MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
OCTOBER 8, 1996
The Regular Meeting of the City Council of the City of National City was
called to order at 6:02 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Eiser, Morse, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by Assistant City
Manager Park Morse, followed by the invocation by Vice Mayor Zarate.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of Regular Meeting
of October 1, 1996 be approved. Carried by unanimous vote.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Zarate, the Proclamation be read in its
entirety. Carried by unanimous vote.
The Proclamation proclaiming the week of October 6-12, 1996 to be:
"FIRE PREVENTION WEEK" was read aloud in its entirety by Mayor
Waters, who then presented it to National City Fire Department Captain
Mark Gundert.

Mayor Waters requested a deviation from the agenda to hear a Port District
related item as the need to take action arose after the posting of the Agenda.
BD OF PORT COMM/PASHA (701-5-4)
ACTION: Motion by Morrison, seconded by Beauchamp, to bring
the item onto the Agenda as the need to take action arose after the
posting of the Agenda. Carried by unanimous vote.
Planning Director Post read into the record a letter received from the Port
District (copy on file in the Office of the City Clerk) requesting the use of
Port District Parcels No. 1 and 3 at the National City Marine Terminal,
claiming their continued legal non -conforming use, requesting it be
continued and requesting permission to pave both parcels.
TESTIMONY: National City Port Commissioner and Port
Chairman Jess Van Deventer introduced Port staff members: Dan
Wilkins, Public Relations Director; David Chapman, Port Attorney;
Tom Morgan, Property; Stan Westover, Director of Marine
Operations Department and Chris Stein, Port Clerk. He then provided
a brief overview and responded to questions of the Council.
Tom Morgan responded to questions of the Council.
ACTION: Motion by Beauchamp, seconded by Inzunza, the Council
finds that the storage of marine cargo is a legal non -conforming use,
the Mayor and City Manager to review the lease agreement between
Pasha and the Port to insure it contains provisions satisfactory to the
City. Carried by unanimous vote.
NEW BUSINESS
WARRANT REGISTERS 1996 (202-1-11)
1. SUBJECT: Warrant Register #14. Ratification of Demands in the
amount of $222,726.53 (Warrant Nos. 140596 through 140665
inclusive excepting none). (Finance)
RECOMMENDATION: Staff recommended ratification of these
warrants.

TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of the Ratification of Demands and Certification of Payroll.
Warrants carried by the following vote, to -wit: Ayes:
Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None.
Abstaining: None. Absent: None.
Councilman Inzunza left the Council Chambers at 6:55 p.m.
LAND USE PLANNING/MULTIPLE SPECIES CONSERVATION
PROGRAM (405-9-2)
2. SUBJECT: Draft letter regarding the Multiple Species Conservation
Program (MSCP). (Planning)
RECOMMENDATION: Staff recommended that Council authorize
transmittal of the letter.
Councilman Inzunza returned to the Council Chambers at 6:58 p.m.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, to
make modifications to the letter to incorporate that the City is
investigating further their pro-rata share of the cost of
processing this document; pro-rata share based on capacity;
pro-rata share of open-space/mitigation value and the Salt
Works - the City Attorney to follow up with the details.
Carried by unanimous vote.
CITY OWNED LAND ADMIN (1001-1-4)
3. SUBJECT: Status report on the City -owned property which is
located between Hoover Avenue and Harding Avenue, north of 30th
Street, A.P.N. 559-200-15. (Engineering)
RECOMMENDATION: Staff requested direction from the City
Council.

TESTIMONY: Robert McDonald 2018 Hidden Crest Drive,
El Cajon, expressed his opinion on the use of the property and
responded to questions of the Council.
John Hewitt, 806 1st Avenue, Chula Vista, provided a history
on the property under discussion and responded to questions of
the Council.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of declaring the property surplus, and accepting offer # c
($39,950) Carried by unanimous vote.
ASSISTANT CITY MANAGER - No report.
CITY ATTORNEY
TAXICAB PERMIT ADMIN (203-4-1)
4. SUBJECT: Updated report on Taxi Cab Permits. (City Attorney)
City Attorney Eiser provided a brief verbal update on the proposed
"Regional Permit" status currently under review by the MTDB Taxi Cab
Commission. Their next meeting will be January 8, 1997. They expect to
have completed their task by then. If completed, they will forward their
recommendations to MTDB. If not, they will provide a status report. In
either case, they will provide the National City Council with an update.
OTHER STAFF - No report.
MAYOR
Mayor Waters invited all present to attend the Annual Salute To Navy
Luncheon to be held tomorrow, October 9, 1996 at 12:00 p.m. in the
National City Community Center.
CITY COUNCIL
Councilman Beauchamp provided a brief verbal overview of the new
technology available which he viewed at the American Public
Transportation Meeting - the worlds largest transportation exhibit,
yesterday.

PUBLIC ORAL COMMUNICATIONS
Louise Martin, 1527 E. 15th Street, National City, invited all present to
attend the political forum for elected officials to be held tomorrow, October
9, 1996 at 7:00 p.m. at the First United Methodist Church. She also stated
she had tickets for sale for Saturday's fundraising breakfast for the National
City Crisis Team and Citizen's Patrol.
Alfonso Hernandez, 2132 Euclid Avenue, National City, expressed
concerns with vagrants using the front entrances of the old Salvation Army
Store on National City Blvd. as a restroom; MTDB property on Civic
Center Drive in need of clean-up and the public right-of-way on Civic
Center and I-5 on -ramp covered with weeds and trash.
City Engineer Myers noted that the telephone poles along Civic Center
would be removed in the next couple of weeks.
Clayborn Vaughn Swanson, 1921 F Avenue, National City, expressed his
opinion on the conduct of Council Meetings.
CLOSED SESSIONS:
NOTE: Mayor Waters stated that the first closed session would be
continued to the next meeting when the Public Works Director and City
Manager would be present.
Conference with Legal Counsel - Anticipated Litigation - Significant
exposure to litigation pursuant to Government Code Section 54956.9(b).
(One potential case.)

ACTION: Motion by Zarate, seconded by Morrison, in favor
of holding the Closed Sessions under Government Code
Section 54956.9(a). Carried by unanimous vote.

CLOSED SESSION REPORT
City Attorney Eiser reported on the closed session for Thrifty Oil Company
v. City Of National City as follows: The closed session was held pursuant
to Government Code Section 54956.9(a) to consider whether to proceed
with the litigation, the City Council voted unanimously to request a
rehearing before the Fourth District Court of Appeal, and to petition for a
review to the California Supreme Court, if necessary.
The meeting closed at 8:35 p.m.
