MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
AUGUST 20, 1996
The Regular Meeting of the City Council of the City of National City was
called to order at 6:02 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Zarate.
APPROVAL OF MINUTES
Motion by Inzunza, seconded by Morrison, the Minutes of the Regular
Meeting of August 13, 1996 be approved. Carried by unanimous vote.
PRESENTATIONS
PERS/NEW EMPLOYEE INTRODUCTION PROGRAM (604-2-2)
Mayor Waters requested that Planning Director Post introduce his new
employee, Mary DeHaven/Assistant Planner; and that Police Chief
DiCerchio introduce his new employee, Tina Tumeo/Police Dispatcher.
The new employees stood and were recognized by those present.
BOARDS & COMMISSIONS
SENIOR CITIZENS ADVISORY BOARD (101-11-1)
Mayor Waters turned the meeting over to Vice Mayor Zarate, who stated
that Mayor Waters had recommended that Mr. Raymond M. Spann be re-
appointed to the Senior Citizens Advisory Board for a full term ending
August 31, 1998, which would required a 3/4th vote from the City Council.

SENIOR CITIZENS ADVISORY BOARD (continued)
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of the re -appointment of Mr. Spann for a full term ending
August 31, 1998. Carried by unanimous vote.
City Clerk Peoples administered the Oath of Office to Mr. Spann.
Vice Mayor Zarate turned the meeting back over to Mayor Waters.
PUBLIC HEARING
CONDITIONAL USE PERMIT (403-9-10)
1. Continued Public Hearing - Appeal of Planning Commission's
approval of modification of Conditional Use Permit-1994-14 to
extend the permitted hours of operation of a church and denial of a
request to modify a condition of approval to remove any link between
parking complaints and the church at 330 National City Boulevard.
Applicant: Rui Morias, Universal Church of Christ. Case File No.:
CUP-1995-17. Continued from Council Meeting of July 23, 1996.
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the City Clerk.
RECOMMENDATION: Staff recommended that Council consider
the information in Attachment No. 1 to the Agenda Statement, along
with the previous reports and take appropriate action.
Council Committe of Councilman Inzunza, Councilman Morrison and
Planning Director Post gave an overview of the metting process with the
Church, business owners and neighborhoods.
TESTIMONY: Rita Heuss, 2121 E. 4th Street, spoke in
opposition to the item.
Everett Dickson, 2745 E. 14th Street, spoke in opposition to
the item.

CONDITIONAL USE PERMIT (continued)
TESTIMONY: Paul O'Boyle, 945 4th Avenue, San Diego,
representing Universal Church, spoke in support of the item,
and requested reconsideration of a capacity of 250 on Monday,
Wednesday and Thursday, and an unrestricted capacity on
Sunday; one -hour pakring from Division to Highway 5 from 8
a.m. to 8 p.m. seven days a week; uniformed security/ and to
allow parking in the truck area at the north end of the street.
Mike Keough, 12440 Kestrel Street, San Diego, representing
area merchants, spoke in support of the item, with the
conditions listed in Attachment 1 to the Agenda.
Ms. Juanita Pinney, 2131 E. 1st Street, National City, spoke in
opposition to the item.
Aileane Roberts, 845 E. 13th Street, National City, spoke in
opposition to the item.
Georgia Guarano, 410 harbison Avenue, National City, spoke
in opposition to the item and made inquiry of the Council and
Staff.
Louise Martin, 1527 E. 15th Street, National City, spoke in
opposition to the item.
General discussion ensued.
Councilman Morrison clarified that on Item C of Attachment 1 special
services would be allowed four time per year from 9 p.m. to 5 a.m. and on
Item G, there will be a minimum of 2 uniformed security guards.
Councilman Beauchamp requested the addition of "occupancy" on Item B,
and to add Item L to Attachment 1 to read: "A review process of the
Conditional Use Permit shall be done after a one-year period."

ACTION: Moved by Zarate, seconded by Beauchamp, to
close the Public Hearing and in favor with the inclusion of
Attachment 1 as amended and findings as contained in
Planning Commission Resolution #6-96. Carried by the
following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison,
Zarate. Nays: Waters.
REDEVELOPMENT/PARK SUMMIT/PARK VILLAS (403-9-10)
2. Public Hearing regarding the issuance of multi -family housing
revenue bonds.
NOTE: Notice of Public Hearing and Proof of Publication are on file
in the office of the City Clerk.
RECOMMENDATION: Staff recommended that Council conduct
the Public Hearing and consider resultion.
TESTIMONY: Community Development Director Paul
Desrochers provided a brief overview of the City's
"sponsorship" by issuing multi -family housing revenue bonds.
ACTION: Mayor Waters declared the Public Hearing closed.
NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Zarate, the Non Consent Resolutions be
heard by title only. Carried by unanimous vote.
REDEVELOPMENT/PARK SUMMIT/PARK VILLAS (403-9-10)
3. Resolution No. 96-133. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
THE ISSUANCE OF THE MULTIFAMILY HOUSING REVENUE
BONDS BY THE CALIFORNIA STATEWIDE COMMUNITIES
DEVELOPMENT AUTHORITY." (Community Development
Commission)
RECOMMENDATION: Staff recommended that Council approve
the Resolution.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of Resolution # 96-133. Carried by unanimous vote.

STREET RIGHT OF WAY (903-3-4)
4. Resolution No. 96-134. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AN
EXCEPTION TO THE STANDARDS FOR PUBLIC RIGHTS -OF -
WAY AND IMPROVEMENTS IN CONNCECTION WITH THE
DEVELOPMENT OF PEROPERTY ON THELMA WAY,
SUBJECT TO CERTAIN CONDITIONS." (Engineering)
RECOMMENDATION: Staff recommended that Council adopt the
Resolution.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Inzunza, in
favor of Resolution # 96-134. Carried by unanimous vote.
STREET DEDICATING/NAMING 1996 (903-11-11)
5. Resolution No. 96-135. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY DEDICATING A
PORTION OF RIGHT-OF-WAY AND NAMING IT EUCLID
AVENUE AND 16TH STREET." (Engineering)
RECOMMENDATION: Staff recommended that Council adopt the
Resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Beauchamp, in
favor of Resolution # 96-135. Carried by unanimous vote.
UNDERGROUND UTILITY DISTRICT 21 (904-1-7)
6. Resolution No. 96-136. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ESTABLISHING
UNDERGROUND UTILITY DISTRICT NO. 21. (HIGHLAND
AVENUE FROM DIVISION STREET TO EIGHTH STREET)."
(Engineering)
RECOMMENDATION: Staff recommended that Council adopt the
Resolution.
NOTE: Councilman Beauchamp stated that he would be abstaining
as he has a contract with SDG&E.

ACTION: Motion by Zarate, seconded by Morrison, in favor
of Resolution # 96-136. Carried by the following vote, to -wit:

7. Resolution No. 96-137. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE A QUITCLAIM DEED AND
ESCROW INSTRUCTIONS FOR THE TRANSFER OF REAL
PROPERTY OWNED BY THE CITY TO ABEL F. ARANZUBIA
AND MARIA ARANZUBIA, HUSBAND AND WIFE."

Resolution.

RECOMMENDATION: Staff recommended ratification of these
warrants.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of the Ratification of Demands. Warrants carried by the
following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison,
Zarate, Waters. Nays: None. Abstaining: None. Absent:
None.
POLITICAL SUPPORT (102-4-1)
13 SUBJECT: Consider Joining Amicus Curiae Brief in support of City
of Del Mar in Breneric Associates v. Del Mar City Council. (City
Attorney)
RECOMMENDATION: Staff recommended that Council authorize
joining Amicus Curiae Brief.
TESTIMONY: None.
ACTION: Moved by Beauchamp, seconded by Inzunza, in
favor of joining Amicus Curiae Brief. Carried by unanimous
vote.

CITY MANAGER - No report.
CITY ATTORNEY - No report.
OTHER STAFF - No report.
MAYOR
Mayor Waters read into the record a letter from Robert E. Brendza, Director
Industrial Development, Pacific Region, Burlington Northern Santa Fe
(BNSF) regarding FNSF support of City development efforts.
ACTION: Moved by Inzunza, seconded by Zarate, in favor of
bringing this item onto the Agenda, as the need to take action
arose after the posting of the Agenda. Carried by unanimous
vote.
TESTIMONY: Mr. Brendza, Director Industrial
Development, Pacific Region, BNSF, gave a brief map
presentation and responded to questions from the City Council.
John Hazelton, Director of Automotive, BNSF, spoke in
support of their proposal and responded to questions from the
Council.
Clayborn Swanson, 1921 F Avenue, National City, spoke in
opposition to the item.
ACTION: Moved by Inzunza, seconded by Zarate, in favor of
placing this item on next week's Agenda. Carried by
unanimous vote.

CITY COUNCIL
Councilman Morrison requested that Staff review an accident scene on
Plaza Boulevard west of Euclid Avenue (sidewalk and fence) where repairs
have not been made, and requested Staff look into the Port District's request
for additional temporary buildings in the parking area as their prior
committment was to use the temporary buildings for two years maximum
when they would have permanent buildings built and it was now over three
years with no visible action taken.
Councilman Beauchamp stated he had been contacted about cruising
problems in the 1100 block of D Avenue; requested Staff be trained to
handle changes to the traffic signal light power grids so the City is not so
dependent on the contractor.
Councilman Inzunza left the Council Chambers at 5:15 p.m.
Councilman Inzunza returned to the Council Chambers at 5:17 p.m.
PUBLIC ORAL COMMUNICATIONS
Cecilia Kirk, 311 E. 2nd Street, National City, expressed her opinions on
what to do with cruisers on "D". She also expressed concerns with the one -
hour parking on National City Boulevard being diverted into
neighborhoods. She also invited all to attend the "Committee to Reclaim
our Neighborhhods" meeting with speaker Francisco Cook tomorrow,
August 21, 1996 at 7 p.m. in the Community Center.

Motion by Inzunza, seconded by Zarate, to adjourn to the next Regular City
Council Meeting - August 27, 1996 - 6:00 P.M. - Council Chambers, Civic
Center. Carried by unanimous vote. Absent: Inzunza.
