MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
JUNE 4,1996
The Regular Meeting of the City Council of the City of National City was
called to order at 3:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Zarate.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Zarate, the Minutes of the Regular
Meeting of May 28, 1996 be approved. Carried by unanimous vote.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Zarate, the Proclamations be read in their
entirety. Carried by unanimous vote.
The Proclamation proclaiming the week of May 19-25, 1996 to be:
"EMERGENCY MEDICAL SERVICES WEEK" was read aloud in its
entirety by Mayor Waters, who then presented it to representatives from
Hartsons.
The Proclamation proclaiming June 14, 1996 to be: "UNITED STATES
ARMY DAY" was read aloud in its entirety by Mayor Waters, who then
presented it to Col. Charles Nochols, USA Ret.

NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Zarate, the Non Consent Resolutions be
read by title only. Carried by unanimous vote.
CONTRACT (C86-17)
1. Resolution No. 96-75. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE
MAYOR TO EXECUTE AN AMENDMENT TO AGREEMENT
WITH AMERICAN GOLF CORPORATION PERTAINING TO
FEES AT THE GOLF COURSE." (Parks and Recreation)
RECOMMENDATION: Staff recommended that Council approve
the request.
TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue,
National City, made inquiry and comment on the need for clean
up of the hillsides and the removal of an old sign standard.
Ricke Crochet, General Manager of American Golf, responded
to the comments of Mr. Hernandez and questions of the
Council.
ACTION: Motion by Inzunza, seconded by Zarate, in favor
of Resolution No. 96-75. Carried by unanimous vote.
POLITICAL SUPPORT (102-4-1)
2. Resolution No. 96-76. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY IN SUPPORT OF URGENCY
LEGISLATION TO PERMIT LOCAL VOTER APPROVAL FOR A
ONE -QUARTER SALES TAX FOR LIBRARIES. " (Library)
RECOMMENDATION: Staff recommended that the Council
approve the Resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in
favor of Resolution No. 96-76. Carried by unanimous vote.

CONTRACT (C96-17)
3. Resolution No. 96-77. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY ACCEPTING A PROPOSAL
FROM ALCO/CASH LEWIS AND AUTHORIZING THE MAYOR
TO EXECUTE AN AGREEMENT FOR THE RENTAL OF COPY
MACHINES." (Purchasing)
RECOMMENDATION: Staff recommended that the Council
approve the Resolution.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in
favor of Resolution No. 96-77. Carried by unanimous vote.
MUNICIPAL CODE 1996 (506-2-11)
4 Resolution No. 96-78. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY SCHEDULING A PUBLIC
HEARING TO CONSIDER ADOPTION BY REFERENCE OF
VARIOUS UNIFORM CODES PERTAINING TO
CONSTRUCTION AND MAINTENANCE OF STRUCTURES AND
TO FIRE PREVENTION". (Building and Safety)
RECOMMENDATION: Staff recommended that the Council adopt
the Resolution and schedule the required Public Hearing.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in
favor of Resolution No. 96-78, Carried by unanimous vote.
CONTRACT (C96-18)
5 Resolution No. 96-79. A "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE
MAYOR TO EXECUTE AN AGREEMENT BETWEEN THE CITY
OF NATIONAL CITY AND MARTIN & DUNN, INCORPORATED
TO PROVIDE ARCHITECT AND ENGINEERING SERVICES
FOR THE NEW NATIONAL CITY TRANSIT FACILITY."

RECOMMENDATION: Staff recommended that the Council
approve the Resolution.

17. SUBJECT: Warrant Register #48. Ratification of Demands in the
amount of $835,452.81 (Warrant Nos. 138976 through 139038
inclusive excepting none) and Certification of Payroll in the amount
of $391,396.90. (Finance)
RECOMMENDATION: Staff recommended ratification of these
warrants.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of the Ratification of Demands and Certification of Payroll.

18. SUBJECT: Request to use fire engine for San Diego Burn Institute
Benefit at Jack Murphy Stadium. (Fire)
RECOMMENDATION: Staff recommended approval of the
request as submitted.

STREET TREE & PARKWAY COMMITTEE (101-2-2)
19. SUBJECT: Street Tree Committee Minutes. (Parks & Recreation)
RECOMMENDATION: Staff recommended that the minutes be
approved.
TESTIMONY: Dave Sheldon, Assistant Director,
Community Development Commission, responded to questions
and comments of the Council.
ACTION: Motion by Morrison, seconded by Inzunza, the
Minutes be approved. Carried by unanimous vote.
REVENUE & TAXATION ADMIN (205-2-1)
20. SUBJECT: Appeal of Transient Occupancy Tax by the Radisson
Suites/Holiday Inn. (Revenue & Recovery)
RECOMMENDATION: Staff recommended that the appeal be
referred to the City Treasurer.
TESTIMONY: George Hood, City Treasurer, 1521 E. 22nd
Street, National City, recommended the appeal be denied and
suggested revisions to clarify the existing code be made.
Cheryl Cox, Cox & Associates, 3130 Bonita Road #200,
Bonita, representing the hotel owners, spoke in favor of the
appeal.
ACTION: Motion by Beauchamp, seconded by Zarate, in
favor of the appeal including the direction to staff to bring back
clarification to the ordinance regarding bartering and that a tax
lien would run with the property not the owner if not paid.
Carried by the following vote, to -wit: Ayes: Beauchamp,
Inzunza, Morrison, Zarate. Nays: Waters. Abstaining: None.

CLAIM (501-1-115)
21. SUBJECT: Claim for Damages: Marcos Alcantara
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, to deny
and refer the claim to the City Attorney. Carried by unanimous
vote.
CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF
City Engineer Myers stated that CalTrans had notified him that the contract
had been awarded for the installation of the Plaza Bonita Center Way signs.
MAYOR
Mayor Waters reminded all present that Sunday June 9, 1996 at 11:00 a.m.
was the date and time for the Philippine Independence Day Parade; stated
he had received a letter from the City of Chula Vista in response to his letter
pertaining to the 4th Avenue and Bisbane intersection control; advised that
the Sweetwater Authority Board had approved $6 million for National City
to upgrade their water pressure; complimented the Council and Staff on
their recent retreat and the value that had come out of it; and then spoke of
the reporting being done by the Union Tribune.
CITY COUNCIL
Vice Mayor Zarate expressed her pleasure in the outcome of the Council
retreat and invited another Council Member to attend a meeting with her
Friday, June 7 1996 at 3:30 p.m. with State Senator Peace regarding Prop.

Councilman Beauchamp echoed the benefit from the Council retreat;
thanked the City Manager for his choice of a facilitator; stated that MTDB,
being concerned with budget deficits, was looking at a 5-year budget and
suggested Council consider looking at a "projection" for the next 2 years to
anticipate changes in funding; invited all present to attend the opening of
the Old Town Transit Center on June 13, 1996 at 11:30 -12:45; requested
Council participation at the end of June in the distribution of new transit
schedules at the 24th Street Trolley Station; requested consideration on a
future agenda of a resolution thanking Senator Boxer for her legislation for
construction funding for the SDA&E Rail line and requested consideration
for a letter encouraging Congressman Hunter to support the issue.
Councilman Morrison thanked staff for their help in putting the retreat
together, which he too felt was very positive, and then requested
clarification on the August 4, 1996 Symphony date.
PUBLIC ORAL COMMUNICATIONS
Alfonso Hernandez, 2132 Euclid Avenue, National City spoke regarding a
map he had previously presented the City containing locations in need of
cleaning; expressed his views on "teamwork" which was needed throughout
the city; spoke regarding the Paradise Creek problems and accumulation of
trash in the channel open space and stated his understanding that any
increase in TOT required a 2/3 vote of the people for approval.

Motion by Morrison, seconded by Zarate, to adjourn to the next Regular
Council Meeting - June 11, 1996 - 6:00 P.M. - Council Chambers, Civic
Center. Carried by unanimous vote.
