MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
November 7, 1995
The Regular Meeting of the City Council of the City of National City was
called to order at 4:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Inzunza, Zarate, Waters. Absent: Beauchamp,
Morrison.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples,
Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Assistant City Manager
Bolint.
Beauchamp arrived in the Council Chambers at 4:03 p.m.
APPROVAL OF MINUTES
Motion by Zarate, seconded by Inzunza, the Minutes of the Regular
Meeting of October 24, 1995 and the Minutes of the adjourned Workshop
Meeting of October 30, 1995 be approved. Carried by unanimous vote.
Absent: Morrison.
PUBLIC HEARING
CONDITIONAL USE PERMIT (403-9-12)
1. Public Hearing - Appeal of Planning Commission's denial of a
Conditional Use Permit for a Mobile Recycling Facility at 1240 East
Plaza Boulevard. Applicant: 20/20 Recycle Centers. Case File No.
CUP-1994-13. Continued from Council Meeting of 10/3/95.

RECOMMENDATION: Staff recommended that Council Close the
Public Hearing and file the report.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, to close
the public hearing and in favor of Staff's recommendation.
Carried by unanimous vote. Absent: Morrison.
CONTRACT (C92-29)
2. Public Hearing on Honeywell, Inc., Comprehensive Energy
Conservation Program.
RECOMMENDATION: Staff recommended that Council hold a
Public Hearing and take testimony.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, to close
the public hearing and in favor of Staff's recommendation.
Carried by unanimous vote. Absent: Morrison
NON CONSENT RESOLUTIONS
Motion by Zarate, seconded by Inzunza, the Non Consent Resolutions be
read by title only. Carried by unanimous vote. Absent: Morrison.
PARKING ADMIN 1995 (801-2-15)
3. Resolution No. 95-154. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE INSTALLATION OF ONE ON -STREET HANDICAPPED
PARKING SPACE AT 336 "D" AVENUE, NATIONAL CITY,
CALIFORNIA."
RECOMMENDATION: Staff recommended that Council approve
the resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
the approval of Resolution No. 95-154. Carried by unanimous
vote. Absent: Morrison.

CONTRACT (C95-15)
4. Resolution No. 95-155. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
CONTRACT CHANGE ORDER NO. ONE FOR THE TRAFFIC
SIGNAL IMPROVEMENTS. (ENGINEERING SPECIFICATION
NO. 94-9)
RECOMMENDATION: Staff recommended that Council approve
the resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
the approval of Resolution No. 95-155. Carried by unanimous
vote. Absent: Morrison.
CONTRACT (C92-29)
5 (a). Resolution No. 95-156. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE A HOME AND BUILDING
CONTROL AGREEMENT AND A LEASE -PURCHASE
AGREEMENT WITH HONEYWELL, INC. AND A CONSENT TO
ASSIGNMENT TO LA SALLE NATIONAL BANK AND
AUTHORIZING THE MAYOR AND STAFF TO EXECUTE
RELATED DOCUMENTS."
RECOMMENDATION: Staff recommended that Council adopt the
resolution.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, in favor of
the approval of Resolution No. 95-156. Carried by unanimous
vote. Absent: Morrison.
CONTRACT (C95-34)
5 (b). Resolution No. 95-157. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE A POWER TO SAVE INCENTIVE
AGREEMENT WITH SAN DIEGO GAS & ELECTRIC."
RECOMMENDATION: Staff recommended that Council adopt the
resolution.

ACTION: Motion by Inzunza, seconded by Zarate, in favor of
the approval of Resolution No. 95-157. Carried by unanimous
vote. Absent: Morrison.
BUILDING PERMIT ADMIN (405-2-1)
6. Resolution No. 95-158. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY GRANTING A
PERMIT TO MOVE A SINGLE FAMILY DWELLING WITHIN
THE CITY LIMITS."
RECOMMENDATION: Staff recommended that Council grant
authorization to issue the permit to move the dwelling subject to City
approval of plans showing compliance with all applicable regulations
and standards as reflected in the attached plan check corrections.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, in favor of
the approval of Resolution No. 95-158. Carried by unanimous
vote. Absent: Morrison.
ORDINANCES FOR ADOPTION
Motion by Zarate, seconded by Inzunza, the Ordinances be adopted by title
only. Carried by unanimous vote. Absent: Morrison.
MUNICIPAL CODE 1995 (506-2-10) / ZONING 1995 (506-1-10)
7. Ordinance No. 95-2098. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
AMENDING TITLE 18 (ZONING) OF THE NATIONAL CITY
MUNICIPAL CODE PERTAINING TO SIGNS, ADVERTISING
BANNERS, FLAGS, BUNTING AND PAINTED WALL SIGNS, AS
WELL AS APPEAL RIGHTS FOR SIGN -RELATED VIOLATIONS
AND AMENDING APPENDIX A OF THE NATIONAL CITY
LAND USE CODE. CASE FILE NO. A-1995-2."
RECOMMENDATION: Staff recommended that the Ordinance be
adopted.

ACTION: Motion by Beauchamp, seconded by Inzunza, in
favor of Ordinance No. 95-2098. Carried by unanimous vote.

DSG/PROFESSIONAL SERVICES SELECTION PROCEDURES

8. Ordinance No. 95-2099. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
ADOPTING PROCEDURES FOR SELECTION OF
PROFESSIONAL FIRMS."
RECOMMENDATION: Staff recommended that Council approve
and adopt the Ordinance.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Inzunza, in
favor of Ordinance No. 95-2099. Carried by unanimous vote.
Absent: Morrison.
WRITTEN COMMUNICATIONS
ROUTE 54 PLANNING ADMIN (803-2-1)
9. SUBJECT: Letter from Dudley Crawford requesting a public
hearing on the re -opening of Cagle Street.
TESTIMONY: Dudley Crawford, 3312 Bonita Height Lane,
Bonita, CA, spoke in support of his request.
Vice Mayor Morrison arrived in the Council Chambers at 4:20 p.m.
ACTION: Consensus of the Council was for staff to contact
the post office to assist in the situation.
PUBLIC REQUEST/COMPLAINT ADMIN (102-1-1)
10. SUBJECT: Letter from Frank Scott regarding reported problems on
Bucky Lane.

TESTIMONY: Frank Scott, 905 Bucky Lane, National City,
spoke regarding a problem house in his neighborhood.
Divera Scott, 905 Bucky Lane, National City, spoke regarding
the problem house in the neighborhood, the large amount of
vehicle traffic to and from this house, their lack of trash service
and other related issues.
Karen Witherspoon -Mitchell, representing her parents who live
across the street from the problem house, expressed her
concerns with the activities going on at the house and the
endangerment to her family.
Carlos Angeles, 923 Bucky Lane, National City expressed his
concerns with the problem house and activities going on at it.
Alice Hill, 906 Bucky Lane, National City, expressed concerns
with the trash generated from the problem house, car traffic,
gun shots etc., and requested assistance regarding a tree on
private property (Summit Apartments) that was affecting her
property.
Bill Croce, 911 Bucky Lane, National City, expressed his
concerns with the activity at the problem house and the effect
on the neighborhood.
ACTION: Consensus of the Council was to refer the concerns
expressed to the City Manager, City Attorney and Acting
Police Chief for further action.
NEW BUSINESS
WARRANT REGISTERS 1995 (202-1-10)
11. SUBJECT: Warrant Register #17. Ratification of Demands in the
amount of $198,373.24 (Warrant Nos. 136276 through 136356
inclusive excepting none).
RECOMMENDATION: Staff recommended ratification of
these warrants.

ACTION: Motion by Morrison, seconded by Inzunza, in
favor of the Ratification of Demands. Warrants carried by the
following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison,
Zarate, Waters. Nays: None. Abstaining: None. Absent:
None.
WARRANT REGISTERS 1995 (202-1-10)
12. SUBJECT: Warrant Register #18. Ratification of Demands in the
amount of $440,797.18 (Warrant Nos. 136358 through 136434
inclusive excepting none) and Certification of Payroll in the amount
of $440,797.18.
RECOMMENDATION: Staff recommended ratification of
these warrants.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of the Ratification of Demands and Certification of Payroll.

Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: None. Absent: None.
TRAFFIC SIGN/SIGNAL ADMIN (801-4-6)
13. SUBJECT: Delay of traffic signal installation at Brisbane and 4th
Avenue (Dixieline/Highland Avenue).
RECOMMENDATION: Staff recommended direction from the
Council on whether they will consider a delay on the installation of
the traffic signal.
NOTE: Councilman Beauchamp stated he would be abstaining from
participation on this item as he has business with the developer.
TESTIMONY: Glen Daigle, representing Gatlin
Development, spoke in support of the request and responded to
questions of the Council.
ACTION: Motion by Waters, seconded by Morrison, to hold
this item over to the November 14, 1995 agenda to allow staff
to gather additional information. Carried by the following
vote, to -wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays:
None. Abstaining: Beauchamp.

TEMPORARY USE PERMITS 1995 (203-1-11)
14. SUBJECT: Request for use of the Community building for National
City's Municipal Employees' dinner/dance Christmas party.
RECOMMENDATION: Staff recommended to approve the use of
the Community Building, with payment of the custodial fee of
$111.70, and provision of insurance acceptable to the Risk Manager,
approve the selling of alcohol for the event subject to obtaining an
ABC permit.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
the request. Carried by the following vote, to -wit: Ayes:
Inzunza, Morrison, Zarate, Waters. Nays: Beauchamp.
Abstaining: None.
TEMPORARY USE PERMITS 1995 (203-1-11)
15. SUBJECT: Requested use of Community building and its parking
lot on Saturday, November 18, 1995 by the Mexican Cultural
Institute of San Diego to hold a Health Fair.
RECOMMENDATION: Staff recommended to approve the use of
the facility as requested, subject to provision of insurance acceptable
to Risk Manager, and security provisions acceptable to the Police
Chief.
ACTION: Motion by Beauchamp, seconded by Inzunza, in
favor of the request. Carried by the following vote, to -wit:
Ayes: Beauchamp, Inzunza, Zarate, Waters. Nays: Morrison.
Abstaining: None.
BUILDING PERMIT ADMIN (405-2-1)
16. SUBJECT: Request of Alex McLintock for additional extension of
Building Permits for construction at 1835 and 1837 "A" Avenue.
RECOMMENDATION: Staff recommended the City Council
select one of the alternative actions specified in the attached report.
TESTIMONY: Alex McLintock, 2038 Euclid Avenue,
National City, spoke in support of his request and responded to
questions of the Council.

ACTION: Motion by Waters, seconded by Inzunza, in favor
of granting Mr. McLintock an additional 30 days to obtain a
required inspection appraisal and required permits. Carried by
unanimous vote.
CASA DE SALUD ADMIN (702-09-01)
17. SUBJECT: Casa de Salud renovation project - Status Update.
RECOMMENDATION: Staff recommended this as an information
item for Council.
ACTION: Motion by Inzunza, seconded by Zarate, the report
be accepted and filed. No objection as filed.
TEMPORARY USE PERMITS 1995 (203-1-11)
18. SUBJECT: Temporary Use Permit - San Diego Low Rider
Association and the National City Police Department Toys for
Tots/Car Show.
RECOMMENDATION: Staff recommended approval of the
application for a Temporary Use Permit subject to compliance with
all conditions of approval and grant the request for waiver of the
$345.00 processing fee.
TESTIMONY: Richard Sherman, 1236 E. 16th Street,
National City, spoke in support of the request and responded to
questions of the Council.
ACTION: Motion by Beauchamp, seconded by Inzunza, in
favor of the request subject to compliance with all conditions
of staff, and grant the waiver of fees. Carried by unanimous
vote.
FIRE DEPT ADMIN (305-1-1) / TEMPORARY USE PERMIT 1995
(203-1-11)
19. SUBJECT: Request by the National City Firefighters' Association
for: (1) Use of the 1925 Seagraves Fire truck; (2) Waiver of T.U.P
fees and insurance requirement.

RECOMMENDATION: Staff recommended to approve request as
submitted.
TESTIMONY: Bob Medina, representing the National City
Firefighter's Association, spoke in support of the request and
responded to questions of the Council.
ACTION: Motion by Beauchamp, seconded by Morrison, in
favor of the request. Carried by unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR
Mayor Waters thanked the Star News for their accurate coverage of the
Crime Report and their positive article on the National City Boys & Girls
Club. He then stated that he had received a letter from Congressman Filner
assuring him that he would not support any proposal that would interfere
with the Marina plans. Mayor Waters then commented on the success of the
Free Trash Haul Day.
CITY COUNCIL
SAN DIEGO ASSOC OF GOVTS ADMIN 1995 (105-1-5)
20. SUBJECT: Verbal report on SANDAG accomplishments.
Councilwoman Zarate provided the Council with copies of a 1995 Year-end
Legislative Wrap-up (copy on file in the office of the City Clerk). She then
invited all present to attend a SANDAG workshop on "Livable
Communities" to be held in the Winn Room at the Coronado Library on
November 17, 1995 at 2:00 p.m.

LEAGUE OF CALIFORNIA CITIES ADMIN (104-2-1)
21. SUBJECT: Verbal follow-up on report of Cities Conference.
Assistant City Manager Bolint presented a brief verbal overview of the
workshops he attended at the League Conference and the legislative
sessions.
Councilman Beauchamp reported on the voting items and the process
followed.
Councilwoman Zarate stated that Ken Fabricatore would be available to
present a workshop on the California Constitution Revision if Council so
desired. He has presented this for SANDAG.
Vice Mayor Morrison reported that at the Free Trash Haul Day one hundred
40-cubic-yard bins were filled, and reminded everyone that this Saturday,
November 11, 1995, a free Hazardous Waste Haul Day is being held at
32nd and Tidelands Avenue in National City.
PUBLIC ORAL COMMUNICATIONS - None.
CLOSED SESSION:
Conference with Legal counsel - Existing Litigation - Government Code
Section 54956.9 (a) - National Police Officer's Association, et al. v. City of
National City, et al.
ACTION: Moved by Inzunza, seconded by Morrison, in favor
of holding the Closed Session under Government Code Section
54956.9(a). Carried by unanimous vote.
Council Members left the Council Chambers at 6:50 p.m.
Council Members returned to the Council Chambers at 7:17 p.m.
