MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
SEPTEMBER 17,1996
The Regular Meeting of the City Council of the City of National City was
called to order at 3:04 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Waters. Absent:
Zarate.
Administrative officials present: Eiser, McCabe, Myers, Morse, Peoples,
Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
Tom G. McCabe, followed by the invocation by Councilman Morrison.
APPROVAL OF MINUTES
Motion by Inzunza, seconded by Morrison, the Minutes of the Regular
Meeting of September 10, 1996 and the Adjourned Regular Meeting of
September 10, 1996 be approved. Carried by unanimous vote. Absent:
Zarate.
MAYOR'S PRESENTATIONS
PERSONNEL RECOGNITION/APPRECIATION (602-4-1)
Employee Recognition - Michael Tricker, Police Lieutenant, National City
Police Department.
The Mayor read a letter from City Manager Tom McCabe and National City
Police Chief DiCerchio (copy on file in the Office of the City Clerk)
congratulating Lieutenant Tricker for his 20 years of service to the City of
National City Police Department. He then presented Lt. Tricker with an
anniversary gift and service pin.

PRESENTATIONS
PERS/NEW EMPLOYEE INTRODUCTION PROGRAM (604-2-2)
Mayor Waters requested that Planning Director Post introduce his new
employee, Ron Santos/Planning Technician; that City Librarian Anne
Campbell introduce her new employee Cathy Clady/Librarian; and Police
Chief DiCerchio introduce his new employees Francisco Gonzalez and
Daniel Nagle/Police Officers. The new employees stood and were
recognized by those present.
LAW ENFORCEMENT ADMIN (302-2-1)
Police Chief DiCerchio then introduced new Canine Officers Taz and Rudy
and their Officer Trainer/Handlers Matthew Remmers and Matthew Smith.
The Mayor presented their badges to their trainers. Police Chief DiCerchio
and Mayor Waters then recognized the San Diego County Honorary Deputy
Sheriffs and San Diego County Law Enforcement Foundation for their
contribution towards the National City Police Department's Canine
Program.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Inzunza, the Proclamations be read in
their entirety. Carried by unanimous vote. Absent: Zarate.
The Proclamation proclaiming September 21, 1996 to be: "UNITED
WAY/CHAD'S DAY" was read aloud in its entirety by Mayor Waters, who
then gave it to the City Manager to send to the appropriate people.
The Proclamation proclaiming September 22, 1996 to be: "AMERICAN
BUSINESS WOMEN'S DAY" was read aloud in its entirety by Mayor
Waters, who then presented it to City Librarian Anne Campbell.
The Proclamation proclaiming the week of September 23-27, 1996 to be:
"LAWSUIT ABUSE AWARENESS WEEK" was read aloud in its
entirety by Mayor Waters, who then presented it to Brenda Lear, Executive
Director of the San Diego County Citizens Against Lawsuit Abuse.

ORDINANCES FOR INTRODUCTION
Motion by Morrison, seconded by Inzunza, the Ordinance be introduced by
title only. Carried by unanimous vote. Absent: Zarate.
MUNICIPAL CODE 1996 (506-2-11)
1. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AMENDING SECTION 6 OF ORDINANCE NO.
2094 AND SECTION 7.06-090 OF THE NATIONAL CITY
MUNICIPAL CODE, RELATING TO ABANDONED
FACILITIES." (City Attorney)
OLD BUSINESS
TEMPORARY USE PERMITS 1996 (203-1-12)
2. SUBJECT: Temporary Use Permit Processing Fee Waivers.
(Building & Safety)
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Inzunza, in
favor of the adoption of Alternative 2: Establish objective
Standards for waiving specified fees for all non-profit
organizations, including those that are religious -affiliated and
direct staff to pursue looking at the Community Building uses.
Carried by unanimous vote. Absent: Zarate.
Mayor Waters requested Agenda Item 7 be heard at this time.
S D COUNTY WATER AUTHORITY ADMIN 1996 (907-1-7)
7. SUBJECT: Presentation of San Diego County Water Authority to
update the National City Council on negotiations with the Imperial
Irrigation District regarding a proposed water transfer agreement.
TESTIMONY: Frank Chenelle, National City representative
on the Metropolitan Water Authority introduced National City
Sweetwater Authority representative Sue Jarrett, General
Manager Dick Reynolds and Ski Volniewicz. He then
introduced Chairman of the San Diego County Water
Authority, Mark Watton, who with the assistance of their
Public Relations Director, Sue King, made a brief verbal and

overhead presentation on the negotiations with the Imperial
Irrigation District regarding a proposed water transfer
agreement and responded to questions of the Council.
Councilman Morrison left the Council Chambers at 4:20 p.m.
Councilman Morrison returned to the Council Chambers at 4:25 p.m.
General Manager of Sweetwater Authority, Dick Reynolds,
provided a brief verbal update on the Loveland Reservoir,
which will include a shore fishing program, and stated that
discussions are continuing with the County regarding the
establishment of a fishing program at the Sweetwater
Reservoir.
ACTION: None taken.
Mayor Waters requested a return to the regular Agenda order at this time.
WRITTEN COMMUNICATIONS
STREETS/CURBS/GUTTERS (903-7-7)
3. SUBJECT: Letter from Ruiz Development Company regarding two
homesites at 30th Street at "J" Avenue.
TESTIMONY: None.
NOTE: Mayor Waters stated that Mr. Ruiz had contacted him
and requested this item be continued to the September 24, 1996
Agenda, when he could be present.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of continuing the item. Carried by unanimous vote. Absent:
Zarate.

NEW BUSINESS
WARRANT REGISTERS 1996 (202-1-11)
4. SUBJECT: Warrant Register #11. Ratification of Demands in the
amount of $486,856.95 (Warrant Nos. 140314 through 140383
inclusive excepting 140315). (Finance)
RECOMMENDATION: Staff recommended ratification of these
warrants.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of the Ratification of Demands and Certification of Payroll.
Warrants carried by the following vote, to -wit: Ayes:
Beauchamp, Morrison, Waters. Nays: None. Abstaining:
None. Absent: Zarate.
FINANCIAL MANAGEMENT (204-1-11)
5. SUBJECT: Consolidated Cash and Investment Report as of July 31,
1996.
RECOMMENDATION: Staff recommended that the report be
accepted and filed.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, the
report be accepted and filed. Carried by unanimous vote.
Absent: Zarate.
FINANCIAL MANAGEMENT (204-1-11)
6. SUBJECT: Consolidated Cash and Investment Report as of August
31, 1996.
RECOMMENDATION: Staff recommended that the report be
accepted and filed.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, the
report be accepted and filed. Carried by unanimous vote.

7. SUBJECT: Presentation of San Diego County Water Authority to
update the National City council on negotiations with the Imperial
Irrigation District regarding a proposed water transfer agreement.
FIRE DEPARTMENT ADMIN (305-1-1)
8. SUBJECT: Request by Sweetwater High School for Public
Fireworks Display.
RECOMMENDATION: Staff recommended that Council approve
the request for the fireworks display and waive the fee.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Beauchamp, in
favor of the request including the waiver of fees. Carried by
unanimous vote. Absent: Zarate.
TEMPORARY USE PERMITS 1996 (203-1-12)
9. SUBJECT: Temporary Use Permit - Saint Mary's Fall Festival.
RECOMMENDATION: Staff recommended that Council approve
the application for a Temporary Use Permit subject to compliance
with all conditions of approval fee and deny the request for a waiver
of the Temporary User Permit processing fee.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Beauchamp, in
favor of the request, with denial of the waiver of fees. Carried
by unanimous vote. Absent: Zarate.
CLAIM (501-1-125)
10. SUBJECT: Claim for Damages: Sallie Graf.
RECOMMENDATION: Staff recommended that Council deny and
refer to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, to
deny and refer to the City Attorney. Carried by unanimous
vote. Absent: Zarate.

CLAIM (501-1-125)
11. SUBJECT: Claim for Damages: Michelle Yodice.
RECOMMENDATION: Staff recommended that Council deny and
refer to the City Attorney.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, tic
deny and refer to the City Attorney. Carried by unanimous
vote. Absent: Zarate.

CITY ATTORNEY - No report.
OTHER STAFF
STREET VACATION ADMIN (902-26-1)
City Engineer Myers provided Council with a brief verbal update and
handout (copy on file in the Office of the City Clerk) on the City of San
Diego Council Meeting and their agenda item concerning Street Vacations
at the US Navy Bayview Project.
MAYOR - No report.
CITY COUNCIL
Councilman Morrison commented on the success of this past weekend's
events in Kimball Park - the Chili Cook -Off and Auto Heritage Days.
CITY STRATEGIC PLANNING (102-16-2)
12. SUBJECT: Follow-up meeting to City Council/Staff Workshop
Retreat.
TESTIMONY: Councilman Beauchamp requested this item
be continued to the September 24, 1996 Agenda to allow for
input of Vice Mayor Zarate.
Louise Martin, 1527 E. 15th Street, National City, expressed
concerns with the acoustics of the Conference Room and the
capacity limitations.
Councilman Inzunza made inquiry of Staff with regard to the freeway sign
inventory.

PUBLIC ORAL COMMUNICATIONS - None.
CLOSED SESSION:
Conference with Legal Counsel - Anticipated Litigation - Significant
exposure to litigation pursuant to subdivision (b) of Section 54956.9. (One
potential case)
ACTION: Motion by Beauchamp, seconded by Waters, in
favor of holding the Closed Session under Government Code
No. 54956.9(b). Carried by unanimous vote. Absent: Zarate.
Council Members left the Council Chambers at 4:55 p.m.
Council Members returned to the Council Chambers at 5:15 p.m.

ADJOURNMENT
Motion by Beauchamp, seconded by Inzunza, to adjourn to the Adjourned
Regular City Council Meeting with the School Boards of Sweetwater Union
High School District and the National School District - September 18, 1996
- 5:30 p.m. - Large conference Room - Civic Center. Next Regular City
Council Meeting - September 24, 1996 - 6:00 P.M. - Council Chambers,
Civic Center. Carried by unanimous vote. Absent: Zarate.
