ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Zarate. APPROVAL OF MINUTES Motion by Inzunza, seconded by Morrison, the Minutes of the Regular Meeting of July 16, 1996 be approved. Carried by the following vote, to - wit: Ayes: Beauchamp, Inzunza, Morrison, Waters. Nays: None. Abstaining: Zarate. PUBLIC HEARINGS CONDITIONAL USE PERMIT (403-10-7) 1. Continued public Hearing - Conditional Use Permit to allow a mobile recycling facility at 3007 Highland Avenue. Applicant: Christy Rael, Environmental Products Corp. Case File No. CUP-1995-10. Continued from Council Meeting of November 14, 1995. (Planning) NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. Book 78/Page 270 07/23/96 CONDITIONAL USE PERMIT (continued) RECOMMENDATION: Staff concurred with the Planning Commission's decision and recommended the application be approved based on the findings and subject to the conditions of approval set forth in Planning Commission Resolution No. 20-95, with an added condition that the facility be screened with an architecturally compatible masonry wall. TESTIMONY: Planning Director Post provided a posterboard outlining alternative locations for the proposed facility. Alfonso Hernandez, 2132 Euclid Avenue, National City, expressed his opinion on the proposed recycling facility, and spoke in opposition to the item. Cecilia Kirk, 311 E. 2nd Street, National City, spoke in opposition to the item. Richard Graff, 220 Argon Avenue, Long Beach, representing 20/20 Recycling Centers spoke in support of the item, but expressed opposition to the requirement for masonry brick walls and responded to questions of the City Council. Everett Dickson, 2745 E. 14th Street, National City, spoke in opposition to the item. Mayor Waters declared the Public Hearing closed. General discussion ensued. TESTIMONY: Councilman Beauchamp suggested that staff look into: 1) Requesting Chula Vista make a joint appeal, 2) Vouchers be given for merchandise, and 3) Assemblywoman Ducheny be contacted to amend the law. Book 78/Page 271 07/23/96 CONDITIONAL USE PERMIT (continued) ACTION: Motion by Beauchamp, seconded by Waters, to approve the Conditional Use Permit under conditions stated,, including the masonry wall, with modified hours (Tuesday through Friday 11 a.m. to 5 p.m., Saturdays 8:30 a.m. to 5:00 p.m, closed Sunday and Monday) and modified description of the facilities (one large bin and four igloos) and direct the City Manager to work with Assemblywoman Ducheny on amending the law and approach the City of Chula Vista to do a joint appeal. Carried by unanimous vote. PARKING DISTRICT ADMIN (801-1-1) 2. Continued Public Hearing on the removal of a portion of "A" Avenue from Residential Permit Parking District A. Continued from Council Meeting of April 9, 1996. (Engineering) NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff recommended that Council open the Public Hearing; consider that now only four out of ten residents are in favor of the revision. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, in favor of Staff's recommendation to take no further action at this time, as there is now less than the minimum number of residents required to dissolve or change the boundaries. Carried by unanimous vote. CONDITIONAL USE PERMIT (403-9-10) 3. Continued Public Hearing - Appeal of Planning Commission's approval of modification of Conditional Use Permit-1994-14 to extend the permitted hours of operation of a church and denial of a request to modify a condition of approval to remove any link between parking complaints and the church at 330 National City Boulevard. Applicant: Rui Morias, Universal Church of Christ. Case File No.: CUP-1995-17. Continued from Council Meeting of May 14, 1996. RECOMMENDATION: Staff recommended that Council open the Public Hearing; consider that now only four out of ten residents are in favor of the revision. TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue, National City, spoke in opposition to the item. Michael Sunshine, General Bead, 317 National City Blvd., National City, supported the extended hours with parking at the hotel and the lot at 7th Street and Hoover Avenue Joe Scannicchio, 299 Landis Avenue, Chula Vista, representing Ellen Stewart, owner of 404-408 National City Blvd., National City, spoke in opposition to changes in the original Conditional Use Permit. Mike McDade, 945 4th Avenue, San Diego, representing Universal Church of Christ, spoke in support of accepting the Planning Commission recommendation, with two changes - no capacity or time restrictions. Mike Keough, 12440 Kestrost Street, San Diego, representing area merchants, provided a handout to the Council requesting that the Conditional Use Permit remain the same. Edward R. Campiani, 12301 Louise Avenue, Granada Hills, declined to speak. Juan J. Torres, 330 National City Blvd., National City, declined to speak. Cecilia Kirk, 311 E. 2nd Street, National City, spoke in opposition to the item. Mayor Waters declared the Public Hearing closed. Mayor Waters then explained the Conditional Use Permit process. Book 78/Page 273 07/23/96 CONDITIONAL USE PERMIT (continued) ACTION: Motion by Morrison, seconded by Waters, to deny the Planning Commission_ decision based on the recommended finding for denial, Attachment 1 dated February, 1996, and support the original Conditional Use Permit. Motion failed by the following vote: Nays: Beauchamp, Inzunza, Zarate. Ayes: Morrison, Waters. Abstaining: None. Absent: None. Councilman Inzunza provided a handout (copy on file in the office of the City Clerk) with a suggested "workable alternative." General discussion ensued. City Attorney Eiser advised that the Public Hearing should be re -opened and continued to allow time for the applicant and interested parties to review and comment. General discussion ensued. TESTIMONY: Mike McDade, 945 4th Avenue, San Diego, representing Universal Church of Christ, requested evening time limits be relaxed. City Attorney Eiser inquired as to whether condition of approval Item # 11 was not included. Eileen Roberts, 845 E. 13th Street, spoke in opposition to restriction on truck parking times. Cecilia Kirk, 311 E. 2nd Street, spoke in opposition to the proposed motion. Rita Heuss, 2121 4th Street, National City, spoke in opposition to not continuing the Public Hearing. Mike Keough, Heileg Myers, stated that they would move if approved and requested that the Public Hearing be continued to allow for review of Councilman Inzunza's proposal with business owners. Book 78/Page 274 07/23/96 CONDITIONAL USE PERMIT (continued) TESTIMONY: Mary Louise Martin, 1527 E. 15th Street, National City, stated that she felt the Public Hearing needed continuance, and was opposed to moving the truck parking. Georgia Guarano, 410 Harbison Avenue, National City, spoke in opposition to the proposed motion. Juanita Pinney, E. 1st Street, National City, spoke in opposition to the item. Alfonso Hernandez, 2132 Euclid Avenue, National City, expressed his opinion on considerations in need of review. ACTION: Motion by Beauchamp, seconded by Inzunza, to have two Council Members sit down with businesses and the church. Motion withdrawn by maker. ACTION: Motion by Beauchamp, seconded by Zarate, to re- open the Public Hearing and continue it to the August 20, 1996 Council meeting at 3 p.m. and to appoint Council Members Inzunza and Morrison to meet as a subcommittee with the businesses, residents and the church to come up with a solution. Carried by unanimous vote. TESTIMONY: Mr. McDade, representing the Universal Church of Christ, stated that his client accepted the continuance to August 20, 1996. UNDERGROUND UTILITY DISTRICT 21 ADMIN (904-1-7) 4. Public Hearing - To determine whether the Public Health, Safety or Welfare require the formation of Underground Utility District No. 21 (Phase I) on Highland Avenue from Division to 8th Streets. (Engineering) NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff recommended that Council hold the public hearing. TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue, National City, spoke in opposition. Book 78/Page 275 07/23/96 UNDERGROUND UTILITY DISTRICT 21 ADMIN (continued) Mayor Waters declared the Public Hearing closed. ACTION: Motion by Inzunza, seconded by Morrison, in favor. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: Beauchamp. Absent: None. GENERAL PLAN (405-8-2) 5. Public Hearing - Adoption of the revised National City General Plan and combined General Plan/Zoning Map, as well as related amendments to the Land Use Code and Local Coastal Program. (Planning) NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff agreed with the Planning Commission recommendation that the City Council adopt the Revised General Plan and Combined General Plan/Zoning Map, incorporating Changes to the Draft Plan (listed in the attachment), as well as related amendments to the Land Use Code and Local Coastal Program, based on the attached findings. TESTIMONY: Principal Planner Steve Ray gave a brief overview of the revised General Plan. Councilman Inzunza left the Council Chambers at 9:25 p.m. Councilman Inzunza returned to the Council Chambers at 9:29 p.m. TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue, National City, thanked Planner Ray for his support and assistance and expressed concerns about additional RT areas and General Commercial zoned property by National City Middle School. Book 78/Page 276 07/23/96 GENERAL PLAN (continued) John Lovett, 10703 Meadow Glen Way, Escondido, owner of property southwest of 33rd Street and National City Boulevard, requested Light Manufacturing zoning rather than Commercial Automotive for his property and responded to questions of the City Council. Steve Yancy, 2740 Hill Drive, National City, Paradise Valley Hospital, thanked council in advance for their approval of the General Plan recommendations for their property. NOTE: Councilman Morrison stated that he would be abstaining on the vote on changes to circulation (# 13 in summary) as the Reo Drive connection would affect his property. ACTION: Motion by Zarate, seconded by Morrison, t change the southwest corner of 33rd Street and National City Boulevard to ML-PD-CZ. Carried by unanimous vote. Councilman Beauchamp expressed concerns regarding the zoning of several areas including: the area across from National City Middle School, 18th & D Avenue, north side of 16th Street from G Street west, Plaza Blvd. from 9th to 12th, the blocks between 8th and 9th Streets and between B & E. He also expressed concern about the deletion of Hoover Avenue over Paradise Creek. ACTION: Motion by Morrison, seconded by Beauchamp, t continue the Public Hearing until August 27, 1996. Carried by unanimous vote. NON CONSENT RESOLUTIONS Motion by Morrison, seconded by Zarate, the Non Consent Resolutions be read by title only. Carried by unanimous vote. CITY OF NATIONAL CITY FEE SCHEDULE (106-3-2) 6. Resolution No. 96-118. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SCHEDULING A PUBLIC HEARING TO CONSIDER AMENDMENT OF THE NATIONAL CITY FEE SCHEDULE." (Building & Safety) Book 78/Page 277 07/23/96 CITY OF NATIONAL CITY FEE SCHEDULE (continued) RECOMMENDATION: Staff recommended that Council adopt the Resolution. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Zarate, in favor of Resolution # 96-118. Carried by unanimous vote. DEEDS & EASEMENTS (D96-5) STREET DEDICATING/NAMING 1996 (903-11-11) 7. Resolution No. 96-119. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING CONVEYANCE OF REAL PROPERTY, DIRECTING THE RECORDATION OF GRANT DEEDS, DEDICATING AND NAMING PARCELS OF LAND FOR STREET PURPOSES, AND RESCINDING RESOLUTION NO. 94-153." (Engineering) RECOMMENDATION: Staff recommended that Council adopt the Resolution. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of Resolution # 96-119. Carried by unanimous vote. OLD BUSINESS CDC/LANDSCAPE DISTRICT NO. 1 (MILE OF CARS) (406-2-8) 8. Public Meeting - Landscape Maintenance District No. 1 (LMD) - "Mile of Cars." (Community Development Commission) NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the Community Development Commission. RECOMMENDATION: Staff recommended that Council hold the Public Meeting. TESTIMONY: Executive Director Paul Desrochers, Community Development Commission, gave a brief verbal report. Alfonso Hernandez, 2132 Euclid Avenue, National City, made inquiry as to the limit of the Mile of Cars Assessment District. Book 78/Page 278 07/23/96 CDC/LANDSCAPE DISTRICT NO. 1 (MILE OF CARS) (continued) TESTIMONY: Mark Green, 1807 National City Blvd., National City, spoke in opposition to the Assessment District's use of funds for painted checkered crosswalks. ACTION: No action taken. NEW BUSINESS WARRANT REGISTERS 1996 (202-1-11) 9. SUBJECT: Warrant Register #3. Ratification of Demands in the amount of $283,894.80 (Warrant Nos. 139602 through 139733 inclusive excepting none). (Finance) RECOMMENDATION: Staff recommended ratification of these warrants. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, in favor of the Ratification of Demands. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. CITY OWNED LAND ADMIN (1001-1-4) 10. SUBJECT: Request for permission to erect fence poles on City - owned property at 1915 Palm Avenue by Christmas -in -July volunteers. (Community Development Commission) RECOMMENDATION: Staff recommended that the request be approved. TESTIMONY: None. ACTION: Motion by Waters, seconded by Morrison, in favor. Carried by unanimous vote. CLAIM (501-1-113) 11. SUBJECT: Claim for Damages: Mossy Nissan (City Clerk) RECOMMENDATION: Staff recommended that Council deny and refer to the City Attorney TESTIMONY: None. Book 78/Page 279 07/23/96 CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR - No report. CITY COUNCIL Vice Mayor Zarate requested that Mrs. Kirk, 311 E. 2nd Street, National City, Citizens to Reclaim Our Neighborhoods and Partners for Prevention, explain the "13th Annual Annual National Night Out Crime Prevention Campaign" on August 6, 1996. Mrs. Kirk explained the event, which is promoted by the National Association of Town Watch, which brings together residents, law enforcement agencies, crime prevention groups and alcohol and other drug prevention services. Vice Mayor Zarate stated that the Mayor had drafted a Proclamation for Ms. Kirk to present to the promoters of the event. Ms. Kirk requested that National City residents, and the City to participate. Councilman Beauchamp stated that the Barrigan Family Boxing program received a grant to allow six to seven of their boxing program participants to go to a ranch in Montana, and he would like the Council to provide them with a letter of conductance. He also reported that he and the MTDB Administrators and the South Bay representatives walked the proposed Excursion Train line, and alerted them that two of the three proposals in the draft final report require moving of the Depot from its' original site. Council consideration was requested to appoint Councilman Beauchamp to the San Diego Railroad Authority because of his connection to the MTDB. Councilman Beauchamp also made inquiry as to whether the League of California Cities was budgeted, and who determines who goes, etc. and inquired about the status of the Assistant Manager position. Book 78/Page 280 07/23/96 CITY COUNCIL (continued) Councilman Inzunza commented on some illegal signage painted on many buildings along the freeways, and recommended a program of notification of the owners of those buildings. Councilman Inzunza left the Council Chambers at 10:02 p.m. Councilman Inzunza returned to the Council Chambers at 10:04 p.m. PUBLIC ORAL COMMUNICATIONS Alfonso Hernandez, 2132 Euclid Avenue, National City, provided copies of the Star News and expressed concerns with the circulation of complimentary papers to addresses in the City and with the need to remove trash at the MTDB Trolley stations and the Sweetwater Adult Education facility construction site. Everett Dickson, 2745 E. 14th Street, National City, commended Principal Planner Ray on General Plan accomplishments. Cecilia Kirk, 311 E. 2nd Street, National City, thanked the Council for approval on Item # 10. ADJOURNMENT Motion by Zarate, seconded by Morrison, to adjourn to the next Regular City Council Meeting - August 6, 1996 - 3:00 P.M. - Council Chambers. Civic Center. Carried by unanimous vote.
