m. City Attorney George Eiser gave a brief report on the item in compliance with the Brown Act (copy on file in the office of the City Clerk). ROLL CALL Council Members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. ADJOURNMENT Motion by Inzunza, seconded by Morrison, to adjourn to the next Regular City Council Meeting - April 4, 1995 - 4:00 p.m. - Council Chambers, Civic Center. Carried by unanimous vote.
