HomeMy WebLinkAbout1995 10-03 CC MINBook 77/Page 329 10/3/95 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA October 3, 1995 The Regular Meeting of the City Council of the City of National City was called to order at 4:00 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Morrison. APPROVAL OF MINUTES Motion by Morrison, seconded by Inzunza, the Minutes of the Regular Meeting of September 26, 1995 and the Adjourned Meetings of September 21 and 22, 1995 be approved. Carried by unanimous vote. BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS Mayor Waters turned the meeting over to Vice Mayor Morrison. PROJECT AREA COMMITTEE (101-27-1) Vice Mayor Morrison stated that the Project Area Committee (PAC) had recommended the appointment of Ms. Betty McCoy to the Project Area Committee. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the PAC's recommendation. Carried by unanimous vote. Book 77/Page 330 10/3/95 PROJECT AREA COMMITTEE (continued) Vice Mayor Morrison turned the meeting back over to Mayor Waters. City Clerk Peoples administered the Oath of Office to Mrs. McCoy. PUBLIC HEARING CONDITIONAL USE PERMIT DENIALS 1994 (403-2-7) 1. Public Hearing - Appeal of Planning Commission's denial of a Conditional Use Permit for a Mobile Recycling Facility at 1240 East Plaza Boulevard. (Applicant: 20/20 Recycle Centers) (Case File No. CUP-1994-13) RECOMMENDATION: Staff recommended that the Public Hearing be continued to November 7, 1995. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of Staffs recommendation to continue the Public Hearing to November 7, 1995. Carried by unanimous vote. NON CONSENT RESOLUTIONS Motion by Zarate, seconded by Morrison, the Non Consent Resolutions be read by title only. Carried by unanimous vote. STREET VACATION (902-29-01) 2. Resolution No. 95-146. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY GIVING NOTICE OF INTENTION TO VACATE AND CLOSE A PORTION OF 27TH STREET BETWEEN NATIONAL CITY BOULEVARD AND "A" AVENUE." (APPLICANT: GEORGE H. WEBSTER) (CASE FILE NO. SC-1995-2) RECOMMENDATION: Staff recommended that Council adopt the resolution and set a Public Hearing date for consideration of the Planning Commission recommendation. TESTIMONY: Zenaido Villalobos, 2730 "B" Avenue, National City, made inquiry of the Council regarding the hearing notification. Book 77/Page 331 10/3/95 STREET VACATION (continued) TESTIMONY: Juan Ochoa, 310 27th Street, National City, requested to be notified of the hearing. ACTION: Motion by Morrison, seconded by Zarate, for approval of Resolution No. 95-146 and to set the Public Hearing date for November 14, 1995 at 7:00 p.m. Carried by unanimous vote. Mayor Waters requested the subject of the "A" Avenue Workshop be brought onto the Agenda as the need to take action arose after the posting of the Agenda. ACTION: Motion by Morrison, seconded by Inzunza, to bring the subject of the "A" Avenue Workshop onto the Agenda as the need to take action arose after the posting of the Agenda. Carried by unanimous vote. ACTION: Motion by Morrison, seconded by Inzunza, to set a Council Workshop for "A" Avenue on October 30. 1995 at 6:00 p.m. in the Council Conference Room. Carried by unanimous vote. Consensus of the Council was that notification of the workshop is to be sent to all residents on "A" Avenue, 18th Street to 31 st Street and the west side of the Mile of Cars. Consensus of the Council was that notification of the Public Hearing is to be sent to all residents on "A", "B", "C" and "D" Avenues, 24th Street to 30th. TESTIMONY: John Moumian, 2721 "B" Avenue, National City, made inquiry of the Council regarding the Public Hearing notification. Forbes Moumian, 2721 "B" Avenue, National City, made inquiry regarding the Public Hearing notification. Ernesto Hernandez, 2113 "A" Avenue, National City, made inquiry regarding the Workshop notification. Book 77/Page 332 10/3/95 STREET VACATION (902-17-1) 3. Resolution No. 95-147. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING EXECUTION OF ORDER TO VACATE AND CLOSE A PORTION OF WILSON AVENUE LOCATED ADJACENT TO THE PROPERTY AT THE NORTHWEST CORNER OF WILSON AVENUE AND 24TH STREET." (APPLICANT: FRED CAMERON) (CASE NO. SC-5-88) RECOMMENDATION: Staff recommended that Council adopt the resolution. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, for approval of Resolution No. 95-147. Carried by unanimous vote. CIVIL SERVICE RULES -AMENDMENTS (603-1-1) 4. Resolution No. 95-148. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY TO APPROVE AMENDMENTS TO CIVIL SERVICE RULES I, VIII, IX AND X." RECOMMENDATION: Staff recommended that Council adopt the resolution. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Zarate, Q approval of Resolution No. 95-148. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1995 (202-1-10) 5. SUBJECT: Warrant Register #13. Ratification of Demands in the amount of $213,180.15 (Warrant Nos. 135925 through 136019 inclusive excepting none). RECOMMENDATION: Staff recommended ratification of these warrants. Book 77/Page 333 10/3/95 WARRANT REGISTERS 1995 (202-1-10) ACTION: Motion by Zarate, seconded by Morrison, in favor of the Ratification of Demands and Certification of Payroll. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. METROPOLITAN TRANSIT BOARD ADMIN (101-15-1) 6. SUBJECT: Request from the Metropolitan Transit Development Board (MTDB) to allow Goodwill Industries to continue operation of an attended donation facility at the 24th Street Trolley Station. (Case File No. AP-1994-1) RECOMMENDATION: Staff recommended extending the deadline for removal of the donation center for an additional year, or until the proposed adult school on the adjacent property to the south is established, and authorizing the extension of the hours of operation to 8:30 a.m. as requested. TESTIMONY: Judy Leitner, Public Communications Manager, MTDB, responded to questions of the Council. ACTION: Motion by Inzunza, seconded by Zarate, in favor of staff's recommendation. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Zarate, Waters. Nays: Morrison. Abstaining: None. Absent: None. STREET TREE & PARKWAY COMMITTEE (101-2-2) 7. SUBJECT: Street Tree Committee Minutes. RECOMMENDATION: Staff recommended approval of the minutes. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of staff s recommendation. Carried by unanimous vote. CLAIM (501-1-113) 8. SUBJECT: Claim for damages: Lucia Castillo Alvarez. RECOMMENDATION: Staff recommended that the claim be denied and referred to the City Attorney. TESTIMONY: None. Book 77/Page 334 10/3/95 CLAIM (continued) ACTION: Motion by Morrison, seconded by Inzunza, to deny the claim for damages and refer it to the City Attorney. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY- No report. OTHER STAFF- No report. MAYOR Mayor Waters stated that the Chamber of Commerce had scheduled the next Clean Up Day for November 4, 1995 at Pepper Park; he had received a FAX from Congressman Filner regarding a meeting on the San Diego and Arizona Eastern Railroad to be held at the Port District Offices which he declined to attend and invited Filner to attend the Council Workshop at the Santa Fe Depot on October 14th. The Mayor then commented on the SANDAG report on the San Diego and Arizona Eastern Railroad, as well as the Union Tribune article stating that National City had the highest crime rate again which was not true. He then cited the FBI Index which showed Chula Vista at 2 to 1. CITY COUNCIL - No report. PUBLIC ORAL COMMUNICATIONS - None. ADJOURNMENT Motion by Morrison, seconded by Waters, to adjourn to the next Regular City Council Meeting - October 10, 1995 - 7:00 P.M. - Council Chambers, Civic Center. Carried by unanimous vote.
