MINUTES OF THE ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
JUNE 18, 1996
The Adjourned Regular Meeting of the City Council of the City of National
City was called to order at 2:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, McCabe, Peoples.
1. Discussion regarding the City Clerk's Office.
Mayor Waters read into the record notes on the prior voluntary division by
the Elected City Clerk of the City Clerk's duties between those which are
"statutory" and those of "executive/administrative non -statutory".
City Manager McCabe stated that prior Council action was to accept the
report from the City Clerk which by definition goes through her term of
office. A temporary part-time position was established in the City Clerk's
Office to assist with additional phone coverage and the Secretarial position
was provided with a 5% over salary compensation. No further action has
been taken at this point.
Mayor Waters made inquiry of City Attorney Eiser as to whether there was
a legal problem with hiring another person to assist with the handling of the
upcoming election. City Attorney Eiser responded no.
City Clerk Peoples responded to inquiry of the Council with regards to the
handling of the upcoming election, the difficulty they were appraised of in
January of 1995, how the City Clerk could be in two places at once with
regards to the election responsibilities.

Councilman Beauchamp inquired as to what the election code requirements
for distribution of election papers was. City Clerk Peoples responded.
Vice Mayor Zarate made inquiry as to the possibility of finding a person
trained in the handling of elections to assist the City Clerk. City Clerk
Peoples responded.
General discussion ensued.
City Manager McCabe stated that there may be a retired City Clerk, Martin
& Chapman might be able to contract the services or the County Registrar
of Voters may be able to handle it at the County offices.
Councilman Morrison inquired of the City Attorney as to the legality of
having someone outside of the City accept papers from candidates. City
Attorney Eiser responded that the processing should be done at City Hall.
Councilman Beauchamp stated that the making of appointments for
receiving and submitting candidates papers, as the City Clerk has done in
the past, was very helpful.
City Clerk Peoples responded to general discussion.
Councilman Morrison made inquiry as to the estimated amount of time that
would be needed for election assistance. City Clerk Peoples responded.
Councilman Morrison made inquiry as to who the person would report to.
City Attorney Eiser stated that the person hired should report to the City
Clerk.
Councilman Inzunza inquired as to what happens when the new Elected
City Clerk takes office i.e. do they come in and take over the whole office
and manage the employees or what?

City Attorney Eiser responded that the professional position of City Clerk
has evolved over time. The Elected City Clerk typically performs the duties
as called for by State Law (statutory). The City Council adopted a
resolution that designates that these are the only duties to be performed by
the Elected City Clerk.
Councilman Morrison made the correlation between the Elected City
Treasurer and the Finance Director. The department staff and day to day
operations of the Finance Department fall under the Finance Director, a
qualified professional, not the Elected City Treasurer. The City Treasurer is
basically a figure head and so would be the Elected City Clerk.
ACTION: Motion by Zarate, seconded by Morrison, to direct the City
Manager to review and take action to hire an Election consultant who would
report under the City Clerk. The Elected City Clerk position to remain part-
time with only the statutory duties, same salary and benefits as the other
part-time elected officials. Carried by unanimous vote.
Councilman Morrison requested action begin on the creation of the position
which will take over the professional duties of the office.
City Manager McCabe clarified Council intent to be once the election was
over, the Secretary position would remain and another full-time professional
position would be created to perform the non -statutory professional duties.
The part-time temporary position would no longer be needed.
PUBLIC ORAL COMMUNICATIONS
Louise Martin, 1527 E. 15th Street, National City, made inquiry regarding
the salary being paid the Administrative Secretary, the Part-time
Administrative Assistant and the Elected City Clerk.
ADJOURNMENT
Motion by Zarate, seconded by Beauchamp, to adjourn to the next Regular
City Council Meeting - June 18, 1996 - 3:00 P.M. - Council Chambers,
Civic Center. Carried by unanimous vote.
