MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
February 13, 1996
The Regular Meeting of the City Council of the City of National City was
called to order at 6:02 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Zarate.
Mayor Waters deviated from the Agenda to recognize Mrs. Aileen Roberts,
present in the audience, who was celebrating her 50th (Golden) Wedding
Anniversary.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Regular
Meeting of February 6, 1996 be approved. Carried by unanimous vote.
BOARDS AND COMMISSIONS
INTERVIEWS/APPOINTMENTS
SAN DIEGO COUNTY WATER AUTHORITY BOARD (101-19-1)
Mayor Waters turned the meeting over to Vice Mayor Zarate, who stated
that the Mayor had recommended that Mr. Frank Chenelle be re -appointed
to the San Diego County Water Board for a full term ending March 8, 2002.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of the Mayor's recommendation. Carried by unanimous vote.
City Clerk Peoples administered the Oath of Office to Mr. Chenelle.

TRAFFIC SAFETY COMMITTEE (101-4-1)
Vice Mayor Zarate, introduced Mr. Gilberto Garcia, 1440 Sheryl Lane,
National City who explained his interest in serving on the Traffic Safety
Committee, and answered questions of the Council.
BUILDING ADVISORY & APPEALS BOARDS (101-10-1)
Vice Mayor Zarate stated that the Mayor had recommended Mr. Mark Kettl
be appointed to the Building Advisory & Appeals Board for a full term
ending February 28, 2000.
ACTION: Motion by Inzunza, seconded by Beauchamp, in
favor of the Mayor's recommendation. Carried by unanimous
vote.
City Clerk Peoples administered the Oath of Office to Mr. Kettl.
Vice Mayor Zarate turned the meeting back over to Mayor Waters.
PUBLIC HEARINGS
CONDITIONAL USE PERMITS 1995 (403-10-7)
1. Public Hearing - Conditional Use Permit to allow a Mobile Recycling
Facility at 3007 Highland Avenue. (Applicant: Environmental
Products Corporation). (Case File No. CUP-1995-10).
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the City Clerk.
RECOMMENDATION: Staff recommended that the public hearing
be continued to the April 23, 1996, meeting.
TESTIMONY: Cecilia Kirk, 311 E. 2nd Street, National City,
spoke in opposition to the location of a recycling facility so
close to the high school.
ACTION: Motion by Beauchamp, seconded by Morrison, hi
favor of Staff's recommendation to continue the Public
Hearing to April 23, 1996. Carried by unanimous vote.

SANDAG REGIONAL GROWTH MANAGEMENT STRATEGY
(105-3-6)
2. Public Hearing - Determination of National City's consistency with
the Regional Growth Management Strategy.
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the City Clerk.
RECOMMENDATION: Staff concurred with the Planning
Commission recommendation to approve the checklist.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Beauchamp, to
close the Public Hearing and move in favor of the Planning
Commission's recommendation to approve the check list.
Carried by unanimous vote.
UNDERGROUND UTILITY DISTRICT 17 ADMIN (904-1-3)
3. Public Hearing - To determine whether the public health safety or
welfare require the re-establishment of Underground Utilities District
No. 17 on Roosevelt from 7th to 9th Streets, on 8th Street from
Hoover Avenue to "D" Avenue, on 9th Street from Roosevelt Avenue
to "A" Avenue and portions of Alleys No. 160, 161, and 162.
RECOMMENDATION: Staff recommended that the Council holds
a Public Hearing to determine whether Public Health, Safety, and
Welfare necessitate the formation of the District.
TESTIMONY: City Engineer Myers stated that the Public
Hearing had not been legally noticed and provided an
explanatory memorandum (copy on file in the Office of the
City Clerk).
General discussion ensued among the Council members.
ACTION: Motion by Inzunza, seconded by Morrison, to
direct staff to bring back an agenda item within 30 days for
Council consideration of specific areas to focus on and
financing possibilities. Carried by the following vote, to -wit:
Ayes: Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: Beauchamp.

NON CONSENT RESOLUTIONS
Motion by Zarate, seconded by Morrison, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.

4. Resolution No. 96-21. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY APPROVING THE
LOCAL/REGIONAL CONSISTENCY CHECKLIST FOR THE
REGIONAL GROWTH MANAGEMENT STRATEGY."
RECOMMENDATION: Staff recommended that the Council adopt
the attached Resolution.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Resolution No. 96-21. Carried by unanimous vote.
CONTRACT (C95-18)
5. Resolution No. 96-22. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND
AUTHORIZING THE FILING OF THE NOTICE OF
COMPLETION, AND APPROVAL OF CHANGE ORDER NO. 1
FOR THE STREET RESURFACING PROJECT F.Y. 1995.
(ENGINEERING SPEC. NO. 95-1)."
RECOMMENDATION: Staff recommended that the Council adopt
the Resolution.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, to hold
this item over pending receipt of additional information from
Staff. Carried by unanimous vote.

CONTRACT (C96-8)
6. Resolution No. 96-23. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY REJECTING THE BID BY
IRISH COMMUNICATION FOR THE OVERHEAD TO
UNDERGROUND SERVICE CONVERSION FOR PRIVATE
PROPERTIES ALONG CIVIC CENTER DRIVE FROM
NATIONAL CITY BOULEVARD TO 1-5, DECLARING THAT
THE PROJECT CAN BE PERFORMED MORE ECONOMICALLY
BY DAY LABOR, OR THE MATERIALS OR SUPPLIES
FURNISHED AT A LOWER PRICE IN THE OPEN MARKET,
AND AUTHORIZING THE CITY ENGINEER TO DIVIDE THE
PROJECT INTO SMALLER INDIVIDUAL CONTRACTS AND
SOLICIT BIDS. (ENGINEERING SPEC. NO. 96-4)."
RECOMMENDATION: Staff recommended that the Council adopt
the Resolution.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Resolution No. 96-23. Carried by the following vote, to -wit:
Aye: Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: Beauchamp.
ORDINANCES FOR ADOPTION
Motion by Morrison, seconded by Inzunza, the Ordinance be adopted by
title only. Carried by unanimous vote.
MUNICIPAL CODE 1996 (506-2-11)
7. Ordinance No. 96-2103. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY, ADDING
CHAPTER 1.40 TO THE NATIONAL CITY MUNICIPAL CODE
PERTAINING TO CLAIMS FOR MONEY, DAMAGES OR
REFUNDS OF MONEY."
RECOMMENDATION: Staff recommended that Council approve
and adopt the Ordinance.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Ordinance No. 96-2103. Carried by unanimous vote.

OLD BUSINESS
SDG&E FRANCHISE ADMIN (205-1-1)
8. SUBJECT: Proposal from SDG&E for Buying Down Conversion
Allocation and New Job Connection Credits.
RECOMMENDATION: Staff recommended that the report and
proposal be filed and no action be taken at this time.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Staff's recommendation. Carried by the following vote, to -
wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: Beauchamp.
NEW BUSINESS
WARRANT REGISTERS 1995 (202-1-10)
9. SUBJECT: Warrant Register #32. Ratification of Demands in the
amount of $686,745.91. (Warrant Nos. 137553 through 137637
inclusive excepting none) and Certification of Payroll in the amount
of $397,606.68.
RECOMMENDATION: Staff recommended ratification of these
warrants.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of the Ratification of Demands and Certification of Payroll.

CONDITIONAL USE PERMITS 1995 (403-10-13)
10. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 3-96 approving a Conditional Use Permit for a church within a
shopping center at 20 N. Euclid Avenue. (Applicant: Robert E.
Sullivan). (Case File No. CUP-1995-15).
RECOMMENDATION: Staff recommended that Council accept
and file the Notice of Decision.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, the Notice
of Decision be filed. No objection as filed.

CONDITIONAL USE PERMITS 1995 (403-10-14)
11. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 2-96 approving a Conditional Use Permit for a karate school at
1625 Sweetwater Road, Suite #G2. (Applicant: Tomohiro Arashiro).
(Case File No. Cup-1995-19).
RECOMMENDATION: Staff recommended that Council accept
and file the Notice of Decision.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, in favor of
Staff's recommendation. Carried by unanimous vote.
CONDITIONAL USE PERMITS 1995 (403-10-15)
12. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 3-96 approving a Conditional Use Permit for a church within a
commercial building at 1539 E. 8th Street. (Applicant: Crisanta La
Rosa). (Case File No. CUP-1995-16).
RECOMMENDATION: Staff recommended that Council accept
and file the Notice of Decision.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, the
item be held over for Public Hearing. Carried by unanimous
vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR
Mayor Waters reported that the National City Police Department would be
reinstating their fingerprinting service; Sweetwater Authority was
considering the re-establishment of an agricultural discount program which
would provide water for agricultural uses at $137 per acre foot and would
greatly benefit the Stein Farm; provided an update on the Community
Development Commission which has issued a check to the City for Block

Grant funds in the amount of $125,686.42 for graffiti, housing inspector,
tiny tots, learn to swim, dusk -to -dawn lighting, El Toyon remodel, building
sensor alarms, ADA building facility improvements, the Library extension
renovation, Casa de Salud, Las Palmas Pool, ADA pedestrian ramps, MOP
statement, traffic signals and storm drains; advised and invited all in
attendance to the groundbreaking ceremony tomorrow at 11:00 a.m. at 24th
Street and Wilson for the National City Adult Education Center (a bus to
leave City Hall at 10:30 a.m.); and lastly, advised that the Fourth District
Court of Appeal had issued a decision in favor of the City and the Port
District, affirming the trial court's decision to dismiss the Save Our Bay,
Inc's suit challenging the EIR for the National City Marina Project.
CITY COUNCIL
Councilman Inzunza made comment on how clean the City was of
abandoned shopping carts.
Vice Mayor Zarate suggested the Marina area be developed with a unique,
family oriented development.
Councilman Morrison added comment on the collection methods for the
shopping carts and commented on what a good event Mr. Natividad held
last weekend in the park for the voter registration volunteers - they kept the
music level down and no complaints were received.
Councilman Beauchamp made inquiry on whether there would be a grand -
opening ceremony for the Paleta Creek Bridge; stated that the SUHI boys
soccer team were the new Metro Champions; expressed pleasure in the way
Port Director Killean was handling NAFTA issues by involving Santa Fe;
stated he had attended an assembly at National City Middle School for
Black History Month and inquired as to the process to obtain proclamations
for presentation at such events.
Mayor Waters commended the Police Chief and his officers for the way
they handled several incidents in the parks over the weekend.

PUBLIC ORAL COMMUNICATIONS
Rosemary Peyron, 207 So. Belmont Street, National City, requested Council
look into a demolished house at the southwest corner of 14th and Roosevelt
that is a community eyesore.
Everett Dickson, 2745 E. 14th Street, National City, spoke regarding the
new Mile of Cars signs and the need for coverage at the knee braces to
improve the looks. Mr. Dickson volunteered to fabricate a template for
making covers for them.

ACTION: Motion by Morrison, seconded by Inzunza, in favor
of holding the Closed Session under Government Code
54956.9 (a). Carried by unanimous vote.
Council members left the Council Chambers at 7:43 p.m.
Council members returned to the Council Chambers at 7:54 p.m.
