HomeMy WebLinkAbout1995 04-04 CC MINr Book 77/Page 103 04/04/95 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA APRIL 4, 1995 The Regular Meeting of the City Council of the City of National City was called to order at 4:00 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Morrison. APPROVAL OF MINUTES Motion by Morrison, seconded by Inzunza, the Minutes of the Regular Meeting of March 28, 1995 be approved. Carried by unanimous vote. MAYOR'S PRESENTATIONS Mayor Waters requested that Proclamations and Interviews/Appointments be heard at this time, prior to Presentations. PROCLAMATIONS (102-2-1) Motion by Zarate, seconded by Morrison, the Proclamations be read in their entirety. Carried by unanimous vote. The Proclamation proclaiming the month of April, 1995 to be: FAIR HOUSING MONTH" was read aloud in its entirety by Mayor Waters who then presented it to Clara Harris, Executive Director of Heartland Human Relations & Fair Housing Association who thanked the Council for their support. Book 77/Page 104 04/04/95 PROCLAMATIONS (continued) The Proclamation proclaiming the month of April, 1995 to be: "EARTHQUAKE PREPAREDNESS MONTH" was read aloud in its entirety by Mayor Waters who then presented it to Mark Gundert of the National City Fire Department, who thanked the Council for their support. The Proclamation proclaiming the week of April 3-9, 1995 to be: "PUBLIC HEALTH WEEK" was read aloud in its entirety by Mayor Waters who then gave it to the City Manager to forward to the appropriate people. The Proclamation proclaiming the week of April 10-16, 1995 to be: "COMMUNITY DEVELOPMENT WEEK" was read aloud in its entirety by Mayor Waters who then presented it to the Community Development Commission Executive Director Paul Desrochers who made a brief statement on the program and thanked the Council for their support. BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS PROJECT AREA COMMITTEE (101-27-1) Mayor Waters turned the meeting over to Vice Mayor Morrison, who called on Ms. Debra Landry. Ms. Landry expressed her interest in serving on various boards and commissions and answered questions of the Council. Vice Mayor Morrison turned the meeting back over to Mayor Waters. MAYOR'S PRESENTATIONS (102-14-2) Mayor Waters called on City Engineer Burt Myers who is this year's Chairman of the Maytime Band Review. Mr. Myers presented the Council with the first ever commemorative pin for the Maytime Band Review and thanked the Council for their many years of support. Book 77/Page 105 04/04/95 CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 95-39 through 95-41). NOTE: Vice Mayor Morrison requested Agenda Item No. 1, Resolution No. 95-39 be pulled. Motion by Inzunza, seconded by Waters, the Consent Resolutions (except Agenda Item No. 1, Resolution, No. 95-39) be adopted by title only. Carried by unanimous vote. CONTRACT (C86-29) 2. Resolution No. 95-40. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE EXECUTION OF CLAIMS, AGREEMENTS AND APPLICATIONS NECESSARY FOR RECEIPT OF TDA ARTICLE 4.5, TRANSNET AND STA FUNDS FOR NATIONAL CITY WHEELS." ACTION: Adopted. See above. CONTRACT (C95-11) 3. Resolution No. 95-41. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING EASTWOOD TENNIS SURFACE, INC. TO BE LOWEST RESPONSIVE BIDDER AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE AN AGREEMENT WITH EASTWOODS TENNIS SURFACE, INC. FOR THE REPAIR AND RESURFACING OF TENNIS AND BASKETBALL COURTS." ACTION: Adopted. See above. CONTRACT (C91-21) 1. Resolution No. 95-39. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST AMENDMENT TO AGREEMENT FOR ADMINISTRATION OF PARATRANSIT REGULATIONS WITH THE SAN DIEGO METROPOLITAN TRANSIT DEVELOPMENT BOARD." ACTION: Motion by Morrison, seconded by Inzunza, to hold this item over for two weeks. Carried by unanimous vote. Book 77/Page 106 04/04/95 WRITTEN COMMUNICATIONS BUDGET FY94-95 (206-2-10) SERRA LIBRARY SYSTEM ADVISORY BOARD (101-3-2) 4. SUBJECT: Letter from Everett J. Dickson, Member of the Serra Advisory Board, requesting a donation to support the Legislative Day Event for the Serra Cooperative Library System. TESTIMONY: Everett Dickson, 2745 E. 14th St., National City, answered questions of the Council. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the request. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1994 (202-1-9) 5. SUBJECT: Warrant Register #37. Ratification of Demands in the amount of $242,463.99 (Warrant Nos. 133787 through 133848 inclusive excepting none). RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the Ratification of Demands. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. TEMPORARY USE PERMITS 1995 (203-1-11) 6. SUBJECT: Temporary Use Permit: National City Lions Club Fourth of July Independence Day Celebration. RECOMMENDATION: Staff recommended that Council approve the TUP subject to compliance with Conditions of Approval 1-11 as contained in attachment B, attached to the Agenda. TESTIMONY: Bob Benson, President of the National City Lions Club, 1420 "L" Avenue, National City, spoke in support of the request and answered questions of the Council. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: Beauchamp. Abstaining: None. CLAIM (501-1-106) 7. SUBJECT: Claim for Damages: Jimmy R. Dean. RECOMMENDATION: Staff recommended that the claim be denied and referred to the City Attorney. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, the claim be denied and referred to the City Attorney. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY CITY COUNCIL AGENDA ITEMS (102-14-1) 8. SUBJECT: Report Re: Home Care Facilities. City Attorney Eiser summarized the memorandum which was written in response to a request made by Vice Mayor Morrison. OTHER STAFF - No report. MAYOR BOYS & GIRLS CLUB ADMIN (109-5-1) 9. SUBJECT: Proposed donation of flag pole from the former Tidelands Avenue Fire Station to the Boys and Girls Club of National City. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the proposed donation. Carried by unanimous vote. Book 77/Page 108 04/04/95 CITY COUNCIL Councilman Beauchamp made inquiry on the status of the letter to be sent by the Mayor to the Port Commissioner on the Bay Rail. He then made inquiry of the City Engineer as to the status of the special parking districts, those wishing to remain in and those out. Councilwoman Zarate made inquiry of the Planning Director on the new laundromat on Plaza Blvd. and the unsightly equipment that can be seen from the street. She also inquired as to the corner store in the Old Schoolhouse Square project and the unsightly window display areas. Vice Mayor Morrison made inquiry of the Mayor as to the contents of the letter being sent to the Port Commissioner and to MTDB regarding freight trains through the City. PUBLIC ORAL COMMUNICATIONS Everett Dickson, 2745 E. 14th St., National City spoke as the public relations person for his neighborhood watch group and expressed gratitude for the assistance Sgt. Iglasias has provided their group. Mayor Waters recognized National City Port Commissioner Jess Van Deventer and National City Chamber of Commerce Executive Director Mary Alice Taliack who were present in the audience. CLOSED SESSIONS CLOSED SESSION: Conference with Legal Counsel - Existing Litigation - Government Code Section 54956.9(a) - National City Police Officer's Association. et al. v. City of National City, et al. Conference with Legal Counsel - Existing Litigation - Government Code Section 54956.9(a) - City of National City v. Pyreduct. Conference with Legal Counsel - Existing Litigation - Government Code Section 54956.9(a) - Castro v. City of National City. NOTE: City Attorney Eiser requested that this item be dropped from the Closed Session. ACTION: Motion by Inzunza, seconded by Zarate, in favor of holding the Closed Sessions under Government Code Sections 54956.9(a). Carried by unanimous vote. Council Members left the Council Chambers at 5:13 p.m. Council Members returned to the Council Chambers at 6:17 p.m. ROLL CALL Council Members present: Beauchamp, Morrison, Zarate, Waters. Absent: Inzunza. ADJOURNMENT Motion by Morrison, seconded by Zarate, to adjourn to the next Regular City Council Meeting - April 11, 1995 - 7:00 p.m, - Council Chambers, Civic Center, Carried by unanimous vote.
