MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
October 24, 1995
The Regular Meeting of the City Council of the City of National City was
called to order at 7:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, McCabe, Myers, Peoples.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Morrison.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza the Minutes of the Regular
Meeting of October 17, 1995 be approved. Carried by unanimous vote.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Inzunza, the Proclamations be read in
their entirety. Carried by unanimous vote.
The Proclamation proclaiming October 28, 1995 to be: "MAKE A
DIFFERENCE DAY" was read in its entirety by Mayor Waters, who then
gave it to the City Manager to present to the proper people.

PROCLAMATIONS (continued)
The Proclamation proclaiming the month of November, 1995 be designated
as: "BUCKLE UP FOR LIFE CHALLENGE" was read in its entirety by
Mayor Waters, who then gave it to the City Manager to present to the
proper people.
NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Zarate, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.
PARKING ADMIN 1995 (801-2-15)
1. Resolution No. 95-150. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE INSTALLATION OF A 40-FOOT SECTION OF RED CURB
ON 4TH STREET AT THE INTERSECTION OF "I" AVENUE."
RECOMMENDATION: Staff recommended that Council approve
the resolution authorizing the red curb.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, for
approval of Resolution No. 95-150. Carried by unanimous
vote.
PARKING ADMIN 1995 (801-2-15)
2. Resolution No. 95-151. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE INSTALLATION OF ANGLED PARKING SPACES ON THE
WEST SIDE OF HARDING AVENUE BETWEEN 18TH AND
19TH."
RECOMMENDATION: Staff recommended that Council approve
the resolution authorizing angled parking on Harding Avenue.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, for
approval of Resolution No. 95-151. Carried by unanimous
vote.

CONTRACT (C95-32)
3(a). Resolution No. 95-152. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE AN AGREEMENT WITH THE SAN
DIEGO UNIFIED PORT DISTRICT FOR UPGRADING TWO
RAILWAY CROSSINGS ON 19TH STREET."
RECOMMENDATION: Staff recommended that Council approve
the resolution and direct the City Clerk to forward both copies of the
agreement along with a certified copy of the Resolution to the
Engineering Department in order to mail them to AT&SF.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, for
approval of Resolution No. 95-152. Carried by unanimous
vote.
CONTRACT (95-33)
3(b). Resolution No. 95-153. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE TWO AGREEMENTS WITH THE
ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY
FOR UPGRADING TWO RAILWAY CROSSINGS ON 19TH
STREET."
RECOMMENDATION: Staff recommended that Council approve
the resolution, and direct the City Clerk to forward the four enclosed
counterparts of the agreement along with a certified copy of the
resolution to the Engineering Department in order to mail them to
AT&SF.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, Q
approval of Resolution No. 95-153. Carried by unanimous
vote.

4. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY, CALIFORNIA, ADOPTING PROCEDURES
FOR SELECTION OF PROFESSIONAL FIRMS."
WRITTEN COMMUNICATIONS
PUBLIC REQUEST/COMPLAINT ADMIN (102-1-1)
5. SUBJECT: Letter from the Delgado Terrace Homeowners
Association concerning safety issues in the neighborhood.
TESTIMONY: Ellie Crossley, 2506 Seawind Drive, National
City, President of the Delgado Terrace Homeowners
Association, expressed concerns with gang activity, abandoned
vehicles, cars traveling the wrong way at high speeds on the
street and the lack of police enforcement or response to calls.
Aurelia Vivanco, 1432 Meadow Drive, National City, member
of Delgado Terrace Homeowners Association, expressed
concerns with cars traveling the wrong way at high speeds on
the street, cars stored in garages as potential bombs, rats in the
neighborhood, gang activity at night, street lights not
functioning properly and not bright enough, and the lack of
police response to calls for assistance.
NEW BUSINESS
WARRANT REGISTERS 1995 (202-1-10)
6. SUBJECT: Warrant Register # 16. Ratification of Demands in the
amount of $130,668.23 (Warrant Nos. 136181 through 136274
inclusive excepting none) and Certification of Payroll in the amount
of $410,533.62.
RECOMMENDATION: Staff recommended ratification of these
warrants.

WARRANT REGISTERS 1995 (continued)
ACTION: Motion by Morrison, seconded by Inzunza, in
favor of the Ratification of Demands and Certification of
Payroll. Warrants carried by the following vote, to -wit: Ayes:
Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: None. Absent: None.
FINANCIAL MANAGEMENT 1995 (204-1-10)
7. SUBJECT: Consolidated Cash and Investment Report as of
September 30, 1995.
RECOMMENDATION: Staff recommended that Council accept
and file the report.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, the
report be accepted and filed. No objection as filed.
CONTRACT (C92-29)
8. SUBJECT: Setting date for Public Hearing November 7, 1995, on
Honeywell, Inc. Comprehensive Energy Conservation Program.
RECOMMENDATION: Staff recommended that Council set the
Public Hearing for November 7, 1995.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Staff's recommendation. Carried by unanimous vote.
CLAIM (501-1-109)
9. SUBJECT: Claim for damages: Eric Hensz.
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, the claim
be denied and referred to the City Attorney. Carried by
unanimous vote.

CLAIM (501-1-114)
10. SUBJECT: Claim for damages: Pablo Ibarra Beltran.
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, the claim
be denied and referred to the City Attorney. Carried by
unanimous vote.
CLAIM (501-1-113)
11. SUBJECT: Claim for damages: Twyla Garrett -Phillips.
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, the claim
be denied and referred to the City Attorney. Carried by
unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF
Public Works Director Williams stated that the Citywide Trash Clean Up
day was scheduled for next Saturday, November 4, 1995 at 32nd and
Tidelands and that the following Saturday, November 11, 1995 at the same
location, a Hazardous Waste Clean Up will be held.
MAYOR
Mayor Waters reported that he met with Congressman Bob Filner regarding
the NAFTA train and the potential conflict with the National City Marina
and Depot Projects. The Mayor sent a letter to the Port District and
SANDAG requesting a 60-day continuance of the review period on the
SD&AE Railway draft report. The Mayor read a letter which was received
from SANDAG (copy on file in the office of the City Clerk) approving the
request for a continuance.

MAYOR (continued)
The Mayor read from a report by the weekend Code Conformance Officer
(copy on file in the office of the City Clerk) showing a total of 295 verified
complaints of yard sales without permits during the months of July, August
and September, 1995.
Mayor Waters commented on two negative articles in the newspaper
regarding the high crime rate in National City. He then reported that the
1995 FBI Crime report shows Chula Vista Violent Crimes at 542, down
10%, while National City Violent Crimes were 346, down 20%. Chula
Vista Index Crimes were 4610, down 13%, while National City Index
Crimes were 2236, down 14%.
The Mayor then read into the record a letter from the City Attorney (copy
on file in the office of the City Clerk) in response to an unauthorized
recording of a conversation with the Mayor.
The Mayor reported that a court date of November 16, 1995 had been set for
the "Save Our Bay" case and that support had been received from Friends of
the South Bay Wildlife Conservation.
Mayor Waters then read a memo from Planning Director Roger Post (copy
on file in the office of the City Clerk) reporting that the City's application to
the State to exempt Vons Market from the requirement to establish a
recycling center had been approved.
CITY COUNCIL
Councilman Beauchamp stated that he had just returned from the League of
California Cities and would be bringing back a report along with the
Assistant City Manager on the next agenda.
PUBLIC ORAL COMMUNICATIONS
Alex McLintock, 2038 Euclid Avenue, National City, presented letters to
the Mayor he had received from the Building Department regarding an
inspection. He requested an extension from the November 27th deadline to
the end of the year to allow for completion of the project.

ADJOURNMENT
Motion by Morrison, seconded by Inzunza, to adjourn to the City Council
Workshop on "A" Avenue Issues - October 30, 1995 - 6:00 P.M. - Large
Conference Room, Civic Center, Next Regular City Council Meeting -
November 7, 1995 - 4:00 P.M. - Council Chambers, Civic Center. Carried
by unanimous vote.
The meeting closed at 8:21 p.m.
The foregoing minutes were approved at the Regular Meeting of November 7,
