MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
NOVEMBER 28, 1995
The Regular Meeting of the City Council of the City of National City was
called to order at 7:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples,
Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Morrison.
APPROVAL OF MINUTES
Motion by Zarate, seconded by Inzunza, the Minutes of the Regular
Meeting of November 21, 1995 be approved. Carried by unanimous vote.
INTERVIEW/APPOINTMENTS
APPOINTMENT VICE MAYOR ADMIN (101-20-1)
Mayor Waters recommended that Councilwoman Rosalie Zarate be
appointed as the new Vice Mayor for the following year.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of the Mayor's recommendation. Carried by the following
vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Waters.
Nays: None. Abstaining: Zarate.

Mayor Waters then called on the City Manager who announced the
appointment of the new National City Police Chief, Anthony L. "Skip"
Dicerchio. The Mayor introduced the new Chief to the Council, Staff and
audience.
PUBLIC HEARING
CONDITIONAL USE PERMIT 1995 (403-10-5)
1. Public Hearing - Conditional Use Permit for a Cellular
Communications Facility with a 65 foot high monopole at 12 N.
Euclid Avenue. (Case File No. CUP-1995-4). (Applicant: Airtouch
Cellular).
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the City Clerk.
RECOMMENDATION: Staff concurred with the Planning
Commission decision to approve the application.
TESTIMONY: Robert Saito, 125 N. "U" Avenue, National
City, spoke in opposition.
Martin Cervantes, 33 N. "T" Avenue, National City, spoke in
opposition.
James Marler, 2111 Melrose Street, National City, spoke in
opposition.
Kevin McGee, 5355 Mira Sorrento Place, San Diego,
representing Airtouch Cellular, spoke in support and responded
to questions and concerns of the Council and public.
ACTION: Motion by Inzunza, seconded by Waters, 10
continue the public hearing to January 9, 1996. Carried by
unanimous vote.
CONSENT CALENDAR
ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 95-170
through 95-171). NOTE: Beauchamp requested Item No. 3 be pulled.
Motion by Inzunza, seconded by Morrison, the Consent Resolutions be
adopted (except Item No. 3 - Resolution No. 95-171). Carried by
unanimous vote.

CONTRACT (C95-37)
2. Resolution No. 95-170. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY DECLARING
MISSION POOLS OF ESCONDIDO, INC. TO BE THE LOWEST
RESPONSIVE BIDDER AND AUTHORIZING THE MAYOR TO
EXECUTE AN AGREEMENT WITH MISSION POOLS OF
ESCONDIDO, INC. FOR THE LAS PALMAS PARK SWIMMING
POOL UNDERWATER LIGHTING REPAIR PROJECT.
(ENGINEERING SPEC. NO. 95-5)."
ACTION: Adopted. See above.
ENCROACHMENT AGREEMENT ADMIN (903-14-1)
3. Resolution No. 95-171. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
AND AUTHORIZING THE RECORDATION OF AN
ENCROACHMENT AGREEMENT WITH MEAD CORPORATION
AND CH2M HILL, INC. FOR THE INSTALLATION OF TWO
MONITORING WELLS ON TIDELANDS AVENUE AND ON
HAFFLY AVENUE SOUTH OF 19TH STREET."
ACTION: Motion by Beauchamp, seconded by Inzunza, in
favor of Resolution Nos 95-171. Carried by unanimous vote.
ORDINANCES FOR INTRODUCTION
Motion by Zarate, seconded by Inzunza, the Ordinance be introduced by
title only.
Amended motion by Beauchamp, seconded by Morrison, that the meeting
times be amended to 6:00 p.m. for all meetings. Motion carried by the
following vote, to -wit: Ayes: Beauchamp, Morrison, Zarate. Nays:
Inzunza, Waters.
MUNICIPAL CODE 1995 (506-2-10)
4. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AMENDING SECTION 1 OF ORDINANCE NO. 1740
AND SECTION 2.04.010 OF THE NATIONAL CITY MUNICIPAL
CODE, PERTAINING TO MEETING TIMES OF THE CITY COUNCIL."

NEW BUSINESS
WARRANT REGISTERS 1995 (202-1-10)
5. SUBJECT: Warrant Register #21. Ratification of Demands in the
amount of $242,115.25 (Warrant Nos. 136598 through 136711
inclusive excepting None).
RECOMMENDATION: Staff recommended ratification of
these warrants.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of the Ratification of Demands. Warrants carried by the
following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison,
Zarate, Waters. Nays: None. Abstaining: None. Absent:
None.
CONDITIONAL USE PERMIT (403-10-11)
6. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 26-95 approving a Conditional Use Permit for used paper
collection, sorting and packaging at 1300 Wilson Avenue. (Case File
No. CUP-1995-12). (Applicant: Browning -Ferris Industries).
RECOMMENDATION: Staff concurred with the Planning
Commission decision to approve the application.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, for
approval. Carried by unanimous vote.
CONDITIONAL USE PERMIT (403-10-12)
7. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 27-95 approving a Conditional Use Permit for a Cellular
Communications Facility at 1645 E. Plaza Boulevard. (Applicant:
Kirk Dakan, Pacific Bell Mobile Services) (Case File No. CUP-
1995-13).
RECOMMENDATION: Staff concurred with the Planning
Commission decision and recommended that the Notice of Decision
be filed.
NOTE: Vice Mayor Zarate stated she would be abstaining on this
item as her home abuts the property.

ACTION: Motion by Beauchamp, seconded by Waters, in
favor. Carried by the following vote, to -wit: Ayes:
Beauchamp, Inzunza, Morrison, Waters. Nays: None.
Abstaining: Zarate.
COUNCIL MEETINGS REGS/SCH ADMIN (102-7-1)
8. SUBJECT: Holiday Season City Council Recess.
RECOMMENDATION: Staff recommended City Council establish
the holiday season Council meeting recess as Tuesday, December 19,
1995 and Tuesday, January 2, 1996.
TESTIMONY: None.
ACTION: Motion by Waters, seconded by Zarate, in favor of
Staffs recommendation. Carried by unanimous vote.
CLAIM (501-1-115)
9. SUBJECT: Claim for damages: Eric Hanson.
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, to deny
the claim and refer it to the City Attorney. Carried by
unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR - No report.

CITY COUNCIL
Vice Mayor Zarate requested that Staff have Animal Control and the
County look into a cat problem at 227 E. 2nd Street, National City.
PUBLIC ORAL COMMUNICATIONS
Louise Martin, 1527 E. 15th Street, National City, reminded all present that
Saturday, December 2, 1995 was the Annual Pancake Breakfast sponsored
by the National City Firefighters' Association to benefit the Spirit of the
Holidays Program.
Ivan Bodge, 2210 E. 22nd Street, National City, stated he preferred the
staggered Council Meeting times, and then spoke regarding code
enforcement, preventative policing, and his action with CalTrans to close
the 805 overpass walkway.
Councilman Inzunza left the Council Chambers at 8:20 p.m.
Councilman Inzunza returned to the Council Chambers at 8:22 p.m.
ADJOURNMENT
Motion by Morrison, seconded by Zarate, to adjourn to the next Regular
City Council Meeting - December 5, 1995 - 4:00 P.M. - Council Chambers,
Civic Center. Carried by unanimous vote.
The meeting closed at 8:25 p.m.
