MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
AUGUST 27,1996
The Regular Meeting of the City Council of the City of National City was
called to order at 6:04 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Waters. Absent:
Zarate.
Administrative officials present: Berkuti, Eiser, McCabe, Morse, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by City Manager McCabe.
MAYOR'S PRESENTATIONS
Mayor Waters read into the record an article about 13-year-old Sophia
Dyjak (copy on file in the office of the City Clerk) who delivered her aunt's
baby at home. A video tape was shown with a news story from Channel 8
News regarding the event. Mayor Waters then introduced Sophia Dyjak and
presented her with a Certificate of Recognition and a Gold Key to the City.
Ms. Dyjak thanked the Mayor and then introduced members of her family
who were present, including the baby.
PUBLIC HEARINGS
GENERAL PLAN (405-8-2)
1. Continued Public Hearing - Adoption of the revised National City
General Plan and Combined General Plan/Zoning Map, as well as
related amendments to the Land Use Code and Local Coastal
Program. Continued from the Council Meeting of July 23, 1996.

NOTE: Notice of Public Hearing and Proof of Publication are on file
in the Office of the City Clerk.
RECOMMENDATION: Staff agreed with the Planning
Commission recommendation stated in the July 23 Council agenda
statement and recommended adoption of the additional changes
recommended by the Commission as well as further revisions as
shown on exhibits AA, BB and CC attached to the current agenda.
NOTE: Councilman Morrison stated that he would be abstaining on
the vote on changes to circulation (# 13 in summary) as the Reo Drive
connection would affect his property.
TESTIMONY: Planning Director Roger Post introduced
Principal Planner Steve Ray, who gave a brief verbal and
posterboard summary of the item.
Ted Godshalk, 2143 Cleveland Avenue, National City, spoke
in support of the General Plan and against the extension of
Hoover Avenue across Paradise Creek.
Vice Mayor Zarate arrived in Council Chambers at 6:33 p.m.
General discussion ensued.
ACTION: Motion by Waters, seconded by Inzunza, to delete
the extension of Hoover Avenue over Paradise Creek. Carried
by the following vote, to -wit: Ayes: Inzunza, Morrison,
Zarate, Waters. Nays: Beauchamp.
Motion by Inzunza, seconded by Morrison, in favor of Staff's
recommendation. Carried by unanimous vote, see above Note.
NON CONSENT RESOLUTIONS
Motion by Morrison, seconded by Zarate, the Non Consent Resolution be
read by title only, Carried by unanimous vote.

CONDITIONAL USE PERMIT (403-9-10)
2. Resolution No. 96-138. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AN
APPLICATION FOR MODIFICATION OF CONDITIONAL USE
PERMIT 1994-14 TO EXTEND THE HOURS OF OPERATION
FOR A CHURCH AND DENYING A REQUEST TO MODIFY A
CONDITION OF APPROVAL TO REMOVE ANY LINK
BETWEEN PARKING COMPLAINTS AND THE CHURCH AT
330 NATIONAL CITY BOULEVARD. APPLICANT: RUI
MORAIS, UNIVERSAL CHURCH OF CHRIST. CASE FILE NO.
CUP-1995-17." (Planning)
RECOMMENDATION: Staff recommended that the resolution be
adopted.
NOTE: City Attorney Eiser stated that there was a discussion last
week when this item was considered at the Public Hearing regarding
a review of the Conditional Use Permit in twelve months time. This
was inadvertently omitted as a condition. He suggested that the
Council may wish to include the review as a condition of approval.
The condition would read as follows: "The City Council shall
conduct a review of this Conditional Use Permit in twelve months to
determine if the Church has been in compliance with the conditions
of approval."
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Inzunza, in favor of
Resolution No. 96-138, with the correction to include the
review of the Conditional Use Permit. Motion withdrawn by
maker.
Motion by Waters, seconded by Beauchamp, to lay this item
over for one week. Carried by unanimous vote.
NEW BUSINESS
WARRANT REGISTERS 1996 (202-1-11)
3. SUBJECT: Warrant Register #08. Ratification of Demands in the
amount of $328,260.93 (Warrant Nos. 140089 through 140175
inclusive excepting none) and Certification of Payroll in the amount
of $479,978.59. (Finance)

RECOMMENDATION: Staff recommended ratification of these
warrants.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of
the Ratification of Demands and Certification of Payroll.
Warrants carried by the following vote, to -wit: Ayes:
Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: None. Absent: None.
NATIONAL CITY COMMUNITY CENTER (1101-5-1)
4. SUBJECT: Use of the Community Center for Salute to Navy
Luncheon on 9 October 1996 (Chamber of Commerce and Kiwanis),
and waiver of fees. (Public Works)
RECOMMENDATION: Staff recommended that Council authorize
the use and waive all fees.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Staff's recommendation. Carried by unanimous vote.
STREET VACATION ADMIN (902-26-1)
5. SUBJECT: Comments on Street Closures for Navy Bayview
Military Housing Project. (Planning & Engineering)
RECOMMENDATION: Staff recommended that the attached
letter, recommending the cul-de-sacing of both Manchester Street and
Ranger Road, be approved for submittal to the City of San Diego.
Mayor Waters turned the meeting over to Vice Mayor Zarate.
TESTIMONY: George H. Waters, 1342 Carol Place, National
City, spoke in favor of either keeping both streets (Manchester
Street and Ranger Road) open or closing both streets.
Victoria Waters, 1342 Carol Place, National City, spoke in
favor of closing both streets.
Councilman Morrison reported that a Public Hearing would be
held in the City of San Diego on this issue on September 10,
1996.

STREET VACATION ADMIN (continued)
ACTION: Motion by Morrison, seconded by Inzunza, in
favor of sending the letter to the City of San Diego, and to send
a representative to the September 10, 1996 meeting in San
Diego. Carried by the following vote: Ayes: Beauchamp,
Inzunza, Morrison, Zarate. Nays: None. Abstaining: Waters.
Vice Mayor Zarate turned the meeting back over to Mayor Waters.
CONDITIONAL USE PERMITS 1996 (403-11-1)
6. SUBJECT: Notice of Decision - Planning Commission Resolution
No. 16-96 approving a Conditional Use Permit for the sale of beer
and wine within an existing restaurant at 1430 E. Plaza Blvd., Suite
#E22/23A. Case File No. CUP-1996-7. Applicant: Wei-Bei Chen.
(Planning)
RECOMMENDATION: Staff concurred with the decision of the
Planning Commission, and recommended that the Notice of Decision
be filed.
TESTIMONY: Cecilia Kirk, 311 E. 2nd Street, National City,
spoke in opposition to the approval of the Conditional Use
Permit.
Rosemary Peyron, 207 S. Belmont, National City, spoke in
opposition to the issuance of beer and wine licenses in general.
ACTION: Motion by Zarate, seconded by Inzunza, in favor of
Staff's recommendation. Carried by the following vote, to -wit:
Ayes: Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: Beauchamp.
TESTIMONY: Cecilia Kirk, 311 E. 2nd Street, National City,
stated that she was in opposition to the issuance of beer & wine
licenses in general.
Planning Director Post stated that National City has had an
Ordinance for eight years which requires a Conditional Use
Permit for all new liquor licenses in the city.

CLAIM (501-1-123)
7. SUBJECT: Claim for Damages: Catarino Navarro. (City Clerk)
RECOMMENDATION: Staff recommended that the claim be
denied and referred to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, to deny
and refer the claim to the City Attorney. Carried by unanimous
vote.
CITY MANAGER
City Manager McCabe introduced the new National City Assistant City
Manager, Mr. Park Morse, who had been the Assistant City Manager in La
Habra, in Orange County, for fifteen years.
CITY ATTORNEY
CLOSED SESSION REPORTS (501-3-1)
City Attorney Eiser gave a Closed Session report for a Closed Session that
was held on July 16, 1996, in regards to Patricia Pittman v. City of National
City, et al. A written report on the Closed Session is on file in the office of
the City Clerk.
OTHER STAFF - No report.
MAYOR
Mayor Waters stated that he had received a letter from "Californians for
Safer Streets" (copy on file in the office of the City Clerk) stating that the
California State Legislature is on the verge of incorporating into the 1996-
97 State Budget a return of traffic fine and forfeiture money to California
cities, and inquired if the funds had been included in the current budget.
City Manager McCabe responded that it has been implemented at the State
level, but would not be implemented at our level until it becomes a fact.

CITY COUNCIL
Councilman Beauchamp made inquiry regarding the response to
negotiations with Santa Fe Railroad and the Port regarding Harrison
Avenue. Mayor Waters summarized the meeting from last week, and stated
that another meeting will take place this week.
Vice Mayor Zarate left the Council Chambers at 7:55 p.m.
PUBLIC ORAL COMMUNICATIONS
Everett Dickson, 2745 E. 14th Street, National City, suggested increasing
the temperature in the Council Chambers; reported that the doors to the
Civic Center were locked this evening and requested that they be opened
earlier prior to a 6 o'clock Council meeting; and asked if the General Plan
Committee would be dissolved.
ADJOURNMENT
Motion by Morrison, seconded by Inzunza, to adjourn to the next Regular
City Council Meeting - September 3, 1996 - 3:00 P.M. - Council Chambers,
Civic Center. Carried by unanimous vote. Absent: Zarate.
The meeting closed at 8:00 p.m.
