MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
SEPTEMBER 26, 1995
The Regular Meeting of the City Council of the City of National City was
called to order at 7:01 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Berkuti, Bolint, Daniels, Eiser, McCabe,
Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Morrison.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Zarate, the Minutes of the Regular
Meeting of September 19, 1995 be approved. Carried by unanimous vote.
BOARDS AND COMMISSIONS
INTERVIEWS/APPOINTMENTS
Mayor Waters turned the meeting over to Vice Mayor Morrison.
CIVIL SERVICE COMMISSION (101-9-1)
Vice Mayor Morrison stated that Mayor Waters had recommended the re-
appointment of Ernest Azhocar to the Civil Service Commission.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
the Mayor's recommendation. Carried by unanimous vote.

CIVIL SERVICE COMMISSION (continued)
Mayor Waters administered the Oath of Office to Mr. Azhocar.
Vice Mayor Morrison turned the meeting back over to Mayor Waters.
NON CONSENT RESOLUTIONS
Motion by Zarate, seconded by Morrison, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.
TRAFFIC SIGN/SIGNAL ADMIN 1995 (801-4-6)
1. Resolution No. 95-141. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE INSTALLATION OF A FOUR-WAY STOP AT THE
INTERSECTION OF 20TH STREET AND "A" AVENUE."
RECOMMENDATION: Staff recommended that Council not
approve the installation of Stop Signs at this location because the
location does not meet the traffic warrants.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, for
approval of Resolution No. 95-141. Carried by unanimous
vote.
Mayor Waters then recognized Mrs. Annie Camacho, who was present in
the audience. Mrs. Camacho, 1937 A Avenue, National City, a 49-year
resident of National City, came forward and greeted those present.
Councilwoman Zarate noted that there will be a workshop for the residents
in October.
CONTRACT (C90-3)
2. Resolution No. 95-142. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE AN AGREEMENT WITH THE
MAYTIME BAND REVIEW CORPORATION."

RECOMMENDATION: Staff recommended that Council adopt the
resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
Resolution No. 95-142. Carried by unanimous vote.
HIGHWAYS/FREEWAY ADMIN/DISADVANTAGED BUSINESS
ENTERPRISES (DBE) PROGRAM (803-4-2)
3. Resolution No. 95-143. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING AN
ANNUAL DISADVANTAGED BUSINESS ENTERPRISES (DBE)
PROGRAM AND GOAL FOR FEDERALLY -FUNDED
CONSTRUCTION CONTRACTS."
RECOMMENDATION: Staff recommended that Council adopt an
annual DBE goal of 15% per the attached DBE program.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
Resolution No. 95-143. Carried by unanimous vote.
REVENUE & TAXATION ADMIN (205-2-1)
4. Resolution No. 95-144. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING
THE LEAGUE OF CALIFORNIA CITIES' RESOLUTION ON
SALES TAX REDISTRIBUTION TO INCREASE THE AMOUNT
RECEIVED BY CITIES TO 2%."
RECOMMENDATION: Staff recommended that Council adopt the
resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
Resolution No. 95-144. Carried by unanimous vote.

CONTRACT (C95-30)
5. Resolution No. 95-145. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE A SEWER AGREEMENT AND AN
OUTDOOR MAINTENANCE AGREEMENT, FOR THE
PROPERTY AT THE SOUTHWEST CORNER OF 30TH STREET
AND NORTH SECOND AVENUE."
RECOMMENDATION: Staff recommended that Council adopt the
resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Waters, in favor of
Resolution No. 95-145. Carried by unanimous vote.
WRITTEN COMMUNICATION
PUBLIC REQUEST/COMPLAINT ADMIN (102-1-1)
6. SUBJECT: Letter from Ivan Bodge concerning crimes on E. 22nd
Street and requesting Council support for a monitoring surveillance
camera.
TESTIMONY: Ivan Bodge, 2210 E. 22nd Street, National
City, provided a handout to Council (copy on file in the office
of the City Clerk), spoke in support of his request and
answered questions of the Council.
Gerald Bodge, 2210 E. 22nd Street, National City, spoke in
favor of the request.
Laura Pettingill, 1306 E. 18th Street, National City, spoke in
support of the request.
Everett Dickson, 2745 E. 14th Street, National City, reported
that there is no Neighborhood Watch group active in this area.
ACTION: Consensus of the Council was to refer this item to
the City Manager to discuss with the Police Chief, and report
back to the City Council at a later meeting.

NEW BUSINESS
WARRANT REGISTERS 1995 (202-1-10)
7. SUBJECT: Warrant Register #12. Ratification of Demands in the
amount of $254,595.76 (Warrant Nos. 135846 through 135923
inclusive excepting 135857) and Certification of Payroll in the
amount of $669,976.26.
RECOMMENDATION: Staff recommended ratification of these
warrants.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of the Ratification of Demands and Certification of Payroll
Warrants carried by the following vote, to -wit: Ayes:
Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: None. Absent: None.
CONDITIONAL USE PERMIT DENIALS 1995 (403-2-8)
8. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 13-95 denying a Conditional Use Permit for the conversion of a
single-family residence into a church and zone variance for a 9.5 foot
driveway in lieu of the 18 feet required at 2504 "D" Avenue.
Applicant: Timothy A. Meyer. Case File Nos: CUP-1995-7/Z-1995-
1
RECOMMENDATION: Staff concurred with the Planning
Commission decision to deny the application and recommended the
Notice of Decision be filed.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, in favor of
staff's recommendation to deny and file the Notice of Decision.
Carried by unanimous vote.
CONDITIONAL USE PERMIT (403-10-5)
9. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 14-95 approving Conditional Use Permit for construction of a
church on vacant property located immediately west of 710 East 8th
Street. Applicant: S.E. Kirk. Case File No. CUP-1995-6.
RECOMMENDATION: Staff concurred with the Planning
Commission and recommended that Council approve the application.

TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
ofStaff's recommendation for approval. Carried by unanimous
vote.
VARIANCES 1995 (409-1-19)
10. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 17-95 approving a zone variance to allow creation of three
parcels without street frontage and five parcels with access via an
easement at the southwest corner of Highland Avenue and State
Route 54. Applicant: American Assets. Case File No.: Z-1995-2.
RECOMMENDATION: Staff concurred with the Planning
Commission and recommended that Council approve the zone
variance.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of Staff's recommendation for approval. Carried by unanimous
vote.
CLAIM (501-1-113)
11. SUBJECT: Claim for damages: Michael R. Leday.
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, to deny
the claim for damages and refer it to the City Attorney. Carried
by unanimous vote.
CLAIM (501-1-113)
12. SUBJECT: Claim for damages: National City Police Officers'
Association.
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney.

TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, to deny
the claim for damages and refer it to the City Attorney. Carried
by unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR
Mayor Waters stated that he had met with Ms. Betty McCoy at her request,
and an item will be placed on next week's agenda for consideration of her
appointment to the Project Area Committee.
CITY COUNCIL
Councilman Beauchamp reported that he had attended a meeting of the
California Treasurer's Association which was held at Oceanside City Hall.
State Treasurer Matt Fong addressed the issues in Orange County, and gave
an update on pending legislation.
PUBLIC ORAL COMMUNICATIONS
Mary Alice Taliak, representing the National City Chamber of Commerce,
711 A Avenue, National City, provided information regarding the 39th
Annual "Salute to the Navy" event which begins on Thursday and continues
for two weeks. She also reminded everyone that the "Taste of National
City" is tomorrow, September 27, 1995, from 5 p.m. to 7:30 p.m.

Motion by Inzunza, seconded by Morrison, to adjourn to the next Regular
City Council Meeting - October 3, 1995 - 4:00 P.M. - Council Chambers,
Civic Center. Carried by unanimous vote.
