HomeMy WebLinkAbout1996 09-03 CC MINBook 78/Page 320 09/03/96 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA SEPTEMBER 3, 1996 The Regular Meeting of the City Council of the City of National City was called to order at 3:02 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Eiser, McCabe, Myers, Morse, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Zarate. APPROVAL OF MINUTES Motion by Zarate, seconded by Morrison, the Minutes of the Regular Meeting of August 27, 1996 be approved. Carried by unanimous vote. BOARDS & COMMISSIONS INTERVIEWS AND APPOINTMENTS SENIOR CITIZENS ADVISORY BOARD (101-11-1) Mayor Waters turned the meeting over to Vice Mayor Zarate who stated that Mayor Waters had recommended that Mr. Alfred J. Hlawatsch be re- appointed to the Senior Citizens Advisory Board for another term ending August 31, 1998--this will require a 3/4th vote from the City Council. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the Mayor's recommendation to re -appoint Mr. Hlawatsch for another term. Carried by unanimous vote. City Clerk Peoples administered the Oath of Office to Mr. Hlawatsch. Book 78/Page 321 09/03/96 CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 96-139 through 96-142). Motion by Inzunza, seconded by Morrison, the Consent Resolutions be adopted by title only. Carried by unanimous vote. PARKING ADMIN (801-2-16) 1. Resolution No. 96-139. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE INSTALLATION OF "NO PARKING" SIGNS IN THE ALLEY BETWEEN "I" AND "J" AVENUES FROM 22ND STREET TO "I" AVENUE." (Engineering) ACTION: Adopted. See above. CONTRACT (C96-12) 2. Resolution No. 96-140. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION, AND APPROVAL OF CHANGE ORDERS NO. 1 AND NO. 2 ON THE SEWER REPAIR PROJECT FY 95-96." (Engineering) ACTION: Adopted. See above. ENCROACHMENT AGREEMENT ADMIN (903-14-1) 3. Resolution No. 96-141. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AND AUTHORIZING THE RECORDATION OF AN ENCROACHMENT AGREEMENT WITH SOUTH BAY FENCE, INC. AND PIC ENVIRONMENTAL SERVICES FOR THE INSTALLATION OF ONE MONITORING WELL ON CLEVELAND AVENUE SOUTH OF 14TH STREET." (Engineering) ACTION: Adopted. See above. Book 78/Page 322 09/03/96 CONTRACT (C96-32) 4. Resolution No. 96-142. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT FOR PROPERTY TAX AUDIT WITH HdL COREN AND CONE." (Finance) ACTION: Adopted. See above. NON CONSENT RESOLUTION Motion by Morrison, seconded by Zarate, the Non Consent Resolution be heard by title only. Carried by unanimous vote. CONDITIONAL USE PERMIT (403-9-10) 5. Resolution No. 96-143. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AN APPLICATION FOR MODIFICATION OF CONDITIONAL USE PERMIT 1994-14 TO EXTEND THE HOURS OF OPERATION FOR A CHURCH AND DENYING A REQUEST TO MODIFY A CONDITION OF APPROVAL TO REMOVE ANY LINK BETWEEN PARKING COMPLAINTS AND THE CHURCH AT 330 NATIONAL CITY BOULEVARD. APPLICANT: RUI MORAIS, UNIVERSAL CHURCH OF CHRIST. CASE FILE NO. CUP-1995-17." (Planning) RECOMMENDATION: Staff recommended that the resolution be adopted. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, in favor of Resolution No. 96-143. Staff to initiate action to implement the parking district referred to. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate. Nays: Waters. Abstaining: None. Absent: None. ORDINANCES FOR ADOPTION Motion by Morrison, seconded by Inzunza, the Ordinances be adopted by title only. Carried by unanimous vote. Book 78/Page 323 09/03/96 ORDINANCES FOR ADOPTION (continued) MUNICIPAL CODE 1996 (506-2-11) 6. Ordinance No. 96-2119. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING ORDINANCE NO. 1812 AND SECTION 7.32.100 OF THE NATIONAL CITY MUNICIPAL CODE AND ADDING SECTION 7.32.110 TO THE MUNICIPAL CODE, PERTAINING TO APPEALS OF ENFORCEMENT ACTIONS." (City Attorney) RECOMMENDATION: Staff recommended that Council adopt the Ordinance. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of Ordinance No. 96-2119. Carried by unanimous vote. MUNICIPAL CODE 1996 (506-2-11) 7. Ordinance No. 96-2120. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY REPEALING ORDINANCE NO. 744 AND CHAPTER 2.40 OF THE NATIONAL CITY MUNICIPAL CODE." (City Attorney) RECOMMENDATION: Staff recommended that Council adopt the Ordinance. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, in favor of Ordinance No. 96-2120. Carried by unanimous vote. MUNICIPAL CODE 1996 (506-2-11) 8(a). Ordinance No. 96-2121. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 1.40 TO THE NATIONAL CITY MUNICIPAL CODE RELATING TO ADMINISTRATIVE CITATIONS." (City Attorney) RECOMMENDATION: Staff recommended that Council adopt the Ordinance. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Waters, in favor of Ordinance No. 96-2121. Carried by unanimous vote. Book 78/Page 324 09/03/96 MUNICIPAL CODE 1996 (506-2-11) 8(b). Ordinance No. 96-2122. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 1.44 TO THE NATIONAL CITY MUNICIPAL CODE RELATING TO ADMINISTRATIVE REMEDIES." (City Attorney) RECOMMENDATION: Staff recommended that Council adopt the Ordinance. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, in favor of Ordinance No, 96-2122. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1996 (202-1-11) 9. SUBJECT: Warrant Register #09. Ratification of Demands in the amount of $223,394.45 (Warrant Nos. 140177 through 140247 inclusive excepting none). (Finance) RECOMMENDATION: Staff recommended ratification of these warrants. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, in favor of the Ratification of Demands. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. PARKING ADMIN (801-2-16) 10. SUBJECT: Appeal of the Traffic Safety Committee's Denial of a disabled person's parking space at 1941 "B" Avenue. (Engineering) RECOMMENDATION: Staff recommended that Council may approve of a disabled parking space at 1941 "B" Avenue based on Mr. Hastings' special circumstances or deny the request based on the City Council Policy, Resolution No. 15,336. TESTIMONY: Everett Dickson, 2745 E. 14th Street, National City, spoke in support of the appeal. Book 78/Page 325 09/03/96 PARKING ADMIN (continued) ACTION: Motion by Waters, seconded by Inzunza, in favor of deviating from policy and authorizing a disabled person's parking space for Mr. Hastings., to be removed when he no longer occupies the addres . Carried by unanimous vote. ENCROACHMENT AGREEMENT ADMIN (903-14-1) 11. SUBJECT: A request for an encroachment into the public right-of- way to install neighborhood surveillance type signs on 22nd Street between Euclid Avenue and Prospect Street (Bodge). (Engineering) RECOMMENDATION: Staff requested direction from the Council regarding this issue. TESTIMONY: Ivan Bodge, 2210 E. 22nd Street, National City, spoke in support of his request. ACTION: Motion by Morrison, seconded by Zarate, IQ regretfully deny the request and encourage the neighbors to work with the City on the establishment of a neighborhood watch program and to refer to the Planning Commission the potential need to clarify what types of signs are allowed on residential property under the code. Carried by unanimous vote. COMMUNITY PROMOTION (102-1-3) 12. SUBJECT: Request to display antique fire engine in the National City Chili Cookoff/Automobile Heritage Days. (Planning) RECOMMENDATION: Staff recommended that the request be approved. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Beauchamp, in favor of the request. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. Book 78/Page 326 09/03/96 MAYOR Mayor Waters read into the record letters of gratitude and appreciation to Christmas in July program participants including the U.S. Navy, Dave Sheldon, Cecilia & John Kirk and Aileen Roberts, received from program recipients Mr. & Mrs. King and Desi Horton of National City. He then stated he would schedule a workshop on the proposed Paradise Creek Park on November 12, 1996 at 4:30 p.m. which he will confirm with each Council member. CITY COUNCIL Councilman Inzunza requested an urgency item be brought onto the agenda as the need to take action arose after the posting of the agenda with regards to the bicycle route along the Marina property. ACTION: Motion by Waters, seconded by Zarate, to bring the item onto the agenda as the need to take action arose after the posting of the agenda. Carried by unanimous vote. TESTIMONY: Cameron Berkuti, National City Engineering Department, provided the Council with a brief presentation including posterboards showing the bike route and marina plans and responded to questions of the Council. General discussion ensued. Mayor Waters stated he would contact the Port District to reaffirm the City's position on the need for access to the water for its' citizens and find out why this item slipped through without City input. Councilman Morrison made inquiry regarding the status on the bus bench contract. Book 78/Page 327 09/03/96 CITY COUNCIL (continued) Councilman Beauchamp requested the Christmas In July letters read earlier by the Mayor be placed in Dave Sheldon's personnel file; stated there was to be a marina convention in San Diego in January and suggested members of the Council and staff attend and perhaps subscribe to a membership in the organization; stated he had been contacted by the Manager of the Town & Country Shopping Center who expressed concerns and the need for the City to clean the drainage ditches in front of the bowling alley as the urban outdoorsmen were now taking up residence there; stated that APTA (American Public Transportation Association) was holding its' convention in Anaheim this year and he encouraged the Council members participation as directors of the National City Transit - further that groundbreaking activities with National City Transit would be coordinated to encourage participation and gain publicity from the conventioneers for National City. He then noted that he had been appointed by MTDB as an Alternate Liaison with North County Transit. PUBLIC ORAL COMMUNICATIONS - None. ADJOURNMENT Motion by Morrison, seconded by Inzunza, to adjourn to an Adjourned Workshop Meeting regarding City Newspaper - September 10, 1996 - 4 P.M, - Large Conference Room - Civic Center. Next Regular City Council Meeting - September 10, 1996 - 6:00 P.M. - Council Chambers, Civic Center. Carried by unanimous vote.
