HomeMy WebLinkAbout1995 09-12 CC MINBook 77/Page 301 09/12/95 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA SEPTEMBER 12, 1995 The Regular Meeting of the City Council of the City of National City was called to order at 7:03 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Morrison. APPROVAL OF MINUTES Motion by Zarate, seconded by Inzunza, the Minutes of the Regular Meeting of September 5. 1995 , and the Minutes of the Workshop Meeting of September 6, 1995 be approved. Carried by unanimous vote. PROCLAMATIONS (102-2-1) Motion by Morrison, seconded by Inzunza, the Proclamations be read in their entirety. Carried by unanimous vote. The Proclamation proclaiming September 15, 1995 to be: "MULTICULTURAL HEALTH CARE AWARENESS DAY" was read aloud in its entirety by Mayor Waters, who then gave it to the City Manager to present to the appropriate people. Book 77/Page 302 09/12/95 PROCLAMATIONS (continued) The Proclamation proclaiming September 18 - 24, 1995, to be: "POLLUTION PREVENTION WEEK" was read aloud in its entirety by Mayor Waters, who then gave it to the City Manager to present to the appropriate people. NON CONSENT RESOLUTIONS Motion by Zarate, seconded by Morrison, the Non Consent Resolutions be read by title only. Carried by unanimous vote. CONTRACT (C 95-8) 1. Resolution No. 95-135. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CHIEF OF POLICE TO EXECUTE AN OPERATIONAL AGREEMENT WITH THE COUNTY OF SAN DIEGO FOR THE SERVICES OF A PROBATION OFFICER AS PART OF THE OCJP GRANT FUNDED SERIOUS VIOLENT JUVENILE OFFENDER PROGRAM." RECOMMENDATION: Staff recommended that Council approve the resolution. TESTIMONY: None. ACTION: Moved by Morrison, seconded by Inzunza, in favor of Resolution No. 95-135, Carried by unanimous vote. POLITICAL SUPPORT (102-4-1) 2. Resolution No. 95-136. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING IN CONCEPT THE MISSION, VISION, GOALS AND STRATEGIES OF THE CHILDREN'S INITIATIVE." RECOMMENDATION: Staff recommended that Council approve the resolution. TESTIMONY: None. ACTION: Moved by Inzunza, seconded by Zarate, in favor of Resolution No. 95-136. Carried by unanimous vote. Book 77/Page 303 09/12/95 CONTRACT (C 89-8) 3. Resolution No. 95-137. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE LAW FIRM OF LIEBERT, CASSIDY & FRIERSON TO PROVIDE SPECIAL LEGAL SERVICES PERTAINING TO EMPLOYEE RELATIONS MATTERS." RECOMMENDATION: Staff recommended that Council adopt the resolution. TESTIMONY: None. ACTION: Moved by Inzunza, seconded by Morrison, in favor of Resolution No. 95-137. Carried by unanimous vote. WRITTEN COMMUNICATION PUBLIC REQUEST/COMPLAINT ADMIN (102-1-1) 4. SUBJECT: Letter from Ivan Bodge concerning crimes on E. 22nd Street and requesting Council support for a monitoring surveillance camera. NOTE: Mayor Waters stated that a video had been provided by Mr. Bodge of activity occuring in his neighborhood and was available for review by Council. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, the item be filed. No objection as filed. NEW BUSINESS WARRANT REGISTERS 1995 (202-1-10) 5. SUBJECT: Warrant Register # 10. Ratification of Demands in the amount of $338,544.38 (Warrant Nos. 135688 through 135769 inclusive excepting none) and Certification of Payroll in the amount of $459,475.71. RECOMMENDATION: Staff recommended ratification of these warrants. Book 77/Page 304 09/12/95 WARRANT REGISTERS (continued) ACTION: Motion by Inzunza, seconded by Zarate, in favor of the Ratification of Demands and Certification of Payroll. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. CITY OWNED LAND/SALE (1001-1-1) 6. SUBJECT: Report on the status of the surplus property located at the north west corner of 16th Street and Euclid Avenue. RECOMMENDATION: Staff recommended that Council develop a C.I.P project to improve the surplus parcel, or sell the property to the adjoining property owners. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, 14 direct staff to work with the property owner and bring a report back to Council. Carried by unanimous vote. TEMPORARY USE PERMITS 1995 (203-1-11) 7. SUBJECT: Seafood City Supermarket requests a TUP to conduct its annual Filipino -Mexican cultural show and singing contest from 10:00 a.m. to 9:00 p.m. on September 23, 1995. RECOMMENDATION: Staff recommended that Council approve the application for a Temporary Use Permit subject to compliance with all conditions of approval. ACTION: Motion by Zarate, seconded by Inzunza, in favor of the request subject to compliance with all conditions of approval. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. Book 77/Page 305 09/12/95 MAYOR Mayor Waters provided an update on the status of the Comfort Inn. CITY COUNCIL Councilwoman Zarate added comment on the Comfort Inn status and her observation of the security now in effect. She then expressed appreciation for the work done by the Police, Fire and Building Departments. Councilman Beauchamp requested the City Manager have staff look into possible enforcement action at the residential facility at the northwest corner of 4th Street and Highland Avenue. He also thanked the City Engineer for his quick action in working with Caltrans to get signs installed on both the north and southbound lanes of I-5 at 24th Street to direct trucks to head west, not east. Councilman Inzunza made inquiry of staff regarding the graffiti on the I-5 side of the BFI fence. Vice Mayor Morrison responded to Councilman Inzunza and advised that he and the City graffiti employee would be painting the fence tomorrow morning. PUBLIC ORAL COMMUNICATIONS Ralph Hughes, 1104 Manchester Street, National City presented petitions, containing 250 signatures of National City citizens requesting consideration of the appointment of Acting Chief of Police, Tom Deese to the position of National City Chief of Police. CLOSED SESSION Conference with Legal Counsel - Existing Litigation - Government Code Section 54956.9(a) - Addendum No. 4 to Regional Water Quality Control Board Order No. 87-55, Waste Discharge Requirements for the Duck Pond Landfill; Regional Water Quality Control Board Cleanup and Abatement Order No. 95-66, Duck Pond Landfill. ACTION: Motion by Zarate, seconded by Inzunza, in favor of holding the Closed Session under Government Code Section 54956.9(a), Carried by unanimous vote. Book 77/Page 306 09/12/95 CLOSED SESSION (continued) Council members left the Council Chambers at 7:40 p.m. Council members returned to the Council Chambers at 8:25 p.m. ROLL CALL Council members present: Beauchamp, Inzunza, Waters. Absent: Morrison, Zarate. ADJOURNMENT Motion by Inzunza, seconded by Beauchamp, to adjourn to the next Regular City Council Meeting - September 19. 1995 - 4:00 P.M. - Council Chambers, Civic Center. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Waters. Absent: Morrison, Zarate.
