MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
MAY 28, 1996
The Regular Meeting of the City Council of the City of National City was
called to order at 6:01 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Zarate.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Adjourned
Workshop Meeting of May 15, 1990 and the Regular Meeting of May 21,
1996 be approved. Carried by unanimous vote.
MAYORS PRESENTATIONS (102-14-2)
Mayor Waters presented a Certificate of Appreciation to Vladimir Valdez
for being named the "Youth of the Year" by the National City Boys & Girls
Club.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Inzunza, the Proclamation be read in its
entirety. Carried by unanimous vote.
The Proclamation proclaiming June 1, 1966 to be: "NATIONAL
SCHOOL DISTRICT DAY" was read aloud in its entirety by Mayor
Waters, who stated he would be presenting it at the celebration, Saturday.

INTERVIEWS AND APPOINTMENTS
TRAFFIC SAFETY COMMITTEE (101-4-1)
Vice Mayor Zarate introduced Mr. Vince Reynolds, 1243 Manchester
Street, National City, who explained his interest in serving on the Traffic
Safety Committee, and answered questions of the Council.
PUBLIC HEARINGS
CONDITIONAL USE PERMITS 1995 (403-10-7)
1. Continued Public Hearing -Conditional Use Permit to allow a Mobile
Recycling Facility at 3007 Highland Avenue. Applicant:
Environmental Products Corporation. Case File No.: CUP-1995-10.

NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the City Clerk.
RECOMMENDATION: Staff recommended that the Public
Hearing be continued to July 23, 1996.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Beauchamp, to
continue the Public Hearing to July 23, 1996. Carried by
unanimous vote.
CDC OWNED LAND/SALE (406-4-1)
2. Public Hearing regarding the sale of CDC -owned property at 1603
Euclid Avenue. (Community Development Commission)
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the Community Development Commission.
RECOMMENDATION: Staff recommended that the Mayor open
the Public Hearing, take testimony from the public, close the Public
Hearing, and recommend that the CDC consider the disposition of the
property.

ACTION: Mayor Waters declared the Public Hearing closed.
Motion by Zarate, seconded by Inzunza in favor of the sale of
the CDC owned property at 1603 Euclid Avenue. Carried by
unanimous vote.

3. Public Hearing regarding the sale of a residential unit on Brick Row,
at 906 "A" Avenue. (Community Development Commission)
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the Community Development Commission.
RECOMMENDATION: Staff recommended the authorization of
sale.
TESTIMONY: None.
ACTION: Mayor Waters declared the Public Hearing closed.
Motion by Inzuzna, seconded by Beauchamp, in favor of
Staffs recommendation. Carried by unanimous vote.
Mayor Waters requested Agenda Item No. 12 be heard at this time.
WRITTEN COMMUNICATIONS
TEMPORARY USE PERMITS 1996 (203-1-12)
12. SUBJECT: Memo from the Lion's Club regarding the fourth of July
carnival and the participation of television and radio stations.
TESTIMONY: Rudy Zamora representing the Lion's Club
and Bill Jacobs of Christiansen Amusements stated that they
were working with XEWT TV Channel 12 and La Poderosa
XEMO 860 am radio and responded to questions of the
Council.
Clayborn Swanson, 1921 "F" Avenue #3, National City, spoke
in opposition.
Aileane Roberts, 845 E. 13th Street, National City, requested
the inclusion of "Early American and Patriotic" music in the
event.

Clayborn Swanson, 1921 "F" Avenue #3, National City, again
expressed his views in opposition.
ACTION: Motion by Inzunza, seconded by Zarate, in favor
allowing the Lions Club to hold their talent show and
entertainment during the Fourth of July Carnival hours of
Friday from 4 p.m. to 9 p.m., Saturday from 2 p.m. to 9 p.m.
and Sunday from 2 p.m. to 6 p.m. Carried by unanimous vote.
NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Zarate, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.
COUNCIL POLICY ADMIN (102-13-1)
4. Resolution No. 96-68. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY APPROVING AN
AMENDMENT TO POLICY NUMBER 903 OF THE CITY
COUNCIL POLICY MANUAL." (Engineering)
RECOMMENDATION: Staff recommended that Council adopt the
Resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, 11
favor of Resolution No. 96-68. Carried by unanimous vote.
SUBDIVISION (415-28-1)
5. Resolution No. 96-69. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY
MANAGER TO EXECUTE A SUBDIVISION IMPROVEMENT
AGREEMENT WITH WELLS FARGO BANK, NATIONAL
ASSOCIATION, FOR A PROPOSED LOT SPLIT AT THE
NORTHEAST CORNER OF 24TH STREET AND HOOVER
AVENUE. (Case File No. LS-95-1) ."
RECOMMENDATION: Staff recommended that the Council adopt
the Resolution.

this item over for 90 days for further review. Carried by
unanimous vote.
CDC OWNED LAND/SALE (406-4-1)
6. Resolution No. 96-70. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF NATIONAL CITY TO SELL ITS 60% INTEREST IN A
RESIDENTIAL UNIT LOCATED AT 906 "A" AVENUE."

RECOMMENDATION: Staff recommended that the Council
approve the Resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of Resolution No. 96-70. Carried by unanimous vote.

7. Resolution No. 96-71. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE
COMMUNITY DEVELOPMENT COMMISSION OF THE CITY
OF NATIONAL CITY TO SELL A CDC -OWNED VACANT LOT
LOCATED AT 1603 EUCLID AVENUE. (SOUTHEAST CORNER
OF EUCLID AVENUE AND 16TH STREET)." (Community
Development Commission)
RECOMMENDATION: Staff recommended that the City Council
approve the Resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of Staff's recommendation to approve Resolution No. 96-71.

8. Resolution No. 96-72. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY SCHEDULING A PUBLIC
HEARING TO CONSIDER A REQUEST FOR CHANGE IN
TRASH SERVICE RATES." (Public Works)
RECOMMENDATION: Staff recommended that the City Council
adopt the Resolution setting the Public Hearing.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of Resolution No. 96-72 to set a Public Hearing for June 11,
1996. Carried by unanimous vote.
STREET DIVISION WIDENING (903-16-2)
9. Resolution No. 96-73. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY APPROVING A DEVIATION
FROM THE CITY'S STANDARDS FOR PUBLIC RIGHT -OF WAY
AND IMPROVEMENTS ON DIVISION STREET FROM DREXEL
AVENUE TO THE EASTERN CITY LIMITS." (Engineering)
RECOMMENDATION: Staff recommended that the City Council
adopt the resolution authorizing the City Engineer to deviate from the
City's standards for public right-of-way and public improvements,
Ordinance 92-2033 (dated June 16, 1992), for the widening of
Division Street from Drexel to the easterly City limits.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, in
favor of Resolution No. 96-73. Carried by unanimous vote.
CONTRACT (C-96-16)
10. Resolution No. 96-74. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE
MAYOR TO EXECUTE AN "AUTHORIZATION TO ORDER
AND CHANNEL TERMINATIONS AND T-1 CIRCUITS UNDER
STATE MASTER AGREEMENT" WITH PACIFIC BELL."

RECOMMENDATION: Staff recommended that the City Council
authorize the Mayor to sign the contract.

11. Ordinance No. 96-2107. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY, REPEALING
SECTION 25 OF ORDINANCE NO. 91-2018, AND ORDINANCE
NOS. 1952, 1935, 1803, AND 1663, AND AMENDING CHAPTER
18.24 OF THE NATIONAL CITY MUNICIPAL CODE BY
ADOPTING THE STATE OF CALIFORNIA DEPARTMENT OF
WATER RESOURCES MODEL FLOODPLAIN MANAGEMENT

amount of $157,816.26 (Warrant Nos. 138889 through 138974

RECOMMENDATION: Staff recommended ratification of these
warrants.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of the Ratification of Demands. Warrants carried by the
following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison,
Zarate, Waters. Nays: None. Abstaining: None. Absent:

NATIONAL CITY COMMERCIAL CENTER (1101-5-1)
14. SUBJECT: Use of the Community Building by Hermandad
Mexicana Nacional - San Diego on June 29, 1996, and waiver fees.
RECOMMENDATION: Staff recommended insurance be required
and Council decision on waiver.
TESTIMONY: Issa Guerrero, representing Hermandad
Mexicana Nacional - San Diego, 148 E. 30th Street, Suite. D,
National City, responded to questions of the Council.
Clayborn Swanson, 1921 "F" Avenue, National City, spoke in
opposition.
ACTION: Motion by Morrison, seconded by Waters, in favor
of the use with denial of the request for waiver of fees.
General discussion ensued.
ACTION: Amended motion by Morrison, seconded by
Waters, in favor of the use with waiver of fees except for
custodial, kitchen and liability insurance. Carried by
unanimous vote.

VARIANCES 1996 (409-1-21)
15. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 12-96 approving a zone variance for a 133 square foot wall sign
in lieu of the 25 square foot maximum allowed for signs facing other
than a street at 1518 Sweetwater Road. Applicant: Wesley
Fieldhouse for Staples. Case File no.: Z-1996-3. (Planning).
RECOMMENDATION: Staff concurs with the Planning
Commission's decision to approve the zone variance.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Staff's recommendation. Carried by unanimous vote.
CITY MANAGER
City Manager McCabe stated he had met with Vice Mayor Zarate and
determined that the date for the Finance Committee Meeting would be
Wednesday, June 12, 1996 from 9:00 a.m. to 4:00 p.m.
CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR - No report.
CITY COUNCIL
Councilman Inzunza clarified that the Marine Military Review will be at
Sweetwater Union High School . on June 10, 1996 at 1:30 p.m. and the 75th
Year Anniversary for Sweetwater Union High School. and Graduation of
the Class of 1996 will be on June 13, 1996 at 6:00 p.m.
Mayor Waters noted that the Councilmembers were having a plaque made
congratulating Sweetwater Union High School. on their 75th Anniversary
which will have their names engraved thereon and their accounts will each
be charged an equal amount of the total.

CITY COUNCIL (continued)
Vice Mayor Zarate requested the Public Works Director fix the street sign
for Euclid and Alpha as it has been turned opposite of what it should be.
Councilman Beauchamp provided an update on the cost and timing issues
of the MTDB Trolley and stated that the Board had made their final
decision on the final alignment of the Mission Valley East Line.
Councilman Morrison informed staff that the Euclid Avenue and Plaza
Boulevard recycling facility was in violation of their conditions of approval.
PUBLIC ORAL COMMUNICATIONS
Clayborn Swanson, 1921 "F" Avenue, #3, National City, expressed his
opinion on the 4th of July music, subdivisions and the silver bag trash
program.
ADJOURNMENT
Motion by Morrison, seconded by Inzunza, to a•journ to the City Council
Retreat on Strategic Planning of Objectives and Goals in the Governance
and Administration of the City - May 29, 1996 - 9:00 a.m. - Senior Services
Center - 1217 "D" Avenue, the next Regular Council Meeting - June 4,
1996 - 6:00 P.M. - Council Chambers, Civic Center. Carried by unanimous
vote.
