ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Zarate. APPROVAL OF MINUTES Motion by Inzunza, seconded by Morrison, the Minutes of the Regular Meeting of February 27, 1996 and the Adjourned Workshop Meeting of February 29. 1996 be approved. Carried by unanimous vote. MAYOR'S PRESENTATIONS Mayor Waters presented a plaque from the Boys & Girls Club of National City to Southland Clutch for their generous donation to the club. PROCLAMATIONS (102-2-1) Motion by Zarate, seconded by Morrison, the Proclamation be read in its entirety. Carried by unanimous vote. The Proclamation proclaiming the month of March 1966 to be: "NATIONAL PURCHASING MONTH" was read aloud in its entirety by Mayor Waters, who then presented it to City of National City Purchasing Agent Brenda Hodges. Book 78/Page 66 03/05/96 PUBLIC HEARING PROPOSITION A TRANSNET (RTIP) ADMIN (205-5-1) 1. Public Hearing to adopt the Seven -Year (FY 1997-03) Regional Transportation Improvement Program (RTIP) and TransNet projects. (Engineering) NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff recommended the Council hold a Public Hearing to adopt the Seven -Year (FY 1997-03) Regional Transportation Improvement Program (RTIP) and TransNet Projects. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, to close the public hearing and in favor of the Seven Year FY 1997-2003 RTIP. Carried by unanimous vote. NON CONSENT RESOLUTIONS Motion by Morrison, seconded by Inzunza, the Non Consent Resolutions be read by title only. Carried by unanimous vote. CONTRACT (C95-18) 2. Resolution No. 96-24. A "RESOLUTION OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION AND APPROVAL OF CHANGE ORDER NO. 1 FOR STREET RESURFACING PROJECT FY 1995. (Engineering Specification No. 95-1)." RECOMMENDATION: Staff recommended that the Council adopt the Resolution accepting the work, approving Change Order No. 1, and authorizing the filing of a Notice of Completion. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Waters, in favor of Resolution No. 96-24. Carried by unanimous vote. Book 78/Page 67 03/05/96 PROPOSITION A TRANSNET (RTIP) ADMIN (205-5-1) 3. Resolution No. 96-25. A "RESOLUTION OF THE CITY OF NATIONAL CITY ADOPTING THE SEVEN-YEAR TRANSNET LOCAL STREET AND ROADS PROGRAM OF PROJECTS FOR FISCAL YEARS 1997 THROUGH 2003." (Engineering) RECOMMENDATION: Staff recommended that the Council adopt seven-year (FY 97-03) Regional Transportation Improvement Program (RTIP) and Transnet Projects. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of Resolution No. 96-25. Carried by unanimous vote. NATIONAL CITY COMMUNITY CENTER (1101-5-1) TEMPORARY USE PERMIT POLICY (203-1-5) 4. Resolution No. 96-26. A "RESOLUTION OF THE CITY OF NATIONAL CITY APPROVING A MODIFICATION TO THE RULES AND REGULATIONS FOR THE USE OF THE NATIONAL CITY COMMUNITY CENTER." (Public Works) RECOMMENDATION: Staff recommended that the Council approve the Resolution modifying the Rules and Regulations of the Community Center. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, in favor of Resolution No. 96-26. Carried by unanimous vote. Absent: Morrison. Councilman Morrison left the Council Chambers at 3:30 p.m. POLITICAL SUPPORT (102-4-1) 5. Resolution No. 96-27. A "RESOLUTION OF THE CITY OF NATIONAL CITY SUPPORTING INTRODUCTION AND ADOPTION OF A VALIDATING ACT IN RESPONSE TO SANTA CLARA COUNTY LOCAL TRANSPORTATION AUTHORITY v. GUARDINO." (City Attorney) Book 78/Page 68 03/05/96 POLITICAL SUPPORT (continued) RECOMMENDATION: Staff recommended that the Council adopt the Resolution. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Waters, in favor of Resolution No. 96-27. Carried by unanimous vote. Absent: Morrison. CONTRACT (C88-57) 6. Resolution No. 96-28. A "RESOLUTION OF THE CITY OF NATIONAL CITY APPROVING AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY OF NATIONAL CITY." (Personnel) RECOMMENDATION: Staff recommended that the Council approve the Resolution. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, in favor of Resolution No. 96-28. Carried by unanimous vote. Absent: Morrison. Item No. 7 was continued pending the return of Councilman Morrison. OLD BUSINESS UNDERGROUND UTILITIES DISTRICT ADMIN (904-1-1) 7. SUBJECT: A Proposed Utility Underground Conversion District on Highland Avenue from Division to 8th Streets. (Engineering) RECOMMENDATION: Staff requested direction from the City Council on whether to underground both Distribution and the Transmission lines, or to underground only the Distribution lines. NEW BUSINESS WARRANT REGISTERS 1995 (202-1-10) 8. SUBJECT: Warrant Register #35. Ratification of Demands in the amount of $75,894.39 (Warrant Nos. 137865 through 137919 inclusive excepting none). (Finance) Book 78/Page 69 03/05/96 WARRANT REGISTERS 1995 (continued) RECOMMENDATION: Staff recommended ratification of these warrants. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the Ratification of Demands. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Zarate, Waters. Nays: None. Abstaining: None. Absent: Morrison. CONTRACT (C86-29) 9. SUBJECT: Informational Report on Restructuring of Paratransit Services. (Planning) RECOMMENDATION: Staff recommended that the report be received and filed. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Inzunza, the report be accepted and filed. No objection as filed. EQUIPMENT/DONATION OF (209-1-3) 10. SUBJECT: Donation of 1983 Blue Bird bus from the National City Transit Company. (Police) RECOMMENDATION: Staff recommended that the Council approve acceptance of 1983 Blue Bird bus for conversion. TESTIMONY: F. Rios, Manager of National City Transit and National City Police Chief DiCerchio explained the proposal and responded to questions of the Council. Councilman Morrison returned to the Council Chambers at 3:40 p.m. ACTION: Motion by Beauchamp, seconded by Morrison, in favor of Staff's recommendation to accept and receive the Blue Bird bus. Carried by unanimous vote. Book 78/Page 70 03/05/96 TEMPORARY USE PERMITS 1996 (203-1-12) 11. SUBJECT: Temporary Use Permit - National Public Library Chili Cook -Off and National City Chamber of Commerce Heritage Days. (Building) RECOMMENDATION: Staff recommended that the Council approve the application for a Temporary Use Permit subject to compliance with all conditions of approval and grant the request for a waiver of the $345 processing fee. TESTIMONY: Anne Campbell, National City Librarian and Mary Alice Taliak, Executive Director of the National City Chamber of Commerce, spoke in support of the event and responded to questions of the Council. ACTION: Motion by Inzunza, seconded by Zarate, in favor of Staffs recommendation to approve the application for a Temporary Use Permit subject to compliance with all conditions of approval and grant the request for a waiver of the $345 processing fee. Carried by unanimous vote. Item No. 7 was heard at this time. OLD BUSINESS UNDERGROUND UTILITIES DISTRICT ADMIN (904-1-1) 7. SUBJECT: A Proposed Utility Underground Conversion District on Highland Avenue from Division to 8th Streets. RECOMMENDATION: Staff requested direction from the City Council on whether to underground both Distribution and the Transmission lines, or to underground only the Distribution lines. TESTIMONY: Joanne Reel, SDG&E, explained the timing necessary to get the projects scheduled. ACTION: Consensus of the Council was to hold a workshop within the next few weeks to discuss the alternatives available. Book 78/Page 71 03/05/96 CITY MANAGER City Manager McCabe stated that the Police Chief had received notification on the COPS program which had approved funding for 3 officers, that the money would be available when the program was in place. Police Chief DiCerchio explained the hiring process and responded to questions of the Council. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR Mayor Waters spoke regarding the need of the Citizen's Patrol, for a new office space location and stated that he would be contacting the various shopping center owners in an effort to assist them. Police Chief DiCerchio stated that he had recently assigned an officer to act as a liaison with the group. CITY COUNCIL Councilman Beauchamp stated that he had delivered a Proclamation Friday to the California Building Officials Annual Conference, whose new president is National City Building & Safety Director Mike Bouse. The organization also recognized Assemblywoman Denise Ducheney as the Legislator of the Year. He then made inquiry regarding the status of the Assistant City Manager position recruitment and the facilitated retreat for the Council. PUBLIC ORAL COMMUNICATIONS Louise Martin, 1527 E. 15th Street, National City, spoke regarding her involvement in the Citizen's Patrol, explaining that they dressed so as not to be identified with any group or organization, talked about a recent incident in which they were involved and then expressed her opinion that it would be cost prohibitive for the group to have to continually relocate among the shopping centers and that one-year locations would work better. Book 78/Page 72 03/05/96 CLOSED SESSION Conference with Legal Counsel - Pending Litigation - Government Code Section 54956.9(a) IN THE MATTER OF THE PETITIONS OF THE COUNTY OF SAN DIEGO, THE CITY OF NATIONAL CITY AND THE CITY OF NATIONAL CITY COMMUNITY DEVELOPMENT COMMISSION, FOR REVIEW OF WASTE DISCHARGE REQUIREMENTS ORDER NO. 88-57, ADDENDA NOS. 2 AND 4, AND CLEANUP AND ABATEMENT ORDER NO. 95-66, ISSUED BY THE CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD, SAN DIEGO REGION. ACTION: Motion by Morrison, seconded by Zarate, in favor of holding the Closed Session under Government Code section 54956.9(a). Carried by unanimous vote. Council left the Council Chambers at 4:53 p.m. Council returned to the Council Chambers at 5:30 p.m. ROLL CALL Council Members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. CLOSED SESSION REPORT City Attorney Eiser reported on the closed session, as follows: The closed session was held pursuant to Government Code Section 54956.9(a) to discuss a matter of pending litigation. The action taken in Closed Session was to authorize Superior Court review of the action of the State Water Resources Control Board in the matter listed on the Agenda, and the vote of the City Council was unanimous. ADJOURNMENT Motion by Morrison, seconded by Inzunza, to adjourn to the next Regular City Council Meeting - March 12, 1996 - 6:00 P.M. - Council Chambers, Civic Center. Carried by unanimous vote.
