MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
MAY 14,1996
The Regular Meeting of the City Council of the City of National City was
called to order at 6:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Zarate.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Regular
Meeting of May 7, 1996 be approved. Carried by unanimous vote.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Inzunza, the Proclamation be read in its
entirety. Carried by unanimous vote.
The Proclamation proclaiming May 17, 1996 to be: "PEACE
OFFICERS' MEMORIAL DAY" was read aloud in its entirety by Mayor
Waters, who then presented it to National City Police Detective Lou Balke,
President of National City Police Officers' Association. Detective Balke
thanked the Council for their support.
Mayor Waters deviated from the Agenda to announce that he had signed
checks for payment of the tax increment moneys in the amounts of $90,000.
to the San Diego County Office of Education, $90,000. to Southwestern
College, $700,604. for the last payment to National School District, and
$650,000. to the County of San Diego.

PUBLIC HEARINGS
CONDITIONAL USE PERMIT (403-9-10)
1. Public Hearing - Appeal of Planning Commission's approval of
modification of Conditional Use Permit-1994-14 to extend the
permitted hours of operation of a church and denial of a request to
modify a condition of approval to remove any link between parking
complaints and the church at 300 National City Boulevard.
Applicant: Rui Morais, Universal Church of Christ. Case File No.:
CUP-1995-17. (Planning)
RECOMMENDATION: Staff concurred with the Planning
Commission's decision to approved the request to extend the church
hours of operation and deny the request to modify a condition of
approval which links parking complaints to the church as authorized
by Conditional Use Permit-1994-14.
TESTIMONY: Planning Director Roger Post gave a brief
verbal report regarding the Universal Church of Christ located
in the Bay Theater at 330 National City Boulevard, and
responded to questions of the City Council.
Mike Keough, 12440 Kestrel Street, San Diego, representing
Heilig Meyers Furniture Store, spoke in opposition to the
proposed modification to the Conditional Use Permit and
requested a continuance of the Public Hearing to allow the
church and merchants to come up with a compromise that
would work for all parties involved.
Mike McDade, of Sullivan, Wertz, McDade & Wallace, 945
4th Avenue, San Diego, attorney representing the Universal
Church of the Kingdom of God, spoke in support of the
proposed modifications to the Conditional Use Permit and
responded to questions of the City Council.
Edward Campiani, Administrator to the Church, 12301 Luiz
Avenue, Coronado Hills, Mexico, spoke in support of the
proposed modifications to the Conditional Use Permit and
responded to questions of the City Council.
Juan Jose Torres, owner of the Bay Theater, 330 National City
Boulevard, spoke in support of the proposed modifications to
the Conditional Use Permit and responded to questions of the
City Council.

Ellen Stewart, John E. Stewart Company, 299 Landis Avenue,
Suite 203, Chula Vista, owner of 404-408 National City
Boulevard, read into the record a letter submitted in opposition
to the proposed Conditional Use Permit modifications that she
had submitted to the City Council (copy on file in the office of
the City Clerk).
Edward Campiani responded to questions from the City
Council.
ACTION: Motion by Inzunza, seconded by Morrison, to close
the Public Hearing. Carried by unanimous vote.
Planning Director Post responded to questions from the City
Council regarding truck parking signage which had gone
before the Traffic Safety Committee.
General discussion ensued.
Vice Mayor Zarate suggested that the lots behind the store be
included in the discussion.
Mike Keough, representing Heilig Myers, responded to
questions from the City Council.
ACTION: Motion by Morrison, seconded by Zarate, to reopen
the Public Hearing. Carried by unanimous vote.
Motion by Morrison, seconded by Zarate, to continue the
Public Hearing for 60 days to allow both groups to discuss and
reach agreement and get the results of the Traffic Safety
Committee meeting regarding truck parking on Roosevelt
Avenue. Carried by unanimous vote.
TESTIMONY: Edward Campiani, representing Universal
Church of Christ expressed concerns with the continual
extensions of their request.

STREET VACATION (902-31-1)
4. Resolution No. 96-59. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY GIVING NOTICE OF
INTENTION TO VACATE AND CLOSE A PORTION OF WEST
12TH STREET BETWEEN MCKINLEY AVENUE AND
INTERSTATE 5. CASE FILE NO. SC-1996-1." (Planning)
RECOMMENDATION: Staff recommended that Council adopt the
Resolution, setting a public hearing date for consideration of the
Planning Commission recommendation that the area be vacated.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza,
Resolution No. 96-59 be read by title only. Carried by
unanimous vote.
Motion by Morrison, seconded by Beauchamp, to set a Public
Hearing for June 11, 1996 to discuss this item further and allow
for additional review. Carried by unanimous vote.
PUBLIC HEARINGS (continued)
BUILDING PERMIT APPEALS/DENIALS ADMIN (405-2-2)
2. SUBJECT: Public Hearing - Appeals of Roy M. and Dorothy
Dickey regarding the Advisory & Appeals Board's Determination of
the lawful status of two dwelling units existing at 525-529 C Avenue.
(Building)
RECOMMENDATION: Staff recommended that the City Council
conduct the public hearing.
TESTIMONY: Building and Safety Director Michael Bouse
gave an overview of the Staff Report and a background on the
property complete with a slide presentation. He also provided
a viewgraph presentation on the Uniform Building Code
Residential Occupancy Designations of the property (copy on
file in the office of the City Clerk).

TESTIMONY: Gary Dickey, 3622 Steel Canyon Road,
Jamul, representing his parents, the property owners, spoke in
support of the appeal and responded to questions of the City
Council. He proposed the removal of the attic unit and
stairway, and installation of a heater in the garage and a carport
for off-street parking.
Mayor Waters declared the Public Hearing closed.
ACTION: Motion by Zarate, seconded by Inzunza, to deny
the appeal based on the findings and have the attic room
removed and the garage unit turned back into a legal garage.
TESTIMONY: National City Housing Inspector Hector
Zamarano reported on the number of identified and corrected
garage conversions throughout the City and responded to
questions of the City Council.
General discussion ensued.
ACTION: Motion carried by the following vote, to -wit:
Ayes: Inzunza, Morrison, Zarate. Nays: Waters.
Abstaining: Beauchamp.

Motion by Zarate, seconded by Morrison, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.

GRANT/LAW ENFORCEMENT (302-1-2)
3. Resolution No. 96-58. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE CHIEF
OF POLICE TO EXECUTE THE COMMUNITY ORIENTED
POLICING SERVICES (COPS) UNIVERSAL HIRING AWARD,
AND ALL GRANT DOCUMENTS RELATED THERETO."

RECOMMENDATION: Staff recommended that Council approve
the resolution.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Resolution No. 96-58. Carried by unanimous vote.

MAYOR TO EXECUTE AN AGREEMENT WITH
CONSTRUCTION ELECTRONICS INCORPORATED FOR THE
MAINTENANCE OF THE SECURITY ACCESS, PUBLIC
ADDRESS AND FIRE ALARM SYSTEMS AT THE POLICE
FACILITY." (Police)
RECOMMENDATION: Staff recommended resolution to approve
CEI (Construction Electronics Incorporated) as sole source vendor to
maintain security, fire alarm and public address system, and authorize
Purchasing Agent to issue purchase order as required.

17.07.032 OF THE NATIONAL CITY MUNICIPAL CODE
PERTAINING TO REQUIRED IMPROVEMENTS FOR
SUBDIVISIONS."
RECOMMENDATION: Staff recommended that Council adopt the
ordinance.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of the adoption of Ordinance No. 96-2105, Carried by
unanimous vote.
NEW BUSINESS
WARRANT REGISTERS 1995 (202-1-10)
9. SUBJECT: Warrant Register #45. Ratification of Demands in the
amount of $168,859.94 (Warrant Nos. 138687 through 138768
inclusive excepting none). (Finance)
RECOMMENDATION: Staff recommended ratification of these
warrants.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of the Ratification of Demands. Warrants carried by the
following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison,
Zarate, Waters. Nays: None. Abstaining: None. Absent:
None.
SPECIAL COUNCIL MEETINGS NOTICES ADMIN (102-5-1)
10. SUBJECT: Preparation of Agenda for May 29 City Council Retreat.
(City Attorney)
RECOMMENDATION: Staff recommended that Council direct
Staff as to preparation of Agenda.

TESTIMONY: City Attorney Eiser stated that the Retreat
would be held in the Senior Center, not the Library as indicated
on the Agenda Statement.
ACTION: Council concurrence was for the Agenda to state
"Strategic Planning of Objectives and Goals in the Governance
and Administration of the City" and whatever else the
consultant suggests.
TEMPORARY USE PERMITS 1996 (203-1-12)
11. SUBJECT: Temporary Use Permit - St. Anthony's Catholic Church.
(Building & Safety)
RECOMMENDATION: Staff recommended that Council approve
the application for a Temporary Use Permit subject to compliance
with all conditions of approval and deny the request for waiver of the
$345.00 processing fee.
TESTIMONY: Mr. Jesse Ramirez, 343 E. Plaza Blvd.,
National City, spoke in support of the Temporary Use Permit.
Richard Sherman, 1236 E. 16th Street, representing the
Lowriders' Association, stated they would sponsor the event.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of the Temporary Use Permit with denial of the request for
waiver of fees. Carried by unanimous vote.
VARIANCES 1996 (409-1-21)
12. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 11-96 approving a zone variance to allow parking within the
front and exterior side yard setbacks on vacant property at the
southeast corner of Highland venue and East 28th Street. Applicant:
Joel San Juan. Case File No.: Z-1996-2. (Planning)
RECOMMENDATION: Staff concurred with the Planning
Commission's decision to approve the zone variance.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, to accept
and file the Notice of Decision. No objection as filed.

CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF
National City Police Chief DiCerchio provided an update on the status of
the 1983 Blue Bird Bus which was donated by the National City Transit
Company to be converted for the use of the proposed Neighborhood
Policing Team as well as crime suppression activities throughout the entire
City.
MAYOR
Mayor Waters reported that the new Community Development Block Grant
total is $1,488,000., which includes an extra $100,000. above what was
anticipated.
CITY COUNCIL
Councilman Morrison stated that the City-wide trash clean-up day Saturday
was a success, and estimated that 112 40-foot bins had been filled.
Vice Mayor Zarate made inquiry of Building and Safety Director Bouse
regarding the status of the McLintock property.
Councilman Beauchamp made inquiry as to the dates that Staff would be
looking at for recess after budget. City Manager McCabe suggested June
25, July 2, and July 9, 1996.
PUBLIC ORAL COMMUNICATIONS
Everett Dickson, 2745 E. 14th Street, National City, spoke regarding the
handicap ramp being used to access the property at 16th Street and Euclid
Avenue on the northwest side, and reported several locations that have
converted garages.
ADJOURNMENT
Motion by Morrison, seconded by Inzunza, to adjourn to a Workshop on
Widening of Division to Harbison - May 15, 1996 - 6:00 p.m. - Large
Conference Room, Civic Center. Next Regular Council Meeting - May 21,
1996 - 6:00 P.M. - Council Chambers, Civic Center. Carried by unanimous
vote.
