MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
MAY 16, 1995
The Regular Meeting of the City Council of the City of National City was
called to order at 3:37 p.m. by Mayor Waters.
ROLL CALL
Council members present: Inzunza, Morrison, Zarate, Waters. Absent:
Beauchamp.
Administrative officials present: Bolint, Harter, McCabe, Myers, Peoples,
Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Morrison.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Regular
Meeting of May 9. 1995 be approved. Carried by the following vote, to -
wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: None. Absent:
Beauchamp.
PRESENTATIONS
Mayor Waters deviated from the Agenda and requested Councilwoman
Zarate introduce John Devore of Granger Junior High. Mr. Devore made a
brief verbal presentation on how the video "National City Dream" came into
being. Three of the students involved in the project, explained the process
and their roles. The video was then shown.

Councilman Beauchamp arrived in the Council Chambers at 4:00 p.m.
The Mayor then read into the record, the Proclamation proclaiming May 19,
1995 to be: "YOUNG AUTHORS OF NATIONAL CITY MIDDLE
SCHOOL DAY"
NEW EMPLOYEE INTRODUCTION PROGRAM (604-2-2)
Mayor Waters requested that the Department Directors introduce their new
employees. Those employees who were present were requested to stand
before the City Council, in the view of the general public, and the Mayor
welcomed them.
Councilman Beauchamp arrived in the Council Chambers at 4:00 p.m.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Inzunza, the Proclamations be read in
their entirety. Carried by unanimous vote.
This Proclamation was heard earlier, during Presentations.
The Proclamation proclaiming May 19, 1995 to be: "YOUNG AUTHORS
OF NATIONAL CITY MIDDLE SCHOOL DAY."
The Proclamation proclaiming the week of May 21, through May 27, 1995,
to be: "NATIONAL PUBLIC WORKS WEEK" was read in its entirety
by Mayor Waters who then presented it to City of National City Principal
Engineer, Cameron Berkuti who accepted it in behalf of the American
Public Works Association. Mr. Berkuti thanked the Mayor and Council for
their support.
The Proclamation proclaiming May 19, and May 20, 1995, to be:
"VETERANS OF FOREIGN WARS DAYS" was read in its entirety by
Mayor Waters who then presented it to a representative of the VFW #4360.

CONSENT CALENDAR
ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 95-63
through 95-66). Motion by Morrison, seconded by Inzunza, the Consent
Resolutions be adopted by title only. Carried by unanimous vote.
CONTRACT (C94-16)
1. Resolution No. 95-63. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND
AUTHORIZING THE FILING OF THE NOTICE OF
COMPLETION AND APPROVAL OF CHANGE ORDERS NO. 2-6
FOR THE STREET RESURFACING PROJECT."
ACTION: Adopted. See above.
TRAFFIC SIGN/SIGNAL ADMIN 1995 (801-4-6)
2. Resolution No. 95-64. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE
MAYOR TO EXECUTE PROGRAM SUPPLEMENT NO. 016 TO
THE LOCAL AGENCY - STATE AGREEMENT FOR FEDERAL -
AID PROJECT NO. 11-5066 FOR THE FEDERAL AND STATE
PARTICIPATION IN THE COST OF COORDINATING TRAFFIC
SIGNALS ON 30TH STREET AND SWEETWATER ROAD."
ACTION: Adopted. See above.
COMMUNITY DEV/CONSOLIDATED PLAN (406-2-10)
3. Resolution No. 95-65. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY ADOPTING THE HUD
CONSOLIDATED PLAN FOR THE CDBG/HOME PROGRAMS
AND AUTHORIZING THE MAYOR TO FORWARD SAID PLAN
TO HUD FOR REVIEW AND APPROVAL."
ACTION: Adopted. See above.

4. Resolution No. 95-66. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE
MAYOR TO EXECUTE AMENDMENT TO THE LEASE -
PURCHASE AGREEMENT WITH HONEYWELL, INC."
ACTION: Adopted. See above.
NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Inzunza, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.
LABOR RELATIONS POA ADMIN 1995 (605-3-6)
5. Resolution No. 95-67. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY APPROVING A
MEMORANDUM OF UNDERSTANDING CONCERNING
WAGES AND OTHER TERMS AND CONDITIONS OF
EMPLOYMENT BETWEEN THE CITY OF NATIONAL CITY
AND THE NATIONAL CITY POLICE OFFICERS' ASSOCIATION
FOR THE PERIOD SEPTEMBER 1, 1994 THROUGH JUNE 30,
1997 AND AUTHORIZING SETTLEMENT OF THE LITIGATION
ENTITLED NATIONAL CITY POLICE OFFICERS'
ASSOCIATION, ET AL. V. CITY OF NATIONAL CITY, ET AL."
RECOMMENDATION: Staff recommended that Council adopt
the Resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of Resolution No. 95-67. Carried by unanimous vote.
FINANCE/RELOCATION ADMIN (204-04-01)
6. Resolution No. 95-68. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY REJECTING THE BID BY
MERZ CONSTRUCTION CO. FOR THE TENANT
IMPROVEMENTS - RELOCATION OF FINANCE DEPARTMENT
AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO
READVERTISE A MODIFIED PROJECT."

RECOMMENDATION: Staff recommended that Council approve
the Resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
Resolution No. 95-68. Carried by unanimous vote.
WRITTEN COMMUNICATIONS
TEMPORARY USE PERMITS 1995 (203-1-11)
7. SUBJECT: Request by the Pilipino-American Community of
National City to serve beer for a birthday party on May 27, 1995 from
6:00 to 9:00 p.m. at the Multi -Cultural Community Center.
RECOMMENDATION: Staff recommended that Council adopt
the Resolution.
ACTION: Motion by Inzunza, seconded by Waters, in favor
of the request with the serving only of beer, no sales. Carried
by the following vote, to -wit: Ayes: Inzunza, Morrison,
Zarate, Waters. Nays: Beauchamp.
NEW BUSINESS
WARRANT REGISTERS 1994 (202-1-9)
8. SUBJECT: Warrant Register #43. Ratification of Demands in the
amount of $320,386.14 (Warrant Nos. 134267 through 134390)
inclusive excepting none.
RECOMMENDATION: Staff recommended ratification of
these warrants.
ACTION: Motion by Inzunza, seconded by Zarate, in favor
of the Ratification of Demands. Warrants carried by the
following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison,
Zarate, Waters. Nays: None. Abstaining: None. Absent:
None.

TEMPORARY USE PERMITS 1995 (203-1-11)
9. SUBJECT: Temporary Use Permit - National Chamber of
Commerce requests a TUP to conduct the Fourth Annual National
City Heritage Days Auto Show in Kimball Park from 7:00 a.m. to
5:00 p.m. on Sunday, August 6, 1995. A waiver of fees is also
requested.
RECOMMENDATION: Staff recommended that Council approve
the application for a Temporary Use Permit subject to compliance
with all conditions of approval and grant the request for waiver of the
$345.00 processing fee.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of Staff's recommendation. Carried by unanimous vote.
TEMPORARY USE PERMITS 1995 (203-1-11)
10. SUBJECT: Temporary Use Permit - La Mesa R.V. Center, Inc.
requests a TUP to conduct a recreational vehicle sale in the parking
lot of Plaza Bonita from 9:00 a.m. to 7:00 p.m. on June 10, through
June 14, 1995. A waiver of fees is also requested.
RECOMMENDATION: Staff recommended that Council approve
the application for a Temporary Use Permit subject to compliance
with all conditions of approval and grant the request for waiver of the
$345.00 processing fee.
TESTIMONY: None.
ACTION: Motion by Waters, seconded by Inzunza, in favor
of Staffs recommendation, with exception to the request for
waiver of fees which is denied. Carried by unanimous vote.
TEMPORARY USE PERMITS 1995 (203-1-11)
11. SUBJECT: Temporary Use Permit - Council of Pilipino-American
Organizations of San Diego requests a TUP to conduct a parade and
fair in celebration of Pilipine Independence. A waiver of fees is also
requested.

RECOMMENDATION: Staff recommended that Council approve
the TUP application subject compliance with all conditions of
approval and grant the request for a waiver of the $345 processing fee
only, with the applicant to reimburse the City for the remaining
$2,990 un-budgeted expenditures.
TESTIMONY: Paul Ones, Chairman COPAO spoke in
support of the request and answered questions of the Council.
He stated that his organization would be agreeable to closing
the event by 6:30 p.m. on Sunday evening and that they would
not be using any of Kimball Park. He also stated that the
$2,990 would be paid by noon on June 9, 1995 or the event
would not be held.
Sandy Ravelo, Event Chairwoman, answered questions of the
Council.
Bert Andrade, 1609 Casa Place, National City, responded to
comments of the Council.
Louise Martin, 1527 E. 15th St., National City, spoke in
opposition to the request.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
Staff's recommendation.
Amended motion by maker and second to include, on Sunday
evening. the event is to end by 6:30 p.m. Carried by
unanimous vote.
PARKING DISTRICT ADMIN (801-1-1)
12. SUBJECT: Dissolvement of a portion of Parking District "H" - "D"
Avenue from Plaza Boulevard to 12th Street.
RECOMMENDATION: Staff requested direction from the City
Council on the dissolvement of a portion of Parking District "H" -
"D" Avenue from Plaza Boulevard to 12th Street.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of the dissolvement of a portion of Parking District "H".
Carried by unanimous vote.

CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR
Mayor Waters announced the dates and times his "State of the City
Address" would be aired (copy on file in the Office of the City Clerk);
stated that the Chula Vista Econo Lube `N Tune proposed at the Southwest
corner of E. 30th Street and North 2nd Avenue has been continued by the
Chula Vista Design Review Committee to June 12, 1995, to allow the
applicant time to address design concerns raised by both National City and
Chula Vista Staff; read into the record a letter received from
Assemblywoman Denise Moreno Ducheny thanking the Mayor and Council
for their support of AB135 regarding vehicle registration fees (copy on file
in the Office of the City Clerk) and read into the record a letter from
Assemblywoman Denise Moreno Ducheny regarding the Mortgage Credit
Certificate Program and the Mortgage Revenue Bond Program which will
be allowed to continue to be competitive with local programs and thanking
the Council for their support thereof (copy on file in the Office of the City
Clerk).
CITY COUNCIL
Councilwoman Zarate requested Staff look into what policies other
municipalities have with regards to public owned facility rentals. She
requested a report be provided on the National City Community Center also
inclusive of a breakdown of revenues generated; allowance of the serving of
alcohol; police activities, etc. and expressed concerns for potential liability
situations.
Councilman Beauchamp thanked the Public Works Department for their
quick action in the repair of a street light at 24th Street and Hoover Avenue.
Vice Mayor Morrison commented that the Food 4 Less had been informed
of their Conditional Use Permit provisions pertaining to delivery curfews
and lot cleaning, etc.; requested the City Attorney look into the possibility
of refunding the appeal fee for appeals which are upheld and inquired as to
the status of the selection process for a new Police Chief.

CITY COUNCIL (continued)
Mayor Waters requested the Planning Director bring back recommendations
for consideration with regards to the use of temporary signs throughout the
City.
Councilman Inzunza left the Council Chambers at 5:20 p.m.
PUBLIC ORAL COMMUNICATIONS
Richard Sherman, 1236 E. 16th Street, National City, representing the
Citizens Patrol and the National City Crisis Team, invited all present to
attend a fundraising breakfast this Saturday, May 20, 1995 at the Fire
Station at 16th Street and "D" Avenue.
Cecilia Kirk, 311 E. 2nd Street, National City, thanked the Council and
Staff for their action to remedy a problem house in her neighborhood;
invited all to attend the Committee to Reclaim Our Neighborhoods meeting
in the National City Community Center on Wednesday, May 17 at 7:00 p.m.
to hear Dr. Jorge Pelayo of the South Bay Regional Recovery Center and
stated that Thursday, the people from Virginia would be present for the
PACE Program Workshop which is being held in the National City
Community Center.

Conference with Legal Counsel - Existing Litigation - Government Code
Section 54956.9(a) - Pittman v. City of National City.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of holding the Closed Session per Government Code Section
54945.9(a). Carried by unanimous vote. Absent: Inzunza.
Council Members left the Council Chambers at 5:25 p.m.
Council Members returned to the Council Chambers at 6:00 p.m.
