HomeMy WebLinkAbout1995 05-23 CC MINBook 77/Page 174 05/23/95 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA MAY 23, 1995 The Regular Meeting of the City Council of the City of National City was called to order at 7:01 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Morrison. APPROVAL OF MINUTES Motion by Inzunza, seconded by Zarate, the Minutes of the Regular Meeting of May 16, 1995 be approved. Carried by unanimous vote. PROCLAMATIONS (102-2-1) Motion by Zarate, seconded by Inzunza, the Proclamations be read in their entirety. Carried by unanimous vote. The Proclamations proclaiming Tuesday, May 23, 1995, to be: "DISTINGUISHED STUDENT DAY" were read aloud in full by each Council member who then presented it to the students as follows: Vice Mayor Morrison to Holly Cortell, Councilman Inzunza to Romiro Ramirez, Councilwoman Zarate to Janis Millena and Mayor Waters to Martha Rosa Juarez. The Mayor then presented each student with a small City Flag and a Golden Key to the City. Student Anthony Gonzalez was not present at the Book 77/Page 175 05/23/95 PROCLAMATIONS (continued) time and consensus of the Council was to have Councilman Beauchamp make his presentation upon Anthony's arrival. Student Janis Millena invited the Mayor and Council to attend their Graduation Ceremonies. Dr. Louise Phipps, Principal of Sweetwater Union High School, thanked the Mayor and Council for recognizing the students, introduced their parents who were present in the audience and spoke regarding the students accomplishments. The Proclamation proclaiming the week of June 3 through June 11, 1995, to be: "PHILIPPINE INDEPENDENCE WEEK" was read aloud by Mayor Waters who then presented it to Paul Ones, Chairman of COPAO. Mr. Ones thanked the Mayor and Council for their support. Mayor Waters then deviated from the Agenda to introduce Mark Musgrove, Past President of the National City Police Officers Association. Mr. Musgrove extended gratitude on behalf of the Association, to the Mayor, City Council and City Staff for their efforts expended in resolving the mediation between the POA and the City of National City. Mayor Waters then provided a brief verbal update on his appearance before the Port Commissioners with regard to San Diego's proposed expansion of the San Diego Convention Center which, if approved, would result in the loss of funds already allocated to the South Bay Cities. He then stated that the result of the meeting was a 5-2 vote by the Port Commissioners to move forward with a Memorandum of Understanding for the South Bay Cities to guarantee their previously approved funds are received. Mayor Waters then introduced National City Port Commissioner Jess Van Deventer, who provided a brief elaboration on prior financial agreements between the South Bay Cities and the Port District, and responded to questions of the Council. Book 77/Page 176 05/23/95 PUBLIC HEARINGS VACATIONS 1995 (902-28-1) 1. SUBJECT: Public Hearing - Vacation of an unimproved alley between "E" and "F" Avenues, extending 290 feet south of 18th. Applicant: City -Initiated Case File No.: SC-1995-1. NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff concurred with the decision of the Planning Commission that the alley be vacated. TESTIMONY: None. ACTION: Moved by Inzunza, seconded by Morrison, to declare the Public Hearing closed, and in favor of the vacation based on the recommended findings for approval. Carried by unanimous vote. CONDITIONAL USE PERMIT DENIALS 1994 (403-2-7) 2. SUBJECT: Public Hearing - Appeal of Planning Commission's denial of a Conditional Use Permit for Mobile Recycling Facility at 1240 East Plaza Boulevard. Applicant: 20/20 Recycle Centers -- Case File No.: CUP-1994-13. NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff recommended that the item be continued for 30 days in order for other options to be explored. TESTIMONY: Cedrik Zemitis, 801 "K" St., Sacramento, CA, representing the State Division of Recycling, spoke neither for nor against the item, and responded to questions of the Council. Kevin Tippets, 1720 Pomona Rd., Corona, CA, representing 20/20 recycling, spoke in support of the request and responded to questions of the Council. Mary Louise Martin, 1527 E. 15th St., National City, CA, spoke in opposition to the request. Cecilia Kirk, 311 E. 2nd St., National City, CA, spoke in opposition to the request. ACTION: Moved by Beauchamp, seconded by Inzunza, in favor of a 30 day continuance. Carried by unanimous vote. Book 77/Page 177 05/23/95 Mayor Waters requested a deviation from the Agenda, back to Proclamations, as SUHI student Anthony Gonzalez had arrived in the Council Chambers. PROCLAMATIONS The Proclamation proclaiming Tuesday, May 23, 1995, to be: "DISTINGUISHED STUDENT DAY" was read aloud in full by Councilman Mitch Beauchamp who then presented it to Anthony Gonzalez. Councilman Beauchamp also recognized Anthony's family who was present in the audience. Mayor Waters then presented Anthony with a small City Flag and a Golden Key to the City. PLANNED DEVELOPMENT PERMITS 1995 (414-1-10) 3. SUBJECT: Public Hearing - Planned Development permit for an addition to a shopping center for a restaurant, and for the sale of beer, wine and distilled spirits within the restaurant at 3030 Plaza Bonita Road. Applicant: John Tarlos -- Case File No.: PD-1995-2. NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff recommended the application be approved based on the findings and subject to the conditions of approval as set forth in Planning Commission Resolution No. 4-95, with an added condition limiting the hours of operation. TESTIMONY: Carlos A. Rivera, 1717-A Sweetwater Rd., National City, CA, representing the National City Chamber of Commerce and as a Local businessman, spoke in support of the request. Mary Alice Taliak, 711 "A" Avenue, National City, Executive Director of the National City Chamber of Commerce, spoke in support of the request. Roberto Sanchez, 3030 Plaza Bonita Rd., National City, General Manager of Plaza Bonita, spoke in support of the request and responded to questions of the Council. Book 77/Page 178 05/23/95 PLANNED DEVELOPMENT PERMITS 1995 (continued) TESTIMONY: David Hokanson, 13125 Cayote Ave., San Diego, representing Westfield Corporation, General Partners with Centermark (owners of Plaza Bonita), spoke in support of the request and responded to questions of the Council. Cecilia Kirk, 311 E. 2nd St., National City, spoke in support of the request. John Tarlos, 17802 Mitchell, Irvine, CA, Architect for the project, spoke in support of the request and responded to questions of the Council. Steve Degrave, 24925 Corte Tonikan Ct., Murrieta, CA, Applebee's District Manager, spoke in support of the request and responded to questions of the Council. ACTION: Moved by Zarate, seconded by Inzunza, to close the Public Hearing and in favor of the Planned Development Permit. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: Beauchamp. Absent: None. Abstaining: None. Mayor Waters requested that Agenda Item No. 5 be heard at this time. Motion by Morrison, seconded by Inzunza, the Non Consent Resolution be read by title only. Carried by unanimous vote. CONTRACT (C95-13) 5. Resolution No. 95-69. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH THE SAN DIEGO UNIFIED PORT DISTRICT FOR THE SUMMER SYMPHONY CONCERT PROGRAM." TESTIMONY: Craig A. Hajduk, General Manager of the San Diego Symphony, responded to questions of the Council. ACTION: Moved by Inzunza, seconded by Zarate, in favor of Resolution No. 95-69. Carried by unanimous vote. Book 77/Page 179 05/23/95 (PLANNED DEVELOPMENT PERMITS 1995 (414-1-10) 4. SUBJECT: Public Hearing - Appeal of Planning Commission's approval of a Planned Development Permit for construction of two residential units on property developed with a single-family residence at 910 "N" Avenue. Applicant: Alex C. Carolino -- Case File No. PD-1994-6. NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. NOTE: Mayor Waters stated that he had received a petition in opposition to the proposed project, signed by 25 residents. RECOMMENDATION: Staff concurred with the decision of the Planning Commission to approve the project. TESTIMONY: Armato Teta, 1708 San Bernardino Ave., Spring Valley, Architect for the project, made a brief verbal presentation in support of the project. The following people submitted speaker slips but did not speak as the item was held over for two weeks: Mary Louise Martin, 1527 E. 15th St., National City, opposed to the project. Cecilia Kirk, 311 E. 2nd St., National City, opposed to the project. Roy Stoker, 1323 E. 9th St., National City, opposed to the project. Mildred Bundy, 903 "M" Ave., National City, opposed to the project. Everett Dickson, 2745 E. 14th St., National City, neither for nor against the project. ACTION: Moved by Waters, seconded by Inzunza, to hold this item over for two weeks. Carried by unanimous vote. NON CONSENT RESOLUTIONS Motion by Morrison, seconded by Inzunza, the Non Consent Resolutions be read by title only. Carried by unanimous vote. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH THE SAN DIEGO UNIFIED PORT DISTRICT FOR THE SUMMER SYMPHONY CONCERT PROGRAM." CONTRACT (C94-16) 6. Resolution No. 95-70. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO RETURN PROGRAM SUPPLEMENT NO. 004 TO STATE -LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP-5066 WITH CALTRANS FOR THEIR PARTICIPATION IN THE STREET RESURFACING PROJECT. (ENGINEERING SPEC. 94-5)." TESTIMONY: None. ACTION: Moved by Morrison, seconded by Zarate, in favor of Resolution No. 95-70. Carried by unanimous vote. CONTRACT (C95-14) SEWER CONSTRUCTION/MAINT ADMIN (906-01-09) 7. Resolution No. 95-71. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING THE EXISTENCE OF AN EMERGENCY AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITHOUT COMPLYING WITH COMPETITIVE BIDDING PROCEDURES FOR REINSTALLATION OF A SEWER LINE AT 30TH STREET AND NATIONAL CITY BOULEVARD." TESTIMONY: Public Works Director Williams responded to questions of the Council. r Book 77/Page 181 05/23/95 CONTRACT SEWER CONSTRUCTION/MAINT ADMIN (continued) ACTION: Moved by Inzunza, seconded by Zarate, in favor of Resolution No. 95-71. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1994 (202-1-9) 8. SUBJECT: Warrant Register #44. Ratification of Demands in the amount of $626,076.90 (Warrant Nos. 134392 through 134505 inclusive excepting 134474). RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Morrison, seconded by Inzunza, In favor of the Ratification of Demands. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None SEWER CAPACITY/FEES ADMIN (906-1-4) 9. SUBJECT: Recommended FY-96 Sewer Rate. RECOMMENDATION: Staff recommended approval of the sewer rates established in July 1992 on Resolution No. 92-141 to be continued for Fiscal Year 1995-96, UNCHANGED. ACTION: Moved by Inzunza, seconded by Morrison, in favor of Staffs recommendation. Carried by unanimous vote. STREET TREE & PARKWAY COMMITTEE (101-2-2) 10. SUBJECT: Street Tree Committee Minutes. RECOMMENDATION: Staff recommended approval of the Street Tree Committee Minutes. ACTION: Moved by Zarate, seconded by Morrison, in favor of Staffs recommendation. Carried by unanimous vote. Book 77/Page 182 05/23/95 CITY MANAGER - No report. CITY ATTORNEY CITY ATTORNEY REPORTS (509-1-3) 11. Tobe v. City of Santa Ana (Ordinance prohibiting camping and property storage in designated public areas). City Attorney Eiser stated that this was a report as requested by Council. OTHER STAFF - No report. MAYOR Mayor Waters read into the record a newspaper article on bar-coding cats; a positive editorial from the Star News; and a resignation from various Boards and Commissions received from Ed Pieters, due to illness (copies on file in the Office of the City Clerk). CITY COUNCIL Councilman Beauchamp spoke regarding a follow-up meeting for the PACE Program which is scheduled for June 22nd and 23rd and requested it be placed on the next Council Agenda for consideration as a Council sponsored item and to reserve the Community Center. Vice Mayor Morrison stated that he would be bringing back "good news" on the trash issue in a couple of weeks and made inquiry as to the status of the Sister City Committee. ACTION: Moved by Waters, seconded by Inzunza, to bring the issue of the Sister City Committee onto the Agenda as the need to take action arose after the posting of the Agenda. Carried by unanimous vote. Moved by Waters, seconded by Inzunza, to appoint Vice Mayor Morrison to Chair the Sister City Committee. Carried by unanimous vote. Book 77/Page 183 05/23/95 CITY COUNCIL (continued) Councilman Beauchamp spoke regarding the importance of the Sister City Committee and the Campo Tourist Train which is proposed to go to Tecate. Councilman Inzunza thanked the members of the Council for making the presentations and recognizing the students from Sweetwater Union High School for their accomplishments. Councilwoman Zarate expressed her willingness to brief the other Council members on the PACE program. PUBLIC ORAL COMMUNICATIONS Everett Dickson, 2745 E. 14th St. National City, requested Council assistance on trash at 1605 Prospect, junk car bodies at 2531 & 2605 E. 16th St., stated his opinion that the traffic signals at 16th and Euclid have not been functioning properly since September and that no more than one house should be built on one lot. Louise Martin, 1527 E. 15th St., National City, commended the National City Firefighters for providing the fundraising breakfast to benefit the Crisis Team and Citizens Patrol groups. Cecilia Kirk, 311 E. 2nd St., National City, thanked everyone who had attended the Committee to Reclaim Our Neighborhood workshop, spoke in support of getting Christina Haas involved in the Sister City Committee and invited the Council to attend the Public Meeting on June 22nd and 23rd for the PACE Program. Mary Alice Taliak, 711 "A" Ave., National City, Executive Director of the National City Chamber of Commerce, spoke regarding the success of the Trash Haul Day in which 113 roll away bins were filled. Larry Beck, 13420 Orange Blossom, Poway, representing the National City Firefighters Association, gave credit to the other organizations involved in the fundraising breakfast for the Crisis Team and Citizens Patrol groups.
